I've heard that theory before...and it seems logical and is probably true to a certain point...but it doesn't explain people like Don who has Jon approved before him and me approved after him...and both Jon and I have our petitions at NVC now. Either way...I hope that everyone's petitions get approved and/or forwarded in next week!!
[/quote]

yeah..it seems logical that they would work that way, but then again, this is our Federal government at work, so logic usually has nothing to do with it! headbonk.gif whistling.gif

Congrats on your file getting to the NVC, Andrea!!!

I just called again to check on mine, and they don't have it yet. Jon's petition was approved on July 8 and has already been received and sent out by the NVC. Yours was approved on July 11 and has already been received by the NVC. Mine was approved on July 9, and they don't have it yet. What's up with that? Another example of how things just don't add up! huh.gif

I was thinking about you this morning and hoping that mine arriving meant that yours had arrived, too. sad.gif I wonder if it has to do with how fast the adjudicators get them off their desks after approval. Like maybe some adjudicators pass them along immediately, but others keep them on their desk...or fill a box and only bring it to be shipped when the box is full. I dunno...I'm just theorizing, but it seems like that might be it.

That's as good of a theory as any, I suppose. Just from random observations, it seems that the K-1 petitions get from the VSC to NVC in a couple of days after approval, generally. And, the same petitions from the CSC seem to often take at least a week and sometimes 2, 3 or more weeks. Based on proximity to the NVC, it would be understandable for the petitions to take a day or two more, in general, to get to the NVC from the CSC, as compared from VSC to NVC. But, the reality seems to be that CSC is much worse at getting the petitions out after they've been approved. After waiting so long for the approval, it just sucks to see that they can't even get the approved petition sent on to the NVC! I will be so glad when my petition is finally out of USCIS hands and in DOS hands!!

By the way, the woman I spoke with today suggested that I wait until July 23 to call again and check. I don't think so!!!!

From what I have seen explained, the CSC does not ship the individual petition immediately to the NVC. They wait until a pallet load has been accumulated and ship a lot at one time. So I guess it depends on which end of that pallet load you were on. if you are one of the first approved for that particular load, you have a much longer time to wait before shipping than does the one who was the last to be approved for that load. I suppose the time averages out for the approved people so everyone is waiting about the same time. One is approved faster but waits to see it shipped, while the other waits longer to be approved, but ships right away. I just want to be approved!!!!

Woo-hoo!! Just called the NVC and they received my petition yesterday. The very nice lady said that they usually keep it about one week before sending it to the embassy, we all know that's usually shorter...so hopefully it will go out today or Monday. smile.gif

Anyone else notice that if we get the wrong answer we always report that the person who answered the phone was snippy, annoyed, unhelpful, exasperated, etc...but when we get the answer we want the person was always nice, friendly, helpful, etc? smile.gif I wonder how much of that is just that we're SO excited to hear what we wanted to hear. biggrin.gif

I guess different countries and embassies charge for differnt things. In Ukraine, we have to purchase a PIN number to call the embassy with any questions and to schedule the interview. The cost is 12.00 for approximately 8 minutes, so I guess when you call, you had better be to the point in a hurry! unsure.gif The only other costs are the 131.00 application fees, and they do have to be paid ahead of time at a bank specified by the embassy. Of course, my application costs are doubled since her daughter is coming, too! The, the AOS charge is doubled for the same reason! SIGH oh well, it is only money, right? wacko.gif

COME ON, CSC!!! My NOA1 was Feb 19th......touch me at least!!!

congrats to all who have been recently approved. I hope I am one of those who do not show any touches, but suddenly the NOA2 arrives n the mail, or an email arrives! However, the only real "good thing' about this delay (the so called silver lining) is airfare to Ukraine is much cheaper in September! jest.gif

ok.now this is probably a silly question after all this time, but how do I know if my case has been "touched"? I have my WAC case number, and when I go to http://www.uscis.gov/portal/site/uscis and enter it in, it always shows the same thing: "Application Type: I129F, PETITION FOR FIANCE(E)

[b]Current Status: Case received and pending.

On February 19, 2008, we received this I129F PETITION FOR FIANCE(E), and mailed you a notice describing how we will process your case. Please follow any instructions on this notice. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service.

I have signed up for email notifications of changes, and have yet to receive one. Is there some place else to check to see the magical word "touched"?

When you log in to the gub'ment page to check you application there should be a last updated date. If that date changes that means you got "touched". if it is still the same as since you first started then no "touch"

thanks! at least I know I am going to the right website. :-)

Hello Fellow February Filers! :-) My NOA1 was Feb 19th, and I am HOPING to have it all wrapped up before August. We have all paperwork done and just waiting to make the call to the Kiev Embassy. :-) Of course, I know NOA2 is the next step, but I have confidence it will be soon. The calculator in my time line still estimates end of July for adjudication, but I hope it will be sooner. And WHY of WHY did I have to send my I-29F to CSC when I am in Indiana and am MUCH closer to the VSC?? (of course, that is a rhetorical question, but it is frustrating anyway. ;-) )

keep smiling!

K-1 Fiance(e) Visa Process & ProceduresNeed advise on Documents needed for K-2 visa
It has been a long time since I have come back to this post. We have progressed much farther with our case--and I expect NOA2 within a short period of time. I have received two replies from the Embassy in Kiev for questions I sent to them. The first was about their outdated forms they had in their packet 3. They replied and said they would accept either the old ones or the new ones. We are going with the new ones to be safe! The second reply came today in answer to my question about what permission forms are needed for the 17 year old to leave the country. This was my question:"My fiancé has a 17 year old daughter that will be accompanying her to the USA. She is completing high school in a few days. My interpretations of the instructions that I downloaded from your website (KEV-1 Instructions__NEWcall_center_Edited 01.18.2008) are that we do not need any type of permission from her father, who is staying behind, to travel and live in the USA."
The following is the exact answer provided in the email. "Thank you for your inquiry of June 03, 2008. Please be advised that children over 16 years old (that is 16 and older) do not need to have permission because at the age of 16 in Ukraine children attain the first step of their majority.

I also have a small snafu because the international passport that was obtained for the 17 year old earlier this year expires in January when she turns 18!! Since it is required to have 6 months of valid time left on the visa to enter the USA, she cannot come in on her own passport and will have to come in on her mother's, afterall! From the Embassy's email reply: "As to the passport question, it is true that the validity of the international passport must be at least 6 month at the time of entering the U.S.A. Thus, your fiancée's daughter either can get a new travel document or she can be included into her mother's international passport, however, in this case the girl will be able to travel only with her mother." That was a waste of money for that international passport! hahaha blush.gif

I hope this information helps anyone else with thier Ukraine process! good.gif

ok..I answered my own questions with a lot more investigating. I do not know if others have noticed, but the link to the DS-156 form under "K1 Fiance forms" no longer works. I discovered that there is an E-form for it now to be filled out online, and then printed. It will not allow you to save and fill it out later. it can be found here: https://evisaforms.s...v:443/ds156.asp As far as I can tell, this is the only option now. The DS-156K download link is to the newest form and it can be saved. Ironically, the Ukraine Embassy site explains the visa process extremely well, and even recommends downloading its 'Information Packet" instead of relying on the Ukrainian mail system to deliver the packet once the Embassy receives the completed package form the USA. The forms are quite old, with the DS-156K expiring 7/31/07 and the DS-156eng expiring on 8/31/2004 !!!! I sent an email to the Embassy with questions about the validity of their forms now, and provided links to the newest forms, suggesting they update their packet. I have not yet heard back from them.

Hello! I am also new to this forum, and am beginning the process to bring my fiance from Ukraine, along with her 17 year old daughter. I was confused by the information here, indicating new forms to be submitted for the K2 visa. I copied the following information from this site in another area--under the Guides.
If you are a US CItizen filing for a K1 or K3 Visa for your non-US fiance/spouse, and they have children, then they may bring them here under a K2/K3 Visa. The children automatically qualify for the K2/K3 visa as derivitive status of their mom's K1/K3 status (you need only petition for your fiance/wife and list the children on that petition in the relavent blanks).

If I understand the above correctly, I do not have to file any other applications for her daughter. I assume I will need a copy of her birth certificate, as well as translated to English, and a passport for her. I know they will both require medical forms later, but are there any other forms needed for the daughter when I first submit my I29F application?

thank you!!
Chris

Nothing additional needed at petition filing other than naming the child on the form.... At the consulate interview then separate visa applications (including the ID documents), medical exam results, police reports and possibly a consent for the minor child.... not sure what age that requirement ceases...

thanks for the information. What "separate visa application" are you referring to? The checklist for the I29F/K1 does not mention a separate application form beyond the I29F, the G325a, and the I134. We are proceeding to have the daughter's father submit a letter and some sort of official Ukrainian form that gives his permission for her to obtain an international passport and to leave for the USA. My fiance` is using a local agency to provide certified translations of all the Ukrainian documents, and they are also advising her on other things she will need. They have performed these duties for a lot of others like her, so I appreciate their advice, too! Thanks for all the guidance!

ok..I looked in the download section and I see the DS-156, but it says it should be supplied by the US Embassy at the time of interview. Is this something that can, and should be, prepared ahead of time?

thanks for the information.

I know they will both require medical forms later, but are there any other forms needed for the daughter when I first submit my I29F application?

thank you!!
Chris

K-1 Fiance(e) Visa Process & Proceduresis it necessary to send the I-29F copies to the foreign fiance?

I have a question to those who already went through the interview in Kyiv. I have quite a lot of paper, material on proof of relationship. I was just wondering if I can organize it in the folder or should I just not worry about any of that stationary because they will take only papers.

I would appreciate any help. thanks.

Hi Marina....I suggest you bring several items for proof of relationship--especially if your fiance will not be attending the interview with you. If he can go, still bring several items along to show his previous visit(s), correspondence, photos of the two of you together in Ukraine, etc. We supplied about 20 photos, print outs of some of our Yahoo messenger chats, some of our emails, a couple of receipts from the US post office to show that I mailed things to her, a copy of a Christmas card she sent to me, plus the airline receipts, apartment rental receipt, and my travel itineraries from my 3 trips. ( the 3rd was for the interview and to bring my fiance and her daughter back home to me). It is better to have too much proof than not enough. blush.gif I know it is cumbersome to carry all the papers and photos (arrange in plastic photo sleeves, if possible), but it will be worth it! good.gif

Not required... unless you want her to know information contained within...

Kyiv will not want to see your BC, ML or DD at the interview...

The non custodial parental consent may be waived but do not expect it... It may also be required to be shown at exit from the airport... my wife was requested by the border control officer for it when we departed KBP.

Thanks! Will they possibly ask her questions at the interview about the information on those, such as when was I divorced and/or previously married? She knows my birthday, so that should not be a problem! good.gif Will I be allowed in the interview room with her? Will her daughter be allowed/required to be in there? I am hoping all of us can be in there at the same time.

We will go ahead and get the parental consent form completed--just to be safe!

Just so you understand something... there is NO interview room... the interview is conducted at a "window".

As for the questions to be asked.. nobody can say for sure... My wife was asked zero questions. This seems to be a current trend in Kyiv to ask no or very few questions (if your documentation is complete).

A K-2 applicant is required to attend if aged 14 or older (I believe).

Thanks for the info! We have been reconsidering me traveling over for the visa interview. Since I am short on vacation time, I may wait and fly after the interview so I know I can bring them back with me. We know they can probably fly to the USA on their own, but there is some fear of flying for at least one of them--maybe both. ;-) I want to make the trip as comfortable as possible for them. Of course, if we consider the money, it would be better for me to just meet them here in the USA. decisions decisions!

K-1 Fiance(e) Visa Process & Proceduresis it necessary to send the I-29F copies to the foreign fiance?
Hello!
I apologize if this has been discussed previously, but searching for the answer has not brought me any success. I have the step-by-step guidelines for the K1 visa process. I am trying to bring my fiance over from Ukraine, and we are in the 'waiting zone' between NOA1 and NOA2. My NOA1 was February 19th, so I know my case has to be getting close to being worked on. (I hope it is!) My question is: Do I need to send to my fiance the replica/copy of the original I29F that was submitted? The guide says to do so, but I am not sure why it is necessary since the original I-29F packet will be waiting at the embassy at the interview time. I know there are many other documents that I need to provide to my fiance, and the weight of this packet to be sent can be reduced greatly if I do not have to include that original paperwork.

I plan on being present for the interview and I had considered not even sending over the documents, but rather take them with me. However, I think I will send them over, anyway, just in case something should happen to my schedule and I am prevented from attending the interview. That way, she would still have the documents necessary to complete the interview process. I am trying to get all documents completed as soon as possible, with only the statement from my bank and my paycheck stubs to gather at the last moment. The timing is such, for us, that I would really like her to be here before the school year starts in mid-August, so I need to make sure there are no delays caused by US. I am confident that Sveta has already gathered almost all of her documents needed. She has applied for the police reports for both her and her 17 year old daughter (neither have ever had legal trouble and have always lived in the same city), and she was informed those should be in within 2 or 3 weeks. The only other document is the notarized statement from her ex-husband that allows her to take their daughter out of the country-and that should happen in the next week or two. I am not even convinced that it is necessary to have this form since she is 17, but we will produce that document, anyway! They both had their physical exams on May 8th. We want to be ready to schedule an interview immediately (if possible) once the approved package has arrived at the embassy in Kiev. We have already downloaded the next packet from the Kiev Embassy website, and filled out and printed the applications and the checklist.

on a different, but related question, do we need to show copies of my birth certificate, marraige license, and divorce decree at the interview? I can send over copies, if needed, but that stupid divorce decree here in Indiana is many pages thick! I thought I was going to get a single certified page when I went to the city records to request it, but I was given a stapled stack of pages that the court says was the official divorce decree. And, of course, since I needed a certified copy, every page had to be stamped and certified and it cost me a small fortune! mad.gif

thanks, and now back to 'the waiting game'.

HUGS Scarlett! I think they have it in for us!
My fiance` called the Embassy in Kiev again today, and though we know the package arrived to them Monday of last week (18th), they say it is not in the system. They said it is probably at the Consulate and they have not gotten it to the Embassy. The she had the audacity to say that it "could take 10 weeks to get to the Embassy"!!!!!!!! The buildings are next to each other in the same compound--possibly even connected! I could fly over and walk it to the Embassy if that is what it takes to get it there!

Oh for crying out loud, ten weeks!? I wish they would stop making up random deadlines to hide behind? The guy called John at London told me "it can take 4-6 weeks from approval", "Well John, it is 6 weeks on friday honey, what are you going to do now?"

I think I might hit him on the head with a mallet when I see him... headbonk.gif

I agree! I think they are making up stuff on the fly just because they are incompetent. GGGGRRRRRR

I think me and cwaf are living parallel lives: I'm sure the London Embassy has my case cos the DHL thing said it was delivered last wednesday, but I call them everyday and they deny it. It'll be 6 weeks on friday since I was NOA2 approved.

How's everyone doing on this lovely Wednesday? I'm very anxious and excited! Three weeks from today, as long as all goes well, Dennis and I will be at the Vancouver consulate, picking up his visa. smile.gif

I hope it all goes well for you two!

We still have not been able to contact the Embassy to schedule the interview. My fiance` is traveling today, so she will have to call tomorrow. I have tried the last 2 days since there is a toll free number for people in the USA to use, but even though I choose the menu for ENGLISH, it reverts back to Ukrainian--which I do not understand! ranting33va.gif So, it appears we wait another day....each day delay is like a drop in a bucket, but those drops add up and push things farther and farther back. wacko.gif some day...some day... maybe someone knows my house is not yet clean enough for her to come over! hahahaha

I got the NOA2 and he received the packet saying what all he needed to do. He will be going for his medical next week in London and hopefully soon after we will have an interview date.

Very good! You keep marching towards that magical time to be together. I hope it all goes smoothly!

Dunno about wanting to hear from California, but I'm certainly waiting to hear from cwaf! laughing.gif I think we need to keep this baby open until we all have visas in hand. yes.gif

Hey Damian! nothing new here YET! As of Friday, the Embassy said our packet was not there even though I tracked it through DHL. They are on national holiday today, so we will try again tomorrow. Interestingly, though, I had sent a letter to my congressman and I received a followup letter from them on Saturday. Their answer was:
"Dear Cwaf (or similar yes.gif ),
Thank you for contacting me with the problem you are having receiving an informative response to your repeated inquiries to the NVC. I appreciate this opportunity to assist you.
I have reviewed this matter and have contacted the appropriate agency on your behalf. My staff and I will continue to work with the US Embassy in Ukraine until its review is complete. Upon receipt of a response, I will be in contact with you again. if you have any questions.........call....." and then signed by Dan Burton
then, handwritten below that was "I have sent communication to the Embassy in Kiev to make sure they have the case and will schedule the final interview. I will be in touch", and signed by KLB, "special assistant".....
So, maybe good things will happen for us, or maybe they will make someone angry and I get showed to the bottom of the pile! hahaha

Holiday here too, cwaf. Oh well, I still reckon you'll get your interview date before me. I have to wait for my long form birth certficate and police certificate before I can do any more. Should be here this week though!

What holiday is it for you? In Ukraine, it is their Independence Day (itwas yesterday, so celebrated on Monday, as well)

Dunno mate - all I know is that there's a public holiday at the end of August. I enjoy it and don't ask questions!! laughing.gif
