Consulates have leeway when it comes to requirements for the interview, many consulates have different requirements that differ from other consulates.
When it comes to the I-134 this is the case more often than not, it is a non-binding agreement so many consulates actually use the I-864 requirements and apply them for use with the I-134, which requires proof of income...It only stands to reason they want to assure that you will be able to supply all the needed documentation at AOS time when you fill out the I-864. They are aware of fraudulent activity when it comes to immigration and know full well anyone can write anything on an I-134.

I would suggest you get the tax returns or tax transcripts just in case and save yourself some possible heartache later.

I would tend to listen to someone who has been through the process FURTHER than an I-129F approval and has not interviewed yet. Most people on this site would tell you to take the tax forms and required documentation or the tax transcripts, and if you do not need them great but if you do and don't have them you will be thankful you thought ahead.

When the approved petition gets to the consulate you can ask for extensions on the original 4 month validity. This is at the consulates disgression but most will extend it up to 1 year if requested. The visa itself, once issued, is valid for 6 months (you must enter the US within 6 months) and then of course, you have 90 days to get married from when you enter the US.

So given a 6 month (average) processing time plus 4 months initial validity, plus 6 months visa valisity plus 3 months for marriage, you are already at 19 months without any delays, but using ALL of you allowed time. One or, at most, two petition extensions at the consulate should do you nicely and I would think would be possible to get approved.

If you are unable to obtain a tourist visa in your current situation, getting married will not make it any easier. In fact, it might make it harder.

Consider a K1.

K1 is not gonna work if you plan on not living in US after marriage, first you have to marry then wait a few months for the ability to travel outside US. Then you can't be out of country for a prolonged period of time using the travel document. Then you have to maintain a residency to remove conditions after AOS in a few years.

DO NOT listen if someone tells you "you don't need a copy of your tax return" because that is a load of garbage. Look at the Manila website http://manila.usemba...ov/wwwfk1en.pdf and read the following from their list of required documents to bring:

n. EVIDENCE OF SUPPORT. You should be able to demonstrate that you will not become a public charge or be a burden on the U.S. taxpayers for financial support. A completed I-134 Affidavit of Support Form will be useful to the consular officer to evaluate your petitioner’s ability to be financially responsible for you. You should also submit your petitioner’s most recent U.S. Federal income tax return (Form 1040) and wage statements (Form W-2). Employment letters stating salaries and bank statements may be included to substantiate the I-134. Download Form I-134 at http://www.uscis.gov/portal/site/uscis.

Notice where it says you need to bring "You should also submit your petitioner’s most recent U.S. Federal income tax return (Form 1040) and wage statements (Form W-2)"

You can substitute the 1040 and w-2's with the tax transcript, which is the IRS version of your tax forms. I did it and I can tell you POSITIVELY you can also.

From the I-864 instructions...basically the same as the I-134 when it comes to counting household size:

Your household size includes yourself and the following individuals, no matter where they live: any spouse, any dependent children under the age of 21, any other dependents listed on your most recent Federal income tax return, all persons being sponsored in this affidavit of support, and any immigrants previously sponsored with a Form I-864 or FormI-864 EZ affidavit of support whom you are still obligated to support.

NO MATTER WHERE THEY LIVE, any dependent children under age of 21. Any OTHER dependents listed on your most recent Federal income tax return.

Pretty simple to understand, but difficult to interpret when you want it to mean something else.

If your fiance needs $32,327.50 to sponsor family of 5 and you said he makes $29,000 and receives child support, does he receive at least $62.26 a week in child support for his daughter. If so, you should have just at the limit, if not you need a co-sponsor.

That is exactly what I was gonna tell ya, but at the interview if you are there you could show them your passport, you really need something to PROVE you were there and the only thing you seem to have are those stamps, you kept NO BOARDING PASSES. What about luggage tags, any still attached to your luggage. Can you get copies of the hotel receipts or possibly your credit card statements showing you paid for things there at the time you were supposed to be there, you need something with YOUR NAME and THE DATES and SOMEPLACE IN THE PHILIPPINES showing all together. And it won't do any good with the cc bills showing you bought tickets because it doesn't mean you used them.


As far as my pics go, unfortunately they where recently printed at a Wal-Mart photo center because they where on my cameras memory card or stored in my cpu, so the date on the back of the photo is NOT the date they where actually taken.

The pics are hardly primary evidence so it won't really matter because they can be date stamped with any computer photo editing software. One thing I tell everyone that is going to meet a fiance is when your plane lands get a picture in the airport of you together in front of a date, clock, airline schedule holding a newspaper whatever you can.

All of this is somewhat frustrating, I mean in my case the objective of my initial trip to Manila was business, I had no intentions of meeting my fiance there, furthermore no idea of a K1 visa or its guidelines, so how is a person like myself supposed have been prepared for all of this....If it was my intention to travel to another country and find my fiance' I suppose I would have had everything dialed perfectly.........

Should I certify mail the I-129F packet or something else?

I've used regular mail with delivery confirmation on everything I have mailed USCIS and never encountered a problem yet.

The forms I am sending in, my fiance wasnt here to sign in person, but he filled them out, signed them, scanned them and then emailed them to me and I printed them out. Will they accept that?

Some forms it is ok to have scanned/emailed but some require a ORIGINAL signature, read the instructions or the guides/flowchart here on VJ and they will tell you.

I know I have more questions, but I cant think of them right now lol

Police certificate for my love.....needs one from every place she lived since 16? What exactly is this and what if she has one from the FBI equivelant? Does that suffice or not?

If it says that then it will be ok, but it doesn't so I would say no, supply that which is asked for.

I've been wondering whether to send four copies, one copy, or what. So far, here is the results from my inquiries online:

1) Asked my attorney -- says since they reduced it to 1 page, and the other 3 pages were just copies anyway, can just send 1 (probably)

Probably, but he has no friggin' idea rofl.gif maybe he should find out since HE'S BEING PAID BY YOU!!!

2) Looked on VisaJourney -- website claims to send 4, claims to be checking into the matter with USCIS -- unverified, just guesswork as best as I can tell

Not really sure because as you can see the answers you received in #3 & #4 below from the source are different per each call and I would say you could call 6 times and get different answers each time...Now this site has 1000's of people who have been through the process successfully and tell you to Cover YOur Azz by sending in 4 JUST IN CASE because they know what has and will happen...OH AND THIS IS FREE INFORMATION AND IT'S BETTER THAN THE LAWYERS

3) Called USCIS a week ago and asked them Attempt #1 -- guy said that if the instructions didn't say to make 4 copies, can just send one

This guy doesn't know the answer or he wouldn't have said "if the instructions didn't say...." so, he's a guesser.

4) Called USCIS today -- another guy said that even though there's only 1 page in the PDF, it's supposed to (magically?) print out four copies with some different text at the bottom when you print it. As far as I know, that's totally and technically impossible. But I could be wrong. He went on further to claim that sending in the same page, copied 4 times, would be incorrect. (this also seems totally unlikely)

Another guy who has no clue...just guessing...

So in summary, my experience is that nobody freaking knows what you're supposed to do, and it depends on who you ask, or where you look! How much more opaque could this process be?

My suggestion is in agreement with VJ because they got me to the AOS stage so far...OR get someone to send you a copy of the old .pdf file and use it...website says you can use old versions...
