So, let me make sure I get this right...I only have to make $22,000 for a family of 3? Yes yes.gif
And that has to show on the last 3 years of my taxes? It depends on what the consulate asks from you, they may ask for only 1 year of tax returns smile.gif

Thanks SSSOOOOO Much!!! That makes me so happy!! Now I know...we will be okay as far as finances go. By the way, how do you get that count down thinga-majig on your screen?

I know we still have a while for this to be needed, but does it do any good for you to get the police certificate early? I didn't know if there was an expiration date or not for something like that. I was just trying to think about what we could do while we are waiting. Thanks

Danielle, I dont know if you have to have the new type of police certificate or not for Scotland, but the one I have to have lasts 12 months best to check on the police website.

Is it something we will definitely have to have?

I really thought the same thing. I thought there is no way we are going to be able to do this and get this right, but the guides and the people on here are truly tremendous. I agree with the other vj in saying you don't need one if you don't have any major hang-ups. Just print out all the information you can get your hands on and sit down and go through it. That's what we did and so far (cross our fingers) we have hadn't any issues and it was alot easier than I thought it would be. If you have any questions just feel free to post and most everytime someone will have the answer. There are alot of smart cookies on this sight who are not only willing to help, but are happy to.

My Fiance pointed out to me that ppl who filed 129F in January 2008 are now receiveing NOA2 this month (March). I would of corse like to be 1 of those lucky people. We filed December 2007!!! So anyone has any clue why or how this is happening?
I expected 6 months at least .... and now i see ppl gettin it after barely 2 months....? I'm happy for them. But I am concerned since they did file after I did.
I called USCIS and got the same old "Case Pending and our customer service department does not have any more other news about your case....,bla bla!

Can anyone clarify what is going on? I know they hired more ppl recently but still...can we catch a break too?

Advance Thanx 4 any replies!!!

I know it's extremely frustrating. We had to file with the California Service Center and I am now regretting living in Indiana lol I couldn't tell you why that's happening or shed any kind of light on it. I'm still new to this process myself, but I will offer you some kind of support in knowing we are all wondering what is going on at those service centers. Keep your head up!!!

I see on your profile you filed at the Texas Service Center? I could be wrong, but I thought the only centers that were processing I129-F's were Vermont and California. Find out where you filed because Vermont is much, much faster than California right now. Until you get the NOA2 there is nothing to do. You will need a police certificate and usually that is good for 12 months, but (I could be wrong) I think that's the only thing you can really do right now until you get your NOA2. Good luck to you.

K-1 Fiance(e) Visa Process & ProceduresWhat type of visa is best for Phillipines?
QUOTE (honeyblonde @ Apr 21 2008, 12:57 PM) <{POST_SNAPBACK}>
My husbands best buddy is a dual US and Phillipine citizen. He's in his 20s and wants to bring over his fiancee and get married this year. Since he has dual citizenship and they grew up together, I'm sure his case will be easy no matter how he files, but I wasn't sure what to tell him would be fastest. She just graduated from college so she can finally join him here. What would be the best way for him to bring her here?

Should he do a fiancee visa, get married there and then bring her on a marriage visa, or would direct consular filing be quickest?

Any help from those who've dealt with the Phillipine consulate would be greatly appreciated.

Thanks!

Liz

I hate to paint this pretty picture you have going on, but there is no such thing as easy when it comes to the USCIS. No matter what path they choose there will be waiting involved when it comes to being together. Regardless of whether they get married there or here they cannot immediately be together. Right now it seems as though the fiancee visa's and spouse visa's are taking about the same amount of time. What it comes down to is what THEY want to do since they cannot be together right away anyways. My fiance and I went through this same question and we decided that when we did get married we wanted to be able to wake up to eachother and rather wait and do the fiance visa. Good luck to your friend.

K-1 Fiance(e) Visa Process & ProceduresTom and Wacharee (Nic) Fiancee VISA USA
Hello I my fiancee and I are new to the forum. Like the rest we are trying to hang in there while we wait endlessly it seems for her VISA to the US. I sent my 129 on September 14 and unfortunately it took them till October 31, 2007 to enter it as received. The return receipt took nearly 4 weeks alone. My file has been touched on December 26, 2007, as I filed an expedite request due to my mother who is soon to pass away from cancer (likely in the next 4 months or so) and would like to see us married before she does. My mother is also the caretaker for my 76 year old Father and 91 year old Aunt ( who I believe is 93 and lies about her age still) who are pretty much home bound and rely on family support that I hope my Fiancee and I will be able to provide for the interim term while we address how to keep them in their home. Not sure what will happen with the request but praying about it. I did hire an attorney, Brian Wright of my Thai Fiancee to help with the process back and to make sure I did not miss anything. Late nights and calls keep me close.

Yes, I understand what you guys are saying. I am saying from the time they receive the petition in the mail to the time it is completed by USCIS. I am simply telling those people who are outside of that time, to get up and make some calls and/or inquire with their congressman/woman if it makse sense.

Exactly my point from date of receipt in mail to adjudication. It is not how long it takes the mail room to receive something. They appearently have commited and are telling congress the whole process is less than 6 months for many of you I do not see that to be true.

K-1 Fiance(e) Visa Process & ProceduresDiscussion with Congressman's Office regarding USCIS K-1, Processing timelines
When inquiring with your congressman/congresswoman ( I want to politically correct here) make sure you ask for who handles Passport Immigration or VISA issues. In my case there was a longtime person who handles this and then escalates it to the congressman. Be sure they do not just put you into a vacum.

K-1 Fiance(e) Visa Process & ProceduresDiscussion with Congressman's Office regarding USCIS K-1, Processing timelines
Hello everyone,

Recently, I had a conversation with my Congressman's office regarding the length of time many people are having to wait for their K-1 Visa's for their Fiancess. Interestingly, I was told congress had received a number of complaints about the delays. My congressman in particular has called the USCIS and was told in person and in writing that the majority of cases were being adjudicated from receipt in the mail to completion within six months. I informed them that this must not be true and that they should really ask for a more accurate report and/or evidence to support this. My congressman's office was also told the bulk load resulting for the recent price changes is now nearly stablized and they are heading back to getting the requests completed within their normal time of about 4 months. I explained that this could not be true again and requested they inquire further. My congressman's office agreed to call on my behalf the USCIS Monday to assertain what is happening with my expedite request and reverify the work load. Perhaps our congress does not really know the length it is taking. I was told if for some reson your Fiancees name hits some reference with the FBI it could take years for them to resolve this. Not good news. Just what I was told. Wonder what your congressman would tell you?

Regarding the questions sorrounding "Does the expedite follow it all the way through the embassy?" unfortunately, you have to start it all again, there is no measures or expedite jacket that will follow the approval. Seesm like they should have some thing, but not. The course of action is for me to continue to request support from my Congressman for help. This is what the USCIS, California Service Center told me. I am again stunned the right hand nver talks to the left, seems logical but it is not. However, I am going to continue to pray my congressman will help me get this done.

K-1 Fiance(e) Visa Process & ProceduresExpedite Request Based on Family Medical Emergency
Hello everyone,

Here is the latest update I received after calling the USCIS and speaking with my Congressman's office. It appears they have steped up and are trying to help me. My mother's condition appears to be getting worse, but she is hanging in there. As a result, she has also contacted her Congressman as well. This is the recent reposnse I received from them shown below. I did censor the name of the contact as I want to protect their identity. I think it is good for others on this board to see in case they have some similiar situtation and/or other.

Response to me below:

Mr. Feagans,

I thought you should be aware that our office has sent an inquiry to the California Service Center regarding the request that your mother’s case receive expedited processing based on her condition. We are waiting to receive a response. Please check back with me on Friday afternoon if you have not heard from me by then. Thank you.

Sincerely,

Hopefully someone has received an expedite request like mine before.

K-1 Fiance(e) Visa Process & ProceduresExpedite Request Based on Family Medical Emergency
Hello everyone,

Just an update here and perhaps some feedback from anyone who has received a approved expedite request would be helpful.

The USCIS is reviewing my expedite request. They touched it again today. It has taken them a little over month to get the details. Normally I would of not requested it, but my mother is dying from cancer and wants to see my fiancee and I married before she dies. Hope that happens, however, I am assuming we are minimal 2 months to 3 months out even if it goes quickly and mom is starting to show signs that things are rgetting worse. She was diagnosed with stage 4 cancer, unable to opperate and it now has speard to her spine, brain, lung, liver and who knows where else. Looks like it is moving rapidly. Unfortunately she is also the caretaker for my 76 year old father and my 91 year old aunt and without her there, I will have to take care of them to keep them in their home they worked for their whole life for. I am making plans to temporalily reside there, not change address as I have a job where I can work form different places in the US, but to provide them security in their home. Anyway the USCIS requested additional information back on December 20th, which I provided a two page letter from me and the Doctors diagnosis, limited in detail because of Hippa laws.

Anyway, if we are lucky enough to get approved, I am seeking information from anyone who has gone through this process and has received an expedite approval to learn how I might get the rest of the process expeditied, not to cause problems. My hopes are that the expedite approval, if granted, will follow the the papers to the NVC and then to Bangkok Embassy. I have thought about contacting my Congressman and my mothers asking for them to look into this and see if they can help but have not done so as I am afraid my case will all of a sudden get delayed longer. Anyone with experience here please fill me in. I may call my congressman to get advice.

We did have a Budhist ceremony, not an official marriage in the sense of Thiialand or the US unless you file marriage papers in Thailand at the local Government office, which we did not. We did this for her family and it was wonderful. I talk to her twice to her a day in the morning and at night as she is waking up when I am about to go to bed. I have been learning Thai daily and she has been studying English.

Sawadee, waiting and hoping

K-1 Fiance(e) Visa Process & ProceduresCan my fiance delay turning in "checklist"
QUOTE (LNguyen @ Oct 6 2007, 05:47 AM) <{POST_SNAPBACK}>
My fiance is expecting her first packet from Saigon consulate. I understand there are forms and checklist she has to sign then send back to the consulate. Can we delay sending in this form for about 6 to 8 weeks? The reason is I don't want using a cosigner. So, by delaying the interview until late January 2008 give me a chance to get this year W-2, file tax, get a certified copy at local tax office and send it to my fiance for her interview. TIA

LNguyen

you won't have to delay anything. the Consulate will not desire to see your tax-return untill the interview. the interview is 3 months after your fiancee returns the check-list.

Thanks for everyone that keeps replying.
thanks Yoko, Tiger, dbears,CBR,and Derekj.
For some time I have tried to fight with the ideas, and one of you might have hit on a point that I was trying to hide, but all of you struck home, you all made me realize some of my faults of speaking without thinking, look at my post woo hoo good one Jerome, but the most recent point was one of you said maybe it wasn't true love, and that i should find true love and not "the idea" of love. About 5 months back, all was good, we were in a video chat, and all at once she looked at me and started to cry, and the chat ended. I asked and asked what was wrong, and it took time for her to talk, and she could never explain what was wrong, but just that "it didn't feel right" such as now. But even before this happened, I had my doubts, about her being able to leave for America, and when I sit back and think it was that we only had 10 days together, and almost 2 years of writing and she simply got scared, but maybe I can simply move on because I know that all we had was 10 days of fun with only "the idea" of what we were about to do, but I do believe that I want to find true love, and that I might not have had it with Iryna, and that she never had it with me. It was a very fast relationship from hello how are you one week to I love you the next. I promise all of you I am taking my time, and that I am using my past to help me with my future. Heck before I went there my friends worried, and did not want me to get hurt, I kept saying "don't worry, if it doesn't work out I had one hell of a vacation!" Maybe I was trying to fool myself, but even if it was not true love then, I know deep down inside I do want love, after all who doesn't? I have had my fair share of bad relationships, heck my ex wife is in prison, please don't ask about that... This time I know what I am getting into, or at least I am fooling myself into thinking I do, but I know that time heals all wounds, and eventually you will find the one that god wants you to find. I can just say that I do believe I am on the right path, and trust me if you all read the first letter I sent to Sheirmane, you would know that when she did reply I was amazed, I did not hold punches, and I was a bit of a ####, but I was true and honest, and she was the same with me. We might wait for my trip, I have time, maybe April, maybe July, maybe never. Any way, what ever happens, before we even talk about marriage, we will talk about why we want this, and why we love each other, because I do not want to make it harder for anyone, and I don't want to go through the visa process again, but I will do what ever it takes to find true love. I write to Sheirmane as a friend, and my intentions are good and honest, we have both fear, and mistrust, and we have talked we are going to take it day by day, and in 6 months who knows.
thanks again for all that read, and all that reply, and do not worry, I am the idiot that posted without thinking, maybe I wont make the same mistake again.
thanks again!!
Jerome

I know it now sounds like I am trying to make me believe that what I am doing is the right thing to do, or that I am asking for your blessing, maybe I am, maybe not, I really don't know for sure either, all of your replies struck a chord in me, but I am going to continue the path that I have chosen, and I am sure god will guide me the rest of the way, and please ad your replies, I read them all

Thanks all!
especially thanks Laura and Nick.
I know that I should take time for myself, I understand this, and I thought about taking time, but I jumped into talking with a woman, not in search for a used car, but in search for the happiness I had with Iryna. I did and still do love her, but she has made her choice, and I am not angry with her for her choice. I have been honest people with Sheirmane, she knows that I just got out of a relationship, I was very blunt, and quite frankly i am surprised that she still wanted to write me. I am going to take my time. I do want to go to the philippines this year for a vacation, and for myself, I planned a trip for the philippines for last year, but when I started to write to Iryna, I went to the Ukraine to meet her. For all of you that are waiting, I know the wait is worth it, I can tell all of you thanks, and I mean it. I am going fast, and I need time for myself, but I also do not want doubts. If I step back now, I will always have doubts. I am sure all of you can understand what I am saying. I ask any of you when you wrote the first letter, to ask yourself did you have doubts. I am sure there are thousands of people that had doubts, and today they are still alone but all of you kept writing, you all fought through your doubts, and if I stop now and wait, I will always have doubts, as I will always have doubts of what I could have done different with Iryna, but I can honestly say that I am not the type of person that will ever hold one person to the other I can tell you all I am a honest and sincere man, and you can believe, or choose not to believe me, but Sheirmane to me is just that Sheirmane, she is not Iryna, and never will be, and I would not ever want her to be like Iryna, this does not mean I say that Iryna is a bad person, she was a wonderful and is a wonderful woman, I have wished her the best, and she has done the same for me, I never wanted a trophy wife, I never wanted a submissive woman, but a equal partner, one that I can grow old with one I can defend, one i can hug, when she is sad, and one that would hug me when I am sad. This I know is what I want, and honestly I will not find it by waiting. I do hope that it is not to soon, as I do not want to hurt any one, and I know that my intentions are honorable and sincere. Please feel as you want, and I do know that there are men that do not take this seriously, and that they make it harder for others. Just have faith that all people are not the same. thanks everyone, for your negative post, and your supporting post. good luck with all and god bless. I hope all goes well and fast for all of you and that you will not have to endure the pain that I have gone though the last few weeks
god bless Jerome

what i read is that you're already in touch with another women from another country... maybe its the reason the ukrainan women left you. No?

This is the reason that it takes so long for Fiancee and marriage visas, and why USCIS looks at all of us with a jaundiced eye.

I havent been on the boards for some time and the first post I read is yours, it is no wonder the US immigration system is so backed up.

I am not going to even dignify your question with a real answer, my only comment is that shopping for a wife like you would a used car is wrong and is the exact reason there are restrictions on the number of filings you can submit.

I consider your attitude toward all this an insult to those of us who have had to endure the agonizing separation from our loved ones, and have REAL relationship,

i couldn't agree more! this guy should be left hanging upside down in a tree full of big red ants until he comes to his senses.

Thank you for your opinion, but please read my reply. I should have stepped back before I wrote the thread, and I know I do deserve some flak about what I said " i am just glad I didn't spend the money on the plane ticket" Yes I should not have said that, I agree, and not trying to defend myself, I said it, I know the journey is long and hard, and I have endured through it like some of you, and unlike you or others it did not work our my way, I do believe marriage is a sacred place that is not like "shopping for a used car" like someone said in a different post, and people say that they would dump me fast if they were in her shoes, but look at it this way, I don't want to hurt the new woman, and make her think that I was a liar, and that i just went there with no true thoughts of honesty, but that I looked for answers, so that if the time comes close I can be honest like I was the entire time with Iryna, When I date, or write to a woman, I have one goal in life, and that is to find love, and I start any relationship with this in mind, and I just started writing, this does not mean I am going there next week, or even next month, but I know that maybe some day, and when I come to the reality that I want her to marry me I want to be able to honestly tell her that we can be married, I do not want to string her along like other men saying there is a delay, but don't worry we will get the visa. I hope everyone understands me, and if you still don't like me this is your choice, as it was my choice to come here for help as the serious man with only good intentions, a man that was hurt, and a man that respects the thought of marriage, and of a real honest relationship.
thanks for the reply Jerome

I consider your attitude toward all this an insult to those of us who have had to endure the agonizing separation from our loved ones, and have REAL relationship,

I'm happy to see that i'm not alone with that feeling.

NO, maybe I should tell the entire story. I simply asked a question about filing. I am currently writing a woman, am I planning on getting married or engaged again, I do not know. I just like to know where I stand if this goes forward, Yes the woman I am writing knows that I just got out of the other relationship, I am not like most of you want to think. I can try to defend myself, but only god can judge me, and for those who try, god will judge you. She wanted time to think about 3 weeks ago, and last week the 22nd she decided to call it off, and then on friday, I started to write to my cousin who married a Philippine woman, and told him about what happened, and he gave me a email of a woman he met in the philippines while with his wife, we are just writing, not talking about marriage yet, just getting to know one another, but as I said I do not want any surprises, and if something happens between us, I do not want to tell her I will try to file for a k1 fiancee visa and then find out that I cant and that I have to wait 1 or 2 years, or that I can not file for it ever, THAT would not be right to HER, so all. please feel free to judge me as you want, I do not care, all I know is that it is funny when someone comes for help some of you want to put your 2 cents in and judge a person, then there are those that jump on the band wagon and ride it out. So to all that judge me, remember do unto others as you would have them do unto you. Thanks all for the support, and know I do truly appreciate it, and I thank you, and keep the replies coming, and for those that want to condemn me, please keep those replies up to, remember what goes around comes around, and i hope your fiancee's don't see your true nature whistling.gif
thanks Jerome!!

what i read is that you're already in touch with another women from another country... maybe its the reason the ukrainan women left you. No?

Sorry, you feel that I am a womanizer, but that is as far from the truth as you can get. I respect her decision, and the entire time I was with her, I was just that WITH HER. I also know that you can not force love, and when she made her choice, I made a choice, and my choice was to move on and not give up on what I want, and that is the love and devotion I am willing to give. Thanks for your opnion, but dont judge the book by the cover. thanks jerome

B. Filing Limitations

IMBRA imposes limitations on the number of petitions a petitioner for a K nonimmigrant visa for an alien fiancé(e) (K-1) may file or have approved without seeking a waiver of the application of those limitations. If the petitioner has filed two or more K-1 visa petitions at any time in the past, or previously had a K-1 visa petition approved within two years prior to the filing of the current petition, the petitioner must request a waiver. These limitations do not apply to petitioners for a K nonimmigrant visa for an alien spouse (K-3).

K-1 Fiance(e) Visa Process & Proceduresvisa application
Thanks all that answered my last question. We had the interview set up for tomorrow (the 28th) and last tuesday she ended our relationship. My question is... Can I file a new application for a different woman right away? or is there a waiting period? I started to write to a woman in the phillipines instead of the Ukraine, and I will probably go over there in the begining of april to meet her if it works out. Please let me know if there is some amount of time that must pass by, so that I can let her know if we feel that our relationship is headding that way. thanks again for the help last time!

K-1 Fiance(e) Visa Process & ProceduresAffidavit of Support, where and when to send?
Does anyone know where and when I will need to send my Affidavit of Support. I haven't received anything telling when I will need to send these documents or where to send them and I don't trust the mail since I haven't received some of the documents that have been mailed to me already?
I want to make sure that everything is complete and ready because my fiance has her medical exam scheduled on Dec 27 th and her interview is on Jan 3rd in Manila.

She hasn't received her packet yet either but we did the scheduled dates from http://203.177.135.1...tment/login.asp

Thanks to anyone that can help me with this, we have waited so long already and hope we will be together soon. My children and I are eager to start our new lives with Shanet.

Thank you,
Jeff

Yes, you fill one out for each of you and send all of both in with yours and her signature on all pages. Use the guide section above and use the example forms area to help you.

K-1 Fiance(e) Visa Process & Proceduresquestions about G-325A
You both have to fill out all four pages and sign them. You send all four pages from each of you.
I'm not sure about the child. Someone else will have to answer that for you.

Best Wishes,
Baileyj

It doesn't matter if you were issued a tourist visa. It's a whole new ball game when you are trying to immigrate.
Try giving this a read and see if it will answer your questions.
