i have a question since my husband came here in 2005 on a k1 we got married and due to an unexpected death in his family he returned home in September 2006 we didnt know bout the advance parole at that time so we have to start over with the 1-130 process. But my question is since when he was here he worked and filed taxes would i be able to count his income on the affidavit of support?

She also checked to see what apps there working on at CSC she said April but i've seen a few people who have gotten approved from may june and july.. Our time will come i just hope its soooooooooooon...

Also that our 6 mth period would be Dec 12th, and she also told me by this date to callback as well (( LIKE I DIDN'T ALREADY KNOW THAT ))

also, I am fighting a bad cold and have lost my voice, so it was a difficult call to deal with sad.gif

Has anyone else here had this happen to where the case status stated that " IT CAN'T BE FOUND" when calling USCIS??

I just asked that question yesterday lol I called got the same message cant be found then i called back talk to some woman she was quick about it i wasnt put on hold or anything she didnt know why it did say my status then she put my reciept number in and there it was still the same its pending but its there. Hope you get good news soon...

I am writing on behalf of a friend of mine who is going through this process... Her fiance came here in 2006 on the K-1 visa they're marriage was a rocky one but did everything right filed all the right papers and filed to adjust status for her husband the AOS was still pending but she decided it wasnt going to work and filed for divorce and wrote a letter stating that she wanted to withdraw her sponsorship of her husband because of divorce she sent the letter to MSC where his petition was and filed for divorce but before the divorce was final she changed her mind and worked things out with her husband so they remained married to this day but an unexpected emergency with his family he left the US with no AP so found out later he cant come back in the US without an AP.. She was advised since he didnt apply for that they would have to start again and do the I130 which they have done so and it is under process too now for another twist to her situation she recieved a letter from MSC on his adjustment of status that they had received her letter about withdrawing her sponorship of her husband due to dissolution of marriage which they never went through with... What should she do? Should she write a letter explaning that the marriage was never dissolved and wants to continue her sponsorship of her husband and explain that they have now filed for the I130? Will that hurt her husbands chances of being denied everything? Any advice would be helpful to her.. thanks

I'm at VSC, and I've noticed a few other VSC folks who got NOA1's after me who've been 'touched' already. I've yet to be 'touched', as far as I know.

It just means your file was moved, looked at, refrenced for some reason. Sometimes if you call it will be "touched". If you are on the USCIS website it will be shown as an update. Most of the time it doesn't mean a whole lot, but sometimes when your time is coming up for approval it will be "touched" because it is being reviewed.

Although, I am not in the same boat you are I have wondered the same thing. I just would like to know how they are doing this. Is there a method to their madness? I just saw someone for a K1 visa get approved and their NOA1 date was 3/8/08 at Vermont. We sent our to CSC at the beginning of February 2008. I'm trying to stay positive and not get discouraged, but it's hard sometimes. I think I would feel better if I knew how and why they did the things they did. But I guess we will never know. wacko.gif

The way you know it's been touched is when the date changes. My date didn't change for 142 days until I got my NOA2. I see you're going for the CR1 so it may be different, so someone correct me if I'm wrong, but it probably is the same way. Good luck to you!!!

While reading on the DS230, I ran across a caption that got me thinking; I read The DS230 is practically an application for the immigration visa, where the applicant, a non-U.S.C., is a petitioner or I guess you could call it a incrimination sheet because here is where you have to tell on your self if you have been in the U.S.A. illegally so after reading that, i thought Isn't this a place where you could attach a page for answering question #25 dates and residence of previous visits to the States, EX.

I was in the united states last in 04/2003. I was ordered removed because I had no papers. This was only because of my attempted entry in 1996. In 1996 I arrived at the border with proper passport and visa, but based solely on my looks, a officer tore my passport up and through me in jail! Once out, I was faced with the fact, that in California where my husband and my four month old daughter. My husband had no money for day care, or time, or even experience to tend to our baby. I had no money for layers, with fear, anger and indescribable worry about my daughter; as any mother would, I did not think to seek help at the Mexican embassy! I thought only of my daughter, and I went for her! It was the most traumatic experience of my life! I latter retuned to Mexico on my own. In 2003 I was single with two kids, and I made a mistake. Fueled from desperation, and a dream to better my life, I chose to return to the United States, and I regret it! It cost me dearly, I received sever penalties, but I was penalized for something that was not a mistake, something that was not my fault . Mexico would not give me a new passport as they did not believe what had happened, and you could imagine what I thought of American immigration! So in 2003 a combination of being young and ignorant, I tried to return with out papers and I was caught. In 1996 the United States made a mistake, but all they can say now, is their sorry! I have no recourse for that, as immigration law is above the law, it cannot be taken to court! Now I not only pay for my mistakes in 2003, I pay for a mistake the United States made in 1996!

It is the wee hours of the morning and I am still in shock that my VISA process has moved ever so rapidly since the Radio show,engaging my Senator and just pure support from this forum. I have not posted lately, because work has had me drained and my Mom's condition is getting worse and all of that really has worn me out. However, at AM this morning my phone rang with great news from the Bangkok embassy, your fiancée interview has been set for March 18th. I said What?, who is this and what again. It was nothing less than the US Ambassador's aid calling me. Again, I asked, who is this and he explained, again and I was left shocked. Keeping all this in mind, lets reflect a moment, it was not till the scheduled event of the Radio show and after the show my VISA process flew like the wind. Take a look at our time line and it speaks loud and clear. In came the NOA 2, Out it went from the USCIS, through the NVC and to Bangkok requesting the interview in record time. The interview, which normally takes a time of 2 months to get, is now set for March 18th. This is really quick considering also that there were no interviews for this month of February in Bangkok. On March 18th, my fiancée and I will be together in Bangkok for her interview. This is truly unbelievable and I am thankful. Shortly, after we will be on a plane and heading to the US to get married. My mother is high on the agenda and I have not told her yet, as it is too early to cal her and thinking about surprise. I must say I do not believe without the events that lined up, this would not of happened. I am grateful and think about everyone who has to endure the process. I must say Thank you to Susie, my Congressman and the radio show, without these efforts, I would be still waiting.

Hello everyone,

I have some exciting news to put forward as I told Suzie last night. I believe it is a result of timing and the efforts of this forum, my Congressman's office and sheer determination to not accept they lost it, can not find it, do not know where it is or "hope your mother lives long enough" responses from the California Service Center I received. It appears many of us get these types of responses and it is time to stand up and say enough is enough. Well for the first part of my story see the beginning of this thread but here is the latest.

Yesterday, I contacted my congressman's office to status their request to expedite my Fiancée VISA. At that point in the morning they had not received a response and it was now approach 7 or 8 days after they had sent the request and was approach a month and half since I sent my request forward. Keep in mind I mailed it, then faxed it, called about and then was told they did not have it, faxed it again 3 more additional times. Every single response I received when I called in the check if they had received it resulted in them telling me, no we do not have it, we did not get it and there is no need for me to cal. Say what? It had then a month sent I sent it in the mail, certified registered mail and overnight, it had been weeks sent I faxed it and at the request of the USCIS faxed it an additional 3 times on different occasions. Mind blowing.

Well as we all know timing seems to be all so crucial these days. So, knowing this show would air tonight, I sent my congressman an email explaining to them I would be joining and would like their help to explain how this could happen, why could not a life request get some answer and that I had, had enough. Keep in mind my Congressman's office is trying to do what they can do to help. I believe they actually understand and bent over back wards to help me. I will shed light on that in a min. Back to the sequence of events yesterday, following a call I made to the back to reality program station in Florida to make sure I knew what they program was about and to speak with someone about what was currently happening with my situation, I was requested by my Congressman's office to forward the letter and doctor's note I sent to the USCIS so they could make further inquiries of the USCIS. Two hours later, I got a call from the USCIS in California and here comes the good news and some surprising answers.

During the call from the USCIS in California the official says to me Sir your fiancée VISA has been approved and we are overnighting it to the NVC. I am of course thrilled. He continues to say, he wants to say he is sorry for all the delays in my case and the problems that have happened. I let him continue to talk. He explains that until today when my Congressman's office sent my letter and the doctor's note the California Service Center they had not received anything. I said your kidding, I not only mailed it but faxed it to them 3 different times. He went on and told me that things were messy over there and there have been a flood of applications. I stopped him in hos tracks and said you knew it was coming, the USCIS can shift surplus efforts to other offices, no excuses will justify what people are going through as a result of bad judgment and actions which represent negligence and conduct unbecoming of their administration. He then agreed and I asked him to please explain to me, if he could, why are they taking so long to receive mail, to process applications and to inform citizens within reason the status for the petition. The 911 thing came up and I told him, 911 is understood but not acceptable for an answer for everything nor is it acceptable for poor processing, poor conduct, negligence in creating an action plan to manage the bulk of applications. If I told my boss, well I just do not know what to do, I would be fired. They need a sense of urgency I told him and one that goes to what citizens expect for their lives. We expect decency, common sense and the right to pursue happiness with our loved ones as anyone would in the world. I then asked him is their anything going on to change this problem. Answer, I do not know. There you go, no urgency, no hard standards to meet, no need to commit. Seems logical , I guess. NOT. I then went on to ask if they would be able to pass on the expedite notice to the file. Guess what, no system or process to do that. He informed me my Congressman's office was instrumental in getting my application processed and they likely could help. However, he thought my idea was a good one. Seems someone need to re-engineer some processing and put some technology and redistribute the workload rather than just waiting for the bubble to burst. What the heck.

In the end, my application is now on it's way to the NVC, but I still need to get it to Bangkok quickly and I pray about that. My mothers cancer is in her brain now. I called her to let her know the news and her response to me was how much longer will it take I am worried I will not be here. I told her I am working it and I am sorry Mom it seems our Government sometimes just does not work the way we would expect it to. So, I will ask my Congressman's office for help again and pray again. I do believe without my Congressman's offices help, the upcoming show, the people on the forum like Suzie, I would not of gotten this far. Thank God for those people. I pray for all of us.

This will definitely go out to the heart of Floridian's and to many. Let me see if I can do it justice in conveying the story to you. It is a real current situation.

The USCIS is reviewing my expedite request. It has taken them a little over month to get the details. Normally I would of not requested it, but my mother is dying from cancer and wants to see my fiancee and I married before she dies. Hope that happens, however, I am assuming we are minimal 2 months to 3 months out even if it goes quickly and mom is starting to show signs that things are getting worse. She was diagnosed with stage 4 cancer, unable to opperate and it now has speard to her spine, brain, lung, liver and who knows where else. Looks like it is moving rapidly. Unfortunately she is also the caretaker for my 76 year old father and my 91 year old aunt and without her there, I will have to take care of them to keep them in their home they worked for their whole life for. I am making plans to temporalily reside there in Florida, not change my current address as I have a job where I can work form different places in the US, but to provide them security in their home. I sent off the heart felt request to the USCIS begging they help honor my Mothers wishes to us married before she passes and to allow my Fiancee and I to provide care for them as my Fiancee wants to help. My mother was a school bus driver and my father, a painter, both retired for a good number of years and have paid their dues in life. Anyway the USCIS requested additional information back on December 20th, 15 days after I sent the request, which I found to be some what unresponsive, but I provided a two page letter from me and the Doctors diagnosis, limited in detail because of Hippa laws. To date, I have heard nothing. I have made calls to the USCIS an been told literally "so what". Gee you think they would have a heart. Also, I called and was told they can not find my expedite request, so I faxed it to them again, pleading my case. Again, a week or so later I called the USCIS, now 5 months into my Fiancee Visa request asking for some update. At this point, I am told "nobdy has access to your case file and can tell you anything. Sit back and wait and we hope your Mom can live several months more, because it may take us some time to find your request. Say what? Find my request, your kidding. Nope, we do not see anything from you yet. At this point, I am speechless, begining to loose faith in anything happening and wondering what to tell my family. I can not imagine our Government being so unresponsive. I still pray I will make it in time and pray for a response, whatever it will be. I am not looking to bypass anyone but to just honor a life request. The last call I made this week, a kind woman from the USCIS practically was crying with me on the phone and said to me she was so sorry that the USCIS had not responded to me about my request. She read my plea and said she had recently lost her mother and would give anything to to do something her wanted to do for her. Well enough said, I thanked her and assured her this was not her fault but she felt compelled to me it is, because the USCIS should take ownership to answer the request. She had seen other requests for military personnel or ranking Gov officials that did not have anything like I was facing get approved quickly. Again, she appologized and said she was sorry. For now, I am left praying for help.

In the last week I have appealed to my congressman and so has my mother. There must be a better way.

Part one:
My wife and duaghter have been given 10 year multiple entry visas. I have been told that once in the US they can apply immdiatley for I-130 and I-485 (AOS) since we have been married for over two years.
There was a statement on a website that said "Entry to US with inspection". Does anyone know what the word inspection means?
The counsel at the embassy made this suggestion to us, though indirectly.

Part two:
Am I requried to file I-130 and I-485 on both? or does my daughter receive derivitative status? This one is confusing to me.

There is very little chance of getting to the US on a visitor's visa while a K-1 or K-3 is in progress. The question will come up at the interview, and the counsel will deny the visa if you say yes. If you say no and then are discovered at the point of entry, they will be turned away and the K-1 or K-3 will be in jeopardy. It is a BIG risk.

Without proof of income one, will need to find a co-sponsor. You have to submit that you are gainfully employed or have substantial assets.

The I-94 is a document stapled inside the Passport attached to the entry visa. It is needed to process the Adjustment of Status later on.

The Visa Waiver Program is under intense scrutiny right now. It is the most misused visa and documents are being checked. If it is found that the visitor is married to a US citizen or that there is a K-1 or K-3 visa application pending, it is unlikely that they will be admitted.

People are turned away at the point of entry every day. You are required to purchase a ticket at the prevailing cost and go home.

Here are some specifics from the USCIS website for the VWP. They also apply for a visitor's visa:

Nationals of VWP countries must meet the conditions noted in the section above (Which travelers may use the Visa Waiver Program to enter the United States?) in order to seek admission to the United States under the Visa Waiver Program. Travelers who do not meet these conditions must apply for a visa. In particular, a visa must be requested if the traveler:

Wants to remain in the United States for longer than 90 days, or envisions that they may wish to change their status (from tourism to student, etc.) once in the United States;

Wants to work or study in the United States, wants to come to the United States for other purposes not allowed on a visitor visa, or intends to immigrate to the United States;

Does not have a machine-readable passport (MRP) issued or renewed/extended before 10/26/05, or is unable to meet other requirements outlined above for passports issued on or after October 26, 2005 or October 26, 2006.
Intends to travel by private aircraft or other non-signatory air or sea carriers to the United States;

Has been refused a visa or admission to the United States before, or did not comply with the conditions of previous VWP admissions (90 days or less stay for tourism or business, etc.); or

Has a criminal record or other condition making them ineligible for a visa (see Classes of Aliens Ineligible for Visas ).

Hello all,
I went to the embassy in Manila to ask some questions and now I am really confused.

1. He said my wife's 10 year visitor visa is not endagered if we submit the I-130 directly to the embassy using Direct Councelar Filing. This seems so contrary to everything I have read. I don't want my wife to get to Detroit and then miss my daughter's wedding because she is truned away at the POE.

2. He said I don't need a US based domicle until the visa is approved. The visa can not be given until the domicile is established. That seems contrary to the usual feedback that a domicile is needed in order to file in the first place. I have to prove residence in the Phils in order to file DCF, so how can I prove domicile in the US?

3. He also said that whether my step-daughter is adopted or not makes no difference to the I-130.

We are planning a trip to the US in May for 10 days. IF I can start the process before we leave, YEAH! otherwise what do I do?

Can anyone clarify this for me?

The I-129F is used for the K-3, not the I-130 (which is used for the Cr-1). So where is your I-130? Have you submitted the DS-230 and the I-864 for NVC yet?


the I-129 and the I-130 are used for the K-3 visa because that is what the lawyer made us do. And I have both of these. Also the I-130 says it expires December 26,2009 but by it still being used in the K-3 visa and we are awaiting the papers to return to the USCIS they said that it stays active. I need to know if I can use this I-130 for the cr1 or it is void once its removed from the connection to the K-3 visa. No we have not submitted any other papers because we are trying to find out what our best option is now at this point.

I aplogize i had said K-1 visa in my first response to you it is yes a K-3 visa.

At what stage is your I-130 at? Have you done anything with the I-130 or is it still sitting at NVC?

If you want to pursue the I-130 then I suggest you call NVC and find out what you need to do to move forward with the I-130. However, the reasons for the denial at the K-3 will need to be overcome. What did the denial letter exactly say? If they think your marriage is for immigration, then I suggest you begin collecting additional evidence of your relationship.

we didnt even get the letter yet. The papers arent even back to USCIS and its been a month. The I-130 was approved and used in the K-1 visa. If his papers are still in the consulate can this I-130 be used to initiate another interview? And one the proof we had every kind of proof you could ask for. The officer said we just brought all this proof so we could make him give us a visa. He didnt even look at our proofs. He only looked at the papers that were sent from the lawyer for the interview. My husband had 6 different books of chat emails phone calls,and then another book of proof of letters cards, packets i sent, reciepts, we had 2 albums of pics of wedding and places we traveled and family. I dont know what else this man could ask for.

Hello and I hope you can help me. We used K3 visa from suggestion of lawyer and look what we got. HA! I was told to give it up on the K3 and file cr1. Jawad had 2 interviews and i was questioned too. This was on December 1 and December 10 for the interviews. They said he married me for papers and used law 221g. Also his papers arent back to USCIS yet. I called the NVC and asked if i could use his I-130 if the papers are still in the consulate to get hiim another interview. She said she cant tell me that and I need to ask a lawyer. Also she said she could not call the consulate for me I will have to. The consulate had emailed me a month ago and said his papers went back on December 17, but they arent here. I am thinking that it will take longer to appeal the K3 visa than it will to file and get the cr1 visa. Is this true?????? Also can i use the I-130 i already have or do i start over. We are new to VJ and need all the help we can get. Especially after being lied to by the lawyer that was supposed to help us. She was just for the money.
Please any info will be appreciated so much.
