I must agree. Hiring an attorney was the worst mistake I made. I wish there were a way to inform all of those considering hiring a lawyer that it is very unnecessary and more than likely will cause more stress than had they just tried to figure it out on their own. Unfortunately, there are those of us who are unaware of the k-1 or k-3 visa process and websites like vj and this leads to fear and intimidation. The attorneys also play their role of adding to this fear and intimidation. They make you feel as though you can not do it without an attorney. Then once they have your money, customer service becomes non-existent. You'd be lucky to get a return phone call in a timely fashion.

Anyhow, I hope your experience will be much more pleasant than mine has been. When this process is over, I will be sure to warn future filers of this attorney.

My attorney informed me that a bankruptcy would have no effect on the K-1 process, but not being above the poverty guideline will, as you already know. Your friend with the 80K+ job meets the poverty guidelines however I do not believe the unemployed friend would meet the requirements.

The co-sponser gives the government assurance that your fiance will not become a public charge once here in the states. The Affadavit of Support reads that it is valid for 3 years, but my attorney informed me that once the AOS gets filed and if I am able to submit my own affadavit of support then that will void out the original affadavit. I'm not sure if this is correct or not.

As far as the K-1 process, your friend would have to submit copies of last year's tax documents, a letter from his company stating hire date, salary and whether his position is temporary or permanent. He would need to fill out the Affadavit of Support form and have it notarized. I am having my sponsor submit a copy of his birth certificate as proof of his citizenship.

I have no advice for your 2nd question becaues I'm not sure. Sorry.

Yes, I have the same problem with my attorney. They will not respond in a timely manner and just refuse to return phone calls. I'll get a response to an email weeks after I've sent it. I no longer call them. I've also learned more about this process due to them not responding to me so I had to research everything on my own. I paid $1900 for nothing.

People enter this website frequently asking if an attorney is a good idea. Most reply with "NO" and that they're only necessary if you anticipate legal problems. However, they make the decision to hire the attorney anyway and then find themselves in the same shoes as those people who warned them not to hire one. However, this is not always the case, but I've seen it too many times. I am not implying that this is your story.

I will say that once you're approved, you no longer need the attorney. You can get all the information ready for the interview and send it to your fiance. Be sure to have the attorney email you a copy of both the NOA1 and the NOA2.

Please fill in your timeline so that we can better help you.

Since you mentioned fiance, the petitioner probably received an approval letter from USCIS and not the NVC. I assume you will be applying for a K-1 visa. Forms can be downloaded from this website under "Downloads". But please fill in your timeline and which country you're from.

You havent had your interview yet, so why will there be any problem? You will give the ds 156 to the prescreener during your interview.
Make the necessary corrections online and then print it. Am I getting it wrong?


My attorney's assistant actually filled out the DS-156. I asked if it's possible to correct it, but she said she wasn't aware of a way to correct it and only said to use "white out" and write in the correct number. Since you've already been through the K-1 process and completed the DS-156, do you know if it's possible to correct it and reprint it?

My fiance's interview is next Tuesday (Aug 19, 2008). Today is the 14th and he still has not received the packet of documents for his interview sent by our attorney. I contacted the attorney's assistant on the 4th of August informing her that the packet needs to arrive by the 11th because my fiance was heading to Rio and staying until the interview is completed. She assured me she was mailing it out that same day (Aug 4th). When she told me she was using DHL to send the documents, I told her that DHL doesn't go directly to my fiance's location. They have to use a secondary carrier once in Rio and this could take up to an additional 10 days. I told her FedEx delivers to his location in 2 days. Her response: We don't have an account with FedEx. #######???? Open one!!!

Well the 11th came and went and my fiance stayed an additional two days. He left for Rio this morning (14th) without the packet from the attorney and will have his medical in the morning.

I haven't trusted my attorney since the day he received my payment in full due to other issues with his office. Thank God I anticipated a problem and sent my fiance the documents well over a month ago.

Since the attorney completed the DS-156 online, I asked her on August 4th to email me the document. I printed it and FedEx'd it to my fiance on the 5th along with some other loose ends. He received it the morning of the 8th.

You need the I-134 for K-1 and the I-864 for AOS.

I'm not sure about the UK, but I called the embassy in Brazil and they said that the medical can be done at anytime as long as it's not older than a year. We waited until the last minute to have the medical done just in case we delay adjusting status once he's here. When you adjust status, you do not need a full medical if your medical for the K-1 is less than a year old.

I'm sure others here can respond to you about the UK. Good luck with your K-1.

This isn't specific knowledge of RDJ, but my general opinion about the Xrays. I think the x-ray is taken and read by the doctor in order to fill out your medical form. After that's done, there is no use for the x-ray again by the doctor or the US Embassy. So they could throw it away or offer it to you to take to America with you. The interviewer (or the POE official) aren't medically trained and would not look at your x-ray. I haven't studied AOS yet, but maybe that x-ray will still be valid to use somewhere in that process to keep you from doing another, so it would be a good thing for you to take to America. Or perhaps you could give it to your new doctor. Maybe if you would get an illness 2 years from now, looking at that old x-ray as a benchmark would help them assess your new illness.

Thanks everyone for your replies. I actually made a reservation at Formula 1 last week, but when he arrived Sunday, he discovered that they did not have telephones in the room. He walked around for a bit until he located Itajuba which is 2 minutes from the embassy. He's happy with this hotel which is R$95 on the weekends and R$120 during the week.

I needed him to have a telephone in the room in order to talk to him at night. We talk for hours and it would be impossible and uncomfortable to do this on a public phone, not to mention expensive.

Keep the certificates from guidance and counseling and CFO as well as the receipts (I suggest). You will need them when you go back to CFO office when you have your visa in hand. Then a sticker is stamped on your visa/passport.

Already had a visa
If you already had your visa, upon payment of Php400.00 and completion of the registration form your passport will be stamped right there and then.


Below is an excerpt from the CFO website.

A. Counseling Requirements for Filipino Spouses and Other Partners of Foreign Nationals
  • Two (2) valid identification cards (IDs) with photograph;
  • Duly completed guidance and counseling form;
  • If married, certified true copy and photocopy of marriage contract on security paper from the National Statistics Office (NSO), or Local Civil Registry Offices (LCRO); or original and photocopy of marriage contract duly authenticated by the Philippine Embassy/Consulate (if married abroad)
  • Other documents as may be required by the counselors; and
  • Payment of P250.00 counseling fee.
After receipt of the passport and visa, the Filipino spouses and other partners of foreign nationals will have to register with CFO prior to their departure. Registration is done either in CFO Manila or CFO Cebu, Monday to Friday, 8:00 a.m. to 5:00 p.m. An emigrant registration sticker is affixed to the emigrants passport as proof of registration.

B. Registration Requirements for Filipino Spouses and Other Partners of Foreign Nationals
  • Original Passport;
  • Original and photocopy of visa;
  • Original and photocopy of Immigrant Data Summary for US bound/Confirmation of Permanent Residence for Canada bound/Embassy Certification of Eligibility (for Spain bound C visa holders);
  • Original CFO guidance and counseling certificate;
  • Duly completed emigrant registration form; and
  • Payment of the authorized registration fee.

Cranky hope things will be alright with you and your fiancee. What can I say? I agree with some here. Talk to her heart to heart before you make another major decision. Listen to your heart and pray for guidance. Trust and honesty are two most important foundations in a relationship. Nobody is perfect and everybody deserves a second chance. If they are worthy to be given a second chance, that's it. It's a risk all of us has to take.

Marriage is knowing and accepting the person all they are, even their darkest secrets in life. Because all you have is each other. You are to love and protect each other, when life is at its worse. But how can you if you don't know each other truly well?

but as far as i know , the embassy has all the paperwork. has been cleared by uscis and nvc. were just waiting for embassy to contact us or let us schedule an interview date. on the embassy website, its says 2 days for processing. has been almost a month now. no letter, no email. when i call they say not eligable at this time to schedule. one other time they said case not complete. i have not read any other posts on this forum about this topic, so i guess its a rare occurance.

We had our I130 petition approved recently and is now at the NVC. When it's finally done at the NVC my husband will be having his interview and all that at the Tunis embassy. Has anyone gone through this process at the embassy in Tunis?If so what all documents do they ask for? Thanks

How long in advance can you start collecting packet 3 info? I'm thinking since I make above the poverty amount I do not need any bank account information...Is that correct? My job will not change so I would like to go ahead and get my letter and get it notarized, but I don't want to do it so far in advance that it's null and void. I have my 3 years tax return. Thanks so much!!!

What forms do I need to send with the I-134? I found out as long as I meet the support guidlines that I don't need to give them my banking information, but do I need to provide my tax documents as well? Also, do I need to have the I-134 notorized? Thanks so much, Danielle

I would just like to say that all of you are a wealth of knowledge that cannot be measured by the amount of thank you's I have...so thank you all for your help. I know I speak on behalf of many. So, to get down to business. lol I may have an issue and I wanted to hear what you guys thought. During the stressful course of this process and being away from each other me and my fiance took a 3 month break from all the mess. It seemed just too much at the time and he was having doubts about uprooting his life in Scotland and coming to America. We have since gotten back together and he figured out he didn't want to spend the rest of his life without me and I didn't want to be without him, as well. My question is...will this look bad at the interview? We did still talk some, but not as much as we did. So, he could still show phone records and such, but it would show a low amount of phone calls and e-mails. Also, I just sent him my info for packet 3 and I wanted to make sure I sent it all. I sent:

NOA2
The I-134 (support data)(Notorized)
Letter from my employer
Last 3 years copies of my taxes
Last 2 pay stubs
Letter of Intent for myself (he knows he has to do one for himself as well)

He is sending:

Filled out packet 3
Police Certificate
Letter of Intent
All of the info I sent him

I know this is long, but if I could get some of your input that would be great! Thanks again for all you guys and your support!!!

We are going through the U.S. Embassy in London so after my fiance sends in packet 3 what will happen? Will they set an appointment for the medical and the interview then? Does he have them on the same day? Thanks so much for your help, Danielle


P.S. I have moved since we started this process. I have my new address on the support forms, but do I need to change my address with USCIS?
