awww..thanks! blush.gif I wish I could help get you out of Embassy Hell!! Yesterday I booked my airline ticket---1 way only--to Kiev for the interview. I did not get return tickets for us because with my experiences lately (like yours) delays seem to pop up for no reason, and I felt I would just be asking for trouble if I got them. I will get the flights once we have the visas in hand--and have checked them for errors! It will cost more for airfare this way, but at least I know I will be safe!

Sorry...I meant to say that MagicJack allows you to call 'any telephone in the USA or Canada'--which is why it is so great for Sveta to have it. She could call any of my family at any time, just like I could with my cell phone.

my fiance lives in Ukraine and I have provided a device called MagicJack for her. As long as she has high speed internet service at home ( it needs to be a minimum of 80k up and down so dial up does not work), this device is simple and easy to use. It is amazing because the device is assigned a USA phone number, and then from that device, a call can be placed to anywhere in the USA or Canada for FREE. To get a Magicjack, it is 39.99 up front, which includes the device and the first year of service. Each year after that is only 19.99 a YEAR--not a month or by the minute. I actually purchased two of them, thinking I needed one for myself and I shipped the other to her. I realized later that I did not need one because I can use my cell phone to call her MagicJack number since it is an Illinois phone number and I get long distance for free on my cell. (they do not yet offer numbers for every state, but as soon as they have them for Indiana where I live, I will change the number so every call will be a local call!) The best part of this is she can call me at any time now, and it costs her nothing! We have used this many times with great success. If we place a call and the voice is choppy (face it, the internet service is not the greatest in Ukraine...hahaha), simply rebooting the computer usually clears up that issue. I was looking mainly for a way for her to call me since outgoing international calls are extremely expensive, and I already had VoIP at home and could call her for .10 a minute. However, an extra added benefit is for future expenses. I know when Sveta and her daughter arrive to me in the USA later this year, they will often need/want to call back home to talk to family. When Sveta moves to the USA, her sister will maintain her apartment and the internet connection, and the MagicJack will remain in Ukraine. Sveta can call the number the same way I do now, and she can speak to her sister, or arrange a time for her mother to come visit and speak to her, too. And it will cost me nothing but 19.99 a year! Oh, I sent my second one to her best friend, who married and moved to Germany, so she could connect it and they will be able to speak to each other. The friend has not yet hooked up MagicJack, but we hope she will soon!

The basics are computer with USB2.0 ports (virtually any built in the last 2 or 3 years) and high speed internet...MagicJack plugs into the USB, then a regular telephone that you would use at home (corded or cordless) connects directly to the MagicJack box. The program for MagicJack is contained on the device, and after the initial file updates at first connection, the program starts automatically each time the unit is plugged back in. (but you could leave it plugged in all the time if the computer is left on). It also comes with voice mail, call waiting, and the other options you would expect. For the initial investment, I think it is a wonderful device and I expect it to save me hundreds of dollars after she moves to be with me. Oh, I am sitting in her apartment as I write this, and I was able to work remotely today, and used MagicJack to call my coworker. I strongly recommend you at least check out the device at http://www.magicjack.com/1/index.asp and NO, I am not employed by them! One additional word, though. As some have mentioned before, if your company firewall blocks ports needed by Skype and others, this unit will probably also be blocked for placing calls. However, you would not need one in the USA since your loved one can call YOU for free if you send them a MagicJack. Oh, it should be wonderful for traveling, too, since most hotels offer free highspeed internet (wired or wireless will work---I am working wirelessly at this time since I installed router in her apartment)

ok..I have an update. After getting off work, my wife and I talked about this. i was mistaken with the document that he prepared/signed to be the father. It was NOT a birth certificate--which makes sense because the baby has yet to be born. However, they had gone to an attorney's office to prepare a document that states he wants to have his name on the birth certificate--sort of like adopting the baby before it is even born. According to my friend, he would have to be present at the hospital to sign the birth certificate/registration and that power-of-attorney is not accepted under Ukrainian law. I believe the attorney just wanted to pocket 100.00 from them! However, I am going to advise the fiance to contact an immigration attorney here as soon as possible and get the legal advice I am not authorized to supply. Regardless if it is legal or not, I feel it is a bad idea and will only slow down their approval and raise all kinds of red flags. I appreciate all feedback and will now compose a letter to the fiance for him to make the decision.

In the immigration process it will cause confusion & delays.

If they attempt to get the child US Citizenship as a result then he will have to prove he was present when the child was conceived or submit to DNA testing.

If USCIS sees a US Citizen named as the father on the BC they will want to ensure the child has no claim to US Citizenship via that relationship before they can proceed with a Visa application.

Another VJ member just went through this in the Philippines.

Thanks for your input. It further reinforces that she should do new paperwork and not let his name appear anywhere!

The laws in the U.S. are very clear on it. If you sign the birth certificate whether you are the bio dad or not...You're the Dad.

My concern is this. If she has fraudlently done this, perhaps the bio dad WANTS to be involved. If she leaves the country without his permission, with his child, and has lied on the birth certificate...she could be in A LOT of trouble. It all depends on the laws of the Ukraine.

Hi Rob and Jill....Well, from what I read today online, in the USA it is illegal to sign a birth certificate as the father if you are not the biological father. I know the actual father has no plans on being part of the child's life. After posting this message, I emailed a friend of mine from ukraine who is a naturalized citizen here, and also went back to ukraine to marry a woman and have a child after becoming the citizen. I will paste excerpts from his email response to me.

"When one of the parents is American Citizen, the child is eligible to be American citizen even if the child is born outside of US. But it does not make him/her American citizen automatically. The paperwork must be completed. It called "CRBA (Consular Report of Birth Abroad") and it must be presented to the American consular in the country of birth (in Ukraine) with proper documentation which include but not limited to birth certificate that shows that one of the parents is American and, most importantly, they must prove that parents were together at the time of conceive. It could be dated pictures together , airfare tickets, stamps in the passport that shows the date of entry to Ukraine and date of departure from Ukraine. If he can not present these evidences, they can and more likely they will send him for a paternal test.

What he did, he committed a fraud. They might get a big problem because of that. It includes banning her forever from entering USA.

nd I completely agree with you. They had to wait for a child birth and than he would do exactly what you did - Fiance Visa K1 and Child of Fiance-K2. Or they could get married in Ukraine and than after he comes back to USA he would file Spouse Visa K3 and Child of Spouse Visa K4.

In any case (K2 or K4 Visas), she would need to state during the child registration that she has no clue who the baby's father is. Otherwise, they need to get biological father's written approval for a child to leave the country.

Also, I am not sure how he did sign the papers that he is a father if the child was not born yet. They can not register unborn child. The law in Ukraine states, that if parents are not married, in order for father to register him as a father he must be present during the child registration process. Notarized documents or power of attorney are not accepted. That is why I had to go to Ukraine RIGHT AFTER the child birth. My daughter was born on 4 and I arrived to Ukraine on 13."

I think I have my answer, but am open to other input who may have gone through a similar experience.

hello everyone...it has been forever since I was here. I successfully brought my fiance over from Ukraine, along with her daughter, in october 2008 and we married in November 2008. We are living quite happily togther. However, that is not the topic of this thread. Ny wife's neice in Ukraine put her profile online during our last visit to Ukraine in may 2010. She met and began correspondence with a man (whom I do not trust)and he just returned home from Ukraine today. (actually still in the air). They became engaged while he was there. Now, the situation. The niece is 21 and never married. She left her "man" of 5 years early this year and moved back home. That man is the biological father of her unborn child. She is due any day now with a baby boy. yesterday, before my neice's fiance` left, they went to the hospital and he signed the birth certificate of the yet unborn baby as the father. He is not the biological father and I firmly believe it is illegal to sign the birth certificate as such and this could cause them great issues during the visa application time. I know his intent was to show his dedication to the baby and his fiance`, but I think he should have waited until the child was in the USA and then adopt the boy. Will this maneuever they performed cause my niece any trouble? My wife argued that he did not sign saying he was the biological father, only "the father". I told her that is one and the same on the legal documents like that as there are not two lines, one for biolgical and one for desired-fathers. I am going to suggest that they remake the birth certificate without his name since the baby has not yet been born.

am I being paranoid? I care about her--not the fiance`--and do not want her to be branded as being a fraud, inadvertently faking that her son was fathered by an American citizen.

Now then, just two more things I need to know before I pop it in the post:

1) In section 29 of the DS-156, it asks you to state your prior visits to the U.S. If you have quite a few visits (as most of us do) then you take up a fair bit of space, but the DS-156 automatically generates a "continuation page" with all the relevan trips listed when you print it off. Section 25 of the DS-230 form requests the same information, but does not automatically generate the continuation page in the way DS-156 does. As such, an improvised continuation sheet will be required. Will a standard blank word document suffice as a template? Or is there a procedure here?

2) ####### is an 'A' number??????? I know from reading various posts on here that it doesn't apply to trips using the VWP, but I have travelled on an F1 before. Is the 'A' number the long number in the top right hand corner? Because it's refered to as a 'control number' on the visa.

Any ideas?

The DS-230 is for Immigration Applications, and if you are going for the K-1 Fiance application, you only need the DS-156(K).

So you mean that the airline has no rights to check paperwork of a passenger to make sure that a passenger can be legally admitted to the country where he or she is heading?
Also, I was talking about all other check points in Borispol, not just the airline one. Probably now they don't care about the passengers visas, but I still remember how a few years ago they questioned me about my AP because they didn't believe it was a proper travel document to enter the US.

to address this specifically, that is why the Warsaw airport was denying her on the flight because they were concerned that she would not be allowed into the US using the NOC. The Embassy assured them that my wife could not be denied entry by using her NOC. I agree that if we should have been denied on any flight, it should have been in Kiev. However, they accepted the NOC at the ticket counter and at passport control. At passport control, they examined the NOC closely, even holding it up to the light to ensure it was legitimate.

I guess I opened a can of worms! :whistle: After speaking to the Embassy in Warsaw, apparently the Department of Homeland Security said we should not have been able to depart the US with the documents that we had since we had a round trip flight. I know when we boarded our flights in Indy and Chicago, they asked for her GC or Visa when she presented her Ukrainian passport, but they readily accepted her NOC as proof. I can only assume that they asked for her GC because they were required to verify her ability to re-enter the US with her round trip ticket. If that is not the case, then they should not have been concerned with her status and allowed her to travel unquestioned on her Ukrainian passport alone. I would have been much happier to have been refused boarding in Indy because we could have returned home and resumed our life while obtaining her US passport. Even though we would have had to pay fees to rescheduled our flights, we would have had flexibility to choose when we flew and how much we were going to pay. When stuck in a foreign country's airport (think the movie 'The Terminal'), that is not an option. Even being refused in Kiev would have been preferable than in Warsaw. I now know that the US passport was the way to go, but there was no time to acquire one before we departed since we flew only 24 hours after the ceremony. At her ceremony, they did not offer passport service. They only offered voter registration and Social Security updates. My line of thinking was that since it was perfectly fine for my wife to travel to and from Ukraine using her Ukrainian passport and her GC--which proved she had the right to enter the USA--that her Ukrainian passport and her NOC (replacing the GC) would be sufficient. According to the US Embassy Consular Officer, the NOC is valid proof of citizenship and travelers are able to enter the USA using that document--as long as it is the original and not a photocopy. The border officer supervisor in Chicago allowed her in with no trouble but would not stamp her Ukrainian passport for entry since they no longer recognized her as a Ukrainian citizen. That is cool because we do not even see her as a Ukrainian citizen any more, either! :thumbs:

I did not mean to start any type of long discussion or disagreements. I only meant to pass along our experiences as a learning exercise for anyone else who might be in our situation. :blink:

Sorry to hear about your story, but unfortunately they were right. Neither american birth certificate nor american naturalization certificate are valid travel documents. If a US citizen wants to travel by air, he/she must have a passport.

Yeah, I tend to agree with that information. However, I am going back after the airline for reimbursement of my additional expenses for new tickets because I view this as an error on their part. If the document really was not a valid travel document, they should never have let us leave the US and we could have worked on a resolution while still here. There may still have been some additional expenses to change flights, but the flexibility of when we traveled would have been much greater. I feel there were multiple places where the airlines failed that just perpetuated the problem. We shall see. :innocent:

it has been a while since I supplied an update, but it was because of vacation. I have not updated our timeline but my wife had her oath ceremony on May 24th! another new US citizen! We left for a vacation to Ukraine the very next day and just returned late Monday night. However, complications ensued with the travels. Since we left the day after the ceremony, we did not have a USA passport for her so her ticket was in her Ukrainian name--like her previous travels. However, instead of having a green card we carried her naturalization certificate since it proves she is a US citizen. We had no trouble until our return trip. We left Ukraine just fine but Warsaw, Poland refused to let my wife board the plane for our connection to Chicago. The reason: not a valid travel document. They told me that I could travel on without her. :rofl: After 20 hours of being in the cold airport (she was not allowed to leave the airport because she did not have a visa for Poland--required for "Ukrainian citizens".) and MULTIPLE phone calls with the US Embassy in Warsaw, we were allowed to leave Poland. I will spare you the gory details. At Chicago, we had a secondary conversation at the border but it was minor and easy. Hindsight has taught me that we should have not traveled until the US passport was in hand, or have gone on vacation before the oath ceremony! Let our pain be a lesson for anyone considering travel like we did. :blink: But we are home now and will apply for her passport at leisure now. :whistle:

On Friday I was Naturalized in Philly, which finally ends my process with the USCIS. From filing to ceremony only took 3 months and 10 days I believe, very quick. The most painful part of the whole process was the very beginning when I had to return to England and my wife was in the USA, this was the spouse petition to come to America. That paperwork process took months, almost a year. However, I'm finally here and am an American. Perseverance is the key, which is extremely tough at times. My process started in 2007, and now I'm finally done. Thanks to all over that time for helping out and chatting on VJ with me; it helps a lot. Good luck to all going through the process.

I know my wife's time will come soon and then we only have to deal with my stepdaughter's citizenship journey. She is now 21 and though she came over with my wife when she was almost 17, she is no longer a minor and, as far as i know from my investigations, she has to wait the 5 years before she can apply. So, a 2 year break for me before helping her with her application and papers.

Mom's status changed back to 'in line for interview'. Dad's still says Interview scheduled, he was given option to take friday 4/26 oath ceremony (the guy said they do oath every friday) but he declined and asked to schedule after June. IO said no prob on that.

Mine still says in queue, I have the feeling there wont be one before the Independence day ceremony here.


I was given a link from a fellow VJer that showed Indianapolis has oath ceremonies usually twice a month at 10am (I thought that was a bit odd--makes it difficult for family to come out for it). I hope we get the letter soon, but I get this feeling even if we get the letter today, the ceremony will not be until later in the month of May.

@blessed .. yes .. she was pretty nervous thats for sure. somebody said rescheduling takes like more than 2 months, no idea on validity of that assumption.


just to throw my two cents in here, my wife has already had her interview (4-19) and we are waiting for the oath ceremony letter now. Our online case status still says she is "scheduled for the interview". It is my experience that the online updates are not reliable because at least one of our previous filings took a year or so to be updated to show it was approved even though that process was already completed. :wacko:

my wife passed the interview with flying colors! :thumbs:
The process was fast and painless. It took less than 10 minutes from when they called her for the interview to the time we left the building!
When back with the officer, she had to swear to state the truth. She was asked if she supported the US constitution. She was then asked 7 questions, which she answered correctly. Those were (not in any particular order:
What is freedom of religion?
How many U.S. Senators are there?
What are two rights of everyone living in the United States?
When was the Constitution written?
What ocean is on the West coast of the United States?
What ocean is on the East coast of the United States?
Name one state that borders Canada.

For her reading test she had to read "What do we pay to the government?" Then she had to write the answer "We pay taxes".

Unfortunately, the officer could not tell us when the oath ceremony would be and that the letter would come in the mail. He said it could be May or in June. (That is unfortunate for us becasue my wife wanted to travel back to Ukraine in May and we cannot make any plans for it--or even know if we can go.)
