From the I-864 instructions:

25. Federal Income Tax Information
You must provide either an IRS transcript or a photo copy from your own records of your Federal individual income tax return for the most recent tax year. If you believe additional returns may help you to establish your ability to maintain sufficient income, you may submit transcripts or photo copies of your Federal individual income tax returns for the three most recent years.

If you provide a photocopy of your tax return(s), you must include a copy of each and every Form W-2 and Form 1099 that relates to your return(s). Do not include copies of these Forms if you provide an IRS transcript of your return(s) rather than a photocopy.

The following items must be submitted with Form I-864:
For ALL sponsors:

A copy of your individual Federal income tax return, including W-2s for the most recent tax year, or a statement and/or evidence describing why you were not required to file. Also include a copy of each and every Form 1099, Schedule, and any other evidence of reported income. You may submit this information for the most recent three tax years , pay stub(s) from the most recent six months, and/or a letter from your employer if you believe any of these items will help you qualify.


So, yes the past years is a must for tax returns. The last 3 is only if you believe they will help you qualify, also the employer letter and pay stubs are if you believe they will help you qualify or show consistent ability to earn above the required limits.

If the date changed it means they did something, that something could be anything. But with your timeline I would say it may be getting looked at and you will probably hear something soon, either an RFE or an approval/denial. There has been alot of activity lately at CSC and VSC, they have been moving pretty quickly so just wait and see for a few.

On the form, there is only 'one' line asking for name of sponsor. Doesnt say 'name(s).... So if Mrs. & Mr are both sponsors since it takes a joint income to sponsor him... do you fill out a different form for each person? Or do you put on that one same line "Mrs. Lucy Loo, and Mrs. Whatever? Loo.... You see what I mean? Wowo... hear come my headache.... blink.gif

You can only use 1 co-sponsor and they will not combine a husband and wives income sad.gif

Does the co-sponsor and I both use the same "I-134" forms?

What I tell you will work, we filed in January and my wife sent her AOS papers last week...

START HERE:

1) 2 days after NOA2, starting calling NVC: 603-334-0700 press 1 then 5.
2) Once NVC has your case, they assign a new case #. Ask them what date they sent your file to the embassy & also for the NVC case #.
3) Once you know the date NVC sent off the file, track it at DHL's website: http://track.dhl-usa...?nav=TrackByRef For the reference code, enter EXP 10 JUL 2009A (adjust using dates just before the date NVC told you), with a shipping range of that day to a few days later (July 13 - July 14 worked for the example above). Look for shipments to your beneficiary's embassy.
4) To find out if the embassy processed the packet, call the Dept of State before 5pm: 202-663-1225 press 1 then 0

Go to St Lukes -- send her a copy of the letter from NVC, email or mail your choice: it's walk in so don't worry best to go Tues-Thurs to avoid rush.

Just posted is a thread in the K-1 forum (it will probably be moved here) The beneficiary was denied at the first interiew for not having the 2008 return of his fiancee. He went back with a second interview and tax return with w-2s and was denied because it was not a transcript. He HAD the transcript with him at today's interview and offered it after they told him he needed it. Nothing doing. Come back again October 21st. Always bring tax returns for most recent year.

Kiev, a much easier consulate than Lagos (OMG YES) "requires" exactly the same thing...2 of 4 items. I was there when a woman was told, without an interview question being asked (Kiev does not ask a lot of questions) "Everything looks OK with your visa and we can issue it as soon as you bring your fiance's most recent tax return" She did not offer that she had it with her, but I am not sure what would have happened if she did, they had already given her the blue slip requiring more information. Kiev interviews are more or less "public" being done at a window in the waiting room. Any questions or results are on view to anyone.

A similar situation occured when Alla went for our son's K-2 to follow in June of this year. So it seems, at least for Kiev, that you must have "2 of the following 4" items as long as ONE of them is the most recent year tax return. They don't tell you this in the instructions, they do not have to.

So I will stand with what I have said. I would never advise anyone to go to an interview without the most recent year's tax return. Further, I would not sit on it and wait for them ask, I would just hand it over. Current income is far more weighty than last year's income so what is to gain in withholding it? If the consulate says "2 out of 4" items. I give them all four plus two more.

IRS states the fax is automated so it could take anywhere between 24-48 hours to be faxed which increases this possibility. Grandma's fax is out.

That leaves 3 weeks or so for them either to contact IRS and have them mail it and have it mailed to me, supposing it does not get lost like it did before, or to take a chance and go there with just the returns, W2's, pay stubs and employer letters. I don't know if there is time for the mailing option. We should have done this before but we did not find out until later that his dad only had 1040's and not transcripts. And found out later that 1040's can't be notarized if they're electronically filed. And then we spent some time trying the fax option but that did not work out. So now we're back to square one and 3 weeks deadline. At first, we were comfortable with the idea of just returns without transcripts but reading that thread has made me panic. (I read the thread about the Ghana interview going awry because both were needed).

My question is,

1. Does anyone know if this 24-48 hour thing to fax is real or bullshit?
2. How long did it take to mail the transcript to you if you ordered one?
3. Is it absolutely necessary to have BOTH? How many of you have had to use both?
4. The woman at the embassy was speaking on behalf of the CO and did not sound confident. Should I trust her and try to wing it with what we have?

1. From what I understand they usually arrive in less than 30mins or so, I think they just say that as a standard practice.
2. I ordered them 2 times and both times they arrived to me in less than 10 days.
3. No you generally only need one or the other. Ghana is a difficult embassy, and we really don't have all the information to know why they are pushing this particular case so much. ALSO I did need a copy of my 2008 transcript before I flew to the Philippines in May and they were not available by phone but I called the local IRS office and was able to get a copy there, Not really sure where you are located but most MAJOR metro areas have local IRS offices.
4. Generally most cases only need the last years unless your case is difficult or SELF EMPLOYMENT is involved.

Last but not least, I have a home appraisel, but it is from 8 years ago. We are about ready to go for the interview and yet, I am worried. I am thinking of getting a fresh home appraisal just to have that as a backup. Sorry for the long diatribe, but I have butterflies. As a kicker; I am 61 and she is 32. Our relationship has endured for over 5 years and yet I worry about the age issue.


Instead of waiting for a hope and prayer, start preparing in case Unemployment gives you problems. Get an professional appraisal of your home and a mortgage statement showing your balance. Get documentation of your 401k $$ and information about any penalties if you were to withdraw the funds so you can show amount of equity in the fund. Get a letter from your bank about your savings account, current balance when it was opened and any deposits you might have made in past year. Also get any documentation of your future SS payments you will be receiving in May of next year if you so decide to exercise your right to these payments. Get information about the annuity also, you must document everything.

Also I must send back the W-2 along with the tax return and I also seen something like 1099? What is this and does this always come with tax returns and must you send this back? Because I am not seeing anything for a 1099 on her tax returns so I was wondering if this was something that everyone gets back or just some people may get this back?

Yes if you send the tax return copy you will need to send an corresponding documentation essentially meaning the w-2's and 1099's. A 1099 is a form used to report miscellaneous income to an individual. Here is a link that explains what a 1099 is essentially http://www.wisegeek....a-1099-form.htm


I also have questions in completing the I-864A Im sorry I have looked for an example form but I dont see one for the I-864A. My question is this on page 2 of form I-864A question 10 it says "My current individual annual income is?________________ Im wondering what I put here? would this be what my mother has made as of now this year? And if so do I need to send something along with this amount to prove this is correct amount?

This would be the amount that she makes in a year. So ask her what she made last year, and what she thinks she will make this year. If they are close to the same just use an average, if this year is more then just use this years estimate. You don't need to send any check stubs unless you want to substantiate this years income. The I-864a says this in the instructions "You may include evidence supporting your claim about your expected income for the current year if you believe that submitting this evidence will help you establish ability to maintain sufficient income. You are not required to submit this evidence, however, unless specifically instructed to do so by a Government official. For example, you may include a recent letter from your employer, showing your employer's address and telephone number, and indicating your annual salary. You may also provide pay stub(s) showing your income for the previous six months. If your claimed income includes alimony, child support, dividend or interest income, or income from any other source, you may also include evidence of ability to maintain that income.

Another question on the I-864A page 3, Part 2 Sponsor's promise number 13 it says I THE SPONSOR and then you print your name and also your signature would I sign this since I am the petitioning sponsor and then my mother would sign the same page the part that says I, THE HOUSEHOLD MEMBER so this page 3 would need mine and my mother's signature?

I also have a question about the I-864 page 4 question 24b It says "income you are using from any other person who was counted in your household size: NAME___________ RELATIONSHIP__________________ Current Income_____________ in this spot I would put my mothers name correct and then what would I put for current income? I am getting all her income information off her tax returns because that is what you are suppose to send back so Im not sure where I get this current income

Yes, you would put the current income spoken of in the answer to your question about current income.

My mother would like for me to continue my college full time therefore not be working. I only have about 2 more semesters until I graduate from college anyway. And my husband will look for work when he arrives. So my question is do you think it would be ok to just let the Embassy know that I will not be working and my mother will be taking care of us financially? Or must I get a job before my husband can come here. To me it seems like it shouldn't matter if im working or not if my husband will be supported when he is here by my mother anyway. The purpose of the sponsor is so my husband wont become a public charge and he for sure wont be because my mother makes more than enough money to support all of us right now.
Also when looking at my mother's tax returns Im confused as to what I am suppose to be looking at. Is it the 1040, W2, and 1099 that I send back to the Embassy? And also what total amount am I looking for in determining how much she made for the year. There is a place on the tax returns that says "WAGES, SALARIES, TIPS, ETC" and then it has an amount and then there is a place on the tax returns that says "TOTAL INCOME & ADJUSTED GROSS INCOME" and this has a different amount so Im not sure what I am suppose to be going by if someone could please help me with all this. Im really trying to hurry and get all this done so I can send all back to my husband so he can hopefully get his interview soon and join me here in the US. Thanks so much.

No it will not be a problem if you have moved and your address is different than when you filed taxes for last year.
Yes it is true many embassies do not require tax returns unless you are self employed BUT many embassies DO REQUIRE them and you should really check to see if yours is one of them. It is recommended by VJ that ALL PEOPLE take their tax returns with them in case they are needed, if they don't that is wonderful BUT it is better to have than NOT. Generally the only people who tell you that you won't need them are very new to the process and most have not even stepped inside an embassy at this point.
And as to needing 3 years at AOS this is not true, you only need to submit the most recent years tax return at AOS and if you want to submit the past 3 years you can BUT IT IS NOT REQUIRED.
As to how many you should submit, if you are well over the poverty limits ONE should be plenty, if you are very close to the limits then submit the past 3 to show you are able to maintain a constant pattern.

You use line 22, the want to see the w-2's to corroborate what you put on your tax forms. Some people have other sources of income and what they have showing on their w-2 is only part of what makes up line 22.

My first question on the I-864A page 2 question 10 it asks "My current individual annual income is $_______ ? what do I put for this is this what my joint sponsor has made so far for this year or what they think they will make for the whole year. Im not sure how to determine this and also this amount is this the same that I put on my I-864 #24b that asks for joint sponsors individual annual income?

It is WHAT YOUR MOTHER TOLD you when you asked her, you said, she said she believes she is gonna make about the same as she did last year. Don't let the word current mess you up with this question, if they wanted to know how much you have made so far this year the question would say "How much income have you made so far this year? Also on page 3 Part 2 Sponsor's promise #13 it says "I, THE SPONSOR ________________ in consideration of the household member's promise to support the following intending immigrant and to be jointly and severally liable for any obligations I incur under the affidavit of support, promise to complete and file an affidavit of support on behalf of the following ________ (and here it says to indicate a number) named intending immigrant. This is really confusing me does anyone know what number I am suppose to put here?

From all your posts I am assuming there are no children involved and it is only your husband, so his name would be on line 13a and he would be the only ONE listed so the number that goes in the space is 1. It is saying there is 1 named immigrant that you are gonna fill out a I-864 for and your mother is gonna fill out a I-864a for. Which means on Part 3 section 15 she has same answer as you "1".

Also if my mother and father filed taxes jointly but I am only using my mothers income do i still need to send it 1099's for my father?

No do not send those just send the w-2's from your mother.

I am also living with my parents and will continue to do so do I need to show some type of proof that I am living with them?

They will be able to tell this from the addresses being the same, you need provide nothing else.

IF anyone can please help me with any of this. Im sure I am not the only one that has filed an I-864A and used 1 person on a tax return that had filed jointly. Please help me.

No they look at many aspects to qualify you if you want them too. If you have a ton of money in the bank or large equity in your home or a big 401k plan balance and can show it you could probably qualify without an income at all, it just depends on the consulate and the $$$ we would be talking about.

Although Australia is probably not in the countries that this may be looked upon with suspicion, as in giving money to get a visa, it still is probably not such a good idea.

If your income is sufficient then you do not need to fill anything else out besides income.
Also, pay no attention to the section II part of the instructions for the I-134 and be more concerned about what the Philippines embassy asks for. You can find that info here: http://manila.usemba...ov/wwwfk1en.pdf
As you can see under Evidence of Support it plainly states Income Tax Returns, many embassies have different rules and some people just can't wrap their brain around this fact. They don't care whether you are self-employed or not they want the tax forms and documents.
EVIDENCE OF SUPPORT. You should be able to demonstrate that you will not become a public charge or be a burden on the U.S. taxpayers for financial support. A completed I-134 Affidavit of Support Form will be useful to the consular officer to evaluate your petitioner’s ability to be financially responsible for you. You should also submit your petitioner’s most recent U.S. Federal income tax return (Form 1040) and wage statements (Form W-2). Employment letters stating salaries and bank statements may be included to substantiate the I-134.

You need to be concerned with what line 22 on your 1040 form states as your income.
They are not concerned with who you worked for, how many people/companies you worked for or how difficult it is for you to supply them with the required documentation to show you can support your fiance and she will not become a public charge to the US.
Your bank statements will substantiate your income and it would not hurt to gather those documents, will it be sufficent?...who knows. The question is are you willing to try it, and risk the possibility of a prolonged visa waiting time period or an outright denial.
Many of us have had to bite the bullet and given up "allowable expenses, depreciation and otherwise items that can be written off" for the sake of passing the interview and then AOS after marriage. After that it will not be a problem anymore.
Maybe you should ask some of these questions in the regional forum for Russia, maybe they are a little more lenient and don't require some things at your embassy, I can only tell you of my own experience dealing with the Philippines embassy, one of the more stringent consulates when it comes to obtaining a visa.
Whichever you decide or whatever you have to do....I wish you luck.

on your second question, the annual income for I-864A (question # 10) should be for this current year, your annual income for 2008, you should be able to find that in your paycheck stubs.. if you're looking for federal income tax information (question #11) on I-864A then refer to line 37 on Form 1040 (adjusted gross income)



I can see where your confusion comes from...From the directions with the I-864a "My total income (adjusted gross income on IRS Form 1040EZ) as reported on my Federal tax returns for the most recent three years was ? It says show your ADJUSTED GROSS INCOME IF USING 1040EZ and if NOT then your TOTAL INCOME from your federal tax form which is line 22. Line 37 on the 1040 is AFTER DEDUCTIONS that is why it is called adjusted gross income. Don't confuse instructions for 1 form (1040EZ) as applicable to the other form (1040).

Why the instruction were not written in PLAIN ENGLISH is a mystery to me....It could have simply said "Enter your total income from line 22 of the 1040 form or your adjusted gross income from the 1040EZ and caused a lot less confusion.

It does not matter if you make negative nine million dollars, she is still a joint sponsor and you are still the sponsor, she fills out the I-864a as a household member co-sponsoring your sponsorship of your husband and you fill out he I-864.

Also my mother and father filed taxes jointly and my fathers SSN and name is on all the tax papers however he didnt work and his income is not included on the taxes my question is how will the Embassy know this is just my mothers income when my fathers name and SSN is on all papers as well I am just worried, I dont want the Embassy to think I am trying to combine their incomes.

Because the documents you are going to provide them will state her income...the w-2's and the other supporting documents if there are any.
You are seriously overthinking and making this more difficult than it is...the consulate does this every day and believe me they know exactly what they are looking at.
Calm down and follow all the directions you have been given and things will be fine.

The co-sponsor needs to be able to support himself, his dependents and your fiance and any of the fiances children (if any are involved). They will not need to count you or your children (if any are involved).
At the embassy stage it is the I-134 that will be used, you need to fill one out and your cosponor would need to fill one out.

Yes they need to be included see below.

Any dependents, no matter where they live under the age of 21, it's pretty black and white here.

"21d - Enter the number of unmarried children you have who are under age 21, even if you do not have legal custody of these children. You may exclude any unmarried children under 21, if these children have reached majority under the law of their place of domicile and you do not claim them as dependents on your income tax returns."


Says to list them even if you don't have legal custody. You can exclude them if they have REACHED MAJORITY AGE UNDER LAW...in most states this means usually if they are 18.


2) Tax information. Should just the most recent be shown or the last three years? They leave it here kinda vague to me... any suggestions? Or should I seek people from the same embassy my process will go and see which they require?

You only need the most recent year.

"You must provide either an IRS transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year. If you believe additional returns may help you to establish your ability to maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns for the three most recent years."

In my opinion they say this for the I-864 because some might be really close to the minimums and sending 3 years showing that they can maintain sufficient income might help with the proof.

3) And on the 125% above poverty level requirement. That number is to be shown on the current income, from the employment letter? Or is it required to be already on the last tax report?

Current income is most important, not what you made last year so...your paystubs and employment letter are gonna hold more weight than last year taxes.

A separate Form I-864A must be used for each household member whose income and/or assets are being used by a sponsor to qualify. This form must be submitted simultaneously with Form I-864.

Form I-864A may only be used when a sponsor's income and assets do not meet the income requirements of Form I-864 and the qualifying household member chooses to combine his or her resources with the income and/or assets of a sponsor to meet the requirements. The obligations of the household member under this contract terminate when the obligations of the sponsor under the Affidavit of Support terminate.

Maybe you missed the part where she lives in the same household as her father, hence the I-864A.
