Africa: Sub-SaharanAnyone denied a tourist visa to Nigeria?

My husband applied for a Niger Wife Visa or Certificate ( I am not sure what the technical name is but another member posted a link above.) My husband was told that they need my passport to add a visa page into my passport that will never expire unless we divorce and he requests that they revoke it. Since he did not have my passport with him, they issued him a residence permit valid for 1 year until I come to Nigeria and get the visa page entered into my passport. The Residence permit is like a driver's license type of card with my picture on it and it shows my name, my passport #, says Niger Wife, and Residence permit. If your husband applies for this for you, I would caution you about mailing him your passport. I mailed my husband my passport (before I had changed my married name on my passport), and their immigration would not accept it because it did not have my married name on it yet, so he tried to mail it back to me and customs confiscated it and kept it and told him it is illegal to mail passports out of Nigeria. I gave them a copy of my new passport with my married name on it when I was there last, but they couldn't print the visa page to put into my passport before I had to return to the US, so they gave him the residence card after I left until I come back with my passport. I hope this clears up the confusion a bit, but honestly, my husband has been doing this and I am not all that clear on it myself.

After reviewing the CERPAC description, I do not think this is what my husband applied for. This looks like a green card allowing you to work and is valid for 2 years. The Niger wife Visa is valid until there is a divorce, and the husband request immigration revoke it. I think Nigerians must renew their passports every 10 years, so what I am not clear on is if I will have to have my Niger Wife Visa renewed every 10 years also like my husband's passport. I called the Nigerian embassy in Washington DC right after we married, and they told me there is no such thing as a Niger Wife Visa, but they gave me incorrect information. I think the best way for you to get accurate information is for your husband to go to his local immigration office and get the specifics. It is common knowledge in Nigeria so He may already know.

My husband and I filed for a Niger wife Visa and was approved, but they gave him a residence permit card which expires in a year until I am there with my passport so they can add the visa page into my passport.

NVC told me no 2 different times, however, like Winnie, I prefer to be safe rather than sorry, and will get a new one if I find myself in that position.

K-3 Spouse Visa Process & Proceduresamerican citizen with wife and kids in mexico
Hello my name is Bryan I have a wife and three kids in Mexico I do not know how similar my story is to others I hope it's rare! trying to keep it short as possible after finally getting married in 2/11/07 in Mexico after a two year battle. I hired who I could afford and who would accept a credit card for payment http://www.ezvisa.us/ god forgive my sole I ever meet him! Me and my wife submitted all information for k3 130/129f when he sent it back to us for us to sign we found 86 mistakes! I was outraged and shocked, I was also embarrassed when I a farmer had to write a letter which took me two days, to a professional white collar dude and notify him of his mistakes he made. I wrote out the questions, then wrote what he had put, followed by what we had originally sent, as we had saved copies of everything before we mailed it to him! Surprisingly he was mad and responded with a sharp tongued letter and denied everything. After I sent him my originals and asked him to compare what his office wanted us to sign versus what we had sent, and pointed out what I believed to be intentional mistakes, such as my three years w2's I had sent, that were about 53, 58 and 61thousand for 04, 05, 06, he had put something like 76, 91 and 217 thousand how could that be a mistake. Then he admitted their were mistakes, but can you believe it, I had to fix them all! When I resubmitted the forms, this time in pdf format he said that I had made changes that were unacceptable to usics but he would go ahead and mail them anyways. I asked for my money back as I had hired him to submit all my papers to the government properly and without error and that I, nor anyone needs someone to submit papers with error's he changed is tune apologized for his, and his business’s behavior!

[three times i asked for my money back, quoting his policy from his website. I never have got my money back but each time i get a immediate change in behavior and apologies the I-129 fiasco is unbelievable]

Next thing we know he calls us franticly saying that theirs going to be a rate increase at usics and he needs to mail the papers rite away and there’s no time to mail our papers again he suggested that I allow him to make all the needed changes and to let him forge our signatures and send them out rite away my wife now 6 - 7 month’s pregnant and fearfull of all the time it would take just to get back to the point of a lawer submitting my papers i agree! God know what he put on those papers!

Finally my I 130 was mailed in April or may and I received my NOA June 20 2007 the I 129 was a nightmare but received my NOA on December 17 2007. I received a RFE for my I 130 12/19/07 my wife was married and divorced I was told by this guy at ez visa that all translations need only be done by someone other than family and they need only submit a letter stating that they are competent to do a translation. This did not prove to be true my RFE was for a certified notarized translation of the Spanish divorce decree I sent this write away certified return receipt insured with confirmation and it took uscis 30 days to say they got it can you believe it.

also I was nervous about the RFE because it was contradictory it said “ all document submitted in Spanish must accompany a certified notarized translation yet they only asked for the divorce? There were other document such as a custody decree in Spanish I called them and asked if I should have other translation redone, they said no only send what we ask for? well in a round about way they asked for both! I sent the following along with RFE

Enclosed is, Notice of action and attached paper, an exact copy of the divorce decree, a certified, notarized translation of the divorce decree along with accomplishments of translator for creditability!

If any other information is needed I will overnight it! I hope you find the enclosed translation to be both Acceptable and Creditable as I spared no expense looking for the best translator I could find, and returned the requested information as quickly as possible! Since filling I have a third child, a brand new baby boy; almost seven months old and I am eagerly awaiting the opportunity to see him and my family every day, for the rest of my life!

Thank you Petitioner- JAMES BRYAN

I don’t know if it good to send a letter but I did. I now have many question and am growing impatient as my baby boy is now 8 month’s and I have only seen him twice! What’s next, I was kind of excited after reading a little that after you receive a RFE often people say you can look forward to be reunited with your family in around thirty days. But what’s this talk of interviews, finger prints, biometrics, adam walsh how long dose this ####### take? What interviews? Where are they? Here, Mexico, both? I want to go see my wife but I don’t have much money, and I was afraid I would be approved and I would need the money to bring her here. But if she’s going to be interviewed that’s another trip to Mexico I’m not letting her go to some border town alone. So can someone explain to me where I am at rite now what should be happing next, what is referring to when people have on there time line “touched”, also on my time line it says;
“Based on timeline data, your I130 may be adjudicated as early as October 13, 2007*. “
If this date has passed by more than 10 days or your application is past due per USCIS processing times then you should consider calling the USCIS to inquire on your petition. If you have been approved please update your timeline.
Well were way past that so what dose that mean?
I have read of people entering the united states before I 130 approved?
when or if I get approved what’s next?
what if I am denied?

how do I get my wife here from Mexico I fly over we pack her bags grab the next flight to Chicago or do you have to got to the border or immigration other than the one at the airport?

I herd you can only leave by car is this true?

more question later thanks

Bryan,

I responded to your post like 3 days ago my friend.
Get a good immigration attorney. And please do not try to just 'bring your wife' over, since this would even more complicate your case.
Good luck in your journey.

K-3 Spouse Visa Process & ProceduresOn March 14, 2008, we mailed you a notice that we have approved this
If only the I-130 was approved then, you'll want to see the step by step guide for the CR1 visa. If both petitions were approved, see the step by step guide for the K3 visa. In either event, next stop is NVC.

K-3 Spouse Visa Process & Proceduresbring up deportation at interview? mexico
k3 visa approved last Friday for my wife and kids, I will have a interview in México for visa in 3 or 4 months I guess. While doing some reading on visa jourey.com, I see that they ask at the interview have you ever been in the united states and or deported! Yikes I guess I figured that I would have had to deal with this in the visa application process, but after providing the additional information they wanted {unrelated], and waiting over a year and now approved! I thought all the problems where behind me! Now I'm debating playing poker or not, reading and talking to lawyers well help me determine if I play or forfeit. My wife as two deportations, I think first was removed with 5 year ban, second was removed with 20 year ban. I do recall, I think, having one lawyer looking her up once with her last deport order , and it did come up. We do not know why USA insisted 'Norma' as her name? There is no association of Norma with my wife or her family but she stayed three extra days in jail arguing that Norma was not part of her name! Her name is ---------------, but after 11 days in jail she agreed with what ever they said just to get out of jail! We do not know how her name is written on 1996 order. But as she recalls, the finger print alone brought her name up right away for the 96 violation which was a 5 year bar from entering. Her reason for entering is one where any one in the world would have done the same thing, and people would only speak of her with words of valor and honor, commendable, but who's ears will it fall upon? [ gamble ] and the billons of stories they must of herd all ready. So will they ask, will they know, am I premature, will we not even be allowed a interview if they discover this? wWll they discover and allow the interview? Do I file for a I-212 now and risk exposing something that may not have ever been brought up? From what I have read if denied a visa at the interview and you file a I-212 its at least a year or more. My boy is 8 months old all ready and I have only seen him three times I cant take much more waiting, advice?

Well I would like to make a one stop forum for all who are faced with the dilemma of filling a K3 [I-129/ I-130] and the I-130 is approved first maybe we can create a new forum.
"I-130 approved first phenomenon"

There is allot actually a whole lot of discussion about this topic! Allot of concerns and confusion, maybe allot of myths, misconceptions, half-truths maybe urban legends. Hopefully this can be the place where we can dispel the rumors and gossip. We can ask question or just see if your question as already been answered

also I would like to note that there seems to be a lot of discussion about, as well as decisions made, based on the fact if spouse will be able to "work"- have green card or S.O.S card the day they enter! Often this sets the course of a discussion in a post or forum! For me this is not important and I suspect for many others as well, I do not plan on my wife ever working, so I only want my questions answered on the basis of what is the fastest way to get her here.
I guess people will need to specify what there priority's are, "fastest here able to work", or just "fastest here"!

Friday march 15 2008 I received a email stating On March 14, 2008, we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCÉ(E), OR ORPHAN. Please follow any instructions on the notice. If you move before you receive the notice, call customer service.

Humm I thought, now what, now where do I stand, now what do I do? So I logged in to visa journey .com and started reading, and to quote one member ""the more I read the more confused I became"" this certainly seems to be the case for me as well!

I was directed to read the following
http://www.uscis.gov/files/pressrelease/PN_i-129f.pdf
http://www.visajourn...h...=116038&hl=

which led me to read
http://www.visajourney.com/faq/k3k4visa-outline.html

there it says Note about the I-130 approval - In some cases the I-130 may be approved prior to the K-3 being processed. There are certain advantages if this happens such as receiving an Immigrant Visa instead of a K3. Please read the IR1/CR1 Guide if your I-130 is approved during the K3 Process to find out what you can do.well I read for eleven hours and there is no talk of any advantages as a matter of fact that is all that is ever said.

Evan more confusing it tells you to Please read the IR1/CR1 Guide well when you go there it says

Note to K3 Applicants: This process also applies to K3 Visa applicants whom have had their I-130 approved prior to their I-129f. In this case you may chose to persue the I-130 path as opposed the the K3. This will allow the immigrating relative to enter as a permanent resident as opposed to having to file for adjustment once here. If the I-129f is later approved and forwarded to the embassy then you can write them to request the approved I-130 be acted on and the K-3 process abandoned.

then it says you may Download the Following Forms:
1. I-130
2. G-325a
The above forms can be filled out on your computer and mailed? am I missing something here I filed these almost a year ago yesterday they were approved now I'm being asked to file a I 130 again IM LOST!

now reading on some people say that once a I-130 is approved first it automaticaly sets a chain of events in to place depending who you talk to

Hi all,
I have a question My i-130 is already approved but I am still waiting for i-129f to get approve. I called USCIS one rep said that once i-130 is approved they do not continue with i-129f. I called again next day, rep lady said you have to wait for i-129f to get approve. I am kind of confused which rep is right.

member replied:

The first one has it backwards. The second one is essentially correct. There is nothing you can do to speed up your I-129F but the I-130 will continue as long as you respond to requests from NVC or use the NVC Shortcuts.

Since your two petitions didn't get approved together, you have two horses in the race. You can keep them both running or abandon the I-130 and wait for the I-129F to pursue the K3 visa.
so at the juncture there are many contradictions
a) In some cases the I-130 may be approved prior to the K-3 being processed. There are certain advantages if this happens such as receiving an Immigrant Visa instead of a K3

cool.gif rep lady said you have to wait for i-129f to get approved "The second one is essentially correct"

which is corect there are advantages, or you must wait for I 129 f, or I 129f will never come now?

also Spousal Visa (IR-1 / CR-1 I think dose not apply for Mexico you can not do to counselor direct visa in Mexico

on James short cuts

http://www.visajourney.com/wiki/index.php/Jame%27s_Shortcut

The big question for everyone in my shoes what's faster wait for I 129 k3 if Evan possible { and is it? } or run with I 130

No, it's not normal but it does happen. I think some of the new employees aren't aware of the Nov. 2006 policy change to hold the I-130 and only forward the I-129F. On the other hand, maybe they've gone back to the old way and just not told us.

Which visa do you want?

Which visa do I want I would pay someone to figure that out! as you may know if you read some of my other post, excited as I was, as I figured that my wife would be here in a month or two per my k3 visa I always figured that I would fail the interview but it was the advice of all the people I'm about to mention that I go through the process once denied file 601 hardship and 97% of the time you win it was here only a week ago I learned on visa journey after a 3 year quest seeking help from consulates, senators, governors, immigration lawyers and embassies that my wife will not be able to come here at all! I will not be eligible to apply for the 601! my baby boy now 10 month's will have no father unless I move there and I will not be able to return here to my country ever unless I choose for him to be fatherless at some point in time! where I would need to come home and earn a income for a year or two to meet the poverty line, as living there I would have no income here, I guess, unless some how I got a job at an American company over there which is highly unlikely as I am not a top ceo here, no one here would want to send me there lol, they have plenty of labor there already. since my wife as two deportations and will not legally be able to apply until 2013 I'm told that said dose one of these visas the 130 or the k3 provide a greater chance for a loop hole or a greater chance for a one in million long shot of going through the system and getting passed I will appreciate help in determining the answer to this thank you Bryan

is there any shortcuts for the k3 visa

shortcuts like James's shortcut are not for k3 or k4, so just wondering if there are any thanks

also I was wondering dose matter who sends the ds-3032 example if i mail it or email it will bare my address obviously so they would no or think if they paid attention that she never saw it or signed it

she's hounding me about the email she doesn't believe I guess that it should take a week or two for a response and before I have her load up the kids for a hour commute to the fed ex office to mail the form over night the old fashion way to set her mind a ease I thought id ask the people her

married in Mexico took 6 trips it was very frustrating I have three children and a wife in Mexico. wife 30, daughter 13, sons 10 and 10 months. Two sons are citizens when my last boy was born before he was 3 weeks old, I had is S.O.S card u.s.a and Mexican passport and birth abroad certificate it was easy all though you have to be firm! First line of offense in the American embassy in Mexico is to considerer all you say to be a lie, and worse read on ! When my wife spoke they distrusted everything she said, they conveyed this with body language and verbally, they said the papers needed were not present and they implied that her request could not be met. When I became irritated and offended by the gross discrimination as I speak both English and Spanish. I intervened and low and behold none of the additional steps where needed when I said in English to the council when you spoke in Spanish to my wife you told my wife she needed to acquire papers and complete some more steps but every thing you wanted, everything you asked for, every requirement is in your hands, she became very red in the face she remarked to my wife in Spanish "he speaks Spanish"? very irritated she remarked yes! Then she acted like she flipped through the papers but she never even looked at them she stared at her desk I watched her eyes, she said oh yes they are here and rushed us out of the office! We had everything in two weeks with out me my wife never ever would of got the things she and I where legally entitled too it was a very embarrassing day to be labeled a united statesmen
I did all my papers in San Miguel Allende in Guanajuato Mexico

National Visa Center (Dept of State)Packet 3 E-Mail Submission?
Here is what I have so far...even cutting it down I'm not sure it would be small enough to send:
Cover Letter
Packet 3 Checklist (bc it says to check the boxes and return)
DS-2001
Applicant's Statement sheet
2 copies of DS-156
1 copy of DS-156K
1 copy of DS-230 Part 1 & 2 (I think I can remove the Part 2)
And I-134 Affadavit of Support

If I take out the I-134, Packet 3 Checklist, and DS-230 Part 2, I still have 10 pages because the DS-156 is 2 pages. Do you think I would only need 2 copies at interview and not right now?

In the packet on the consulate's website it says Applicant Statement, DS-156, and DS-230 Part 1. If I sent just that and only 1 copy of each that would be 5 pages which would probably be small enough to e-mail.

Thoughts?

National Visa Center (Dept of State)Packet 3 E-Mail Submission?
Hi All-
My fiance and I have completed the Packet 3 documents and scanned them as PDF documents. Both his e-mail and my e-mail account were both able to receive the attachment and documents but they are like 15MB (18 pages). Any suggestions on how to submit the paperwork to the VFS for Mumbai consulate as the e-mail we sent was returned back to us undeliverable and I've read and been told they only accept submission via e-mail?

Thanks!

Hello,

I filed my I130 in early June and I129F in late July (CSC). I am still waiting for NOA2. I talked to USCIS (CSC) and they stated currently working on June 18,2007- I130 and July 15,2007-I129F. She told me that she cannot request anything for another 3 weeks. Although my petition is 210+ days. I am in the same boat as you and I filed 30 days prior to you. Good luck in your process...I hope the worst part of the wait is behind us. smile.gif

K-3 Spouse Visa Process & ProceduresWhat is your favorite USCIS customer service excuse ?
This one is funny! A friend of mine filed a month after me...SO from same country...she was approved 1 month before me! So I called and asked how this could happen if they really process in order received. The lady told me "You need to be more patient...obviously the person who completed your friends paperwork works faster than the individual who has your case assigned to them!"

I wanted to reach through the phone and slap her!

I am so happy! Both of my petitions were approved yesterday at the CSC!

Congratulations!

My wife is Syrian and I wonder if our approval time will be similar to yours. How often was your case "touched" or updated throughout your wait? I received my NOA1 for the 129 almost three months ago and haven't seen any "touches" since then. Did that happen to you also?

Phil

It took 7 months for our approval. Was your petition forwarded to Cali? Your timeline shows received in Nebraska which is where I originally sent my I130. They forwarded it to CSC and matched it with my I129F and approved them together.

K-3 Spouse Visa Process & ProceduresI12F sent to US Embassy in Amman
I sent an email to Amman asking why the I130 which was approved the same day as the I129F did not get forwarded to NVC and then to Amman. I wanted to know if I needed to request it to be forwarded. This is the response back:

Dear Rhonda:
Although both petitions are to bring a spouse to the United States, The NVC always treats the I-129F as an expedite case.
They will forward the I-130 after that. This will not delay process, since we will process the one we received first unless the beneficiary asked to use the I-130 instead.
Thank you

Hey everyone. I filed my I129F in late July also. Both of my petitions were approved together on Jan 9th, 2008. I received a letter from NVC yesterday stating my husband should receive his packet within the next 2 weeks.

Not sure why they are telling some of you that they are not doing the I129F. The letter from NVC was about the I129F not the I130.

My petitions went to California. Is that where most are going?

Hello again..

I've been searching here.. I must not know how to use this search thingy or putting in wrong key words..or just get tired of searching.. So other than this post, I sent out PMs.

My question is regarding Question 10 on I-134.

QUOTE
10. I have submitted a visa petition(s) to U.S. Citizenship and Immigration Services (USCIS) on behalf of the following person(s). If none, state none.

On example form on VJ it refers to a K-1 visa (fiancee).
NAME- JANE JOAN DOALLY (filing now with I-129f petition)
RELATIONSHIP- FIANCEE
DATE- SUBMITTED01/15/2003

Anyone know what a K-3'r would put there?

Hope to hear ya soon.

Thanks- gwen

Gwen,

I just put my husbands name and then I130 and my husbands name again I129F with file dates and approval dates. I think they want to make sure you filed the necessary paperwork prior to filing the I134.
