Hello and I hope you can help me. We used K3 visa from suggestion of lawyer and look what we got. HA! I was told to give it up on the K3 and file cr1. Jawad had 2 interviews and i was questioned too. This was on December 1 and December 10 for the interviews. They said he married me for papers and used law 221g. Also his papers arent back to USCIS yet. I called the NVC and asked if i could use his I-130 if the papers are still in the consulate to get hiim another interview. She said she cant tell me that and I need to ask a lawyer. Also she said she could not call the consulate for me I will have to. The consulate had emailed me a month ago and said his papers went back on December 17, but they arent here. I am thinking that it will take longer to appeal the K3 visa than it will to file and get the cr1 visa. Is this true?????? Also can i use the I-130 i already have or do i start over. We are new to VJ and need all the help we can get. Especially after being lied to by the lawyer that was supposed to help us. She was just for the money.

My husband (USC) is filing an I-130 (and all the other related paperwork) for me, but as he hates paperwork I am doing a lot of the information gathering and form organising.

I was filling in a G-325A for myself, with no problems when I noticed at the bottom there is a box with a heavy border at the bottom for the "Applicant" to fill in. I am probably completely over thinking this but I have gotten myself in a quandary huh.gif . Is that just for who evers form it is to fill in? So on my form I fill it in on my Husbands form he fills it in. Or as he is applying for me does his information go on both forms or as I am the one applying to move does my information go there on both forms? (I hope that makes sense )

I know this is probably a silly question, even the book he bought to get more information about the immigration process says that this question is "self evident" but it doesn't seem so self evident to my poor paperwork overloaded brain. I have read through too many forms and guidebooks in the last week that I am now stressing over every little thing.

Any help or advice much appreciated.

A little background on our story. I am an Australian citizen married to a USC and am currently living in the USA legally, we are in the process of filing an I-485 and and I-130 (plus all the other forms that go with them). I am in the process of trying to organise my medical exam so I can send that in with all the other paperwork. I tried reading the guide, which I have found very useful for other forms, but they seem to mostly offer advice for people having their medical in their home country.

I am finding myself confused about so many parts of the whole thing, not only am I trying to get to grips with the immigration paperwork minefield, I am trying to sort out a medical system that is a lot different to the one I am used to. Not to mention the joys of health insurance.

I was hoping if I write down what I think I have to get done that I might get some idea of how on track I am and what I may or may not be missing.

The only civil surgeon in my area works at a free clinic. I went in to speak to them, to try and find out what I had to do and I felt very guilty about it as I am lucky enough to have what I am told is very good health insurance through my husband and there were so many people there waiting that obviously needed the clinics services more than me. I found the poor nurses and receptionist swamped and as nice as they were they didn't really have the time to help me. I understand that the civil surgeon has to do the physical examination so I will have to go there for that, but they gave me a huge long list of tests and vaccines I am supposed to have as well and this is where the confusion starts.

My family moved around a lot as child, and while I know I had all the usual childhood vaccinations and I clearly remember having chicken pox I have no idea how I would go about finding any proof of any of that. Do I need to prove that I had them? Should I just get all the shots again?

I have a local family doctor that my husband and I use, and while they are not civil surgeons I spoke to one of the nurses there and they can arrange for any of the shots I need as well as the TB, HIV & Syphillis tests. Is it OK to go to them for the tests and vaccinations instead of the civil surgeons and then just take the paperwork with me when I go for the physical? If I do that what paperwork will I need to get to prove the tests and vaccinations were given? What sort of wait would there be done to getting the results?

As far as I can work out for the medical for my age of 40 years I need the following

- A physical exam
-TB skin test (xray etc only needed if positive result)
- If clear for TB a TB vaccination?
- HIV Test
- Syphillis test (VDRL, RPR, STS/Treponema)
- Diptheria/Tentnus (Td & Tdap) Vaccination
- Measles, Mumps & rubella Vaccination
- Chicken Pox Vaccination

Have I missed anything?

I am sorry for all the questions but I am not a big fan of going to the doctors (who is?) and would like to keep the number of trips and shots and blood tests down to the bare minimum and still make sure the medical form is completed correctly.

I just got some interesting news today.
Our Approval notice has apparently been lost in the mail and it is going to cost me $340.00 to get a duplicate copy.
What's everyones thoughts on one government agency (the United States Postal Service) losing a document that another government agency (the USCIS) was to send you for free?
I don't mind spending the money it takes for my fiance to come here and be a part of our family but who's to say that the duplicate won't get lost in the mail too?
This has been a nerve racking time for us trying to get everything done correctly the first time and to have such an importent document lost in the mail is beyond me.
I hope the rest of the processes go alot better then getting the Approval notice since Shanet has her packet now and her medical exam and interview are scheduled and she has her airline tickets for the trip to Manila.
Myself and my children pray everyday that Shanet will be here soon and we can start our new lives together.

Don't know about the form #/id for those claims but I also was looking at NOA2 approvals of K1 visas for the Philippines and the amount of VSC approved versus the CSC approved since sometime in November is drastic. CSC has hardly any compared to VSC and I believe it to be the cause of the new petitions.

Yep, an article I read stated over 400,000 Deferred Action claims were filed with over 150,000 being approved as of late January. At the end of November they had processed just over 50,000 of them and by mid December over 102,000 claims. They are sure concentrating on these claims, just wish the article had stated the amount of claims submitted each month to see where they are on these claims. Are they processing Oct/Nov claims when they are still only on Jun/Jul/Aug claims for other processes.

Here is hoping that some cases get moved to other centers for assistance in speeding up the process, even though I highly doubt it.

You need joint account statements, joint credit card stmts, marriage/wedding photos, joint tax returns, etc.


How in the world do they expect you to have joint anything if you just got married and the SO is in another country? Oh well, I feel for you all that have to go through this.

Ok so this is basically me freaking out 3 days before my husbands interview... just wanting honest opinions on our chances of approval.I will keep this as short as possible and basic. You want or need more to form better opinion just ask :)

I am a USC. My husband is from cameroon and has been living in germany for over 3 years now as a student. We met online. Obviously fell in love :), since we met 5 months later. I traveled to Germany on a 2 week trip. On the 5 day of my travel we married in Denmark. We chose Denmark since it is easier overall marital process than in Germany and I would only be there for a few more days. Since then we have kept in extremely close contact. We send constant gifts and letters and cards to eachother as well as talk several times a day. we have the phone records and emails and mails to prove it. we have lots of reciepts of money gram where he sends me money. we are buying a home together here in the u.s. both of our names are on the lease. We included a copy of that lease in our initial marital proof, along with 2 sworn affidavits of our marriage. We have pictures of our marriage, before during and after. We also have pictures of us together during my stay in germany. I have a statement from my bank that I attempted to add him to my account but they cannot approve the request until he is present in the U.S. to sign the forms.

So...although that is a sweet story, I am worried about the fact I have only been there one time. The only time we have been together in person was my trip to Germany. He dosent live in africa right now but i know allot of times african countries will raise red flags for no reason at all. the fact that our time between meeting online to being engaged to meeting in person to being married to me going home was so short. And yeah the fact that my life is going to change for ever in one way or another in 3 days!!!!

please any opinions are welcome. i want to be honestly prepared for whatever the outcome is and dont want to feel blind to anything. we are truely in love and if me moving to germany is what we have to do to be together then that is what we will do. thank in advance, god bless and good luck to you all in your journey!

But - it'll either be a short one or a LONG one, a Cameroon National in Germany is a magnet for closer scrutiny. Is weird, though, that the 'other background checks' on him weren't started at NVC.. Something may be amiss there..

Yes is true.... I just feel even though our case is somehow not so strong with a short engagement and so on, she can tell we really love eachother and is the reason she asked him for passport. however, becasue he is african in germany and wanting come to u.s. she was afraid she might let a african slip through the cracks. I hate racism but in cases such as these it is only the fraud ones who make it hard for others so one is stuck with anger towards their own culture.

I agree with the previous poster, it is AP- Could last a week or a month or more, but the fact they asked about the passport is a good sign. There is a chance that they will investigate his background (ie visits to his work/ neighbourhood, contacting his parents). This is very unusual for Germany, but not uncommon for Cameroon, where your husband is from. I could imagine the US embassy in Frankfurt contacting the one in Cameroon for background checks.

I would wait 2 weeks, and then you (the USC) call and ask for a status update, but you can call on Monday if you want. If there is a second interview, he should definitely bring more proof along.


Thank you for all your help. Yes i was very happy to hear she had asked if he will be needing his passport! I have read many times here that it is always good when they keep it. However, when he was asked he told her he will need it to present it along with resident permit if he is aked proof of it. He had fear of waiting for decision on visa taking long and being without it not knowing how long he will wait or what he should expect to be recieving. Is it bad he chose to keep it? Or it's still good sign that she asked if he need it? You know although she told him she feels our marriage is fake and wants to investigate our case more i feel it is more about him being from cameroon even though he has been a student in germany for almost 4 years now. he said so many people, mostly germans and or whites comming in there with pants down to their ankles hair all a mess and such that were in and out with approval. then you have him an african, clean cut and shaven in a suit who just so happened to mary an american in a not so convient or typical way and we are red flagged before he ever got to the window. I could have been present at the interview and from the reasons she was giving him for our marriage looking fake i wouldnt have had any more proof for her eithier.

You can call the embassy or the Department of State any time you want to check the status of your case. Did they keep his passport? Them keeping the passport is a good sign.


Yes, thank you for the help I will surely call them to check the status! She asked him if he would need his passport and he told her yes since he is suppose to show it along with his resident permit any time he is asked he must have proof of it. He would have allow her keep it if he knew he was approved and was expecting visa, or if she hadnt been so rough and negative throughout the entire interview. Is it a bad thing he has done by not letting her keep it? I am very curious I had read many places where if visa is kept it is extremely good sign of approval.

My husband had his interview this morning, as most of you have said we raised so many red flags. She even drilled him on the fact he was denied a tourist visa! People are denied those every second of the day! She had no comments or questions on the albumn of photos he included. He answerd all her questions correctly and honestly. However she didn't like any of his answers! None at all!He brought so much evidence along with him (you can find a list of it on previous posts). So at the conclusion of the interview she basically told him she thinks our marriage is a fake and wants to further investigate it. She said he would be hearing from her and that she would contact him. Did not tell him how or when just that she would contact him. She asked him if he would be needing his passport. Then finally she gave him a green paper titled "pending worksheet 4" he said it is like a pre-typed slip with many possible reasons for further investigation but nothing in particular pertaining to us and she had checked nothing off on it as a reason for the investigation. My question now is what does this all mean? Has anyone had a similar case to this and what was the final interview decission? Since she asked him if he would be needing his passport isn't that a good thing? Should we call the embassy to check the status and if so when can we start calling? how long could it be before we hear something? If it is denied can we fight it somehow? If he is scheduled for a second interview and I have visited again could he bring that evidence along with him? Please help us! I cant get past the though of just setting here and playing the waiting game yet again being this far in the process!

no we are not denied were are in AP, you can find all the details in my previous post. she gave hm many reason she wasnt satisfied with our case to give us an immediate approval, also she believes are marriage is a fraud

Just because your AOS went through NVC without a problem doesn't mean that it will be ok at interview. The NVC basically just processes the paperwork and makes sure everything is there. It is ultimately up to the CO if income is sufficient.

Similar thing happened to another VJ member I know - all AOS paperwork went through the NVC with no problems, but the CO at interview told them that their income was insufficient and they needed a co-sponsor.

Hope you can get everything sorted out.


So after they are finished reviewing our case will they tell us the errors they found one at a time or will they somehow gives us a list of things to correct?

when time for our AOS came I made eneough current income but was lacking in past so to be safe we chose to have a co-sponsor. He is my father and works for the union so is laid off in off seasons when weather dosent permit his work and earns unemployement and such. Everything went through and AOS was processed. Dosen't that mean that our AOS was good and approved? If not would we have been notified if otherwise long before the visa interview? I ask this because one of the many issues the officer had at our visa interview was the fact that our co-sponsor cant rely on unemployement so much through the year? Is this just something else to tear us down? maybe she is having a bad day?

as the message says clearly that the copy of the marriage certificate was not legible in its orginal language, do you suggest i have my wife not only go to a place to make legible copy of the marriage certificate and also certified the copy?


After reading all of the above comments and suggestions, this is my suggestion:

Call them on the phone. Never be afraid to ask them directly! Many memebers here have great knowledge but merely all suggestions are only our opinions. When you call them, simply explain what has happened and ask them to clarify what exactly is the problem. Wether they need the original certificate or wether the copy sent was not legible... or whatever the reason may be they will tell you. Once you know the reason it was rejected fix the issue and return the proper documents as soon as you can to avoid more delays.

I am having some difficulties finding a co-sponsor. However, I have found one who meets the poverty guidelines, but am unsure her income is acceptable? Is dissabilty accepted as income for an AOS? I have looked and looked and I have seen yes and I have seen no...so which is it? I have looked through the government site also and it is not specific eneough to answer my question?

I feel if you want to do this the legal and honest way and get this off your mind since it seems to be giving you much stress, contact them by phone. It is a sure way to talk to a person and not waiting ans waiting for a response to an email. Explain to them the situation and you are ready to proceed but want to resolve this issue first. if they are not who you need to notify then they will give you the proper contact.

Hi to all my VJ family. I am here to post and ask if it is okay to attach declaration on I-130 to discuss some matters and the USCIS will be informed beforehand. Below is the declaration we plan to attach. i would like to hear your opinions on these, please help me...

D E C L A R A T I O N
I, Xxxxxxxxx, the petitioner of these two I-130 petitions for my wife and for my son, do hereby understand that my petition will be put under administrative review due to some unintentional honest error made by my father when he filed my N-600 application last April, 2010. I was working in Alaska during that time when my father filed my Certificate of Naturalization application without my prior knowledge so he committed a mistake of declaring me as single when in truth and in fact; I was already married since February 11 of 2009. My father knew nothing about my existing marriage because I hid the truth from him about it because he believed that I was still young to enter such big responsibility, more so, my application for my naturalization was not yet filed and he was worried I might encounter problems later thus he didn’t want me to marry my girlfriend back then, since anytime after I’ll be naturalized, I can file a K1 and K3 visa for both of them very fast and easy. But I made the decision to marry her anyway without my father knowing it last February of 2009. I came home to the Philippines to marry my girlfriend (who is now my wife). From then on up to the time of the filing of the N-600, my marriage with my wife was concealed to my father and he was not aware of it, only now that I need to petition my wife and my son that I need to reveal everything. Being declared as single in my N-600 and now filing I-130 petition for my wife and my son might occur as a red flag to the USCIS, thus I am doing this declaration to discuss my case and be honest as much as possible regarding the discrepancy with regards to my marital status. And I am aware that my petition may be put in certain difficult situation because of this. In connection to this, I am taking the full responsibility for all my actions and I am solely accountable for whatever action I made in the past and I believe that my father and I did not do any material misrepresentation of my case but a lapse in judgment. Hence, I hope that my petition will be judged fairly and with kind understanding.

I declare further under perjury that the above mentioned statements are true and correct.


I feel this declaration was wrote very well and with good intentions. However, I have a few questions to be able to answer your post properly. Have you been confronted witht his error and have been asked to explain it in a declaration, or are you putting the error out in the open to try and resolve it now to procedd with this process correctly?
