STOP: Do not have your spouse pick up a Police Certificate until you have your NVC Case number.

WHY? Because they expire within 3 months. This is the biggest mistake we see fellow filers make over and over again.

Even if you haven't reached the NVC stage, looking ahead at the current month NVC Forums will truly teach you this process fast. Look for your own country of filers and pay special attention to their questions and answers given them since your process will be the same. Remember though, there is a little difference between K1 filers and CR-1/IR-1 filers toward the end of the process. So also pay attention to that information also.

On Page 1 of every monthly NVC Forum, you will find a simple guideline for NVC with frequently asked questions and answers. Copy and paste that info to a Word document (or equivalent) and print it off so you can use it as a, kind of, checklist.

That is what I did and it helped tremendously!

Now some simple pointers.

ON page one of the monthly NVC forum, you will also find an electronic format of the DS-3032 (This is the form where your spouse assigns an Agent...which will be you). Go ahead and plug in all of your information and save it on your system so it is ready to go when you have your NVC Case Number and Invoice Identification Number (IIN) assigned. Once you have the NVC Case number, you can plug it in, copy and paste it in an email to your spouse…they can clean it up and forward it only the NVC.

If you do not believe your spouse can handle this, start a new email address for them now and do this yourself. NVC will request an email address for both you and your spouse. Make sure your spouse has the user name and password so they can see the information you are getting from NVC and the information you are sending. Once the DS-3032 has been accepted, all of the future email will come to your email address.

Second, complete your Affidavit of Support. Run a Google check and see if you qualify to file an I-864EZ or if you will need the I-864. If you are not sure, ask the forum.

Third, if you have not done so, order your "TAX" transcripts from the IRS. Instructions to do this are on page one of the monthly forum as well . Make sure you do not order an "ACCOUNT" transcripts; this is not the correct form and the NVC will not take it. (I personally made this mistake but caught the discrepancy before time to send in my I-864, thanks to a friend guiding me through the process).

Forth, complete the DS-230 form. Double check the information on it. This documents information should CLOSELY or IDENTICALLY match the form 325A you completed on your spouse/fiancée during the initial phase of the process (I-129F or I-130). The same information is being asked but in a different format.


Fifth, print the completed DS-230. Scan it into a PDF format and attach it to an email to your spouse. Your spouse will then print the completed form on their end and SIGN THE DOCUMENT ON PAGE 2 WITH A BLUE INK PEN ONLY. DO NOT DATE THE FORM (you will date it before you forward the form in the IV package.)

NOTE: Complete the actual DS-3032 form as well and forward the same way as the DS-230 form above. Also, have your spouse sign in blue ink only and do not date. The NVC takes this form in electronic format but it's a fairly new process so cover yourself just in case it is asked for.

Sixth, your spouse will be forwarding all of these forms to you when you send off the I-864. They will need to include the following in the package to you immediately so you will be ready to file the IV petition:

• Long form or Certified Birth Certificate (if they do not have this they need to be getting it now, it does not expire. It Just must be from National Population Commission of Nigeria
• DS-230 Form , signed on page 2 only, DO NOT DATE. (Page 4 is signed in front of the CO during interview and swearing in process.)
• DS-3032, signed in blue ink, not dated.
• Police Certificate (your spouse should obtain a PC as soon as you send off your AOS package…not before.


Lastly, if your spouse has ever lived in another "Country" they will need Police Certificates from every Country they have lived in.

Thank you for all of the great info and advise. I have just finished creating a word document with the info from the links posted here so I can work on everything and check it off as it is completed. I will be looking at it closer tonight. I have filled in the DS-3032 and have it waiting. Email address was created previously and is already and in use. I already know I can use the I-864EZ, and I am in the process of completing that. I am currently working on filling out and forwarding the DS-3032 and the DS-230 to my spouse.

Do you think it is better to use the IRS transcripts than to just send a photo copy of tax forms filed?

I am not sure what you mean by "Long form or Certified Birth Certificate (if they do not have this they need to be getting it now, it does not expire. It Just must be from National Population Commission of Nigeria" He was born prior to 1979 when birth certificates were registered via computer (per NVC rep), so can he even get a certified birth certificate? And what is a long form? Do you have any information regarding NVC's recommendation to note his was born before 1979 as an explanation for the hand written version (whether it is accurate information)?

Also, I am still learning to maneuver this website. Can you tell me how to add my time line to my posts?

The vaccinations has to be done when doing the Medicals and yes the Embassy has Two specific locations to get that done.

You cant do the medicals now until you get an interview date

The medical costs N12000 an initial payment to be paid in Zenith Bank, then a balance of N9000 which will be paid at the clinic

As for the birth certificate, I dont really know, hopefully someone with such an experience will give you a better feedback

All glory be to our precious Lord....our NOA2 was mailed out on 8-27-12 from CSC. :dance: So I called NVC to check on my case number. The NVC representative told me that it takes 15 days for them to get that, and she told me that the police background check should be sent in with the visa application, the birth certificate, and other original documents such as the marriage license etc. Because it was my understanding that it expires in 90 days, I asked her what happens if the interview date is set for a date after the report expires. She stated that they send a notice with the packet to the embassy noting that the report was not expired when the application was submitted. Is this correct? :blush: I also asked her about what was acceptable as a birth certificate because my husband's birth certificate is hand written from the hospital he was born at. She stated to send a note with it explaining that he was born before 1979 which is when birth certificates began being recorded on computers in Nigeria. Does anyone have any information on this? :help: And finally, can anyone tell me about when the vaccinations need to be done and how much they cost? Does this need to be done with the medical exam or at a specific location the embassy requires, or can we go ahead and do that now? :) Thanks in advance for any guidance on these matters.

Once they receive your paperwork, they may process it very quickly. I had an RFE for more evidence of bonafide marriage. They received mine on Aug 26th and had processed it and sent me a message that it was approved on Aug 27th. I had been waiting 7 months to hear from them before the sent me the RFE. Mine went through California. I pray yours goes through quickly as well.

In the USA, if you are charged, but not convicted for any reason (case dropped, charges modified to something else, etc) you will not have a criminal history (except through the police depts - they can pull up what you have been arrested for - it is their job to know those things) and would answer no to any application that asks if you have any convictions. I cannot speak for Nigeria laws, but being charged with a crime is not the same thing as being convicted of a crime. So if the application asks about convictions you would say no because your case was dropped and you were never convicted in a court of law. I would not provide any information they do not ask for. The process is hard enough without adding confusion and additional processing - do not make it more complicated than it already is.:no: God bless your journey and may His favor go before you and prepare the way.

For Lagos this is not near enough information. All you have sent is who you guys are. The I-130 is allabout you. None of that stuff about beneficiary is needed. You will need the originals for Beneficiary at the NVC level. You need to be front-loading (I pray you haven't sent this up yet. You need to redo quickly). With Lagos its all about Face time and visits. Each piece of evidence you should have a coverpage to point oit exactly what they are seeing. If its a visit at the beach say during my 3 week trip from this date to this date we went to Victoria Island. That way they know. Don;t expect them to figure it out.

1. How you communcate, email, IM, Skype, text, Facebook - however you do show a log of that showing time and date stamp easy from any email subscriber.
2. Phone records so needed in and out of number time stamp duration
3. Ring receipts
4. Proof you visted (Visa stamps in passport) - you can't assume they will look at that unless you point it out.
5. If you have children letters from them to him
6. Divorce decree
7. Affidavit from kids father saying he is happy for you and your furure - (this is an issue that has come up recetly at Lagos about pass relationships and the father of the kids). What to let the CO know the father is out the picture.

I totally agree with Dwheels. I sent in a little more than you did, and I got an RFE. Fortunately, by the time I got the RFE,I had found VJ and was better prepared. I took the opportunity of the RFE to front load my petition with a lot more evidence like pics of trips we took together etc. Lagos is a tough embassy, you will need more evidence. Being able to send it in with the petition is best, because there is no guarantee they will ask for it or even let you show it during the interview. Best wishes to you on your journey.

As long as you guys do all the forms and paper work and he passed the interview he would be approved. It can take 8-9 months sometimes a little longer depending on if they get put into AP which is extra processing.

Hi all,

We received our interview letter Jan 30. The letter said the NVC had forwarded our case on to the embassy. However, I called the NVC today (Feb 6) to confirm if the embassy had received our case yet. To my surprise, they said they had not mailed it yet and still had it. Does anyone have any experience with this? Our interview is a ways off (Mar 27), so I'm thinking maybe they are just taking their time to mail it. But I think it's kind of strange that they said in the letter it had been forwarded, when it has not.
The reason I'm concerned is because I'm hoping to rescheduled our interview for earlier, but the embassy won't talk to me until they have the case. Is there any way to get the NVC to get this thing in the mail?

they will only talk to ya only until they have your case . and that is when you can reshedule it . also, it took my husband and i months to get our interview date so be prepared to wait for it. good luck !!!!!

Ok here was my first post: This is our second time to do this whole process and it is making me insane!!!!! I have filed the I-130 received NOA1 July 5, 2011 hardcopy. I have called the USCIS to see if it has been touched and they said they dont know what I am talking about when I asked if the case has been touched. I have checked our status in the web site and it still says the same thing. I asked the senators office and they cant tell me any thing yet because they said I am not out of the processing time yet. I am ready to hurt some one seriously. Can any one tell me how you get this information?
Also I am in good old Indiana the state of Republicans that dont want to help you because they take lip service and tell you the same thing the USCIS tells you. Can any one give me info on how to find some one that will help me? What other offices can i go to or call. I need help PLEASE!!!!!!


Now the update : Since the time of this first post I have contacted the senators office again and called the USCIS the first effort on the part of the senator was to make again an inquiry and told me that the case was waiting ajduication. Well I knew that much. I called the USCIS with the pretense of finding out why I never recieved a document they said they had sent back in september. When talking to the represenative she only had the same info so I asked to speak to a Immigration officer. They put in a request and a woman called me and said the docutment was only an address change confirmation and could not be resent but called to tell me what had happened and what the document was. But said we should be hearing some thing soon on our case( HA!!!!! Like that happened) So I called the senators office again and pushed to find some thing out. She made another inquiry and while waiting her to answer me I called the USCIS again and this time pushed straight for an immigration officer. This time I was told the case was in transit to an officer. Then the senator doesnt contact me so I contacted them again and said the case is with an officer now. I have been back and forthe like this with senator and USCIS and now the congressman since December 5 2011 (and to make a long story short cause believe me there is more) The last report was from the senator and said since this is our second case the old case had to be recalled to the officer so they could match the old one with the new one. We are next week at 7 months of waiting for an approval. PLEASE is there any thing else I can do to help our case get finished. We are so sick of being apart from one another this is killing us.

Hello every one we have our interview date and I have a few questions of all the folks who can help.
This is our second case and we finally have our interview date. The NVC sent the letter of what to bring and there is nothing on there about proofs such as chat, phone history and such as this. Did any of you bring things that was not requested to the interview?? Also our interview is set for 8 am is this a bad thing?? Most was saying it will be in the afternoon. Does this have any bearing on our case?
Also I am wanting to buy my husbands ticket now along with my own because I wanted to be there in the time of the interview, that is the reason for my questions if they issue the visa the same day so we can be sure to leave together. It will be a better price for the ticket also to buy it now.
Also I have not been back for just under a year now because my work would not let me leave when we wanted in which was in December and then we got approval in February so we waited to see about the interview date. Is that going to make a problem that i havent beent there for a year by the time of the interview??? But I have aleready been 4 times in three yrs.
Plz if you can help I would appreciate it. I have all these questions running in my head and anxiety because we want our life to finally start together not apart. This is killing us little by little literally!!!!!!!!

:luv: Hello everyone! Well after being married for 4 years and working for 3 years on this immigration process, finally my husband has got his and his 3 children's visas in hand and will be flying from Manchester, England to Detroit, Michigan to be with us forever this Friday, 11/11/11!

Now he's stressing over going thru immigration at Chicago O'Hare, which will be his first POE to the US. Can anyone who has gone thru it fill us in a bit on what happens, what they ask, if it was hard or easy, did it take a long time, etc?

Also we went the IR1 route as we thought he'd be able to work right away when he got here. But the letter he got back with his passports and sealed envelopes mentioned something about filling out a green card form at customs and waiting six months?? That's why we didn't go the K3 route, to avoid the six month wait so he could work straight away. Did we misunderstand? Are there additional fees for this form?

Thanks everyone! We are so excited, but still feeling anxiety over this all until I pick him up at the airport Friday night!!

My husband and I have sent out our I-130 packet, and recieved our first NOA about 2 months ago. From what I have seen by reading many timelines of other members we have 3 more months to wait. My first question would be is it possible to get it sooner? My second question being is their anything we can do now to speed up this waiting process in its intirety?...intervirew preperations, forms we can download and fill out to have ready etc.

First of all, transcripts are the preferred documentation--says exactly that right in the I-864 instructions...amazing how many people think they know better, but I have to tell you--when all else fails, follow the directions--REALLY !!! Transcripts are ALL you need--period.

Now as to current income, if it is marginally above the minimum, then they may require a joint sponsor even if you are over the limit, and if all three prior years are below the minimum level, it increases the odds, but there is honestly no way to know until you get input from either NVC or at the interview. If you are barely over, better start thinking about a joint sponsor just in case. As far as being at the job less than a year, a strong letter from your employer will be a big help.

Wait--this is too complex. If you send the transcripts, that is ALL YOU NEED. But if you for some reason I can't understand you send the actual tax returns, then you do need the W-2's....so make it really really simple...transcripts ONLY !!!

My current yearly income is above poverty level, but in 2008, 2009 and 2010 I was below. Due to my last 3 years income being below poverty level, will I need to have a co-sponsor to meet the income requirements even though in the current year of 2011 I meet the requirements? Also I have been at my job less than a year?

No. I suspect lots of people who intend to commit marriage fraud can get a family member to help them by filing as a joint sponsor. The joint sponsorship may speak of the relationship between the joint sponsor and the petitioner or beneficiary, but not between the petitioner or beneficiary.

For example: USC wants to marry my sister from Vietnam. I agree to be the joint sponsor for my sister because I want to help her immigrate to the US now. What does that show about the relationship between my sister and the USC? Nothing.

Another example: USC is my brother who wants to marry a girl from Vietnam. I agree to be the joint sponsor for my brother; to help him out. What does my joint sponsorship say about their marriage? Nothing.

P.S. Please don't shout. You do not need to use all CAPS. It is hard to read.


i was refering to an affidavit from someone who feels are marriage is indeed bonifide so strongly they are willing to take on such legal obligations as to be a co sponsor. maybe that explanation will make more sense?

really i would go with your dads income it seems much stronger unless ofcourse as jojo pointed out the household size makes you ineligible. plz see the poverty guidelines for 2011 and consider all factors. i wish you the best i know how stressful this all is we have all been through it. :)


I talked with my sister today and she and hubby agreed to be our co-sponsor.For the 6 of us, her income must be a minimum of 37,487/year or 3,124/month. Her monthly total is 3,138 or 37,656/year. She barely qualifies at just $15 a month more than the minimum! I am not sure if my Dad will do it? But, if he agrees should I use both of them? Will I make myslef look suspicious? I just dont want any delays! This entire process has just been.... well everyone here understands how it can get.

The I-864 signer includes herself, her husband, her minor children, her dependents on her taxes, legal permanent residents she petitioned for with a current I-864 obligation, and the intending immigrants.

There is nothing wrong using the disability income so long as it is over the minimum for the number of dependents. If you father is way over the limit even with periods of unemployment, that would work too, but it really doesn't matter where the income comes from so long as it is not means tested.

I think they should deny affidavits when all the people use is their ssi and unemployment to try to show they meet the minimum income requirements. Obviously, you aren't making any money and living off the government and more than likely so will the people they petition for, at least until the beneficiary gets an ead or green card, then they will work and take another job america doesn't have.


I agree with you that is why I am trying to be very cautious on how I handle things in my case. I meet the financial guidlines now but in the last 3 years that is not the case. Because of the past 3 years fluctuating and being well below the requirements. I feel it is in my best interest to have a sponsor just incase they request it. I was adopted and I am very limited on options for sponsors. the majority of my family is deceased and being that I am much younger than all in my family, most are retired or not earning income that could qulify them as a co-sponsor.

The rules in i-864 do state that disability(SSDI) not ssi can be used to meet the burden but the embassy can deny it if that is the sole source of income because i know of someone that happened to. i think it all depends on your embassy who ultimately has the discretion. i am not saying that to worry you just wanted you to consider that. i think the reason was given that if the beneficiary became a public charge they would not be able to garnish a govt check. we used ssdi to meet the guidelines but their was also a stable salary with it.

So eithier choice is an option but using my sisters dissability would higer my chances of not being accepted.Using my dad would be much stronger since he has been a carpenter for more than 20 years and only relies on unemployement when the weather or season of year dosent permit him to work or limits amount of work available. or what do you feel?

We received an RFE requesting the employment letter with hourly wage, position, dates of employment, possible promotion, etc and we sent in the payment stubs too. Send them in.


Thank you for the help I will definately get the pay stubs and letter from my employer. I don't want to take any chances! Christmas is right around the corner and it would be sooo nice to have him home!

True I might not need one. However, he has agreed and I have all his documents ready to go. Do I have to wait for them to tell me I need one? Can't I go ahead and submit his AOS with mine in the same packet? I figure if i wait for them to tell us we need one that will cause delays?

My husband used his IRS tax transcripts for the previous 3 years and we also submitted a letter from his employer with his yearly salary.
We did not need any pay stubs at all. You may not even need an employer's letter either but we included it just in case.

So I felt my AOS was a bit week so I opted for a co-sponsor. My dad has agreed to help us out. I was going to get a letter from my employer and a print off of my paystubs, but is that necessary since I feel I still will need a co-sponsor? As for Dad he just needs to include his transcripts right? No paystubs or anything is necessary since he is over the minimum currently and for the past 3 years right?

An affidavit from a 14 year old is not a strong piece of evidence. I would urge you to have an adult, rather than a child, provide you with an affidavit.

If you claimed your niece as a dependent on your most recent tax return then she is a part of your household count. If not, then she is not included in your household count.


It was not my only affidavit, the other was from my mother who has very strong relationship with my husband.I claimed her on 2009 transcript but not in 2010. She isn't in my house hold count, I already know that. The question is now that she isnt living with me and stated she was in her affidavit which was included in our I130 packet will this cause me any issues?
