I am wondering if anyone else has thought of purchasing two RT tickets from the US to the country of there spouse and using the last half of the ticket? (ex. to RT tickets from the USA to Thailand and back and only using the return portion of the one ticket for my wife)

Are you saying that you will buy 2 RT tickets from the US and then you will use yours to fly to your wife and bring her the other ticket and then she will use just the return portion of the RT that was not used in the US?

If that's what you're saying, I don't believe that's possible. I believe that the first leg of the trip has to be used in order to activate the 2nd leg. You can call the airlines and ask, but I'm pretty sure that's how it works or that is one huge flaw in their system. That would mean travelers would be able to circumvent the one-way ticket.

Call and be sure this is possible.

Check your case status online by logging in. If the date in the "Last Updated" box has changed, your case has been touched.

You can definitely be approved with absolutely no touches. I was approved and the only touch i received was for a name change in our petition. So don't be concerned if you are not getting touches. It might be a good thing. Think of those who have been touched and then months later, still no approval. I wouldn't want to go through that.

Compare timelines: K-3 was originally developed at a time when the Immigrant CR-1/IR-1 was taking a very long time, this is just not the case any more, NVC has streamlined many processes.


Also keep in mind that the attorney will also charge for filing a different petition.

I am currently using an attorney and regret it everyday. An attorney is a third party that only delays the process. You will acquire all of the documents needed, fill them out, sign them, and return them to your attorney who will then send them to the USCIS. This usually isn't immediately. You could be delayed days, weeks or even a month. It's not worth it unless you or your wife has had immigration issues here in the states. If you haven't, then save your money and your mental health and prepare the documents on your own. There are many vj members here who are more than willing to answer any of your questions if you have doubt.

What you need to consider is that this process is 10% paperwork and 90% waiting. Once the paperwork is mailed by the attorney, you'll be lucky if they inform you that it's been sent. Then the waiting begins and daily you will grow more and more impatient and anxious to receive your NOA1 (receipt that the USCIS received your petition). You will contact the attorney and all they will tell you is to wait. You will begin questioning whether the attorney sent the documents in the first place. You will become stressed and then once you receive the NOA1, your stress subsides momentarily and the stress will begin all over again until you receive the NOA2 (approval of your petition). However, once your attorney receives the receipt that your petition has been received by the USCIS, you will be told to not contact them for at least 3 or 4 months. In the meantime, you're impatience is growing two-fold and you're going to be checking the USCIS website many times per day in hopes that your petition is approved. You will see others being approved and you'll wonder if yours is ever going to be approved. You will see petitions approved that were received after yours and it's going to add to your stress and frustration. You're going to think that perhaps your petition has been lost. You'll contact the attorney and they'll say "wait". By this time, you'll regret hiring the attorney. Hopefully it's just the waiting that is killing you and not mistakes your attorney made such as mine did.

Our interview is on Tuesday the 19th and my fiance has not received the interview documents that the attorney sent to him two weeks ago. If I hadn't prepared the documents myself months ago, he would have to postpone his interview which would be scheduled another 2-3 months out. I've sent emails to my attorney asking for a tracking number of the documents and no one has replied...his interview is in two days and no one has replied. They were also supposed to call him Friday to discuss the interview with him and offer legal advice. They did not do this either.

This is just a part of my story. There are many others with negative stories regarding their attorneys, but also those with positive stories. You truly have to choose for yourself. My advice is as stated above. If you do not have previous immigration issues, then do this process yourself. It's as easy as collecting the information from your wife and well as your own information, filling out the docs, printing, signing, creating a cover sheet, organizing and sending the documents. Don't include a third party who increases the waiting time. Trust me, you may not see it now, but you will want to be in full control of this process. Having an attorney does not give you control.

Does anyone have any advice at this? Can I report him? Can he give me a hard time to give me my paperwork back? Is that legal?

So anyone please help me and tell me the best route to go for his next steps when he gets here!

I'm not familiar with the K-3 process, but for us, the only paperwork we needed after my fiance arrived here was the NOA2. When my attorney received the NOA2, I had her email me a copy of it for my records because I knew it was necessary for AOS. However, if you do not have a copy of it, then your attorney might not send you the NOA2 without paying the rest of his fees. If you owe him $800, it would be cheaper for you to just pay the $340 fee to get a new copy of the receipt from USCIS (form I-824). There we no other documents that I needed from my attorney for AOS. Check to see what is required for you.

Many of us here at VJ have hired attorneys and regretted it. When a newbie solicits advice for attorneys, those of us who have had terrible experiences try to inform them that they would be happier doing this process themselves if their case is straightforward. There's enough stress with this process without having to worry about if a third party (attorney) is giving their best effort to return docs in a timely fashion as well as keeping you updated throughout the process. You only end up in the end wishing you had did it yourself.

no one can tell you there will be no problems, those that do are simply doing so to make you feel better. anthing can happen at this stage, I told my now wife while in the interview to answer only the questions asked and to not volunteer or ramble on anwering any question. short precise anwer to each question and answer the question only.

as for the paper work sounds like your confident, thats all that matters. search posts about NBI seems that i recall if certain wording were incorrect that it might cause a problem or delay. maybe someone can remember.

it's like the saying goes, "pay a little now, or a lot later." waiting 6-8 months now sucks, but being barred from the country for 10 years or more would be devastating. the B2 visa is for tourism - traveling on a B2 visa with the intent to marry COULD be considered fraud, and you might find that out the hard way when you file for the AOS. and remember, even though your intentions are legal, USCIS issues visas at THEIR discretion. for this reason, people on this thread are advising you to play by their rules.

maybe you can travel here on the B2, file the I-129F while you're here, and then return home to complete the process. that way you can spend part of the time waiting together. you might want to get some other opinions before trying this, though.

8 weeks on AR,i cant explain how happy i am after many days of

HELLO EVERYBODY!
Ive already done my interview last feb.9,and
it was so bad coz they put me in AR because my NSO birth certificate
is blurd and the consul only saw the date of preparation of the certificate
was NOV.1979,
He questioned me why it is 1979 since i was born March 1980, Because
the NSO BC is not clear he didnt saw the date of registration MAY 1980.
He ask additional documents 1.Local Civil registrar BC 2. grade school records
3. old ID's.

I didnt expect that the reason for my delay is my birth certificate since I didnt have
a problem with it in the past.I was so depressed for how many days after my interview.

Last Feb.14 i went there and pass the additional documents and my fiance called up DOS today
and the lady was so nice and she said that it was in the consular office already FEB.15(phil.time)
I hope they can review it soon and contack me if they still need more documents.

I hope everything will be ok,not only for me but also to those who were in AR club.

It is great! He's going to a brand new mosque in Indy tomorrow for the 1st time. The people we have been talking to there are awesome. He is acting like a kid on the first day of school! It's so wonderful to see him so happy.

We will definately make plans to get together. Ask Esmat if Jaser gave him his yahoo id when they met in Irbid. He gets bored during the day when I am working so he would love to chat with him.

Jaser flew into Chicago Friday night May 30th. Poor guy experienced Indiana weather in the worst way! Tornados were hitting all over the state and his flight to indy was delayed 8 hrs after his 13 hr flight. It was a long wait but all is good.

It's been fun watching his reaction to American life. We have went to a high school graduation, graduation party, my 2 yr old nieces b-day party, several cook outs and my family gave us a wedding reception. It's been a busy week!

I am just thankful he is finally here!!

I just received my letter from NVC stating that they have processed my I129F and the embassy in Jordan will receive the package within a week! It was dated Junuary 24, 2008.

I didn't get the DS230 or anything requesting Affadavit for Support. Is that normal?

I haven't heard anything either!! crying.gif My I130 was received in Nebraska 6-6-07 and forwarded to California 6-15-07. My I129F was received in Chicago 7-28-07 and forwarded to California 8-9-07. Which date do I assume they go by? I called USCIS yesterday and was told they would do a request for the I130 since it was past 6 months- when transferred to the center I was told they would NOT do it! She claimed it had to be 30 days past the 6 month time period. The lady was rude and kept stating "You need to be patient!" I wanted to scream! lol

Our RFE was simple.... I had sent the settlement agreement from my first marriage, not the divorce decree they actually needed. It was a quick fix.

Does anyone know if I can call USCIS to find out exactly what they are wanting? I'd like to use this weekend to prepare what is needed, and hate to wait until receiving the RFE in the mail.

Is there a fee for the Visa Center processing the Visa? If so, how much is it? Also, I know that I will need to send a I-134 (Affidavit of Support) to my fiance , can I send that with the letter from my employer and bank now? My petition for I-129f was accepted on September 1st but hasnt arrived at the visa center yet. I want to be as proactive as possible.

My lawyer doesn't explain things to me, his secretary always tells me that she has talked to my husband and he knows everything that he is supposed to do, so i am way out of loop with the whole thing. His 1st appointment was May 14th and he was denied because he entered the U.S. illegally. His 2nd interview was June 7th and they asked for more information. I submitted more information and he had his 3rd appointment February 25th and was issued his visa March 2nd...he recieved his visa June 13th but it was expired. So he recently went to Ciudad Juarez on July 19th and they told him that he would get his visa this week and then our lawyer said he has to make another appointment...but as i read on here there is packets...what are they??? I'm so out of the loop on everything. And when i ask the lawyer he doesn't explain them very well...so can someone please help!?!?!


i would tell your lawyer if they do not fill you in that you will get another lawyer . that shoud do it and get them to tell you everything. they hate to loose business.

I posted an update earlier, but I don't know where it went. Anyway, with our situation we had to file an I-601 waiver. This was done in May 2010. I haven't seen anyone talk about this type of waiver along with their experiences so if anyone would like to share I'm all ears! :thumbs:

Ok, so I haven't heard anything about the status of my husband's case for quite a long time. Actually we hadn't heard anything since his interviews at the US embassy in El Salvador last May (2010). I tried to be patient, but then called and asked our lawyer. She said she called the embassy and was told his case had been transferred in June of 2010 to the Dept of Homeland Security. What?! What does this mean? Has anyone else heard of this. Please help!

Yes, you cannot go by the USCIS process times! This website has been right on target!!! We Filed in December I 130 & I 129 and were approved May 6th! The USCIS website is showing 10/07!!???? Crazy!! Now we wait for the NVC? Any comments on processing time for them to get it to our Embassy in Trinidad???
