Hi my wifes 1040 states she is single as we didn't get married till this year January 2011

Is this OK?

As far as the IRS is concerned, whatever your marital status is on December 31st of that tax year is what your status is for the whole year. So, if you were single on Dec 31, 2010, you would file as single for the whole year.

In that example, you can't amend for 2010 because you were not married for that tax year.

My wedding pics were stolen. I am just getting ready to file the Application now this. Do I darn submit all my evidence and I have alot without pictures and hope for the best or try and hunt down this court photographer to see if we can get it off his camera drive. It was way back in May so I highly doubt he keeps them all.
Lord advice please

If I were a wedding photographer, I'd certainly keep ALL photos I took in case reprints were ordered($$$$). I'd hunt him/her down if I were you since (I'd guess) you would want to have wedding photos for your own use.

Hi everyone,

So, me and my now fiancee are just looking into all the Visa options, and everything is so confusing! Im not too sure where to post this topic but, after reading through the guides, it seems like the IR-1/CR-1 visa is the best route? I just have a few basic questions....and I apologize, as I am sure they have been asked a million times. I am from Canada and he is American.

1) Which visa is the most recommended: K-1, K-3 or IR-1/CR-1?
2)If we were to apply for the IR-1/CR-1 after we were married, can I move to the states while it is being processed or do I have to wait until I am actually approved? If not, am I able to go to the US to visit or am I stranded in Canada away from him while we await the approval?
3)Is he able to visit me while we are waiting for it to be processed?
4)Do we have to be married in the US, or can we be married in Canada?
5) Are the parameters for visiting while the visa is being processed after marriage the same for the k-3 and the IR-1/CR-1 Visas?
6)I know this is an american immigration website but just wondering if anyone knows if the process is easier for him to immigrate to Canada than me to go to America?

If you are just engaged, you'll have to do the K-1. The others are for those that are already married.
You can't move to the US until you have the visa, but you, as a Canadian, can visit for up to 6 months in a year
Yes, you can visit, but you'll need to show strong ties to Canada to cross the border. They will know that a petition has been filed on your behalf, so never lie about it.
With a K-1, you'll have to marry in the US. The others, I think you can get married anywhere.
Yes, the same parameters.
Not sure which is easier, but there are a lot of forms for both countries.

My passport has stamps from crossing to visit, never asked for them they just stamped it lol


My husbands passport wasn't stamped, we included copy of every page in colour and a copy of his birth cert.
We opened his passport so that 2 pages of it would be on 1 computer sheet to try to save some sheets.

We had no problems with this, included ticket stubs and itinerary's and 25 photos etc. Front-loaded I guess for Canada but had very fast smooth and no RFEs or hangups anywhere.

They've never stamped either of our passports. I guess they don't do it routinely for Canadian and US citizens since so many of them cross the border daily?

I made my passport copies in color and opened it so there were two pages per copy page as well.

I don't have the boarding pass from my last trip there, but I do have the baggage claim tags and they have my name, city and date on them. I hope those, along with my itinerary will work for my visit. We do have the boarding passes from her visits. We have to take more pictures! We only have a few of us together since are usually taking pictures of each other.

We hope that the path is fast and smooth for us too! :-)

You can ask them at the border for a passport stamp, and tell them you need this for your I-129F application. That's what I did when I went there 2 weeks ago.

Unfortunately, I didn't think they did that so I didn't ask the last time I was there. By the next time I'm there, we will have, hopefully, already applied, but maybe my fiance can get the US side to stamp hers when she visits here in a couple of weeks.

Yes, copy all pages and copy them twice. Why? Your evidence you two met in the same place at the same time. Do the same with your fiance's passport. This is not the time to worry about saving trees. It's the time to make sure you do it in excess and correct! Anything less is a chance for an RFE and wasted time.

Well, I just made 5 copies...just to be on the safe side. :-)

Yes absolutely. I have many blank pages in mine, but the instructions clearly state all pages. I would not risk your file initially being rejected for failure to provide all pages. I would save yourself some time and just follow the instructions precisely and help to ensure you have better chances of your file being approved without needing to provide additional information.

If you dont want to send the copy of all the pages of you passport, you can just send them the copy of yout birth certificate, and send them only the copy of the stamps you have on your passport for visiting you fiancé. We did that.

They don't give stamps for US citizens at the Canadian border, so I guess I will be sending a lot of blank pages :-)

I sent a certified copy of my birth certificate only (which is what the guides said to do, one or the other to provide proof of citizenship) and was sent an RFE, in which one of the things it asked for was "all copies of my passport pages" (and my spouses also). I would send both just to be on the safe side.

Play safely. Just copy all and give more than they ask. Nothing to lose. Better spend more time to prepare your K1 application then later we sorry once we send it. No question later like this; oh did we send right thing? Oh dont you think it should be like that?. Good luck on your Journey.

The instructions that ask for passport photocopies actually say this, in not quite as many words. The instructions that allow the use of the passport as proof of US citizenship specifically ask for all pages of the passport. Instructions in other places that allow the use of the passport merely as an identity document specify that only the bio page is necessary.

When in doubt, read the instructions very carefully, and interpret them literally.

Only if you're using your passport as proof of citizenship. If you can send a photocopy of a certified copy of your US birth certificate, there's no need to send ANY of your passport.

I was going to send both on the theory that more is better.

What I did was scan all the pages of my passport, and then use a color printer to print them. Not only should you print ALL the pages, but I highly recommend color copies. Good luck!

Got the email telling me that my petition was received (NOA 1). I thought, since I live in Indiana that it would be going to the Vermont Service Center, but the email says it is going to California. Does anyone have any idea why it went west?

I'd like to say yes to the signed for :) But he forgot, unfortunately. The point of the tracking is to know that they received it since they only give you 30 days(I reckon) to reply and they'll allow up to 60 days to review it so you'd probably be more relaxed knowing it's in the hands of USCIS before time runs out. If you use Express it'll include tracking and signed for - my fiancé used priority and forgot the extra services.

You can use a bigger envelope. Personally to be sure, my soon to be husband(yay!) taped the return envelope onto a bigger one. Otherwise the documents couldn't quite fit in there. We got approved in some weeks from USCIS getting the RFE back, and it was at CSC too.

I have been trying to schedule an interview in Montreal for WEEKS!! The website keeps telling me "No available appointments at this time." If anyone else having any luck scheduling an interivew?


We're having the same problem! We got packet 4 in the mail today but no luck getting an appointment booked. Keep trying is about all we can do I guess. I was told today when I called that it can change very quickly from No available appts to open bookings again.

Here is the situation my fiancee and myself have been applying for our K1 visa since March of this year and as of yet I have not been invited for the interview in the London embassy. I have completed all the forms and my medical was completed on the 26th of August

My concern is I am due to fly out to the States on October the 6th as our wedding is supposed to be on the 16th. After the wedding I am supposed to fly back to the UK as I am due to have an operation on my back. I can probably postpone my operation but we have forked out a considerable amount of money on the wedding and quite a few of my family and friends are due to fly out so we really do not want to cancel or change dates if possible. I know we really should have waited for the visa to be approved but we thought that 7 months would have given us plenty of time.

I have phoned the UK embassy premium rate line on 2 occasions, the second call resulted in an email code which I have sent an email to the London embassy regarding the situation.

What I was really wondering,is there anyone else that has been in a similar situation that may have some advice on our options next? If we get married without the visa what would happen? I really don't know what to do, we don't want to break any rules but financially cancelling the wedding could be disastrous. This is now causing me and my fiancee some serious distress.


Please please help.


I don't know anything about the London embassy procedures, but I do know If you go back to the UK before you have your Advance Parole card, you will be viewed as abandoning your visa and will have to start all over with a CR-1 visa. If you get married before you get your K-1 visa, you will have to start all over since the K-1 is for unmarried couples.

I'm planning to drive up to see my fiance in Canada the first week of February. I've never crossed international borders by car and I remember how nosy the customs officials were at the airport. Should I tell them I'm going to visit my fiance? Or will this raise suspicions? Should I just say boyfriend?

Also, I'm bringing him a care package with some necessities. Deodorant, toothbrush, cold medicine, shavers, etc. (I get all this stuff for almost nothing so I have tons in bulk.) Will they think this is suspicious for some reason? It's just so we can save as much money as possible, and since I'm driving, I thought I'd bring a box full.

If you have copies of your NOA's, it will show the CDN border guards that you are planning for him to come the US and that you aren't planning to stay in Canada. Tell them that you are visiting your fiance. It's never a good idea to lie when crossing the border (or any other time)!

If the value of your "gifts" is under $50, I think that is the limit that you can take across, but I'm not sure.

Hello VJers. I dont know how to even start this! I seem to always have problems to formulate a question since english is my second language but here it goes. Okay so my question is, me and my fiance filed K1 visa around december and we are not expecting our NOA2 until june/july but i have booked tickets to see her in the end of march and go back to UK in may. What worries me is the fact that i have never told immigration officers that i am going to america to see my girlfriend i have always been telling them that i am here for a holiday and to see few friends, and i had no problems going through board control.But this time its abit different because i have a feeling they can see on their records that we have filed K1 visa and if i say i am going to see a friend they gonna see that i am pretty much am lying about it..I also feel like if i say i am going to see my future wife they are gonna think that i am not coming back to UK or something! I have been reading from previous posts that its good to bring somethhing that will prove that you have a reason to comeback home but problem is i dont work right now and i am still living with my parents so i dont get that many bills to pay! So my main concern is do i tell them i have filed K1 visa and i am going to see her to get all the documents right and spend time with her before i go home and wait for my interview or do i just say i am here for a holiday staying with my friends? If any of you know anything about this or have experienced it before i would really appreciate if you could help! Thank you!

Do not lie. They know about the K-1. One thing that I would bring are any NOA's you've received. That shows you are trying to do things the right way.

Okay so my fiance and I sent our application in December, NOA1 was January 3rd.

First question is, is it normal to not have even a touch on our application in almost 2 months? We're aware it can take up to 5 months to get the NOA2 (Cali service center). I keep seeing time lines with people's applications being touched 4 times the same month it was sent.

Second question is, when I go for my interview, where will it be country wise? I live in Canada, fiance in Arizona. Will my interview be in my country, or will I have to fly out to the states to have the interview there?

Third question is (probably dumb), is my medical exam I'll have to go through in Canada aswell? I keep seeing people say it costs over $200, but I talked to my family doctor and they said it's not going to cost anything for a medical exam (Canada, free health care, you get it). What's going on with that?

Your interview will be in either Montreal or Vancouver depending on where you live. You will have to go to a doctor that is approved to do the visa medicals and your Canadian health care does not cover the cost.
