And all I know is, subjectivity or no subjectivity, I am following instructions and bringing what I was told to bring. And my fiancee has stated over and over again that she is not giving me her birth certificate.


You will most likely be fine without it - people just want you to be aware that you could be asked to show originals of any documents, including the petitioner's birth certificate. Probably very unlikely (it varies from consulate to consulate how much they want to see at the interview, in any case), but... just be aware of the possibility. Before I had my interview I was asking questions to find out if I'd really need a copy of my then-fiance's marriage certificate from his previous marriage (he is the USC) - he was of the opinion that that was a ridiculous requirement (given that we'd already sent in his divorce decree with the I-129F), he didn't have a copy of it and wasn't about to apply for one. In the end, I was barely asked for anything at interview, let alone that. But... when I originally asked the question, I was a bit worried when a couple of people confirmed that yes, they had been asked for the petitioner's previous marriage certificate at interview. If I remember right, those people had been interviewed in Montreal... I know it's not the same thing, but it sounds like Montreal aren't above making seemingly pointless requests of K-1 applicants at interview, just be aware of that!

Also... I would second what Yodrak says. There's no point having the attitude that any requirement in this process is ridiculous/pointless/whatever, because at the end of the day if the CO asks you for something, you have no option but to smile sweetly (or not) and give them what they ask for - they couldn't care less about you, me, or any other foreign beneficiary, they're not there to do us any favours, they're not doing us a service, they are allowing USCs the PRIVILEGE (not right) of applying to bring their foreign fiance(e)s/spouses to the US. Our opinions on the efficiency or otherwise of the whole process are less than irrelevant!

Oh... good luck, by the way. And really, you should be fine without your fiancee's birth certificate - I really don't think it's something people are asked for on a regular basis! Don't let the infuriating-but-accurate standard VJ response of 'they have the right to ask for anything they like' worry you overmuch... just be aware that the reason people say this is because it's true! :)

I do think we have the right to be annoyed with things though. If you bring everything you're told to bring to your interview and they pull a fast one on you, you should be angry even if you don't show it. You're paying for the whole process after all.

There is a great deal of subjectivity and flexibility in the visa process. This can work for or against the applicant, and the applicant can take advantage of the subjectivity or they can fight it. But the bottom line is that it exists.

You have been advised, take the advice or leave it as you see fit. My final bit of advice is that if you show the antagonistic attitude with the interviewer that you have been showing here on VJ you risk doing yourself more harm than good. The visa officer has the authority to approve your visa or to deny it with the concurrance of their superior. Recognize that fact of life and conduct yourself accordingly for best result.

Packet will not mention a "spot check" but what people here are telling you is that you may be asked for something that is not listed in Packet 3. It happens. Read the forums. The consulate officer has a job to do and may require additional information to finish his/her job in a manner compatible with U.S. national security. Remember, we're in a post-9/11 world.

The K1 FAQ here is based upon past experiences. It's not for nothing. I would think that the majority of the time, you only need what's listed in packet 3/4. However, as people here are saying, don't be surprised if you're asked for more.

I am not saying that "spot checks" have not occured or could not possibly occur but let's realize one thing, it is not the job of the consulate officer to re-adjudicate a petition. I have read many threads and have little or no recollection of a situation where these origianl documents have been requested by the interviewer.

I would think these officers are reasonable people. If you follow the instructions and your case is straight forward, you have no worries. I have no idea what happens if they want something you don't have, but don't stress over it.

And I think this whole process is rather ridiculous :) Or at least, the delays are.

Photocopies of documents may be submitted with the understanding that a USCIS or consular officer can ask to see the original at any time. Interviews are a convenient time to spot-check. Chances are that something will be asked for, it may or may not be the petitioner's birth certificate (or other evidence of citizenship).

I think you need to prove to the consular officer that the petitioner is allowed to petition (i.e., s/he is a US legal permanent resident or citizen). You can prove this with a copy of birth certificate, naturalization/citizenship form, or full copy of US Passport. I am going to do the latter.

The instructions that you get from the consulate will tell you all the documents that you are required to have available or in your possession at the interview. If they require it they will indicate it on the list, it is as simple as that.

My fiancee didn't have mine. The job of the USCIS is to validate the petitioner, while the consulate has to validate the recipient. On looking at our copy of the packet 3 checklist, it doesn't call for the petitioner's documents - neither original nor copy.

I had Jerry's with me, as well as a photocopy of it. I think I gave them the photocopy, and was not specifically asked to produce the original for inspection, if I remember correctly. Just my experience.


Ok thanks. It's nice to know they didn't ask you for the original. I have a copy. She is not about to send me her original in the mail and I don't blame her. I have no reason to have her original birth certificate. It is hers. The Consulate is going to have to be satisfied with a copy. They will be able to find out it's a valid copy of a U.S. citizen's b/c with very little effort.

I see several questions regarding income statements for the I-134. Some of these may pertain to my case. Anyone have quick answers?

1) What's the difference between I-134 and the I-864? (other than length?) :help:

2) I recall that if a sponsor lacked earnings at 125% of the poverty level, liquid assets of five times the shortfall could be used to cover the discrepancy. I can't find this in the documentation. Does anyone know where it is?

3) Can IRA/401k assets cover this earnings shortfall?

4) Suppose I don't want my beneficiary to have a summary of my earnings and assets. Is there a way to send them directly to the embassy in Kiev?

I-134 is not legally binding the I-864 is. Yes 401K is an asset, Yes you can send directly in some cases , China you can. However during course of interview there may be questions asked so fiancee may need to reply in a correct manner. One question if you desire to marry this person why keep them in the dark as far as money issues are concerned.Trust is needed in a marriage.

Vaccinations are NOT required for a K-1. They ARE required for AOS. Most people just get them done at the K-1 exam because it is typically less expensive than waiting to get them here.

If she can't prove what innoculations she is supposed to have according to the requirements, be prepared that she will most likely receive them again. She needs documentation proof. That is the point of the medical exam, to make certain she is fully immunized and passes to be issued her visa before entering the US. I don't have the list of immunization shots on hand the embassy requires. I know my fiancee has it. I will ask her for a copy of them and let you know if you don't receive a list if anyone hasn't mentioned it here after I receive them.

Do I need an I-864? All instructions I've seen say it is not needed, and even state DO NOT submit an I-864. Note that K1s for fiancees are fiancee visas, not immigrant visas.

Here are two examples.

They already know/have your SSN. It's perfectly fine to black out the account numbers in black marker and I would highly recommend it.

Once the case is in the system, call them and inform them of the mistake. They will create a service request in their system to correct the mistake. This could take a short time to correct or it could take months as my correction took 2 months. Just be sure to call in the correction as soon as they have your case in their system.

I think you're asking of if it's wise to file an I-129F for spouse, two months after the I-130 is submitted. The answer depends on how well you've matched your priorities to the appropriate visa category.


Yes, you are correct with your terminology. However, most VJ'ers do not distinguish between the "applying" for as opposed to the "filing" in order for the beneficiary to apply. They understand the jist of it and that's ok with me.

Also, I understand the difference between the I-130 and the I-129F, my concern is whether or not filing the I-129F will delay the approval of the I-130. For example, if the I-130 were to be approved in August, would receiving the I-129F delay that approval due to combining the two petitions?

I'm asking because I've been told by a friend that it's best not to file the I-129F this late in the process because there's a good chance that it will delay the approval.

Can someone tell me if it is a wise decision to apply for the K-3 visa two months after the I-130 was submitted? Will this delay the process or will one be approved regardless of the other?

It will be filed at the CSC.

Are you saying that you will buy 2 RT tickets from the US and then you will use yours to fly to your wife and bring her the other ticket and then she will use just the return portion of the RT that was not used in the US?

If that's what you're saying, I don't believe that's possible. I believe that the first leg of the trip has to be used in order to activate the 2nd leg. You can call the airlines and ask, but I'm pretty sure that's how it works or that is one huge flaw in their system. That would mean travelers would be able to circumvent the one-way ticket.

Call and be sure this is possible.
