Yes you are correct in the IV packet you have to send originals or certified copy of all your personal documents, then in order to get all your original documents and or certified copies back at time of interview you must also include a copy(wich you can do yourself) of any of the documents that you wish to have back.

Went to the Embassy again today! With the regular copy, and it was totally fine! They were asking around a little bit, it took about 10min untill they said 'OKAY PICK YOUR VISA UP MONDAY!'' TOTALLY APPROVED!!! I AM FLYING HOME TUESDAY!!

Hey guys!
I am debating here on what to do ...
Some of you allready know the story, for others here in short : Went to Embassy last week, missed out on a paper (birthcertificate of Joint Sponsor, basically proof of citizenship) .. anyways,, Called the Embassy back later to ask them what kind of copy they needed,, they said certified copy...

NOW.. If you read the instructions for the filing of I 864 for Joint Sponsor, (where NVC should of noticed it was missing.) It says: For U.S. citizens or nationals, a copy of your birth certificate, passport, or certificate of naturalization or citizenship

So A COPY.
NO specifications...

See, tomorrow I have to go back to the Embassy, if I have the document (right now I have a regular copy of the birthcertificate of jointsponsor).. They only take 'comebacks' on Thursdays, If I don't have the original through UPS by tmorrowmorning, here I have another delay of a week to go back up there... Orrr, I can take the simple copy thats in my email.

What would you do??

Go with a regular copy anyway? If UPS doesnt get the original to me by tmrwmorning?

Really! Wow am sory to hear of this! If they stated it needed to be a certified copy then that is what you need. Taking them anything else will just be a waste of your time. I pray you get it in time and are not delayed in your process. I just sent off my AOS / IV packet 2 days ago to the NVC. I did not include and proof of citizenship for my co-sponsor? Is this proof needed for me as well or is it specific to particular countries?

So we mailed off our AOS/IV packet last week. I called yesterday and they had recieved it. However i was informed that the police certificate my husband has for Germany wasn't eneough? Also the certified copy we sent of his birth certificate wasnt accepted because was issed to him in germany and not from property authority in Cameroon. Sooooo..... basically after being so careful in assembling this packet we made 2 errors. I am trying to stay positive, however the mailing system in Cameroon!!! not so positive to say the least. So keep us in your prayers as we wait for his mother in cameroon to send me this police certificate all the way to US and also that the original birth certificate is not lost in the shuffle. It is the only one he has. Stay strong guys we all get closer to our goals each day even when it does not feel like we are moving at all!

I am the USC petitioner.

I need some help. I was not planning to get my NOA2 so fast. I got it today. It's only been 4 weeks! :rofl: My husband and I were not planning for him to come till late april/early may so we decided it's best to delay the case a bit. For many reasons, it's best for us to wait. However, I want to make sure I do things right. I read some wiki guides, but i'm still a little confused about what to do next.

1. When do I call NVC to get a case number?? Do I still need to get a invoice identification number? What is the difference between that and a case number? Additionally, I would provide my email as well as my husbands....correct? :blink:

2. When do I email the DS-3032?? Right after I get the information above from NVC? :help:

3. Since I want to delay the case a bit, do I have to pay the fees (AOS and IV) asap? Or can this be delayed too?

4. If the fees cannot wait and I pay them soon, is this where I halt, and wait on sendings AOS and IV packets since I would like to delay the case for a couple of months? :help:

So your reason for wanting to pospone the process is not exactly for his arrival, but more about you wanting to be present at the interview? Am I right?If I am right and it is that important for you to be present then when the time comes for it to be scheduled if the interview given does not work for you explain that you want both of you to be present and an estimated time when you will be available to travel there. But i have to be very honest we are on their time and they are definately not on ours. They could give you an appointment just as you ask for or they can give you an appointment a year later? Ultimately the decission is yours. You do seem to be very lucky! As i am still in shock to hear you getting NOA2 as quickly as you did! I definately dont recommend trying to postpone anything in the visa process. Go ahead with all fees and filing that are possible as soon as you can. This process will always keep you on your toes! You never know what to expect! just get through it then when at the final stages if you feel the need to delay the interview then so be it. You have been lucky so far! I will admit verry lucky! extremely lucky! however i would not rely on the entire process to go so smoothly. I hope i am not rambling so much... you asked for advice and everyone seems to be stuck on you getting your NOA2 so fast so here it goes...

1. NVC Case number is your identification number issued to you by the NVC that is used as your Identification number. You will have to put this on nerly everyhting you send out from the time you recieve it on. The Invoice Identification number is a recept number that will be found on the reciept you will recieve after paying your visa fees to the NVC.

2. It is best to not send anything till it is asked for. However, sending it in early is an option but just keep in my mind send them anything they have not specifically asked for can always cause delays. Your case number is not needed on this form and will be given afterwards so you can send this in as soon as you like just keep in mind delay it might cause. Things could also go very smoothly as well i dont mean at all to sound so negative in any advice i give, just being as honest as possible.

3.You do not have to pay the fees until they are requested. I waited long in my case for packet 3, i ended up notify them by mail and soon i did that everythign went by very nicely and i submitted my DS-3032 through an email to them and also paid my fees online when it was requested.

4.You can pay the fees whenever you like but not before they are requested to be paid. Dont hesitate to email the NVC with any questions you might have reguarding this or anything else that may come to you. You can choose to wait to send in the packets or not as i have already discussed this above. Please be careful not to delay it to long as you will have to start this entire process all over including repaying all the fees.

I hope this helps and dosent bore you or confuse you in anyway. blessings to you and yours through your journey.

After sending out our IV/AOS packet I recieved a notice that the birth certificate was not sufficient because it was not issued from the property authority in hubby home country it was issued to him in germany where he now is studying. Also we had sent only a police certificate from germany and were not aware they need one from cameroon as well. So they also requested that we send one from his home country of cameroon. I sent them the missing documents they asked for witht he cover sheet they sent me. But then after i had mailed it off i became aware that i had not included proof of us citizenship for our joint sponsor, so i didnt know if i should send it now or wait...both the documents they requested were part of the IV packet and the citizen proof for joint sponsor would be for the AOS part of it. So i assumed that is why i didnt get and RFE for it at the same time as this one. Even though i sent them at the same time in seperate envelopes inside 1 express envelope dont they handle everythign seperately?


Just called the NVC. i think sometimes we make things harder than they have to be by not wanting to mess with dealing witht he officials. I just got off the phone with the NVC, and they said there is no RFE for the joint sponsor proof of US citizenship and there will not be. MY AOS has already been completely processed and approved. MY IV packet will be completely processed and approved as soon as the RFE response documents I mailed have been recieved by them. "When all else fails just follow directions" hehe I learned that rom a very helpful fellow here on VJ.

I forgot the proof of citizenship of the sponsor as well, and I also did not get an RFE for it. Mail it in with the form, attach a note saying that you were not sure if it is needed. If there it's there and one thing less you have to think about.

Well, i have already mailed off the response letter cover sheet they sent me to have on the tp of the missing items in the packet they requested , so i cant put it along . i have emailed them and i will make a discission based on what i get back from them. maybe i can get lucky and since a copy is sufficent i can just send a scan of the proof through an email? thank you for your help though.

Before I sent in that paperwork again, I re-checked everything I had already mailed and realized there was no birth-certificate of my sponsor. So I just mailed it in with it.

I am so happy to be nearing the end finally. I have actually already sent the AOS/IV packet out and since then have recieved a notice that one of the documents was not acceptable but nothing was mentioned about proof of citizenship for joint sponsor missing? Should i send it in? Why didn't they tell me on the same form? Will they not ask for it until the interview? If so... should i just send the proff to hubby so he has it for his interview?

Yes, proof of being legally resident in the US (citizenship or being a greencard holder) is needed. A photocopies birthcert or bio page of US passport should be fine.


Thank you for the help and how sure are you that a photo copy will be sufficent? I know every consulate is different...I had no luck on clarification on their site.

When using a joint sponsor for your AOS, is proof of US citizenship needed? If so what is acceptable as proof? Will a zerox copy of joint sponsor's birth certificate work or will it have to be certified? For a sworn affidavit of your marriage each who is giving testimony has to have their own letter and give reason why they feel your marriage is real as well as sign it.

Thank you for your thoughts. I just think it's odd that 2 attorneys said that I shouldn't bother sending anything. I think I'd rather send it, better safe than sorry or receiving an RFE and delaying the process at all.

No I did not get any. I sent a copy of our contract for our home with both our names on it. two affidavits of family members. Since then we have continued to gather evidence in case he is asked at his visa interview. I have sent him a statement from my bank stating that i have requested he be added to my account but unfortunately they cannot do that until they can get his signature in person, phone records, money gram reciepts, pictures of our wedding and also time we spent together in germany. Anything you can get with both your names on it or his name witht hat adress is always helpful. Wether you add him to a utility bill, or get him a type of magazine subscription.

Hi there,

I am a US citizen married to an Australian currently abroad. We were only recently married (end of October) and I am starting on the I-130 paperwork at the moment. One of the things I noticed is that a lot of the evidence they request in the I-130 packet wouldn't be possible for me to have since we got married recently and he moved right back to Australia. Things like a joint bank account (he doesn't have a SSN), a lease (we don't live together, that's the point of the petition), etc. I do have things like him being the beneficiary on my bank accounts, life insurance, and loads of photos and skype and phone records. I could also of course get affidavits if needed.

My question is, how much of this is required to be sent with the actual I-130 petition during a consular processing, as oppose to just bringing it to the interview process?

In my research over the last few days I have spoken to a few attorneys, many of which have said that the burden of proof is less in a consular petition because they know you aren't living together and naturally wouldn't have that stuff. In fact 2 (unrelated) attorneys said that most often they simply submit the marriage certificate with I-130 (and no further documents), and it is sufficient. According to them, the other "comingling of financial stuff" isn't expected because they know by virtue of filing a consular processing, we don't live together.

While I'd like think these attorneys know what they are talking about, I am having a hard time reconciling this with the fact that the instructions themselves request additional support of the bona fides.

Does anyone have any thoughts/experience with this?

I found myself in a very similar situation, however you have much more evidence than we do. I would send as much of it as you need to send to make yourself feel comfortable. Make sure to just send copies of all the evedince incase asked to show it again later in the process. There is no set amount of how much evidence to provide.

Cameroon has updated their passports to biometric ones so hubby has done one and it is ready to be picked up. however he has failed to pick it up with concerns that that difference in passport number from the old one to the new one and the fact the old one will not be valid any more may casue problems at the visa interview. When he arrives at his interview his old passport will be marked all over statating invalid..invalid...invalid The passport number will be different from the old to the new one so will this cause any issues? Will he just need to have a copy of the new passport to give them at his interview?

I really do want to reiterate though, you CAN enter the US, on a visa waiver (ie, without a visa), with intent to marryPROVIDED you leave after and dont try to adjust status.

If you enter the US, without a visa (or even on a different visa) with INTENT to marry AND adjust status, that is when you have problems.

Intending to enter and marry is FINE!

Intending to enter, marry and immediately stay is NOT!

Yes i stand corrected you can with the intent to marry as long as you can prove strong ties that you will return. amazngrace, most of this information is incorrect.

1) You need a fiance (K1) visa to marry and then immediately reside in the US. If you want to marry and then leave, that is not a problem (I married in the US and am currently awaiting CR-1 completion in England)
2) You do not have to meet the requirements for the last 3 years, I believe it is better if its for the last year, but so long as you have proof of ongoing employment meeting the poverty guideline you should be okay (I know this doesnt apply to you, Liz, but just thought i'd clarify!)


1 i did say a fiance visa, you cant just enter the US without a visa and she has stated he has never been a card holder, also entering the US to get married without proper ducuments is fraud and will only cause issues in the long run!

2 as far as a co sponsor i meet the guidelines now and last year but not the 2 previous years. i had to get a co sponsor so better to have one in case then to cause yourself delays.

However if i caused confusion i apolojize and we are all here giving our opinions based on our own experiences.

Yes, you have to fill out papers and apply for a finace visa to come here and get married since he has no visa to enter the u.s. you need this as you plan to enter and to marry.Entering the u.s. with the intent to marry and not having a visa permitting you to do so, is definately a problem you want to avoid! There are indeed major penalties if you are caught in such a thing. i am not so familiar witht he differences between the visas. however when it comes to income if you do not currently and for the last 3 years meet the level above poverty level required your only option is a cosponsor. Read the outlines here they are very helpful. Me and my husband our now just waiting for his visa interview to be scheduled and i have done all the work on my own through the help of this site and its wonderful members.

its important to stay calm.

if you have a real marriage, everything will work out in the end one way or another. the embassy will have seen cases like yours before. meeting online is not really considered abnormal in this day and age..

how long was your visit? does he have dual citizenship? how long have you known each other? what website did you meet on? are you of the same religious persuasion? do you have strong evidence documenting your relationship? did family and friends attend the wedding?

these questions are probably more telling than the mistake on the form. (and as vanessa said, volunteer the error BEFORE the CO brings it up.)



there is nothing else you can really do before his interview. make sure he is prepared to answer any questions and he knows to be 100% honest. he will do his best and you will move forward with whatever decision the embassy makes.


After looking closer at the error i thought i had made i actually didnt make any error at all. it was just be being really nervous i suppose.

To answer all your questions: yes we indeed have a real marriage. i understand that meeting online is very common and especially in cases such as international marriage. my worries come from the fact that our engagement was very short. however our relationship might be more common that what i think these days. we have only met in person once my visit was for 2 weeks and we married on the 5th day i was there. we had known eachother 5 months before i traveled to germany. we met on afrointroductions.com its the typical chat site but this one has an african basis. we are definately the same religion, that fact alone is actually what got us so addicted to eachother :) as far as proof of our relationship he has many letters and packages i have sent him, reciepts from where he has sent me money, 2 sworn affidavits from my family members, phone records, copy of the lease to our home in the u.s. with both of our names shown on lease, letter from my bank stating i attempted to make my account into a joint account with hum but cant do that until he is able to sign the forms in person. none of iethier of our family our friends attending the wedding. we had a quick and simple courthouse wedding with just him and i the judge that married us and 2 officers that served as the witnesses.

Which form asked if he had ever been denied a visa? I just looked at the I-130 petition and I don't see this question on there. I also looked at the DS-230 form and couldn't find it there either. The DS-230 form does ask "Have you ever been refused admission to the United States at a port-of-entry?". Is this what you are referring to or is there another form I am missing? The reason I ask is because my wife was denied a tourist visa a year ago when I was naive enough to think that they would issue her a tourist visa so she could meet my family and friends before we got married.

OK so here is the issue. when filling out forms for our visa we were asked if he had ever been denied a visa and we said no. thing is he has been denied! it was an honest mistake. if they ask him if he was denied he will say yes but that is not what we put on the documents if they detect fraud will they question him or immediately deny him? surely they have noticed the error i mean they know EVERYHTING!!! if they detected fraud would they still have scheduled the visa interview? i am extremely nervous about this. his uncle had sent him an invitation letter for him to visit the states while on a break from school and they say he didnt have strong proof that he would return so they said no. honestly i think it is because he is african and even though in germany know africa is labeled high fraud. please help me any advice is appreciated!

I sent a package of docuents to my husband nearly 2 weeks ago and he is yet to recieve them. Most of them where just duplicates of documents we have sent in throughout our process that were repiditively advised to be taking along to the interview just in case. However there are a few items in there such as extra proof of our marriage, along with a copy of the original birth certificate we sent in. In the chance that he dosent have the documents in time i can email him sets of duplicates to print out. However the maritial proof i sent is originals and i have no copies to send as well as the copy of birth certificate. the birth certificate we had to send is his original issued in country of birth and can only be replaced by traveling to cameroon and filing for it in person. that being said it is a must for the birth certificate to be returned to him. so i am left with the folling questions:

1. if more proof of relationship is asked and he has none with him because of this delayed packeage will he be given extra time to provide it or will he simply get his visa denied?

2. without provinding them a copy of the original birth certificate he wishes to get back is there any chance he will be allowed have it back?(i never understand why they cant just copy it and give it back?)

3. are duplicate copies of documents such as I-130 and so on that you filed throughout your process really that important to have with you, as you have already sent them in once before and they were obviously approved if you know find yourself at a visa interview?

4. in a situation where a document is needed to be supplied to the interviewer and it is not available is there ever extra time given to provide that document or is it an automatic denial?

please help i am scared to death for my husband. i am just so incredibly nervous! i love him so much! even though he is living in germany he is originally from cameroon and i know sometimes just them seeing a word that has anyhting to do with africa will raise red flag!

Thank God! I have just found a photocopy of the original birth certificate that I can scan and send to him if need be. I have copies of everyhting else besides the most recent maritial proof I had gathered in the last minute before sealing the package and mailing it off. Still praying the package is recieved just in case he is asked for more proof of our marriage. Enclosed was a letter from my bank stating that I attempted to change my account over to a joint account with my husband but they cant approve our request till he is present to sign the bank forms himself in person. I feel that is strong evidence and to me it is the next best thing to a joint account or atleast as close as I can get.

If they were to need something, they would give a slip saying they need thing X, Y, &/or Z before further processing would take place and that it would need to be provided by a certain date. His visa will not be denied outright in this situation.



Duplicate copies of the I-130 form itself is not necessary for the interview. It is good to have copies of the I-864 and DS-230.



It's not an automatic denial, just an instruction to submit was is needed before the case can be processed further.


so in a situation of them requesting something he would have until that date to provide it. so once he obtained what was requested he would schedule an appointment to provide it and then he would then recieve his approval or denial of visa?

It would have been better if you would have planned to be there at the interview with him. You may be put in AP for a while.
I hope he will get approved and wish you the best ! At worst he will be refused and the case will go back to USCIS for more waiting to be reafirmed.
At this point why drive yourself crazy ~ be positive.


if he is refused the case goes back to the uscis for more waiting? what exactly does that mean? i thought if he is denied we can petition again which is starting all over is this basically the same thing as starting over? what is the difference if any? i did really want to be there but i started my job right after comming back to the u.s. and have not had anytime allowed from work to travel. it has been so hard not seeing him but we need this job for means to live on after he gets here until he can start work and help provide our needs too.

Should we pay the AOS first or do we have to fill up the form DS-3032 or we can do both at the same time. I appreciate it very much.

IN THE LONG RUN AND WHEN IT'S TIME TO GO TO TEH EMBASSY IT WILL CUT YOUR PAPERWORK OUT FOR YA JUST MAKE SURE YOU DON'T OPEN THE PACKAGE FROM THE MEDICAL EXAMS AND PAY THEIR FEES . More on our case too. Also i have contacted senators, congressman and they will make inquiries on my behalf but the last time I called the liason tells me in a strong tone "Well maybe you will just need to sacrifice and go there and live for 6 months so they will believe your marriage is real." I said ok i would love to do that but how am I to keep a job, and a residence, and be his sponser if I go there and live? What is she thinking when I am the only one that is the sponser.
I need more advice folks. I appreciate any thing. I need to move this case is there any way to speed this up??? We are living in hell apart. This is to much to put people through.

Dear VJ family. We are on our second time around with this whole process. First one ended in revoke saying marriage is fraud. We have now been married 2 yr and 5 months and our petition for the I-130 is in the USCIS. Please if you can give me any advice on how to make the process any faster and any info to not fall into the same mess again. Senators, congressman, and two lawyers that were from legal aid said OH you need a lawyer. I didnt find that did me any good the first time around cause she just took our money and sat on her butt. I did all the fighting for us after I had to fire her. We are dying from this seperation and not being able to start our lives here in US. To tell you everything I did the first time would end up being a book. But please if you can help us I would so greatly appreciate it.

This is our second time to do this whole process and it is making me insane!!!!! I have filed the I-130 received NOA1 July 5, 2011 hardcopy. I have called the USCIS to see if it has been touched and they said they dont know what I am talking about when I asked if the case has been touched. I have checked our status in the web site and it still says the same thing. I asked the senators office and they cant tell me any thing yet because they said I am not out of the processing time yet. I am ready to hurt some one seriously. Can any one tell me how you get this information?
Also I am in good old Indiana the state of Republicans that dont want to help you because they take lip service and tell you the same thing the USCIS tells you. Can any one give me info on how to find some one that will help me? What other offices can i go to or call. I need help PLEASE!!!!!!

Then on Sept. 20, 2011 I called the USCIS and they said that is correct and I checked the website and it said the same thing. I posted in Visa Journey and was told it was probably a mistake. So I contacted the Senator and they said it was mistake. I waited and still have not received any docutment. I have had the Senators office trying to help me and they made a phone call and said that the I-130 is in process and then I did a request to the Senators office and the USCIS sent an email back saying that they appologize that they are past the processing time and that they are trying to make this as fast as possible and sorry for any inconvience this has caused us.
So then I call the USCIS again today December 20, 2011 and they are still saying that this is correct and I had them put in a service request to find out where this docutment is. They said they will be sending a new one that it is probably lost or something of this nature. I then asked to speak to a supervisor, in which i was under the impression that they know more but she told me alot of the same thing but added that maybe the case has gone to the NVC in this time. I asked if that is true they would be able to pull up our case and she said yes. So then I called the Visa office in Washington and they directed me to the NVC with the correct phone number. I then called the NVC and they did not have our case she did input the case number twice.
So my big question is what is next we are here in limbo with no real answers dieing fromt he pain of being kept apart all the time and no one knows where our case acutally is. We have been married 2 yrs. and 9 months and this is our second time for the process and we are heart broken.

PLZ I need any ones help to know what to do so we can finally be together and actually start our family before we die from the pain of this paper work and red tape.

Does anyone know if I used a cosponsor and they live in my home what proof do I have to provide?

I think you will need their birth certificate or passport biography page and a ID to show their address is the same as yours..maybe someone will come along that has filled out a I-184 A and can tell u specifics..good luck:)you might be able to find the answer at the uscis site under forms (then directions) for I-184 A ..
