IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 Approved!!

I posted not too long ago about my I-130, i went a little crazy there. Worrying whether i did everything correctly, and about RFE's..ugh thankfully that part is over!! I also was approved pretty quickly, a few days shy of 3 months. Might give some hope to anyone still waiting, they must be working quickly since they recieved my app. on sept 12. Anyhow NVC?! I do have the basics down, i dont know if the required documents vary by country, but i do have:

-Police Certificate in Bosnian (I believe no translation is needed)
-Birth Certificate
-Wedding Certificate
-2x Passport Photos
-Signed (part 1) and completed DS-230
-Copy of passports Biographic page

Bosnia requires military participation i have the certificate that he served for 6 months, do i need to include this?

And i also have everything ready for my affadavit, with 3 years of tax returns, employment letter etc.

When can i start calling them? My case was approved on 12/7 so about a week?
When my husband emails them his choice of agent form, then i can send all of his documents?
Im not expecting to fly through NVC in 20 days, but i wouldnt mind.
Does anyone have any information as to how the us embassy in sarajevo schedules interviews? wether it takes a long time, or fairly quick.

Any advice and tips would be great, i have LingChe's guide printed out and have read through it several times, its just im worrying that i missed something. I Just feel so close to the end, i dont want to mess up now!

Thank you all!!

Congrats since i put in mine in November u have given me hope:) im happy for u and boy what a christmas present:)..

IR-1 / CR-1 Spouse Visa Process & ProceduresJoint checking account problem.
QUOTE (BrianJenny @ Dec 7 2008, 01:07 AM) <{POST_SNAPBACK}>
OK my question is: One of the things they list as proof a bonified marrage exhists is the sharing of financial resources, such as having a joint checking or saving account. I have found this to be impossible, and am still searching for a solution. Here is my specific circumstances. My wife is Philippino and I am American. She lived and worked in South Korea. She has a bank account in South Korea. When I was living together for 6 months in South Korea we tried endlessly to set up a joint checking or savings account, but in South Korea that is impossible, since they do not have checking accounts, and the savings accounts only can have one name on it. I even tried at my bank Citi Bank in South Korea, and was told we can't because the Citi banks in South Korea are not tied with banks in the US, and I can't even open up a new account there because of tax reasons in a foreign country. So I was told that I would have to apply for a joint account with Citi Bank when I got back to the United States, which I did. I got the proper paperwork, and was told by two supervisors this is all I needed to do. I sent the forms to my wife to sign, and she sent them back. This cost me 100 dollars for the fast shipping because I was told I had 15 days to do it. I got the papers together with copies of birth, passports, etc. They sent off to Texas to process. I waited after 4 weeks got nothing. Called a dozen times kept being told it takes time, till the one day I was told it was denied, and additional paperwork needed to be done. I was told we needed a pay stub from her employer, or a bank referance letter from her bank in South Korea. By now my wife was back in the philippines having our first child. First, she never got checks from her employer, secondly after asking her bank in south Korea they will not issue a bank referance letter unless she is there in person, with identification. So after two months of trying and 100 plus dollars still no joint checking account. Has anybody been able to get this done, and please list your bank, so I can drop citi bank after the run around they have given me, and waisted money, oh yes they also said I would have to do the whole process over again, with the signature cards etc, so more money and waiting for a month once again, but they made it impossible to accomplish this. Any ideas or help would greatly be appreciated. Plus im tired of western union. Thank You. wacko.gif

I don't know how much my story will help, but here it is. When my fiance arrived on his K-1 visa, we went to my credit union to have his name added to my account. They added his name, but I couldn't get an ATM card until we had his social security number. Once we received the social security number, we returned to the credit union and they added his information and printed a card on the spot. No problems at all.

I too would have reported this to DHL. Would be nice if she had gotten the employee's name.

I have an account through FedEx so I don't think it would be possible (though anything can happen) for an employee to request more than the published rates. All it takes is a credit or debit card to set up the account and all shipments will be billed directly as long as your account number is listed on the waybill.

IR-1 / CR-1 Spouse Visa Process & ProceduresNVC phone question
QUOTE (YOUTOO @ Jun 5 2008, 11:40 AM) <{POST_SNAPBACK}>
So, I finally tried calling NVC tonight from Tokyo ( btw it's about 11:30 a.m. on the eastcoast ).
The operator seems to be busy so it throws me back into the automatic loop. But my Case#
prefix TYO is not on the list they run off, and it says if I do not have any letter combination
as they announce, which I don't have, then they shoot me back to a live operator. But since
they are busy, I end up at the automatic response again. Help please mad.gif
OK, the numbers I dial is 603-334-0700, then 1, then 5.

I had the same problem. I've been calling for the past 2 days and kept being thrown back into the automated loop as well. I would call at various times throughout the day and even at 20 minutes to midnight last night and still was unable to get through. Since the NVC opens at 7:30am, I called them exactly at 7:30 this morning and was able to get a person.

If it's not too much of an inconvenience with the time difference, I would try to call at 7:30 in the morning.

The phone number you are using is correct.

Good luck

Hey guys-

I have tried to call the 24 hour NVC phone line several times today and I always get a busy signal. What's up with that? Has anyone else experienced this??

The number was from loto's NVC guide, and also on the website. It is 603-334-0700. It's supposed to be a 24 hour hotline so not sure why it's always busy. Anyone else having this problem?

I had the same problem and when I finally got through, I kept being sent into the automated loop and then disconnected because no agent was available. I decided to call exactly at 7:30 AM and was successful.

Good luck.

IR-1 / CR-1 Spouse Visa Process & ProceduresTo use or not to use a Lawyer?
QUOTE (frali @ Jul 7 2008, 12:15 PM) <{POST_SNAPBACK}>
Sorry guys ... if there is already a thread with this topic then guide me to it.

If not, Should we use a Lawyer or not? I have heard mix reviews. Majority of people gone through the process believe having a lawyer just makes things more complicated.

Views?

If you have no problems and your case is straight forward, then I'd suggest that the 2 of you file the paperwork yourself. You hire an attorney for legal expertise, if you do not need any legal help, then I would not pay an attorney to put your packet together. Keep in mind that you're are still gathering all of the documents and you will then send it to the attorney. They will then turn around and send it to the USCIS. The attorney will organize it and add a cover letter. With the help of other fellow VJ'ers, you can receive great advice and directions for doing this yourself.

This process is 10% paperwork and 90% waiting. My experience with an attorney has only added stress and increased my waiting time. Remember that you'll have a third party in the mix and everything goes through him. You will be constantly sending emails to your attorney asking for any updates. If you file the paperwork yourself, you will know immediately if there is any news of your case.

Today I will be sending my 3rd request to my attorney to send me the documents needed for our interview. I should not have to ask 3 times for these documents. Looks like I'll be printing the documents off of this site and sending them to my fiance myself. This is just one of the many examples I have from my attorney. Your experience might be different, but keep in mind that you only need to FILE paperwork.

Wait for other responses and be sure to choose wisely.

I paid the IV bill online and now its asking me to send in the docs with the cover sheet, in the past it was that after the iv bill was paid the case was forwarded to the embassy and they collected the docs. I don't have police report for my wife nor the photographs. what do i do next? is it supposed to be like this?

Most likely. In the past the NVC only forwarded the case to the embassy and the beneficiary had to bring those documents with them the day of the interview. Things have changed for most embassies if not all. They now have to send a list of documents to the NVC along with the DS-230.

Go to the DOS link where you'll find all the info you will need. Click on the Applicant Document Processing link.

You will need to get this from your wife ASAP so you can continue with the process at the NVC.

My husband and i are also waiting for the IV invoice and while we're killing time, i have my passport photocopied, got my certified copy of birth and marriage certificate from NSO (National Statistics Office), got my police & NBI clearance & got my 2 passport size photos. I only submitted NBI clearance in my married name (no need for the maiden name since we have changed our status) and I also submitted Police Certificate (not Police Clearance) from places I lived since I was 16. For the employment--> just put there "Physician Reliever" for those year/months (I was also a physician reliever in the early part of my employment history after board exam). No need to send photocopies, just send the original copy you got from NSO and NBI. For the NBI, just get a new copy few weeks before your interview and also make sure you have extra copies of your documents (NSO, etc) for your interview as well and for future use. You are well prepared.

For your daughter just write your current address (if she's less than 16). Good Luck and God Bless.

When we get an NBI clearance, we are given two copies automatically, one personal copy and one copy for whatever purpose we need it for, in this case the DS230. So the personal copy is also an original and is valid for the same time period the other copy is which is one year. Also, did "no record on file" appear in your married-name NBI? I was told that this is because this is a new application and obviously they have no record on file.

I included photocopies of the documents as per instructions on the site I was directed to when I downloaded the coverpage for the ds230. As for the CENOMAR, the only surviving copy is with my husband and he will attach it to the form when i send it to him.

Now regarding the "physician reliever" thingy...will they not ask for references for this?

Thank you, thank you , thank you!!!

I am preparing the same for my wife in the Philippines and may I ask what is CENOMAR? Glad I read this as I think she only has NBI clearance for her maiden name as needed to marry. So I will pass this information on to her. Thanks friends

Despite of the long flight, I was too excited to feel the tiredness yet. But I know it would take a few days to adjust to the time difference and get over the jetlag.

Left the hotel in Seoul 9.00 a.m in the morning to catch the flight (09/30 12.15 p.m local time in South Korea), was pleasantly surprised that my flight was upgraded to a complimentary business class. Had a stopover for two hours at Tokyo and the plane left on time.

After a 16+ hours of flight + stopover + change plane, arrived at Chicago O'hare Airport on 09/30 1.30 p.m local time, 45 minutes earlier than scheduled. After claiming the baggage, I was not sure whether to line up at the visitor or US citizen/resident line. A woman officer was there to help direct people, she pointed to the visitor line when I showed her the brown envelope and asked where should I go.

Both the visitor and US citizen/resident lines were equally long but were moving at a fast pace. I stayed in line for about 10-15 minutes and then was directed to a separate section for processing. Two other people were there, it took a few minutes for my name to be called. The officer asked whether I speak English and when did we get married. That were the only two questions he asked before he took my fingerprint, had me signed twice on a form and then said we were done and I could proceed to the custom clearance.

The custom clearance was easy, they didn't even open my baggage, just ran them through the machine and I was good to go. I was out at the arrival hall at 3.05 p.m, 35 minutes after arrival. My husband was not there yet as we thought it will take a while to get out. But, didn't have to wait long, he appeared shortly, before I have a chance to get the coins out to give him a call. :-)

Congratulations and Chicago is 2 hour drive from my town. Where will you live? Hope you have a very good life together!

Yes, NBI Clearance will and may suffice. Police Certificate is required from any country in which the applicant lived for more than one year after age 16. But there was also a"confusing instruction" regarding this for the NVC requirements, so I submitted both NBI Clearance and Police Certificates from places I lived since age 16 (just to be on the safe side).

Additional Info: Police Certificate is not Police Clearance, these are different forms. Police Clearance is what peeps usually submit which is like NBI Clearance where you have your picture and thumbmarks and with remarks that reads :"NO RECORD ON FILE". And just like the NBI Clearance, you will only submit the upper part of the Clearance (crosswise size).

Police Certificate is a Different Form with the PNP heading on the top and is usually signed by the Chief, Record & Clearances Section (PNP) or Senior PO/Warrant PNCO and with a "seal"-> which will state that _______ (Name) is a resident of ____ (Place) from ____ (dates) , has no criminal records during her stay or have no derogatory record filed in their office (etc..).... and that this certification is issued this ___(date) upon the request of ____ (Name) for Travel Abroad. This form is more expensive than the Police Clearance.

IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion regarding Affidavits
QUOTE (HisGirl @ Oct 22 2008, 05:32 AM) <{POST_SNAPBACK}>
I am in the process of having my family and friends go to a notary for the affidavit of evidence......what exactly should the letter say?

The instructions say nothing about Notarizing the affidavit and I did not get mine notarized and there was no problem at all. Just make sure the witness provides name, date of birth and address and signs and dates it.

IR-1 / CR-1 Spouse Visa Process & ProceduresFiling joint 2008 taxes???
QUOTE (cassi9879 @ Jan 26 2009, 03:56 PM) <{POST_SNAPBACK}>
Where can I get help with my ITIN application?
You may call the IRS toll-free at 1-800-829-1040 for information and help in completing your Form W-7 and your tax return, or to check on the status of your application six weeks after submitting Form W-7.
Assistance is also available by appointment at IRS Taxpayer Assistance Centers (TACs) in the United States to provide in-person help with ITIN applications on a walk-in or appointment basis. Applicants outside the United States may contact an overseas IRS office to find out if that office accepts Form W-7 applications.
You may also use the services of an IRS-authorized Acceptance Agent.

Thanks again, good information posted here.

IR-1 / CR-1 Spouse Visa Process & ProceduresFiling joint 2008 taxes???
QUOTE (elkfarmer @ Jan 24 2009, 10:32 PM) <{POST_SNAPBACK}>
Yes, young lady, you file as married and jointly. You fill out a W-7 for ITIN. I am doing it myself. I called the IRS and spoke with them. I too was getting all kind of answers from people and H & R Block. Dependents do not get a SS # until they arrive in USA. But that does not matter in the eyes of the IRS. You can not file electronically. You put the W-7 on top of the return and send it in. When the IRS gets the ITIN, they fill in the number and process the tax return.

And do you send your form to a different location than normal?? Thanks

IR-1 / CR-1 Spouse Visa Process & Proceduresaffidavit of support
I have a question: My husband came here in 2005 on a K-1 visa we married and filed for AOS also in 2005 as of today May of 2007 we have heard nothing just that its pending still. But in 2006 my husband had to leave unexpectedly due to a death in his family and at that time we didnt know to file for AP. So now we are filing the I130 so he can come back to the states. Since we filled out an affidavit of support and got a joint sponser when he applied for the fiancee visa will we need to do that again for this one? Thanks

IR-1 / CR-1 Spouse Visa Process & ProceduresI130
I think i'm in the right forum room... My husband came over on the K1 fiancee visa back in 2005 we were married a couple weeks later and he applied for AOS which was never approved or denied still to this day... But in 2006 he had a death in his family we didnt know bout the travel document you have to have to leave. He is in Libya right now.. I've talked to an attorney and the INS both told me the same thing since he left wthout a proper document to come back to the states he abandon his application.. So what i would like to know is i'm filing the I130 for him to get him back here. Do you send the I130 and I129f together at the same time? And also we had a joint sponsor for the K1. Will we need to do that again too? If so can we use the same person we had before? Thanks

IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 and past K-1
I'm in the same situation as you. My husband also came over on K1 and we married and an unexpected death in his family he returned home to be with his family and come back. Didnt work out that way. He didnt apply for a travel document either which at that time we didnt know about it well we found out to late. So we have to start again this time with the I130. As for question 16 Has your relative ever been under immigration procedings?" I put no because he wasnt in removal or deported or recission or judicial proceedings. Why did your wife leave the country? I did write up a letter explaning what had happend and why we are now applying for his visa again. Hope that helps some.

i have a question since my husband came here in 2005 on a k1 we got married and due to an unexpected death in his family he returned home in September 2006 we didnt know bout the advance parole at that time so we have to start over with the 1-130 process. But my question is since when he was here he worked and filed taxes would i be able to count his income on the affidavit of support?
