I appreciate your help, but I don't think that sounds right about the children. They are not wholly dependent on me. They do not live with me. Can you show me where it says that minor children are wholly dependent even if they don't live with me.

That changes the household required income going from 2 people (Aya and myself) to 4 if my 2 children are on there even though they live with their mom full time.

I looked through the guides and didn't see an answer for this so I am asking.

Part 3 is confusing me. Perhaps it's because I had 7 concussions from playing Minor League football ;) but for that part I need to put the information for my Fiancee Aya (who is in the Philippines) right?

Also I saw what part 4 says so that just re-confirms that part 3 is for Aya's information. I just want to make double sure.

I already put my information up top so I figured that Part 3 was for my Fiancee (I am the USC).

Part 8.

I am divorced and my 2 sons live with their mother and I pay child support. It asks if they are wholly dependent or partially dependent and I know that it's partially but I am wondering if they take this into account as far as the money made by you because I will only have 2 people under my roof, Aya and myself. Just wondering.

I am also wondering if I need to wait until I get the NOA2 to complete and do this form. I need to ask my job about the paper giving my information, it may have to go to the corporate office to get it done and I wanted to get it done asap. If I get something dated Jan 1 (for example) and the NOA2 doesn't come till Feb-March will I have to get another one to prove that I still work there (been there for 10 years).

Last thing. On the guide here at VJ it says to include 2 of 4 of the things requested in the instructions like bank stuff and the like, but it looks like I am supposed to include all of the following.......

Statement from the bank with Date account opened, total amount deposited for the past year and present balance.
Statement from my employer with date and nature of employment, salary paid and whether I am temp or permanent.

I figure I need to get all that information.

But technically the I-129F has nothing to do with that. They don't care about that. You only have to prove you are a USC, able to marry and have met in the past 2 years leading to the filing. The rest is honestly just fluff for the I-129F.

We will be getting new copies of NBI and cenomar etc once the NOA2 is received and sent to her for the interview etc. You are right, a lot could happen.

Will leave out mom Itin but I am going to keep hotel letter from manager and receipts I can get from them.

You are only proving to the US that you are eligible to file for the K1 by filing the I-129F.

I would just read the instructions on filling out the I-129F (which is here http://www.uscis.gov...i-129finstr.pdf).

Make sure you follow those instructions to a T.

They are wanting to make sure that you are eligible to bring her here. This requires you to be a US citizen and that you have met in the past 2 years. You meet both these criteria. Send hotel receipts, pictures of you together (which you have to write on the back of with a felt tip pen information. The mother's trip to Manila don't matter. They only care that the two of you met. If you have pictures with her family, you'll indicate that on the back of the pictures.

I personally included proof of an ongoing relationship seeing as it's going to get forwarded to the Embassy. Something like proof of an ongoing relationship doesn't expire. But the other things like Cenomar, NBI like that might be better to just take with her when she files her paperwork after the I-129F is approved.

These things have variables associated with them. You never know what's going to happen along the way of the process. I'm not sure how long the forms are good for when you get them, but I believe it's best to have recent versions of the Cenomar, NBI, I-134 and stuff like that. A lot can change in the 6-8 months it takes for the I-129F to get approved. She could have been in trouble with the law, she could have gotten married (to you of course since you live there as well) and your income could have drastically changed. (Not saying any of this is going to happen, but you have to look at it from the Consulate's eyes as well).

You don't have to be rich to get a K1.

 

I have payed

 

1,400 for my flight out there the first time.

250 for the engagement ring (bought from a pawn shop because she told me if I bought her an expensive ring she'd kill me)

315 I-129F application fee (unless it's changed or whatever)

 

To finish it I'll need

 

~ 500 for the Embassy interview/ medical exam

~ 2500 for the flight to go get her and bring her back.

 

That's just me and your mileage may vary.

 

 

Probably about $20,000.

All the I-129F is for is to make sure the USC meets the requirements to file the petition to bring the foreign fiancee/fiance over.

 

They check to make sure

 

1) proof you have a bonafide relationship

2) proof you have met within 2 years of filing the I-129F

3) proof you are a USC

 

I think there are a few more things they check out like if you have any domestic abuse cases and stuff like that. Everything else comes when the foreign fiancee/fiance gets before the American Consular.

 

Any paperwork above what the I-129F calls for is a waste as you will have to include all those documents again when the interview at the Embassy happens.

I don't think you should be worried. You could call if you want but if you got your NOA2 letter then that's all that really matters (in my opinion).

 

You'll be a family of 2. You must make more than 125% of poverty level for the amount of people that you'll be supporting in your household (including yourself). Do you have any kids even if they live with their father/mother (regardless if it's joint/full custody)?

 

 

 

7 months to the day that they received our application they approved it!  One step down and what seems so many to go.  A couple of things that have got my attention.  The USCIS have not updated our information via the USCIS website.  So when I received the notice in the mail I was very shocked and almost didn't believe it.  I was checking the site up to 4 times a day! Should I contact them and ask why or just leave it for now??

Penguin is right. The letter is just recommended to have in case there is doubt. If there is a W2 along with the 1040 to support what was made last year and the consulate will take only one year, I would just provide the minimum.

 

$19,387 is 125% of poverty which is required. I'd just do everything to support the 30k and leave out all the superfluous stuff. 

 

 

Don't get a letter, just do pay stubs and the tax filings which support the $30'000 figure.

Make sure petitioner has W2s and the 1040. Not sure what the USEM in Australia requires (up to 3 years worth of both) but I personally don't think there should be any problems with it.

Why can't she still fly to the USA? I know that she will not be able to fulfill the K1 because of the death but getting a tourist visa will be next to impossible. Why not use the K1 to fly, spend time with the family, get some closure and then fly back before the 90 days is up so that you will not be here illegally?

I'm starting the K-1 visa process and in the instructions it mentions including a passport style photograph. I also see in the photograph specification document on this site that it should be about two inches square. My question is, where should I go to get a photograph this size in the U.S.? Because I think a passport style photograph is smaller than this. What did you do when you filed your application?

I know people from Michigan that it's gone to CSC and people from Oklahoma that has gone to VSC.

It doesn't seem to have rhyme or reason but I was wondering if people know what decided what service center you got directed to?

That national average is junk.

They took the 4 processing times from the 4 Processing centers (even though only California and Vermont are the only ones processing 129Fs anymore) and then divided by 4 to get the 10 month average. No extra thought went into that such as the amount of people going to each service center etc. It's ridiculous.



From USCIS site:

USCIS National Goal = 5.5 months
USCIS National Average = 10.2 months
California Service Center = 6.6 months

In our case, it will be 3-4 months from now (we filed early September last year) if we based it in National Average (10.2 months)...just a conservative forecast tho.
Keep yourself busy and time will fly by in a drift (hopefully!).

You may want to look at DHL still if it's there. Just because you don't have one near you doesn't mean they don't facilitate pick ups from other sources such as USPS and FedEx and/or UPS.

I'd look into that. Any to your door delivery service has to be better than the regional postal service of most countries. Same for the Philippines. Mail is bad there sometimes, God forbid you send anything valuable through Manila. My fiancee told me not to send anything that I don't potentially want lost so I go with FedEx/UPS/LBC (PI carrier).

Every post I see from you is complaining about the Amnesty Act which you don't even know how it works (as evident from your other postings).

Post your timeline so we can see where you are in this process and to see if you are even entitled to be complaining like this all the time.

Don't keep giving people misinformation as they are trying to deal with this rather trying time in their lives and they sure in the hell don't need to hear your disillusioned, over exaggeration about the process.

Don't waste your time all they will tell you is to "WAIT" I called 2 tier support and was on hold for 1 hour and 45 minutes to be told to wait 45 times in a 10 minute conversation and do not believe anything uscis tells you on first tier the times have doubled if the say 10 days it will be 20 if they say 5 months it will be 10. And there is nothing we can do about it they are to worried about processing all these illegal amnesty bs that they have forgotten the people doing this legally. So just find something else to do with you time because the Uscis could care less if you got your visa or not.

a quick question here if someone can help me at least speculate till i can further contact my wife! since the nvc knows that im the choice of agent and everything goes through me as it has been,and knowing as you can see in our timeline were about to have case completed at the nvc,at this point what would the nvc possably be sending my wife? one good thing about this is it tells me everything i did so far is correct,no rfe's and all documents are correct and i already know of course for awhile that all fees are paid,so im just wondering again what they might be sending her?could this possably be the instruction letter to my wife telling her about her interview appointment and the need for a medical exams for her n my stepdaughters and are about to notify me by email of the same? any ideas from anyone would be appreciated even gud educated guesses just so much excited :thumbs: thk you
