An affidavit from a 14 year old is not a strong piece of evidence. I would urge you to have an adult, rather than a child, provide you with an affidavit.

If you claimed your niece as a dependent on your most recent tax return then she is a part of your household count. If not, then she is not included in your household count.


It was not my only affidavit, the other was from my mother who has very strong relationship with my husband.I claimed her on 2009 transcript but not in 2010. She isn't in my house hold count, I already know that. The question is now that she isnt living with me and stated she was in her affidavit which was included in our I130 packet will this cause me any issues?

I pray to the Almighty that I am just paranoid and freaking out for no reason! PLEASE HELP! Here it is...... In our I-130 package 2 pieces of evidence we used were affidavits of a bonifide marriage. One of them was by my niece, who was currently living with me where my husband will be comming home to. She stated her proof of why she indeed feels our marriage was real and mentioned being anxious for him to be comming home to be with us. Problem!... she does not live with me anymore. I am worried on my Affidavit of support when I just count me and my hubby that they will ask why she is not being claimed? Should I send them some kind of notice or something? What to do? She is living with my parents now and they will most likely be my cosponsor. I can't just expect them to assume she is staying there when they include her in there house hold size. I dont want to lie! That is never a good idea! Besides, if I count her then I will be below income requirements? Any Suggestions will be much appreciated!


Another question....she was 14 at the time. Is there and age requirement for those? If yes and she was below min age, does that mean they discareded it all together as evidence?

You can put each in a separate envelope and then both into one USPS Express Envelope and mail it together. Start calling NVC after 5 days of the packets received at NVC to find out the status. After one of the packets is first reveiwed, you will get what is called a false RFE for the other, even though it is also sent in the same cover - so don't worry and inquire the status of the second packet with NVC till your case is completed.

My AOS packet is complete just waiting on my transcripts to seal the envelope.
Packet 3 is just waiting on the documents Hubby sent to complete it.
Can I put both in same envelope and express mail them?
Should I put AOS in 1 envelope and packet 3 in another and then possible to put both inside same express?
OK so what is next?
Is there anything I should be doing in the mean time?

Other normal fees left are to ship his copies of the documents to him for your interview (if you have not already), and perhaps fees to pick up visa (if you are approved), the only other fee left would be his airline ticket to you :dance:

I stand corrected...by following all the links at the German embassy website, they DO want the DS-2001, and it looks like there is a similar form specific to them that they will request later. Here are their instructions:

# Paying the visa processing fee.

* The NVC which will provide detailed information on method of payment.

# After the NVC has received confirmation of payment, they will then request that the required documentation be completed.

* To be completed by the visa applicant:
o DS-230 (pdf), Application for Immigrant Visa and Alien Registration (pdf)
o DS-2001 (pdf), Applicant's Declaration of Qualification for Immigrant Visa Interview

* To be completed by the American Citizen or Legal Permanent Resident petitioner:
o I-864, Affidavit of Support
A processing fee may be applicable for this form. If so, this form will not be sent until the processing fee payment is confirmed.

# After the forms are completed, it is now time to mail all required documentation to the National Visa Center. This includes:

* DS-230
* DS-2001
* All collected documentation listed under [Step 4: Gather Required Documentation].

If I recall you are putting together the I-864 and DS-230 packages--what specifically is causing you trouble?? Those instructions are among the easiest, but there are some nuances to be sure.

Though it was mandatory few year back say 2006, 2007 when the consulate use to schedule the interview date at that point of time you were not supposed to sent DS-230 or any document to NVC, consulate use to receive all these documents. I don't think this form is used anymore or is required... what you require to submit to the NVC is....Document cover sheet, 2 passport photos,DS-230 Part 1&2, Copy of passport biographic page, original birth cerificate and a copy, original translation of birth certificate, original marriage certificate and a copy, original passport police clearance.When you print off your cover sheet iv bill status is showing after that their will be a link to what exactly they want.As you are submitting all the documents to NVC then most likely you do not have to fill out DS-2001 since NVC will schedule your interview date.

Are you seeking a CR-1 visa? If so, the DS-230 would have already gone to the NVC and be in the file the Consulate receives. Those DS-156 and DS-157 forms are not used in a CR-1 case. I looked through that link you posted and the majority of information on that page only seemed germane to K1 visa cases.


Yes we are seeking a CR-1 and have already sent the DS-230 in as well. My only concern was the last thing listed "document check list". Thank you for your input on the Ds-156 and 157 forms. I agree with you. I think that a lot of where the confusion is comming from when instructions are not specific to a particular visa and are just for spouse/fiance visas in general.

Do you know anything or have any opinion or sugestions about the DS-2001, and wether it is needed in my case are not? i am afraid that sending it if not needed will cause delays but also afraid to not send it. it says in bold letters that an interview will not and can not be scheduled until they have recieved it?

- DS-156K (do not sign form; you are required to sign it before a consular officer on the day of your interview)
- DS-157 (for all male applicants between the ages of 16-45)

*My only problem is the document checklist? I didn't recieve my packet in the mail...would this have been in it? Mine was recieved by email. Is the checklist the barcoded cover sheet? SomethingIi have to type up maybe... like a table of contents for the documents I have included in the package?

Does anyone here know if the DS-2001 is necessary for the IV packet? I suppose it is the checklist in packet 3. However we never recieved our and have just been following online notifications from the NVC in which it has never been mentioned. I have sent an e-mail to the NVC for clarification on the DS-2001, I thought I would try this as well in the mean time, since I get faster results for VJ typically then the NVC.

I am preparing to mail my AOS/IV packet off to the NVC. Is there any special instruction as far as to when mailing them by post? Seems like I read somewhere I am supposed to print our case number on the outside of the envelope? However, I can't find where I got that info from? Can anyone help?

Well from 2008-2010 I dont meet the income requirement at all because of real estate property that I claim on my taxes, I claim a loss, but my gross pay before the allowable loss is double the poverty guide line for 2 people. but for 2011 I will meet it and exceed it I recently got a raise and my income will be just right. Also my new monthly salary going into next year will be above the poverty guidelines so should I be worried? I have been working for the same company for 7+yrs and 8yrs in April 2012. So there is stability in my work. I dont really have anybody that can help or at least I havent found anybody yet. my employer said that he will give me any letter I need and my job is secure! I still havent filed my I-130 yet so I have time to figure this stuff out. thats why I'm counting on 2011 taxes as I will be sending in my I-130 in mid December as I will be getting married on Nov. 25, 2011. thanks in advance for all the advice.


Unfortunately the only way for you to know if you need a sponsor is if the NVC tells you that you need one. I am in a similar situation right now. I decided to go ahead and get a co-sponsor since I had one available. However, since you will be filing your AOS in 2012 you will have 1 of the 3 previous years of income listed above poverty guidlines. This will help your case a lot. I highly recomend getting a letter of employment (make sure it is on company letterhead). This is an example of the one I used:

I would also include an explanation of why your income doesn't appear as it actually was due to the property you calim. Any documentation you have to clarify that might help you greatly and no co-sponsor might be needed. You have plenty of time ahead you though to get it all straightened out, in the mean time try to get an option or two for a co-sponsor just in case.

Certified copies in this context mean a certfied copy issued by the original authority that issued the original. Yes certified copy, as mentioned, or the original will do both at NVC and Interview. You can cross NVC without either of these. Ask your hubby to get a certified copy of the Birth Certificate from Cameron authority that issued his DOB.

we're on the same boat my dear.. good thing i have my family to spend a lot of time with while i am still here.. i just really hope that the time flies fast to the point that an interview slot has been scheduled. i am unemployed too at the moment, so it makes waiting a lot more hard to bear.. but being in constant communication with your hubby, reading books, researching online, doing activities outside the house makes waiting a bit more bearable. i often told myself that it took us 11 years before we got married, and i was that patient, no such harm waiting for a few more months till the journey is finished :D :o :no: :blink: :bonk: :innocent:

Ok.... so I never thought I would ever get to this point...... but now that I am here, I don't know what to do with myself. Just waiting on the last documents needed for our IV packet that Hubby sent to me and both the AOS and IV packet are complete and ready for the mail. Once I get them sent to the NVC my part is preety much over. Right? Next is packet 4....I was apointed to recieve all notifications and mail on the DS-2030. However will I continue to do so from the Consulate and recieve packet 4?
Police certificate, needed shots, and Dr. appointment have all been obtained prior to interview. Besides collecting the last bit of evidence we have of a bonafide marriage and sending it to Hubby before interview, WHAT CAN I DO!!!!! I AM GOING CRAZY WAITING....WAITING...AND WAITING... any advice on how to pass the time would also be greatly appreciated!

When you say your case is complete... do you mean you are just waiting on your visa? Does all notifications and mail go to the address of your attorney?

Yes you are correct it does state that. I followed the directions very closely. I didn't include my w2's since I used my tax transcripts. However, my dad is my co-sponsor and I used his actuat tax forms so I included the w-2's just as required.

Yes, it's suggested to write the beneficiary's full name, birth date, and case number on the back of both photos in pencil.

If I had to do it, I'd put both photos into a plastic bag and staple it to a blank paper and include it with the other documents in the IV package.

I can't be certain about this because i have not got to the interview yet . Embassy hasn't even made appointment yet. However, I feel strongly that if you didn't include copies of them in your packet, just bring copies to your interview. Surely if you have a copy to give to them at the time of interview and are requesting your originals I don't see why they would refuse to accept them? I hope this helps!
