K-1 Fiance(e) Visa Process & ProceduresCashiers check or money order?
I don't know. I went to the bank, asked for a money order and got a cashier's check. This country is confusing. Everything is done so differently. I assumed a cashier's check was fine since that's what the bank gave me.

Are Copies of translated official docs allowed? (Kiev-Detroit Interview)
My wife's AOS interview is scheduled for the last week of March. For her visa application in Kiev, she had to produce several original documents that were in Russian. They were translated into English and certified by the translator. These docs are for her divorce and birth certificate, and name change.

These official English translations were kept by the embassy in Kiev. She kept copies of these, and the copies were not certified. They are copies simply run off a photocopier. The translator's certification seal is clear on the copies, but they are still only simple copies.

Are these copies of the official translated documents in Kiev acceptable?

Or do we need to get them translated again so that there is a new "original" seal by the translator?

TIA (Thanks in advance)
Rob and Tania

With the USCIS you will have no problems.... For the most part they do not need/want or require originals..

Thanks, this eases our anxiety.

I sent an email to the U.S. embassy in Kyiv, here's my initial email and the reply for anyone interested:

Dear Sirs:

RE: KEV 2007987654321 K1 visa approved/stamped July 9, 2007

Please return the certified English translations of Tania Yyyyyyy's birth certificate, divorce certificate, and name change certificate. She asked for these while in Kyiv, but never received them. Additionally, return to us any other documents you are holding regarding our K1 filing.

Thank you for your assistance,
Rob and Tania

The embassy's reply:

Dear Mr. Xxxx:

Ms. Yyyyy's visa was issued on July 9, 2007. When the visa is issued all translations, police records and medical records are sealed into a manila envelope and sent to the fiancée with the passport and visa in it. Immigration inspector at the first airport in the U.S. should have taken away this packet from Ms. Yyyyyy when she entered the U.S. the first time after the visa had been issued to her.

Once the visa was issued there are no documents kept on file in our office.
We hope this information will help you.

OK, I have the DS-230 Part I, DS-156, DS-157, DS-156K, Form I-134 & Photograph Information Sheet - DONE....

My question is:

What exactly do I mail in with this?!?

Do I mail in the Form I-134 or keep it for the interview - or both?!?

The list that we need for the interview (birth certificate, etc...)

Do I send in these copies too, or just wait for the interview....

I think I'm really confusing myself with all of this!!!!!

My fiance is from Brazil and all he will need to do is mail the DS-2001 and the DS-230 part 1 immediately to the Embassy. The other documents he will need to take to the interview.

I called the USCIS customer service and asked about sending in more papers because I knew the G-325A's that I sent for my fiance were not of the best quality (photocopy). I was told NOT to send anything in to try and prevent a RFE because whatever I sent in after the NOA1 that was not requested would most likely get lost. Logically this makes sense because I assume that my case is in a box in storage somewhere waiting for the time that other cases from this time-frame are given to someone to work with. I doubt that anyone would take any additional un-requested paper-work mailed in and find your filed away case and add the papers with it. From what I have read on this web-site, it seems that the USCIS has a difficult time not losing entire cases, much less additional papers sent in that were not requested.
With all that being said, you have 2 choices: 1. Send the papers and be sure to put your case # all over the outside and inside the envelope or 2. Just wait for the RFE.
The cost to you to send the papers is minimal, so I would just error on the side of hoping that sending the papers can make a difference. You really lose nothing, but might shave some days off of waiting for the NOA2.
From other post I have gathered that an RFE will slow your case down from 1 to 2 weeks, assuming you reply immediately.
Good luck with everything.

Thanks msmuth, I just might go ahead and send the documents in. I can also include the case number on the letter of intents. It will actually cost $60 for him to Fedex his letter to me, but it still might be worth it. Thanks a lot.

After learning more about the K-1 process on my own (definitely not from my attorney) and reading many posts from this site, it seems that myself and my fiance should have supplied a letter of intent for the petition. My attorney's assistant never asked for this document from either of us. I am still waiting for my NOA2. Do you think it is possible to send in both of our letters of intent with a copy of the NOA1 before a RFE is issued? Will the documents be placed in our files?

Thanks in advance for any help.

Click on Example Forms (Top right hand side of this page) and it has a 'letter of intent' sample that you can use. An attorney is not necessary for this process unless you have a 'tricky' case or do not have time to read up on what needs to be done. Ask specific questions and people will try and help you. Good Luck

Thank you motu...I will have the letters ready for the RFE.

K-1 Fiance(e) Visa Process & ProceduresIntent to marry document (K-1)
Hi everyone,

I hired an attorney to process my K-1. I left everything up to the attorney because after paying $1900, surely they know what the hell they're doing, right? Anyhow, later I discovered websites like this one where many petitioners process their own petitions and I'm just amazed at the support you all give one another and the information that can be learned.

After dealing with my attorney's office on countless occasions just trying to get a return phone call or return email, I am completely disappointed in the service I have received for my money. I became completely uncomfortable with this attorney's office and I didn't believe my petition would be filed correctly or timely. When I asked for a refund of my money before my petition was ever filed, so that I could find a more competent attorney, the answer, of course, was NO!! When I complained about the horrendous customer service I was receiving from the attorney's assistance (who, by the way, seems to be the only person I'm allowed to speak to), once again, I was welcomed with a complete lack of caring. They couldn't have cared less about the lack of customer service I was receiving because they had already received my money. I was actually told that if I was not satisfied with his office, then I can find another attorney without being refunded.

Let me share one experience with you. I received an email from my attorney's assistant stating that they had received my NOA1. The assistant included the case number in the email. I immediately went to the USCIS website to make sure this wasn't a joke because truly that's how my experience has been with these people. I entered the case number and the reply from the website was that I was missing a digit. I was furious. That incompetent #$%@ gave me all by one digit of my case number. Can you all imagine how I felt. I had been on pins and needles waiting for my receipt notice and when the attorney's office gave me the good news, they freakin left out one digit. Are you kidding me??? I immediately replied to the email asking for the correct case number. I didn't get a reply for over a week. You all know that a week for us petitioners seems like a lifetime. Hiring an attorney is suppose to reduce the stress of a very stressful and emotional process. These incompetent people added to my stress 10-fold. crying.gif

If any of you are planning on hiring an attorney, check to make sure that you can't actually do this process on your own with the help of all the other wonderful petitioners on this site. $1900 is a lot of money to spend for a stamp. When you think about it, all the attorney really does is take all the forms that YOU filled out, place them in an envelope and mail them. I'm not even sure that my documents were looked over for accuracy.

Maybe someone here can explain?

My flew to Brazilia yesterday for her pyhsical.
Before she went she was given a price for the physical, they now want R$960 for the physical and take 2 days.
I have read that the max cost of the physical would be $100.

Olá,

I haven't gotten that far in the process yet, but that sounds extremely high. I've also heard that the price should be around $100 but almost $600 US dollars is ridiculous. Did she get a quote when she made the appt? I would have her question the doctors office regarding the amount. If they will not reduce the amount, I would see about making an appt with a different doctor if that is possible. At least get an itemized list of what was performed. Not sure if this was helpful, but I'm sure others will respond.

Maybe you can also contact the embassy in Rio. I would talk to someone about it. Might not do any good, but it couldn't hurt.

Boa sorte

K-1 Fiance(e) Visa Process & ProceduresDelay in receipt correction
QUOTE (kid brooklyn @ Apr 18 2008, 10:12 PM) <{POST_SNAPBACK}>
You are dealing with CSC, not VSC. I don't think there have been any quick approvals. They are all from VSC. You will probably wait the 5-6 months to get approved, that seems to be the average for CSC.

Don't worry about not seeing any touches. We never saw one touch either, and then one day POW, approved. Touches means absolutely NOTHING!

Thanks for your reply. However, I'm more concerned with not having a correction made than being approved. I've calculated that the average time for a visa approval out of the CSC is roughly 150-200 days. That wait I can endure. It's the waiting for a correction that has me on edge. I suppose I am becoming impatient about it and feel that a correction should be processed quicker than this.

As far as me mentioning touches...I was assuming that a touch would indicate that they're working on the correction. Maybe you're right and I won't get a touch and my correction will be made. We'll see.

I'm hoping that others will share their experiences and timeframes with having a correction made.

I suppose I'll just pray for more patience.

K-1 Fiance(e) Visa Process & ProceduresDelay in receipt correction
Hi all,

I contacted the CSC the first week of March to have an error corrected on my NOA1. I was told the change will be corrected by 4/11/08. However, on April 11th, the correction had yet to be made. I contacted the CSC again and was told that the correction was assigned to an officer the same day that I had inititially called in the error and that the officer had until April 26th to make the correction.

Well I decided to call again 2 days later and was asked if I had received a notice in the mail of the receipt. I said no and asked if a correction was made. They could not say if the correction was made, but that they would enter another request for the correction. I was told that they have up to 45 days to respond.

I have seen approvals granted in a lesser timeframe than it is taking to just have an error corrected. An error that THEY made!! I'm afraid that if it's taking this long to make a correction, it's going to be that much longer to get an approval.

It will be 3 months next week since my NOA1 and I have yet to have one touch. I'm afraid that I will be one of those petitioners who after 6 months still doesn't have an approval.

I really want to nip this in the bud. Does anyone have any suggestions? Am I just being too impatient with this whole correction thing or is this truly indicative of how my petition will be processed? Has anyone else had to wait over 2 months just to have a correction made? Is anyone else out there currently going through the same thing?

I'm really beginning to lose hope and freak out!!

Ok have an odd question here and not sure if it should be in this section or not. I was previously married to a US citizen. In the past, approx a year ago or more, she said she would call immigration to prevent me entering the States again. Now i dont know if she has, will or not call them. She is a strange person to say the least and its the type of stunt she could do. I dont want any problems for when we file the K1. Will the USCIS take any action if she has called? Theres nothing she can say to them but all i know is that shes a manipulator and a liar. Sorry if this is off topic folks, just wanted some views on this one.

I too am not sure if she could create a problem for you, but like "psiprez" said, don't share your future plans with her. Since you two are no longer friends, I assume you haven't been speaking to her so she is unaware of your plans.

However, if there's a possibility of her creating a problem, I would be more concerned with her contacting the embassy than the USCIS. She might have an easier time convincing them. It's the embassy who wants to disprove your relationship.

Found this spreadsheet on the Homeland Security website with the stats:

http://www.dhs.gov/x...06/table26d.xls

It shows about 30,000 K1 visas issued in 2006. Also interesting to note is how the number of visas has increased over the years...from only 12,000 in 1998!

Excellent Meridien, that was exactly what I was looking for !
So to satisfy my curiousity I did this basic math. According to the the timeline statistics the last 360 days were 1532 K1 timelines and according to the spreadsheet from homeland security approx 30,000 K1 each year so if you do the math Approximately 5% of k1 applicants use this site, or at least post a timeline.

A bit lower than I would of figured. But of course there is likely a decent number that just lurk and never create an account or timeline.

Still it gives me an idea that when I see in some of the posts here how many applications are approved this month or how many are pending etc. I can just take that figure and take it times X 20 and extrapolate approximately the actual figure at the USCIS.

Many people on this site adjust from visas other than K-1 or K-3, successfully. This website focuses on all types of marriage-based immigration.

Yes I realize that, was just trying to counter that the numbers from the press release referred to all types of applications of which I think marriage based application are quite a low percentage.

USCIS Processing Times and Case Status
November 24th, 2007

From the USCIS:

Applications are processed in the order they are received by application type. The average processing times for all applications are posted on our website. Processing times are an estimate of how long it will take to complete your case. Each case is different; so some cases may take longer than others. You can use your receipt to check your case status on Case Status Online (See the “Related Links” section of this page). Please be advised that we will only research your case if it is beyond our posted processing times (You can also find a link to processing times in the Related Links section).

The processing times are for applications that have been just completed. If you have just filed your application, these timeframes may not reflect how long your application will take to be completed. We encourage you to check processing times before inquiring about your case. The processing times are updated monthly.

USCIS has received a significant increase in the number of applications filed. In July and August, nearly 2.5 million applications and petitions of all types were received. This compares to 1.2 million applications and petitions received in the same time period last year. This fiscal year, we received 1.4 million applications for naturalization; nearly double the volume we received the year before. The agency is working to improve processes and focus increased resources, including hiring approximately 1,500 new employees, to address this workload.

As a result, average processing times for certain application types may become longer. In particular, naturalization applications filed after June 1, 2007 may take approximately 16 - 18 months to process.

When your application is received by a USCIS Service Center or the National Benefits Center, we will mail you a receipt notice. The receipt notice will have all of the important information you need about your case. With your receipt number you can check the status of your case on our website and also register on our website for automatic case status updates as we process your case.

For more information about when and how to contact us, whether your case is outside our processing time, or if there are other issues, please see our customer guide Case Services - How Do I… know what kind of services are available to me after I file my application or petition? also available in the Related Links section of this page.

K-1 Fiance(e) Visa Process & ProceduresHow many K1 visa are processed each year?
I'm just curious does anyone have a source or know the figures or if they are reported anywhere how many K1 visas are processed each year?

Mainly curious because I was wondering what percentage of K1 visa applicants statistics are represented on this site.

I would think it is a decent percentage because I can't even comprehend anyone going through this process without researching on the net what all was needed and this seems to be the main site to get the information.

I just wonder how many people just send the paperwork on their own without getting the valuable insight and information that is contained here on VJ. I guess maybe many just hire an attorney.

Just as a note to everyone on this site, it is a fantastic resource and community. It is of great comfort to me going through this process reading all the stories and experiences of others in the same situation. I can not even imagine trying to go through this process alone or without this website! So Kudos to VJ and all it's members good.gif

K-1 Fiance(e) Visa Process & ProceduresPassport valid for 6 months policy?
I have some questions about passport expiration. My fiancee just realized that her passport expires at the end of November. Right now theres is a backlog in her country with the processing of passports because of the new chip they are putting in the passports now. The agency told her it would be a minimum of 1 month to get the passport back.

The question I have where does the 6 month rule apply in regards to K1 visa? Is this 6 months from when they issue the visa or 6 months when she tries to enter the country at the POE?

Her interview is likely going to be mid May and the medical before that and she will need it by then. I know were cutting it close so I'm trying to get the exact policy somewhere.

Just get married before his visa expires. AOS can be filed whenever you want.

Thanks for the help and congratulations on the baby. I have a 7 month old myself.

Thank you for your help. I see the updated date now. It hasn't been touched since January 8th. This process is so overwhelming at times!

Just in case you were wondering...if you go to your controls and go to edit your signature you can put your timeline in that way so everytime you post it will show it. I think it all kind of keeps everyone going...just thought I would let you know in case you didn't. It took me awhile to figure out how to get around in here. My fiance is from the UK, too. Good luck with everything!!!

K-1 Fiance(e) Visa Process & ProceduresNOA1
I received our NOA1 ( I take it) on 2/19/08. Now I'm starting to question what that really means. I thought it was the first approval in the whole process now I'm starting to realize all that was is the receipt. It doesn't mean an approval at all. There was nothing special in it. I was looking for some kind of RFE (I've been hearing about), but I didn't see anything in there. If there is a problem, does it come seperately? Thanks for all your help...

P.S. What does AP and EAD mean?

K-1 Fiance(e) Visa Process & ProceduresVermont Filers
I'm starting to wish more and more that I lived in another state so I could have filed in Vermont!!! Why doesn't California share some of that backlog with Vermont and then California could be approving them within this century. good.gif

But don't get me wrong Vermont Filers...I am really, really happy for you because we have all put our blood, sweat, and tears into our other halfs and I wish you nothing, but the best of luck in your lives together!!!

K-1 Fiance(e) Visa Process & ProceduresA prayer for those still waiting.....
QUOTE (rupa @ Feb 24 2008, 02:51 PM) <{POST_SNAPBACK}>
Hi Folks,

it breaks my heart sometimes to read some of the stories and situations posted here on VJ. I myself am just starting the procss of waiting and have already begun experincing the emotions that can debilitate and sap your strength as we stumble through this process. I felt compelled to say that the love that we share with our SO's is something that is very precious and worthy to be upheld, nurtured and protected. Origionally I was going to post about how tough this week has been, but decided that instead I should offer up a prayer for those still waiting and those struggling in the process, who have had their love and patience tested.

Father, please hear my prayer.

You say to us Lord that the things that matter in this life are faith, hope and love and that the greatest of these is love. For each and every person who has started this proces of immigration because of the love they share with another, I ask you for your protection over their lives, their family and their relationship. Please grant them grace for the moments when their visa's are held up and the waiting becomes stressful. Father I pray for each couple who has hit a snag that you would watch over their communication, help them to deal with each other in understanding, being patient and encouraging even when it is a struggle to find the stength. Father I pray that their defered hope would not make their heart sick, but that you would grant them a special reprive, in some special way, a break from the stress and frustration of waiting. I ask that you would use this process for the good of their relationship and not for harm, and that you would intervene where the immigration process has treated them unfarely or where mistakes have been made. Pease father bring those people who are waiting too long for their loved ones together soon, bless and strengthen their love for each other and guard their hearts from despiar. Please make their homecommings a sweet sweet moment and watch over them as they build thier new lives together in America.

Amen

God bless you and I wish you the best in your journey!!!

We filed for our I-129F and we received our NOA1 already. Is it okay that during this process he come and visit? He won't be here but for just a week or so, but I wanted to make sure he could still come while we are waiting for California to get their act in gear. Thanks so much!!!

So, let me make sure I get this right...I only have to make $22,000 for a family of 3? Yes yes.gif
And that has to show on the last 3 years of my taxes? It depends on what the consulate asks from you, they may ask for only 1 year of tax returns smile.gif

Thanks SSSOOOOO Much!!! That makes me so happy!! Now I know...we will be okay as far as finances go. By the way, how do you get that count down thinga-majig on your screen?
