Im filling out the N-400 application for Naturlization. My husband and I can't agree on Part 9. Information about your children. I don't have any children to any one what soever. My husband however has two children to a previous marriage. Although I don't have any contact with the children of his, I feel they should be "step children" he says no they aren't. Can anyone help?

The other thing is I want to file on 3rd August, but I am away in the UK then, can I file then putting the 10th August as my return, or would they see it as not telling the truth as the 10th August(my return) wouldn't have arrived yet? Should I just leave it until the 10th so I can put on Part 7 countries visited?

thanks for you help in advance!

Hi Gemma,
Wow you are all well-prepared... alright here is my answers to your two questions:
1. Since you are currently legally married to your current husband, his children ARE yours too (even though they are your step-children and you don't have any contact with them). Remember your husband is the legal biological father of his children no matter what. You can just list the names of these children and explain that they are your step children.
2. I would rather wait until Aug 10th, when you are physically back in US land, to send your application. 7 days of difference will not make too much difference in rushing sending your N400 application. Being honest will serve you the best in the long run

Just my 2cents...

I agree with chitown. At first I wasn't sure if you had to list the stepchildren, but I looked at the instructions for the N-400 and it says to list all stepchildren.

Also, it would be best to just wait before sending it in. Chitown is right that a week wouldn't make difference.

what to do if I get a traffic ticket about a few days before the interview?

What should i do should i mention it even though before this i did not have a ticket for the last 4 years.

What should i do?

If i mention this should i bring the ticket to the interview?

Do you have the option to have the ticket not appear on your record? I'm not sure if it only applies to citizens, but I would think if you have a license then you should be able to do this if your state offers it. I received a ticket a month ago which cost $116. I paid $182 for their diversion program in which the ticket will not appear on my record if I stay ticket-free in the same county for the next 6 months. Might be worth checking into.

My current yearly income is above poverty level, but in 2008, 2009 and 2010 I was below. Due to my last 3 years income being below poverty level, will I need to have a co-sponsor to meet the income requirements even though in the current year of 2011 I meet the requirements?

i understand why the consul did what he did. what if your mother gets ' pissed ' again in the near future and kicks you and your hubby out of the house. then who would pay for all these services for your kids . not to mention support your hubby and yourself. im not sure if this is the exact thinking behind the consul verdict, but maybe . gl , yes agree you need to file cr1 , although im sure they will see the result of your failed k1

Sounds like you did not research this process enough before starting it. everyone feels for you, but no one is going to lie to you just to make you feel better. if you could just find another part time or full time job, and get a letter from that new job stating how much you make weekly. add that to your income you have already and you should be good to go.

or a co sponsor.

US Embassy and Consulate DiscussionU S Embassy Manila
yea , this is my favorite part. you call them and tell them you spoke to nvc, and that the embassy should have it. but your told your case is not complete.

I came to understand this is just a ploy to delay the process for some reason or another. i called the embassy over 20 times. the last time i called i told the guy that i already spent well over 100 dollars on there pin number calls.

finally , i just told the guy that i got a email from the embassy. he told me to read it to him.

then magically he scheduled our interview!

this part of the process is a pain, i dont know if there trying to make as much money as they can on the phone calls or if they delay you becuase of scheduling problems.

may be different now with the ecomony tanked and not as many apps.

Just a opinion at this point . but if he legally signed over all responsbility of the child, i would presume that he has no obligation, personally or money wise.

If i were you i would tell your fiancee to prepare for that child to be counted. the only way i could see that the child would not be his responsibility to some extent would be if your fiancee legally signed over his rights and the mother took full responsibility of the child, which may not even be possible, that would be for a court to decide im sure. in manila prepare for the worst, if it works out the easy way then great.

US Embassy and Consulate DiscussionNotorized? packet 3 help
well, i emailed the embassy in Jerusalem last tuesday, and they responded by sending me an email with an attached pdf document that appears to be packet 3. it's a list of instuctions with blank forms and a list of doctors, but the footing indicates that it was created in 8/91 (and it looks it, too). it even says to complete and return form OF-230, OF-156, and OF-156K. a quick check on google shows that those forms were superceded by the DS versions in 2001 - 8 YEARS AGO!! i sincerely hope other embassies are a little more up to date.

anyway, my questions are:
1. which documents should be submitted to the consulate now?
2. which documents need to be notorized?
3. which documents need to be original and which can be copies?

here's what we've been collecting - please tell me if i'm missing something or using the wrong form or whatever:

we're planning on mailing these to the consulate:
- DS-230, part 1
- DS-156
- DS-156K
- DS-157

we're planning on bringing these to the interview:
- DS-230, part 2
- originals of NOA1 and NOA2
- I-134 affidavit of support
- passports
- passport style photos
- copy of I-129F package
- copy of RFE package
- letter of intent to marry
- copy of 3 most recent bank statement
- copy of W2 from last 3 years
- copy of tax return from last 3 years
- letter from my employer
- copy of 3 most recent pay checks
- original birth certificates for both of us
- her military records
- police records (submitted by police)
- approved medical results
- list of vaccinations
- list of places she's lived since the age of 16
- evidence of ongoing relationship
- phone and skype records
- travel itineraries
- passport stamps
- boarding passes
- pictures

thanks for everyone's help!!! much appreciated as always!!

US Citizenship General DiscussionQuestions after I130 Approved
QUOTE (AhmadGwen4evr @ Jan 13 2008, 11:46 PM) <{POST_SNAPBACK}>

Hello all,

I am a bit confused as to what happens at this point in the process. My I130 was approved on 1-09-08 as well as my I129F. I assume that the I130 will void the I129F since the I130 is the better visa.

Hi rose.gif
Where is your I-130 and I-129F now? According to my NOA2's it states that I-130 remains in U.S. and I-129F was sent to NVC in which they would be sending it to consulate country where we were married. The reason for this is bc the K-3 (129F) visa route would be pursued.. K-3 interview completed.. non-immigrant visa issued.. the SO could come to USA while awaiting to complete I-130 petition and get immigrant visa (10 yr visa). If your I-130 remained at U.S. svc center and you want to change your k-3 route then I believe you need to notify them and (possibly) pay a fee. You would then be pursuing IR1/CR1.. check out this forum
http://www.visajourn...showtopic=302ts

I wish you both the best.. with no more delays

rose.gif

My Notice said his I130 was approved and my petition indicated my spouse is in the US now. He isn't...still in Jordan. I called the CSC and notified them of the error on the I797. The CSR took all my information and told me all my paperwork including the I130 was forwarded to the Nat'l Visa Center. She said when they enter my case as received there that they will correct my I130 stating he is out of US. She said the I130 will void the I129F automatically and he will receive information from Amman with interview and that he will enter as a Resident not on the K3.

She said I will probably receive a packet for my Affadavit of Support within 2 weeks. She also said it could take 90 days before the paperwork is forwarded to the US Embasy in Amman. I hope he does come with the I130---this will save me $1300 right?

Hello all,

Next I need to send my Affadavit of Support, past 3 years IRS Transcripts, letter from my employer and finally the last 4 paycheck stubs. Is that correct? Do I need to wait for the NVS to send the letter to me or should I send it asap? Also is there a fee for this? IF so how much?

Next I believe they send all I130 Paperwork and Affadavit to the US Embassy in Amman. They will then send a Packet to my husband with interview date and the Medical and Biometrics instructions. I need to send all copies of the I130 I sent to the CSC as well as approval letters to my husband to take to his interview.

Am I on track so far?

Finally does anyone know how much the medical exam will cost there and also the biometrics? Also how much will he need to give them at the embassy for the VISA itself and Aramex fee to have it mailed?

I am just trying to get a basic idea of how much money we will need to get all of the paperwork done.

Any feedback is greatly appreciated! I am so thankful for my VJ Family!! biggrin.gif

Thanks!

In the case of the Bangkok embassy, they ask you to pick up the visa 3 business days after you are approved at the interview. Does anyone know the exact reason behind this wait? It seems like they could print it up in an hour.

You've been very fortunate with your Fiance Application, Your "Timeline" is Unbelievable!!

I'm going on 90 Days & have yet to recieve the NOA2 & many other members have waited much longer, than myself.

Congrats!!

US Embassy and Consulate DiscussionDS - 156 Form Question
In the DS-156 form that my fiance needs to fill out - under question 4 for Marital status it wants to know if you are now married or have ever been married. She has been married in Canada twice (and divorced). There is not room to put two names or dates on this page. Has anyone ever come across that before? Does she just put the last husband down?
It is getting closer and we don't want to do anything that will slow this down any more than it is!
Thanks!

US Embassy and Consulate DiscussionConfused about Packet 3&4, and Interview requirements

Hello,

We now have an interview date, and I just wanted to confirm a few things I was not sure of...

1. If I have a document ( I received via E-mail), with my interview date and a list of documents, does that mean I have Packet 4? (Can I print this out to present for any medical checks and to present at the embassy on the interview?)

2. If so, what happpened to packet 3?

3. What is this document?: DOCUMENT NAME: CORRESPONDENCE INSTRUCTIONS --------- C

4. What does it mean when I read: FEE PAYMENT ------- $, are there extra fees that need to be paid at/after the interview?

Lastly, any tips on anything else that needs to be brought to the embassy? It has been so long since I sent in I-130 and NVC package that I have forgotten most of the documents. Maybe I should carry copies of everything I have sent in so far?

I apologize for many questions at once, but any help is greatly appreciated. Thank you.

Regards.

When my husband went for his interview he assumed that since we sent in everything prior to the interview that he wouldn't have to take anything. When he got there he was told that he needed ORIGINAL copies of his birth certificate and our marriage contract. So his interview was postponed for the following week. You may want to take those types of documents with you. Good luck!

hopefully somone in the Juarez section can help me out... i just received my letter from the juarez consulate and said i have an open appointment.
i applied for a fiancee visa. My noa2 states it is valid from 11-6-2006 to 3-5-2007. We would like to go to the interview in mid march, so i can be there in support. But according to the noa2 it is only valid until march 5. I contacted uscis i the person helping me was confused . I am still waiting to hear from the nvc. Does anyone know what the deadline of march 5 means? does my fiancee have to go to the interview before then? Or does it mean she has to enter the u.s. by march 5. i seen there was a form posted to file an extension, but if so where does it go to?

US Embassy and Consulate DiscussionI-134/Bank Letter
Hi! I am currently gathering all the info my fiance will need for his interview, because we got our NOA2 about a week and 1/2 ago. For the I-134, I will be using a co-sponsor, as I just graduated from college and am presently looking for a job. However, I still need to fill out an I-134 for myself anyway, correct? If I submit W2s, and 1040s for myself as well as my co-sponsor, do I still need to get a letter from my bank for either myself or the co-sponsor. I went to the bank today with the intention of getting the letter for myself, but it seemed to require a lot of work on the bank's end. I don't want to inconvenience them unless necessary. Please let me know!

US Embassy and Consulate DiscussionCan I ask for a later Interview date?

Why is the Canadian government helping YOU with 2K a year and you're not a Canadian citizen? I'm a Canadian citizen and they ain't paying any of it for me!

Er, what? I most certainly am a Canadian citizen. I've stated a few times that my fiance is the USC. Where did I state otherwise? You can clearly see the Canadian icon below my avatar, and I have repeatedly stated that I am the one moving to the US. Logic would dictate that I am, in fact, the Canadian citizen. As for the government making a payment towards my loans, I was mistaken; they only help(ed) me when I have been enrolled in classes the previous year. They are still covering the interest, of course, provided I remain a resident of Canada.

Well, I had started typing out an apology and an explanation. But then when I read how you were unnecessarily rude and antagonizing, I changed my mind. So...no apology. No explanation. Pay your own loan off.

You barrel into my thread, don't bother to read it, and then demand to know why the Canadian government is extending assistance to a non-citizen, protesting that I (in CAPS no less) am getting something that you aren't. Then, when someone else asks what your question contributes to the thread, rather than offering an explanation or even an "I read that wrong", you responding by demanding to know why he did not help in any of your threads, while simultaneously questioning the contribution he is making to this thread.

The way you phrased your question was both accusatory and 'antagonizing' in tone, which would explain why you got an unfriendly response in turn. You also had plenty of time to edit your post to add this 'apology and explanation', but you did not do so.

Perhaps you, like so many of us on here, are feeling the stress of having your future with your spouse in the hands of a faceless and uncaring organization. If that's the case, I offer my sympathy and wish you the best in your visa journey. Please remember that everyone on here is feeling this strain, and honey attracts more flies than vinegar.

Who says I had 'plenty of time to apologize and edit what I said'? For one, you don't know that. And two, you are accusing me of lying. I didn't lie. I was going to apologize and explain myself. But then I saw your response. No apology forthcoming. No explanation forthcoming. Have a nice day.
