We are about 116 days into our wait for the I-129F petition approval for our K-1 visa. I want to start filling out the paperwork for Packet 3 and Packet 4 (I-134, Letter from Employer, Letter from Bank, Letters from family, Updated Letter of Intent, etc) but was wondering if the dates would be too early as our interview may still be 3+ months away. It will probably take a few weeks to gather all these letters but would the dates on them being in March be too early if our interview isn't until June? Whats the rule of thumb regarding dates on these letters?

Also, does the updated letter of intent have to have different wording or can it say the same thing as the first one just with an updated date?

Are there any November 2011 CSC filers out there getting anxious as they watch the time lines creep closer to our adjudication dates? Rounding out 4 months and it honestly hasn't felt that long. I've tried to keep myself busy and I guess it worked! Actually, with each day I get more anxious and nervous and then start stressing about all the paperwork we still have to get done for Packet 3 and 4...Where did the time go? B-)

Hi All-
Here is my dilemma...Received my NOA2 approval on 03.30.12. Packet 3 was sent around 04.17.12 and we sent Packet 3 back on 04.18.12. After a month of no information my fiance called and checked on it and found out they "lost" our Packet 3 and we had to re-submit our documents on 05.23.12. We did that successfully and have already received confirmation of receipt so we are back on track. With how our consulate(Mumbai, India)schedules their interviews about a month in advance, we will probably have our interview scheduled for the beginning of July. My petition approval expires on 07.29.12. Should I request an extension? At what point do you request an extension and what are the steps/forms to do so? Our consulate is a high fraud consulate and to prepare for the worst, sometimes applicants are put into administrative processing and I'm concerned if that happens, our petition would expire and then they would deny strictly because the petition expired. Any thoughts?

You will need to check with the VFS to see what the exact exchange rate is at the time of your interview. Ours was 13920 Rs. I've seen cases where if you go under, they will let you go to the bank and come back same day to interview, however in our case of going just a little over, we had to come back the next day for the interview. I would assume that is what the process is now.

No, you cannot send a check from your bank in the US, it has to be in Indian rupees.

However you decide to answer the question of why you decided to get married in India, it needs to be honest to you both and your relationship. Our first reasoning to get married in US was because it was faster but then as time went on and we started thinking about our wedding plans, neither my fiance, his family, nor I had to money to pay for the wedding so my parents (US Citizen) are pretty much paying for the wedding and that is the truth and that is why.

Thank you emmandenn...we are praying for that. Where are you in Phils and which state you will be applying for. My fiancee is telling me that it is hard nowadays to apply for NCLEX-RN exam especially most of the states now requiring a SSN. I assume you just sent your packet too..God luck for us! :)

No need to worry if he got denied on the tourist visas and if he isn't a a USRN upon application of K1.

I am also planning to take my NCLEX when I get to the US after getting the coveted NOA2 and visa by September. :) My fiance is also a Fil-American. :)

Red flags will be like a relative introducing the two of you or K1 visa applied multiple times for your fiance by different people. Things that would note something fishy about the relationship. If it is not related to your relationship then it shouldn't be a problem. :)

You don't need to pass the NCLEX-RN in order to get a K-1 visa.

As a side note, I'm not sure if there are any states left which will allow a foreigner to sit for the NCLEX-RN unless they have a Social Security number.

NOT passing the NCLEX exam will also not affect your k1 petition.

Tourist visa denial has nothing to do with K1 (two different processes) Although if asked if previously applied for any type of visa, should be answered honestly.

Hi Vjers,

I am new here. I did a searched but couldn't find a related topic about my concerns.
I already sent my K1 application last April 6, 2013 via fed ex and says it will be in USCIS on Tues. I am a Fil-American citizen and just had my oath last apr 5. After I gathered all the necessary requirements for K1 I sent my application the day after I got my naturalization certificate.

I had few concerns about our situation as K1 filers. My fiancee is a RN in Philippines. Not working since 2011 after working 3 years in middle east (stay in Philippines since 2011). He has I-140 application in one of the nursing home in New York which her employer said that they didn't push through because of some lacking requirements (NCLEX-RN licence). When her Aunt got a severe illness in the US she attempted to apply for a tourist visa twice and got denied twice. Does having an immigrant petition (I-140) and twice denial of tourist visa could raise a red flag for our K1 application.

Also, is there any nurses here from Philippines required to pass the NCLEX or been ask by the immigration officer about passing the nclex and got denied for not passing the exam?. Me and my fiancee plans to take it when she arrives here. I am very anxious now. Hope you guys could answer my query.

Someone might be able to answer this better, but you probably should have sent the petition to the address that was listed on the form. If I remember correctly....it was a PO Box. It may or may not matter...

We got it (2nd notice of approval) in march (notice date 12th March 2009). Problem is it has been 9 weeks now and we are not getting a package as yet from the consulate in my country. We called the 603 number first they told us that it is not there as yet, Then someone else told us that it was sent to my consulate in my country, Still did not hear aything. So i called NVC again , this time a gentlman told me that my documents were forwarded to my country since the 6th of February 2009 and he even gave me my case number(the number i have to bring to my consulate. That has been 1 month now. So i called Nvc againand i am still hearing that it is not there so i don know who to call or what to believe. The valid date on my 2nd NOA is the 31st january2009 to June 1st 2009. will it be a problem if the date is passed and i dont hear from them. I wrote my embassy by email and got back an automated responce, but nothing personal as yet. Does anyone here in the visa family has any answers for us. We are worried and dont know where else to turn helpsmilie.gif



You say you have been calling NVC....I don't think NVC has information about if the package reached the consulate..you have to call DOS...202-663-1225 and give them your new case number. If THEY tell you its not at the consulate yet, you probably need to start calling the consulate.

edited to add: we met at my uni when he was studying there...so it was a bit more straightforward than an initial online meeting, and then meeting in person at a later date.

Criminal pass, drug use, misrepesentation. The list goes on, up to the person looking at your case.

They look at everything and if you pass, you AOS, if not, you have some hoops to jump through.

CR-1 doesn't require AOS. If you want to stay in the US legally, you HAVE TO do AOS.

Generally, once the K-1 visa is in her passport, she will need to enter using that. However, I think I may have read some instances where Canadians have been able to enter without activating the visa (I have ONLY seen this for Canadians). So its possible, but its not something I would personally risk. As for while the application is being processed, she can definitely come visit you, but make sure she brings proof of ties to Canada.

They do allow it. Keep in mind if she will be going through Montreal that right now they are booking about 3 months back so if you got your NOA2 in October lets say, odds are unless Montreal speeds up that her interview wouldnt be until January/February anyway. If you delay the return you can push that back. Theres also been some ppl who got approved and asked if they could wait a month or 2 to pick up the visa as they weren't ready to move due to work/housing whatever. Not sure on the timeline for Vancouver, but you should be able to do the same thing through them.

If you got the 120 days estimate from the site, its just that..an estimate. You can't really do much until its been 6 months (I believe this is the current processing time listed on the USCIS website...the website won't load for me).

I'm assuming this is something you read on this site? If it is generated based on the timelines we fill in, I'm going to guess it includes weeks. Also, if is is based on our timelines, its going to be around the same as what you estimated date is on your own timeline on this site.

It doesn't matter how many times you've been there if you haven't been in the last 2 years. And if I were the person looking at your case I would really wonder why you hadn't been in 2 years...or almost 2, or whatever.

The I-129F instructions don't say anything about "two years from the time we receive your submission". I presume they mean two years from the time you signed the form. You have no control on when they issue the NOA1.

In any case, if you haven't been to visit your fiancee since May of 2007 then you're definitely due for another trip. Having multiple trips on a somewhat regular basis goes a long way toward convincing the consulate that your relationship is legitimate.

The cover letter at this site stated something like " Copies of documents submitted are exact photocopies of unaltered documents and I understand that I may be required to submit original documents to an Immigration or Consular officer at a later date."

So I sent in all copies and kept the originals for my self. The reason I have not been back to the philippines since 2007 is that I have two children there and are supporting them and saving money for them. So I really have not had any extra money. To waste on that. I have no doubt in my government that it would be approved. But just a bit worried about filing late. I miss read it at first and thought that they wanted me to prove that I have known my wife for at least two years and not that I only needed to visit her within the last two years. I hope my government wont fail me.


OK, this might just be me being picky, but you call her your wife, and you filed for K-1....which is a fiancee visa, not a spousal visa. Second, if it ever comes up that you don't have the money to go visit, I am not sure if they will feel you have the money to support her and file for AOS, etc, as that's probably only a little less than a flight to the Phillippines...just my speculation....but I am pretty cautious.

The VJ timeline is an estimate. USCIS is NOT going to care what your VJ timeline says. If you call them now, you are right, they will just tell you to wait until 6 months.

PB&Jam, you know I love you, but I disagree here. I have talked about this exact issue with my pastor, at the beginning of our process. He was the one that recommended to ME to do a non-legal church wedding early if need be (I decided against this being an option, after thinking about the potential risks). He assured me it would be "real" in the eyes of God, which is the more important part to me in the first place. He was more than willing to do a non-legal ceremony for me, and then, when my SO got over here on the K1, sign everything to make it legal.

I do, however, agree that God would want us to obey the laws, and that a legal wedding would also be valid in the eyes of God, but I don't think any of that means that God would not see a non-legal wedding as real. I don't mean to get into a religious argument, I just wanted the OP, and other people who may have this question in the future, as I did at one point, to know that your experience is not what everyone has experienced.

I called USCIS to find out what was the delay in my petition. The tier one said they are working on Nov. 2nd petitions and I had to wait 15 days. I asked to speak with a supervisor and was basically told the same thing. I was finally put through to an Immigration officer who put in a request to find out what the hold up was. I checked the USCIS website at 11:15 and my petition is APPROVED!! :dance:

The RFE doesn't necessarily mean they want more proof of relationship. It could be any number of things..maybe you forgot to sign something, missed a line on the petition somewhere...it's possible it is something with a very easy fix.

agree another person on here they were wanting the long form of birth certificate instead of short form...try to stay calm i freaked out when i got my rfe and when all said and done i had everything they needed in couple days..good luck to you:) :thumbs:

So I have noticed that some fiance' visa applicants are asked about having sex with their partners and are asked to produce intimate photos. While some folks do have sex, others think its bad form to have sex before marriage. This doesn't seem to vary by nation but more perhaps by religious proclivity.

How can consular officers ask about or expect that those of us in Fiance' relationships will have had sex???
And honestly my sex life is none of their business, but I'll answer the questions if it gets my fiance here. I think it borders on cruel and unusual punishment.

It definitely sounds like his employer is not paying him on time. My husband had the same issue in Brazil. We lived there together so I saw it first hand. I noticed that there were certain employers in Brazil on the island where we lived who just did not pay their employees on schedule. When you're paid monthly, it makes all the difference when you're not getting paid on time. What this particular employer would do is give out partial payments when the employee began to complain that they needed money to pay their rent and utilities. In fact, this very employer was taken to court by the owner of the building she was leasing because she wasn't making her lease payments and hadn't paid for over a year. To this day she is still in that same building and probably still not paying. Several of her employees also took her to court and won so she was forced to pay them.

I completely understand your situation, however, it's very common in your country that employers do not pay and you should have by now become accustomed to it. If you did not have your fiance who happens to be an American, how would you be solving your money situation? How were you handling it before you met your fiance? Americans are very skeptical when someone from third world countries ask for money. Some of us tend to believe that we are being scammed and unfortunately, many of us are being scammed.

Living in Brazil, I learned that when you live in such poverty, for many of them they have to do what's necessary to get money. I was propositioned several times to marry so that they can come to America.

Many citizens of third world countries believe America is where the money is and will do and say whatever is necessary to obtain a better life for themselves. I've met so many opportunists in Brazil that I became very skeptical of anyone who wanted to be my friend. However, on the flip side of that, I also met many who were not opportunists. My impression when I left Brazil is that poverty is a great motivator.

A good friend of mine was chatting online with a guy from an African country. Within a couple of weeks or so he was telling her how much he loved her and wanted to get married and go to America to be with her. She ended that relationship immediately.

Sounds like your fiance is playing it safe and and has decided to end the relationship before she regrets it later. It's her choice. You know her better than we do so if you think you have a chance to salvage the relationship, I would suggests as others have to not ask for any money and take care of your situation as you have been prior to meeting her.

Its accuracy is also limited by the number of people who choose to fill in their timelines which is why VJ members insist on telling those who have yet to fill in their timelines to do so... timeline.gif

Also keep in mind that not everyone applying for a K-1 Visa is a member of Visa Journey so their timelines are not included in the estimate.

As I stated earlier, I have been with him up until a couple of weeks ago so I am hoping that won't be a problem.

3. He plans to come here with at least $5,000. And we are hoping that he will be able to apply for him to be able to work here after we get married, which will be like the following week of him arriving. Will I need to give an AOS? And is that something I need to file along with the I-129F or do I wait until they ask for it?

4. He has a bit of a criminal history. A couple of driving offenses, A couple of marijuana charges, (small amounts) and one larceny charge for taking a couple of surfboards from someone off of a beach. These have all been cleared up. He had fines for them but they have been paid for and he has not been in trouble with the law for over 5 years now. Will this stop him from getting here? Will they give him an interview and decide based off that, or will he not even get a chance to have an interview?

Anyway, thank you for taking the time to read this. Any info that anyone has is greatly appreciated and I am sorry this was so long.


I always believed that if you had a drug conviction you were banned for life from entering the US. Seems my thinking might be incorrect. I don't know a lot about waivers, but it seems like you will need one. I believe you'll have to submit an I-601 waiver. Wording from the waiver instructions read:

If you are found to be inadmissible based on criminal grounds, you make seek a waiver of inadmissibility for the following: A controlled substance violation according to the laws and regulations of any country insofar as it relates to a single offense of simple possession of thirty grams or less of marijuana.

If he had more than 30 grams then he would not be eligible for a waiver and thus inadmissible.

Maybe others who have dealt with the same issue can chime in and share their experience. As others have mentioned, it would probably be wise to consult an attorney.

They don't really care where you get married, that's why they have different types of visas. A fiance(e) visa is for a FIANCE(E) not a spouse. What is so hard to understand about that. If you want to be married in another country then do so and then file for one of the SPOUSE visas.

The co-sponser only needs to count herself and your fiance. If her income is sufficient then she doesn't need to show any other assets.

You entered with the K-1, did not get married, then went back to your country and want to reenter again? Is that correct? If so, you will have to start the process all over again for a K-1 or if you fiance goes to your country and it's possible for the two of you to marry, then you can file the CR-1.

I think he meant that if you did have financial problems (lets be clear, you CANNOT SELF-SPONSOR under any circumstances- It must be a USC that sponsors you) you would be denied for that reason regardless of which visa path you took. The requirements are the same for all visas.

And for the record, do NOT do K-3. From the posts ive seen from you two you guys still have ALOT of research left to be done, so get studying, and study hard. Read the same stuff not once, not twice, but at least 3 TIMES, if not more. For me i often found stuff i missed the 1st/2nd times around.
Besides, last i heard the K-3 was being phased out- i bet you heard K-3 is faster than CR-1 eh? WRONG, that information is old. Now Cr-1s are making it out FASTER (not to mention ALOT cheaper/easier) than K-3s, so it may or may not even be an option anymore. A person in their right mind WILL want to go CR-1, rather than K-3.


Since only the USC can self-sponsor, is it an option to have the $28K transferred to her bank account for the purpose of sponsoring him?

You fill out your own I-864 that includes yourself, your dependents and your husband. That is your household size. Your step father fills out his own I-864, and lists himself, wife, dependents and your husband for his household size. You are not part of his household size since you are not his dependent. He must qualify to sponsor your husband based on his own income for himself and his dependents + the immigrant, not you.
