On 4/22, several #s directly before and after me got approved, with one RFE the very next number. Yesterday another RFE three after me. This makes me crazy, it's only me and the one, two numbers before me that don't get anything out of the 10 I-129Fs in my cluster. These are all NOA1s on my same day. Before and after this small group, are a different type of application.


Well, I am hoping you get something soon. Nothing yesterday for anyone in my group.

Just because they are before you doesn't really mean they will be processed first. I've had 3 behind me already approved this last Monday and 2 others getting a RFE. You want to find all same kind of petitions with the same NOA1 date as yours. all the best.

I am filling out the form and have him listed on one of the child lines.  However, the instructions state that "If you are sponsoring more than one alien, you must submit a separate Form I-124 for each alien.".  So even though I have him listed, I must do another I-134 for him too?

We don't have boarding passes anymore and tickets unfortunately. My Fiancé has a habit of throwing everything while I was a pack rat.

So in short. We only have Passport stamps. sad.png and MAYBE a credit card history with the purchases of plane tickets and other things from Philippines.

I didn't have any boarding passes or ticket copies but did put the passport copies of the stamps showing the dates I was in PI.  And a picture or two had a recognizable item in it.  One was the Manila Ocean Park sign with both of us in the picture.  Items like that with the passport stamp copies should do the trick.  Along with the other items you have listed.  All the best.

We are applying for K1/K2 visas for my fiance and his 19 year old son. 

 

Do I need to schedule 2 different interviews (one for each on of them)? Or just one? 

Not sure if each embassy's website for this is different from others.  For Manila, we scheduled hers under K1 option online and then it asked if there were any children to add.  At that point we added her 18 son (K2) to the interview.  And then it showed that both had prepaid and were scheduled for an interview on that day.

I hear you... Hopefully It will get better. I am just in awe... haha with a big shock!

 

It was indeed about 600 pages... with all the information possible... but at this point I will take a deep breath! and keep waiting. 

 

 

By the way, my total package was under 15 pages.  It makes it a lot easier to dot the i's and cross the t's when the stack of documents is smaller.  They are not looking for quantity, just enough quality to clear the hurdle requirements.  In my opinion, make absolutely certain you meet the requirements, but don't overwhelm with too much extra info.

 

My two cents.

 

Same here, at most 30 pages and I didn't have any flight tickets, boarding passes in my package and approved.  Sometimes too much could cause confusion and something could get lost in the shuffle through all that.  Hope it is a simple fix for you both.

Look people not trying to stress anyone out and not trying to be selfish OK, I just received a denial email late last night and will receive my letter in the mail soon. I have no idea why I was denied. I did everything by the rules of filing a K-1, I never got a RFE. I don't have a criminal record, she does not have a criminal record.  We had a lived together and I have flown back to see her within a year and a half. I gave my proof us meeting in person (2009) when I was living in Thailand all the way up til the time I left (Sept 2011). The only info I received since my NOA1 (Aug 28th 2012/CSC) was this denial email, nothing else.  This is the best I can give for detailed information. Once I get the letter I will give you all an update. My info pass is scheduled for May 22nd. Thank you all for your help. And once again I will update with info once I receive my denial letter.

 

On behalf of this group, I apologize to you for the rude individuals here.  They just didn't get the fact that all you have is an email of denial with no specifics for now.   I hope whatever caused this is fixable.  All the best to you both.

Did you every stay together at a hotel that you have receipts for? Also on the picture of you together, I submitted some that had an identifiable object in the background that showed where we were. And when labeling them, you need to put names, dates and where the picture was taken on them. I would also get statements from anyone that can confirm a visit and have it notarized and send that too.

Good luck with the medical and interview.   She and her son have completed day 1 of the medical, back tomorrow for vaccination shots and done.  Then wait till 4 June for interview. 

 

Don't forget to print off the payment slip and go to a BPI bank to pay for the interview.  About 4 hours after that you should be able to go into the embassies website to setup the fiancee's profile as K1 and if you have a K2 going with it that will be later.  Set up her profile information and then if you have K2, add child and set up that profile.   Now to select a date and be done.

"Offer letter", meaning the letter by employer stating when I was hired, how much I make, and that it is a permanent job, etc?

 

Exactly, I had an employment verification letter done up by my job right after getting the NOA2 so it was dated closer to the interview date.  It stated date started, title, yearly salary, full time and that it is a permanent position.  Then right before mailing everything to her, I printed off the last 3 pay stubs/statements.

Deal with it ...yes you have to for now. However, when you get to 4 months call and check on your status. If there is an issue they can tell you on phone long before you recieve anything in the mail. At 5 months if still no change call one a wekk and check status. Or atleast that is what I did and I got mine almost right at the 5 month mark :) Good Luck

3 Month is nothing. 5-6 month is a normal processing to get approval. Unless you are in California Service Center they are extremely slow at this moment. Just praise yourself with the wait.

Ok, so about two years ago, we started the fiance visa process. I (US citizen) ended up moving to my fiance's country while the papers were being processed. Everything went fine and much to our surprise the process went a lot faster than expected. We got called for an interview, but felt that we weren't ready to go to the US yet. We filled out some papers at the US embassy and they said that our interview would be pushed back some months and they would contact us then. Well...they never did. And due to some other circumstances, we never went back to the embassy to find out what happened.

Can we still reapply? I realize most likely we will have to start from the beginning, but does letting our first application go have any affect on applying again? I'm scared they could think we are not serious about being together, but at least we have evidence of living together the last two years.

Also, my fiance and I would like to visit the states for the summer, but I'm not sure if the whole fiance visa thing will affect his ability to be approved for a tourist visa.

Any help would be appreciated. :)


You stated that they told you they would contact you when a new interview has been scheduled and never did. That being said I would contact them, explain the situation and that you were never contacted with a new interview date and ask if one has been scheduled. If not schedule one. In the case their was some type of error, starting over is a possibility. I highly recomend calling them before taking any further action.

Hi! I'm still at lost when it comes to the I-134. I'm the petitioner and I'm "sponsoring" my fiance. I'm currently unemployed because I'm 6 months pregnant. My sister is the co-sponsor but we were wondering if it was enough. We live under my parents roof, so everything my sister earns is only for her she has no dependents. She makes 21,000 a year and has life insurance and vehicle she owns. I was wondering if this is enough. Thank you in advance for the help :)

Since you are all living together everyone has to be included in the household size. If she is the joint sponsor then she will fill out the proper documentation and be the only one obligated to you and your fiance financially. However everyone in your household will be listed on the documents she submits and if they have an income there is a space provided for that information. The house hold income is the total of income for all living in your home, and that amount has to meet the poverty level for the number of people in your home. Since you dont work she will have to meet the guidelines for the 3 of you to qualify.

It is not so long ago for me i was filing the same forms as you so this is all from what i remember in my own situation. i hope this helps. Any members who find error in my post please feel free to clarify.

Call USCIS and speak to a 2nd tier representative, see if they can tell you if the file has been sent. Keep calling the NVC Info line, you can call daily, I called about every other day and when they receive the file, it will be in the system as received but then it takes time to get it entered.

I filed for a I-130 so don't know if the process is different, but I found that the NVC operators are way more helpful than anyone at USCIS.

Did your approval letter from USCIS state it was being forwarded to NVC?

I wasn't sure if this was covered, but I need to vent (or cry) and need some help from veterans of this process if anyone has had this happen to them. I got my NOA2 saying my I-129 F was approved, dated May 11, 2012. So, I am trying to be patient and working on critical work deadlines and trusting the process but finally I cannot take the suspense of waiting any longer so I sent an email to the NVC and they have no record of my file. So, I am hoping that perhaps they just mailed it on to Amsterdam for review so I contact them, and they have not received it either. :oops: It has been over a month and now I am concerned that the files may have been lost and I cannot tell you how depressed that makes me other than to say I just feel like curling up in a ball and crying. :crying: :(

Has anyone had this experience? I sent my I-134 and everything to support the I-129 F to my fiance' in anticipation of his receiving packet 3 - so we could proceed as fast a possible. My last visit was at Christmas and New Year and we aren't wealthy so we were waiting to move forward since that made better economical sense and the price of airfare has skyrocketed so a visit didn't seem a good idea if we are going to need the funds for moving expenses.

Now, I don't know what to do other than wait for a response from the NVC who stated they would follow up by contacting USCIS. I hate being stymied though. Waiting is hard enough as it is, without the added emotional burden of this. :unsure: :cry2:

If you look closer at the instructions for completing the I-864 and I-864EZ, the instructions state that you only need to submit a copy of tax forms you filed or an IRS transcript of the last year. It states that you can submit the last 3 years if you feel it will help your case, but only the last year is required. :yes:

Okay...for starters, I wish I had found this site when we first started our K1 process. It truly has so much info on here to literally help you, step-by-step. Yet, unaware, we hired a lawyer and nothing wrong with the idea, just more of the thought of saving us $. :) So, I'm reaching out to my new found friends on here. Our interview was denied and said it was being sent back to where it was approve for review. So, we are trying to get that next step figure out.
Here are the thoughts playing in my head....since we don't know NOW the length of this "redirected step"...I was thinking of making a 2nd trip to visit him in December, since things didn't go as we hoped. Then, I "thought" of "maybe" getting him to visit me as he has more flexability in time than me due to my job and kids. If I visit him, my time will only allow a 8-10 days stay vs him a 90 days stay (as far as hear-say goes). Forgive me if I state incorrect info, but from what I heard it's harder to bring him here to the states for a temp visit vs me going to him.

Is this true?
If not, how do I go about this?
And, IF it's possible, would him visiting me risk anything during our wait into our next step?
Finally, Dec and June/July are my best times to travel...should I assume due to timing that I should plan my trip in Dec; than look into him visiting me next time (allowing more time to get that going)?

It is only a delay so don't get too discouraged. :no: Good advice has been given above. :yes: I would like to add that the more visits you make the better it is to establish relationship. Lagos seems to like visits and pictures, so when you visit take many. Take pictures of outings and visits with family. Label the pictures with dates and who/where etc. Once you have followed all the post interview options you have, you can read different posts from this site specific to the embassy you will be interviewing at, and you will find a wealth of information to give you a better understanding of what Lagos is looking for and what you need to provide. About 20 years ago I got a misdemeanor conviction of peace disturbance and paid $100 fine. I wasn't going to list it because on the I-129F it asks if you've been convicted of specific crimes and I haven't been charged or convicted of any of those things. But now I'm afraid if I don't list it that it could cause delays or they could deny us on misrepresentation. So how do I go about getting a copy of it / my "criminal" history? And how much emphasis will they put on it? I'm the petitioner. I'm the us citizen. Thanks.

You can contact the state police dept for a background check specifically in the state the conviction took place. I have had to do these myself for employment purposes. You can request it via the website for the state police dept of that state. You will see an option to order a background check and fill out the request form and pay a small fee ( I think I paid 25$). Also, any conviction should be recorded at the county courthouse where you were convicted (you can find there contact info online). If you call the courthouse they can look up the records for you as it is public information, and for a nominal fee they will copy the record and send it to you. I will reiterate as in your later post...make sure you are replying to the question they ask. If it does not apply to you answer no. God bless you on your journey and may peace reign in your life.

Answer the question asked. If it does not apply to you, and you indicate above it does not, then answer no. If it does, then answer truthfully and prepare to provide the documentation they require. Do not try to read things into it and add confusion to your case. They know what they are looking for, and if they want it they will ask for it. Yes...New Delhi honestly scares me a little bit and we are going through Mumbai but not sure if they are truly any better.

I sent a book with over 200 pictures of my fiance and I together from our trips that we've spent together in India and in the US. We had a family lunch in India on my last trip there to celebrate our pre-engagement and so that I could meet his entire family, but no official engagement ceremony. I had seen too many cases where the CO questioned it as "Are you sure you did not get married?" or "Why didn't you just get married?" So he proposed to me in the US and then we had an engagement party that we sent invitations for with my friends and family. Both of our families are very supportive of the marriage even though we are different religions. We have lots of pictures all together and we even still Skype with each other's family too.

You are SO right about the boring part...There is nothing boring about an international long-distance relationship... :-)

From the research I have done on K-1's in India...They do not always get AP, but I will say that certain consulates are more strict than others so the chances are much higher at certain consulates than others. My fiance and I are going through Mumbai which has historically been a little bit easier. It's been going through a lot of changes lately though so we'll see what the outcome is. And yes that did play a factor in our wedding date but the date also has significance in our relationship and so it kind of worked out too.

We have NOA1 of 11.08.11 and the average for K-1 from start to finish was 6 months when we received NOA1. Our wedding was over 9months away from the NOA1 date. I have not seen very many people go longer than 9mos even with RFE or AP...but we'll see...I'm not making any fixed plans right now and we are not planning a HUGE wedding either. We are also having a lot of friends and family helping like with cake and photography so there is flexibility as they are all aware of the process we are going through.

All that we can do is be positive and encourage each other...no matter what the circumstances are or what our personal situation is. We are all here for the same reason and none of us want our hopes and dreams crushed before a decision is even made.

What you have said makes perfect sense from a 'logical' standpoint, and would find myself in complete agreement. However, the same logic may not work from a practical standpoint from the perspective of the CO.

Try to place yourself in the CO's position. He/She has a VERY small amount of time to sift through a stack of paperwork, ask a few questions, and make a snap decision that will effect peoples lives forever. They are bombarded with lies, cheats, and criminals who are VERY talented at looking and sounding like a sincere and loving fiance. The CO's are not heartless, and are effected by the crying, heartbroken, and sometimes hostile fiance who is handed a denial or blue slip of paper. The CO is under incredible pressure from their supervisor to not only make the correct decision, but to ALSO do it FAST to prevent a backlog of cases. Not to mention that these people do this same job over and over and over.

So if you were a CO, what questions would you ask? What evidence would you want to see? What would sway you too see inside peoples heart? Is this person a fraud? What if I decide incorrectly and ruin a good persons life? You need to make that life-altering decision NOW, you have 15 minutes, HURRY the next 20 couples are waiting!


Very good point...I am in management for my job so one of my duties is hiring people. Typically, when I conduct interview screenings, I don't have much time. I'm between meetings and I really only have 3-5 minutes. I ask about their previous experience, look at their resume, listen to how they answer the questions, and then go with my gut to make a decision. I know not everyone works that way but I have never been wrong when I go with my first instinct. Even when there are multiple supervisors interviewing/screening the same person, if I'm out-voted...I still end up right as that person ends up not being a good employee or ends up leaving the company fairly quickly after starting their job.

I know the CO has a very hard job but the USCIS spends 4+ months with our paperwork and then they approve it. You would think they would do some research and actually review some of the documentation. You would think the petition approval would mean something more...

K-1 Fiance(e) Visa Process & ProceduresLegitimate Relationship = $$$
As I sit and wait for my NOA2, I can't help but think about the K-1 process. I've been on VJ for several months now and I've read numerous success stories but also numerous horror stories. I know I need to be informed of the worst case scenarios to be prepared but I can't help in worrying that for some reason my legitimate relationship may not be approved because the country my fiance is from is high-fraud and the CO did not like the way he said "the".

As I've read different journeys I've realized the proof of the relationship is not necessarily in the "pudding". I feel the CO wants to see how much money are you willing to spend to validate and prove you have a legitimate relationship. Have you gone to see each other several times spending thousands of dollars in airfare, hotels, etc? Have you spent hundreds of dollars sending letters or packages to your fiance across international waters (are we not in the 21st century?!?) when you could just send an e-mail or wait to deliver the package and gift when you actually visit them?

Does quality not mean more than quantity? Why would $$$ be an indicator of authenticity? If someone was trying to "buy" their way into the US, don't you think it would be via $$$ (bribes)?

Why is religion such a red flag when one of my freedoms as a USC is freedom of religion? Can I not love someone from another religion? Even two USCs from different states could have such different beliefs and different cultures it would be comparable to being from a different country.

Why don't they read some of the e-mails or text messages that go back and forth between the couple? You can't make up that type of conversation between 2 people in love. Why don't they care about the details?

As I digress, I am at the discretion of the US government and will follow this process if I want to have a future with my fiance in the US. I will provide as much evidence as possible that they deem valid, but I can only hope and pray that my fiance and I have a smooth journey and that we can get married in August 2012. I can only dream that this will be my last holiday season alone and that next year, we will be able to celebrate our first Thanksgiving, Christmas, and New Year's together as husband and wife.

K-1 Fiance(e) Visa Process & ProceduresIs Your Case Really Different?
As I sit and read the forums daily, I keep telling myself "my case is different" as a means of trying to stay positive through this process. This takes the edge off the fear that my fiancé and I will go through all this waiting and end up getting denied or put in AP...but the question has been looming the last several days...

At what point does your case stop being "different"?

I don't mean to be a debby-downer and in all reality...everyone's cases are ultimately different and everyone's outcomes can be different...I know that...

My fiancé and I have built a strong case and we just want to be together so bad like so many other couples...it's almost made our relationship somewhat different because we are going the extra mile to make sure we have documentation of EVERYTHING... My first thought before every decision is "can we use this as documentation?" which was not at all how I thought this journey would be...

When I visited an immigration attorney a couple months before we started our process, I was so naive and now I feel so tainted by the government...It may be years after we are married that I let go of the feeling that we constantly have to prove our relationship and love is true...

But alas, we are building great memories that will last a lifetime and that we will have documented. We will have an amazing love story to tell our kids and grandkids and we are determined to live happily ever after...

Just some thoughts on a lonely and cold winter's night... ;-)

K-1 Fiance(e) Visa Process & ProceduresK-1 Random Questions
Hi All-
A couple questions here while we wait for our NOA2.

1. I know there are a lot of posts out there about visiting your fiance in the US while the I-129F/K-1 is pending and how immigration goes but I wanted to get an updated opinion. My fiance is in India and his POE would be Newark. He still lives with his family so all of the bills are in his father's name. He does have a good job and will potentially be able to bring documentation from his boss that advises the date he is expected to return to work but not guaranteed. He has been to the US twice before we filed our K-1 and his first entry experience (Detroit) was horrible, they grilled him and asked for a lot of documentation of his roots in India and where he plans to go back and that was for a business trip but his 2nd experience (Newark) was perfect and pain-free and they did not even ask for any documentation and that was for a personal visit. Comments?

2. I've also seen a lot of debate on whether to do invitations, Save the Dates, etc. A lot of the advice has been not to do wedding invitations or Save the Dates because that is being presumptuous about planning a set date. At the same time, I've seen a lot of reviews for my embassy (India) where they ask to see a guest list and the plans for the wedding such as invitations, venue bookings, etc (which typically you need to set a date to make plans). I've been making plans for our wedding but they have been flexible plans so that we can change them as well as the date if need be. I thought it would be fun to play on our long-distance relationship and do Save the Dates with a Skype theme and then put an * on the date and a fine print that says "Date Subject to Change At Any Time Pending Visa Approval"

K-1 Fiance(e) Visa Process & ProceduresK-1 Paperwork Dates
We are about 116 days into our wait for the I-129F petition approval for our K-1 visa. I want to start filling out the paperwork for Packet 3 and Packet 4 (I-134, Letter from Employer, Letter from Bank, Letters from family, Updated Letter of Intent, etc) but was wondering if the dates would be too early as our interview may still be 3+ months away. It will probably take a few weeks to gather all these letters but would the dates on them being in March be too early if our interview isn't until June? Whats the rule of thumb regarding dates on these letters?

Also, does the updated letter of intent have to have different wording or can it say the same thing as the first one just with an updated date?
