I think you are correct when you say you were told that any time accumulated out of status before you turn 18 will not be held against you.

This is what is states on the USCIS section about people ineligible to receive a visa....
ALIENS UNLAWFULLY PRESENT.-

(i) In general.-Any alien (other than an alien lawfully admitted for permanent residence) who-

(I) was unlawfully present in the United States for a period of more than 180 days but less than 1 year, voluntarily departed the United States (whether or not pursuant to section 244(e) ) prior to the commencement of proceedings under section 235)(1) or section 240 , and again seeks admission within 3 years of the date of such alien's departure or removal, or

(II) has been unlawfully present in the United States for one year or more, and who again seeks admission within 10 years of the date of such alien's departure or removal from the United States,is inadmissible.

(ii) Construction of unlawful presence.-For purposes of this paragraph, an alien is deemed to be unlawfully present in the United States if the alien is present in the United States after the expiration of the period of stay authorized by the Attorney General or is present in the United States without being admitted or paroled.

(iii) Exceptions.-

(I) Minors.-No period of time in which an alien is under 18 years of age shall be taken into account in determining the period of unlawful presence in the United States under clause (I).

I do remember reading a Thread where a person was taken to the US as a child and they did not leave prior to their 18th birthday. Their visa was denied, if I remember correctly they were barred for either 3 or 10 years. I think you are very wise in wanting to do the right thing in leaving and then coming back legal. I'm not sure about student visa's or what you have to do to apply for that. I do wish you much luck and hope you can work things out so that you can come back legally and finish your schooling.
Hopefully someone can give you more info on that but this site is for family immigration and not for student visa's

You will definately need a waiver. Give this a read http://travel.state....ities_1364.html there is a section about multiple convictions and that will apply to you. You will need a very strong hardship letter but it is possible.
There is also another very good site that might give you more information. There are several examples of hardship letters. It's called immigrate2us.net. Have a look there and look in the I-601 waiver section. Read through the sticky's at the top.

Hi dexy.

No your waiver stays in london and will be decided there. since your case is now under review you should hear something soon. (I would guess in the next couple of weeks) They will send you a letter when they have made their decision with the results. You will then mail your passport back to London so they can attach your visa to it and mail it back to you.

We filed our waiver in May but it didn't get put on the lists until June so we have several more weeks to wait yet. Beetee's waiver went under review on July 25th also. You both should hear something about the same time.

I wish i had more info for you but I have a few suggestions that might help. There is another site that is good with information about I-601 waivers. It's called immigrate2us.net. I have read on there about some kind of report you can send off for to find out what is on your record. FION i think but not postitive. I have also read that you can request a report from the FBI . I found this posting with the link included.

click on the above link and print a copy of the FBI fingerprint card. The instructions tell you where to send the prints. You can go to your local police department and ask them to print your husband. got the results back in less than 6 weeks.
If your husband never went before a judge, then he most likely wasn't deported, but the fingerprint results should tell you what is on his record with immigration...

It sounds like to me his visa was revoked because he admitted to working without having proper documentation not that he was deported. but that's just my thoughts.

Hi Irish,

Not sure you will need this but if it makes you feel better to be prepared then good luck.

I have some suggestions but I'm at work and really can't do very much right now. I will try to do a quick summary of what I can think of.

Your waiver if needed will go through London. London told my fiance that they like for you to write your own letter and not used an attorney. You both will have to write a letter. The way we done ours is the USC's letter should be more detailed with lots of supporting documents and signed dr's letters and so on. His can be more relaxed and almost a copy of yours. Lots of proof of rehabilitation and regret for what ever crime it was. Might even put a description of exactly what happened. Anything you can think of that would prove rehabilitation.

Think I would list your grandmothers situation first. Seems to be the strongest. Get signed statements from a dr for her condition, treatment and rehabilitation. What do you do for her and how often. Lots of details and reason you are the one responsible to do this for her. What would happen if you were not there to provide this care/ assistance.

Compare your salary vs working in Ireland. Do you have insurance coverage, retirement, anything you can think of.

Dr letters about your anxiety. Signed statement from him and what the results would be if you did not continue to receive treatment. Worst case possible. supporting documentation from internet. google your condition........... Statement from dr about your surgery, treatment, rehabilitation. Compare Ireland medical care to US. try to google that also.

Yes london doesn't keep the passport. They will mail you a letter to inform you if your waiver is approved. They will instruct you on what carrier to use to send the passport back. It usually takes 10 days to 2 weeks i think.

Once you get your waiver filed it takes about 2 - 4 weeks for them to put you on the online waiver list. You can track your case once it is on there. http://www.usembassy...s/ivwaiver.html

i got the same response to my service request for my fiance. still waiting. I think the reasons can be 1) your name matches closely someone who has a flag in their system 2) something that strikes them as "off" about your case. for example we are filing for the 2nd time after having a mistake in our first petition....

I already moved to Russia once before to be with him (before we got engaged) and moved back right when he got his first visa... then they CANCELLED it :-( because of this mistake. So now we are separated for almost 1.5 years waiting already even though I did already stay with him in Russia through an entire K-1 visa wait process for our round 1 of the process. ARGH.

Our plan B is to move to a 3rd country together...

I have not been able to find a lot of examples of people who got this same notice to see how long it took. The example you found with 1 month is encouraging!

yeah the one month is encouraging...im not sure if Im so upset about the 6months I've already waited but to wait 6 more months i am:( maybe we will here something by the end of this month I hope so and wish all good luck

Yes, I agree it has nothing to do with the countries. My husband at first wanted me to give up everything and live in Turkey with him, but now he doesn't because he saw that I was not happy in Turkey. My plans will change if he doesn't get a visa though. I will sell my home, car, all personal belongings and move to Turkey.

I tried staying in Turkey with my husband until the visa came but I was like a fish out of water. I then came back to the US and booked us a 2 month stay together in the Dominican Republic and had to come back again because a co-worker had a stroke and they needed me to come back to my job. Now I am thinking of selling everything and going back to Turkey. This is a nightmare. I wish I hadn't called for a service request. It is like I am being punished for checking on our status.

I loved Albania and my husbands family but he thought he was asking for me to give up to much, house, family etc...I was thinking the same thing , punished for calling to much because I couldn't check my status at first and had to call a couple times in the past to see ...someone said maybe the countries we are from but doesn't make sense because ppl from MENA countries have been approved alot faster..:(

Please share your experience if you received this same information. We have waited six months from NOA1 and now they are saying we are in background checks that could take another 6 months. Contacted Senator and Senator's office called today and said they were told the same thing. E-mailed CSC and I just received e-mail from them saying sorry this is the current processing time. What? We have already waited 6 months.

If anyone has experienced this, please share your story with me.

My mom got married to an american guy who is a US citizen. My step-dad (my petitioner) petitioned my mom and my younger brother who are now a Lawful Permanent Residence of US. I didn't come with them because I want to finish my school here in the Philippines. I was only 17 when both of them were petitioned by my step dad. I stayed with my grandparents here in the Phil. Fortunately I graduated and got a job. I enjoyed working for almost 4 years. In the year 2008 I realized that I wanna be with my family. My step dad filed a petition for me (I-130). I made a research about petitioning child over 21 years old and I found out that here in the Philippines it would take 5-10 years to get a visa available. I told my step dad about what I've found out. He told me that I am still included with my sisters and mom's petition therefor According to him I don't belong with F1 Visa. Here are my questions I hope some could help me understand things:

1. Some says that the petition must be filed before I turned 21. Is that right? However my step dad just filed the I-130 petition just 2008 and it was approved by USCIS just this year (May 10, 2011).

2. I heard about CSPA, is there an exception with my case? My stepdad send a letter to USCIS explaining the reason why they didn't filed the petition when I'm under 21 years old. (Before my petitioned got approved, USCIS asked for supporting documents (RFE) like the death certificate of my dad and certificate of non marriage.)

3. Am I eligible for K2 visa then?

4. USCIS sent the approval notice to my stepdad saying that they will send the approved petition to the NVC and gave us 90 days to wait for visa processing. It also stated that I will be receiving a paper as well coming from the consulate here in the Phil. If I may ask, All of the notice of approval sent to the petitioner has the same content just like what my step dad received?

VietnamQuick question about pink slip

Hi guys,

We had an interview today and we passed. The CO kept my fiancee passport and told us that we passed the interview and we can proceed to pay the EMS fee (we don't recall what we gave to the EMS). We went to the EMS windows and paid the fee. We were so happy that we didn't even look at what papers he gave to us. Tonight we checked and only found a pink domestic brochure and a white paper saying our visa has been approved. Did we miss anything else or did the CO forgot to give us the "pink slip"?


Not sure but read thru these reviews of your embassy. May be some information there for you.

It is frustrating. Its practically February, you would think by now they could update the chart through the end of December instead of leaving it as current as of Nov 30, 2012. Especially since right above this it says the chart is updated on the 15th of the month :wacko:


I prefer this link here on this site to track and guess timeframes. But it is nowhere accurate since we know that all petitioners are not coming to this site and setting up a timeline. Wish you the best and try to find something to do to keep yourself busy vice going to the websites multiple times throughout the day if it is frustrating you.

As you can see, VSC seems to have increased their production here lately.

There is an entire thread full of people here from Pakistan going through the process, many are not of the same religion. All have met the requirement of meeting within 2 years.


Yes, for I know of a USC lady that is living in Pakistan with her husband since his visa was denied a few years back.

Anyone have any thoughts on the topic of how the K-1 service centers might/will be affected once they get passed the August 15 filing date of when they started transferring a lot of non-K1 visa apps out to other centers? Of course, I'm hopeful that things will speed up for us but I guess we'll have to wait and see. :whistle:


What are you referring to about transferring non K1 petitions to other centers? Where did you read about this or heard this rumor and why August 15 filing date?

I have noticed that VSC is still processing K1s very consistently where CSC has practically come to a stop on them. Also, quite a few are August filed petitions too.

I did my k1 petition last year in February and it took a smooth 5 months with no RFE after that the USCIS/NVC sends it to the embassy and it was only 1 month and she got her visa, I did notice that some visa fees did go down. I been hearing that a lot of people's petitions are bing held up longer.


You are one of those that cause false data since you started a timeline but didn't finish it. Please take a moment to complete it with accurate dates.

I've been telling everyone that major issue on slow processing time at all service centers are due to DACA, some believed, stay skeptical and felt hopeless. It is fact that DACA is main cause of delay at CSC because of intake of these DACA cases and you can see it on here True DACA (March) Data

Recent case transfers from CSC to TSC gave us hope that CSC will speed up on other petitions including K-1. Well, it is only apply to DACA cases that are currently backed up at CSC to balance # of DACA cases between CSC and TSC. Correct, balance between #1 DACA intake service center CSC (128,000 cases) and #2 DACA intake service center TSC (73,258 cases) and both service center are STILL accepting incoming DACA applications. These case transfers are done to increase processing time only for DACA.


How did you get to this? When I try to access Resources it give me a forbidden error.

Pretty much sums it up!! It would be different if they would provide a little communication to let us know what the hold up is and if they have a solution, but they can't even manage to update their site. What great customer service! They would never survive in the private sector!


I contacted my congressman about the website and lack of being updated. But the individual I talked to didn't sound confident that their involvement would help with USCIS properly updating their website consistently.
