Thanks for your reply, but I keep seeing this NOA, what is that? This process I was told would not take longer than 6-months is this true? What are the steps? I thought once they approved the application he just had to go to an Interview at the US Embassy in London....is this right?

Hi all, I have just started my process. I sent my fiance visa off on March 5th to the California Service Center. I'm just wondering how long this process takes. Also I did not send all the proof of evidence that I am reading people sent. All I sent was our letters of intent, his boarding pass, our sons (who is 9 months old) birth certificate (that has my fiance's name on it), and I think that was about it. I did explain that we met will I was going to school in England. Will this be good enough? Thanks all!!

Okay I am not in the same boat as you...YET....it has been almost 3 months and I have not heard anything as of yet, and I called the USCIS as well and they told me that the WHOLE PROCESS should be completed by 6-months and if I haven't heard anything by 6-months that they would have my case expediated...this is crazy!!

Hello,

My fiance is from the UK and I'm an American citizen. I've just poured over the current data collected by everyone on this website on how long it takes a visa to be approved from sent date to approval. Our issue is that my fiance is currently a student and graduates in early June/late May 2011. We'd like to get married in July or August of 2011 so I've been trying to calculate some sort of a time line. From what I can see, it currently takes about 5 to 9 months from a fiance from the UK to have their I-129 approved. I figured that since the I-129 lasts for 4 months we'd probably what to have it approved by May 2011. If I figure the max amount of time it could possibly take being 9 months (this all being speculative), I should send in the information in early August of 2010. My one problem is; what if the form is approved faster and it expires before July/August? I know it's possible to get an extension, but (1) how much do they cost and (2) is 'my boyfriend is still at university and hasn't graduated yet' a valid reason?

I wouldn't wait...My fiance is from the U.K. and we started are process in March 2009, they have lost or packet 3 and asked that we send another one in. So we did a delivery confirmation and it shows they received it on 12/29/2009, I called last week and they STill say they have not received it....I starting to get pissed as we are coming up on a year. He's already done the medical and everything...we just want a freakin interview date!! Good Luck

my fiancee had her interview in Riyadh. She is from the Philippines though on a working visa in Saudi Arabia at the time of her interview. Remember to answer their questions with confidence and have lots of photos. Engagement party if available and try to show western traits of an engagement. IE engagement ring etc etc. Oh and make sure you have e-mails talking about planning your lives together and make sure they are dated. If you call each other try to get phone logs etc. Bring all this with you. YOu don't want to be sending stuff to the embassy after the interview like what my fiancee had to do.


She had to send in more pictures of our engagement party a picture of her engagement ring because she couldn't wear it at the time (wouldn't fit).

called the NVC today and they told me that my fiancee's packet 3 was sent to me and not her. hmm I wonder why that is. Her address is correct on the petition form.

Is there anything in that packet 3 that has to be mailed in via snail mail or are all the forms in electronic format? If they are in electronic format (eg pdf files) that would be great i can just e-mail the forms to my fiancee and she can print them out and send them in. I really don't want to mail the forms from the US snail mail to Saudi Arabia is so slow.

They are all the same but $131 for the non-immigrant visa. What varies is the local currency equivalent.

well after dealing with the missing police clearance from the Philippines and dealing with the shipping companies and the fact that my fiancee lives in a muslim country where the work week starts on a Saturday and ends on a Wednesday. It is almost over.


Like i said before if anyone has questions about processing a k1 visa outside the home country of the fiancee let me know i will be happy to help.


a few things that were asked


my fiancee didn't have these at the time of the interview

pictures of the engagement ring (it was too small for my fiancee's finger because she is pregnant)
i sent the receipt for the ring to help too.

pictures of our engagement party.

Make sure the fiancee has a police clearance from her/his home country and the country she/he resides in.

My fiancee was in Saudi during the the k1 process. The only difference in going for the interview in a country that you are not a citizen of is that you might and probably will require 2 police clearances. One from your country of citizenship and another from the country you work in which is what my fiancee had to do. She was so stressed because we didn't realize this until after the interview. She had to fedex her expired NBI clearance back to her sister in the philippines for renewal.

Where did she live? If she lived in São Paulo state, she's lucky 'cus São Paulo have an online service where you can order the certificate.



She did live in São Paulo state....specifically in Bauru.
The other problem we are having is this....on that website that you can order the report, it asks you for your Brazil ID number. She was only issued a temporary ID and never received the official one....which is the one needed to order the report online.....we're being told that she has sign a power of attourney and send it to a friend there to physically go to get it. But we're not sure on how to do that or if we can get someone to do that for us....we really don't want to have to send her back to Brazil just to get this report

Hey everyone out there.....hopefully someone will have some info about this type of situation


My fiance is from Ecuador....she was living in Brazil while doing dentist school there. We didn't start doing the fiance visa process until right before she left because we didn't know when we were wanting to get married.

Anyway, I came across the packet 4 from Ecuador and it states she needs a police report from all countries outside the US that she has lived since age 16.
In Brazil, there are 2 types of police reports, a federal report and a state report. Apparently, the federal government keeps a separate database from the civl/state government....so a federal report and a state report are both required for when she goes to her interview at the consulate.

She was able to obtain the federal report...but didn't have time to get the state report as we learned that she needed it too late and the processing time for the report would have been after she left.

I had talked to someone at the NVC service center about this and they said that we would only need one report...however; I emailed the consulate in Guayaquil and they told me that since the federal and state governments keep separate databases, both reports would need to be obtained.

The problem is now that since she is back in Ecuador, we are having a real tough time getting the state report....and it is starting to look like we might not get it.

Has anyone come across anything like this....any advice? Will they deny her visa because the state report isn't obtained even though she has a federal report?
Any help would be appreciated!!

Hello all!

I filed my I-129f petition to the Nebraska Service Center on 06/22 and just received my NOA1 in the mail yesterday. I was wondering at first what was going on....but discovered something.
I'm not sure if it has been widely discussed, but I figured I would just throw it out there...

All of the I-129f petitions are being forwarded to the CA service center. I called the USCIS today and confirmed that info. This is probably the reason why it took 17 days to get my NOA1....it was sent to NE first and forwarded to CA. The forms state that if you live in certain states, to send your petition to the corresponding service center. This apparently is changing and they will soon be instructed to send directly to the CA service center.

This is the info they gave me....if I have anything wrong....don't hesitate to let me know.

Thanks everyone for all the input.

I really hope we don't get an RFE just for the pictures. I sent in copies of the boarding passes from my trip to see my fiance while she was in Brazil in May as well as a boarding pass from when I saw her in January. That boarding pass was for an Ecuadorian domestic flight from Quito to Cuenca.

Also, I submitted copies of my passport pages that show my entry and exit dates from both Ecuador and Brazil when I saw her this year. Hopefully these will be enough.

As far as her interview goes...I don't think I'm going to be able to go see her before the interview....but she is going to take pictures of me and her from high school (when we met) and letters we had sent eachother as well as MANY emails we send daily.

Hopefully that will all be enough without any further pictures.

For some reason, we didn't really think of taking more pictures of us together. Anyway, I did send this picture in with our petition....

Is it bad that this is the only one?

She needs the state report. She obtained the federal report while in Brazil. We were told at the time that is the only one that she would need. We learned after she had already returned to Ecuador that she also needs the state report.
We've been told that if she can show proof that she attempted to get it but was unable to obtain it, then it would be sufficient.

I'm hoping that someone out there has had to submit such proof so they can advise at all what kinds of documents they might accept for this.

Is it possible to get a report for the civil police (not federal) in Brazil without going there?
If not, what did you take to your interview with you to show sufficient evidence that you attempted to get the report but was denied?

We have already contacted the IV unit in Rio and they stated they don't have any contact with the civil police that we need to get the report from.

She was living in Brazil for just over a year. We've contacted the US consulate and they told us that if we can't get the report, we need to provide proof that we attempted to obtain it and we were unable to get it.

Like I said before, we contacted the civil police directly and made a power of attorney and sent it to a friend in Brazil. Her friend went to the police and they told her that a police report can't be obtained for someone if the party is not there in person to request it. They won't even give a paper or document stating that it was denied. They said they can't give any documentation without my fiance being there in person to get it (which totally negates the power of attorney option they told us would work).

My question was (and still is) has anyone had to present documentation at their interview showing they tried to get a report but couldn't get it?...what documentation did you present?

I know it's all so very confusing! My fiance did not steal the money! It was the horrible immigration attorney.

I am a college graduate and not employed. So I need to find an attorney that is more willing to give us advice, the free kind. Haha.

And my fiance' was adopted because they proved his real mother was unfit and that the adopted parents could give him a better life.

(Quick side note. When he was brought here, his mom married a man. Making HER legal. But the husband thought that he would wait and make my fiance' legal to make sure that my fiance's mom wasn't using him for her son's citizenship. Well, they got a divorce, and his mom became horrible. So, with a good heart, he took my fiance' in and adopted him.)

Is there anything that we could fill out to make this look better? :(

He was born May 5, 1990 in Santo Domingo, Dominican Republic. At age 1, he was brought here, ILLEGALLYby his mother. At age 15, he was adopted by US CITIZENS. They changed his name and places his adoptive parents on a birth certificate, and they have a letter where they were deemed the parents. There is a line in their that says '_____________ will be treated as _________ and ________ natural born son'. So, naturally, they thought the paperwork was over. However, they never filed for a visa or anything. So, without knowing, he finished High School, in 2008. (Don't ask me how he did that without a SSN or something. I really don't understand this mess.)

We met on September 2009, and began a relationship. His adoptive family did not approve, so they kicked him out. He had to move back in with his blood mother. When they went to enroll him in college classes, they realized his ADOPTIVE PARENTSnever finished the paper work.

Ever since January 2010, we have tried to find out what we can do. All his adoptive parents needed to do was sign like 3 pieces of paper, but it was too late. It needed to be filed before his 21st birthday..when we find that out, it was one WEEK before his 21st birthday.
So, now, we are up in the air. He has given every piece of information he has about himself to the Dominican Consulate. They gave him a copy of his Dominican birth certificate.

This is what he has for identification purposes:
  • Maria's Travel? (Has his ORIGINAL name from birth)
  • High School Diploma (With adoptive last name and first name correction)
  • Adoption papers (Recognizing him as their son)
  • ITIN Number (He has a job at a church)
  • Dominican Birth Certificate (With original last name and first name misspelling that was changed by the judge when he was adopted)

Because this is just a mess, his mother paid an attorney. All he said was to give himself up and go back to the Dominican Republic and face possible barment. Then, he stole thousands of dollars, and skipped the state.

I don't know how he can get back to the Dominican Republic without being barred. None of this is his fault.
He needs to go back to just get that Dominican Passport right?
Then should we fill out the K-1 Fiance' form?
If we fill that out and send the letter of intent, withouta passport attached for him, and we sent adoption papers and his birth certificate, maybe that would work?

Please help me. :(
