K-1 Fiance(e) Visa Process & ProceduresDocuments with original signatures
QUOTE (cyclops10 @ Aug 24 2008, 04:30 PM) <{POST_SNAPBACK}>
Getting ready to start the process for a K-1. I see where original signatures and documents are required for some of the forms.

I have a question on some ways to go about this. Is there ways to do this by computer or other electronic means?

Reason being is Fiance is from Russia. We dont plan to meet again for a couple of months. I have to travel there. She cannot travel to the US.

To file the I-129f package I will need her signatures on some of the forms. It will takes approximatly 2 weeks to send the forms by mail and another 2 weeks to recieve them back, if lucky. Losing a months of time for signatures. FedEx or DHL is extremely expensive to send packaged letters. Close to 400 t0 500 hundred dollars for send and recieve services again losing close to 2 weeks and a lot of money.

Is there a way around this or is it inevitible to lose the time and wait. How did some other members do this when you know you wont be seeing each other for a couple of months but want to start the process?

How did you obtain the signatures in a short period of time?

Thanks.....By the way this is a fantastic site.

It's been awhile since I started the K-1 process, but I believe the initial petition only needs her signatures on the 4 copies of the G-325 Biographical page. It can not be done electronically as they need an original signature in pen. She can print these documents herself and sign them then mail them to you. I find it hard to believe that Fedex charges 400-500 US dollars to send documents. I sent documents to my fiance in Brazil via FedEx and it costs me $75 US dollars for 2 day service. It costs $65 US dollars for him to send them to me.

Maybe there is a significant difference in FedEx rates between the two countries. Seems you should have her mail the documents to you via express mail with the local mail service if available and if it's not too expensive.

Thanks, were on it now

We applied for a passport in 2006 and it only took a week. Unless things have changed, you should be able to get one in time for the interview. Have her get to Rio and submit her application as soon as possible. She'll have to return to pick it up, but she can do that a day before she goes to the interview.

By the way, does she live in Rio? If not, where does she live?

Good luck.

K-1 Fiance(e) Visa Process & ProceduresNot tourism visa - JM
Sounds like she had her fiance apply for a tourist visa instead of the K-1 visa and now his interview is next week for the tourist visa.

The best thing might be to cancel the interview and apply for the K-1. Anyone else with better advice?

K-1 Fiance(e) Visa Process & ProceduresWorried about my lawyer's handing of K-1 visa application
QUOTE (Ken1 @ Oct 28 2008, 07:44 PM) <{POST_SNAPBACK}>
I decided to hire a lawyer in this process and she seemed experienced and like she knew what she was doing. That said, there are a couple of things that she didn't include in the packet that I now wish I had pushed for and I am worrying I might get and RFE. In terms of my lawyer filling out papers, I'm confident that she did all that right, and where we wrote about events in our statements the lawyer included things like "see photos at tab 1" and "see receipts at tab 2." I am just worried about evidence and I hope I'm just being paranoid and would love any advice you more experienced folks have.

My lawyer included photos and some receipts and my boarding passes, a copy of my passport and a few emails as well as our statements, all of which seemed great. I had a TON of other documentation when I was at her office, but she said that she knew what the USCIS was looking for and there was no need to send in too many things. My main worries are the following:

In our application she included bus tickets (two round trip tickets) to document a trip we did together (we had mentioned this trip in our application and included photos), however they had no names on the tickets. She DIDN'T include the plane ticket receipts for a flight we took together that DID have our names on it. All the receipts she included (which weren't many), had no identification of names - incidentally, we had some receipts with our names on them that she didn't include (all pretty generic hand written from bed and breakfast type places).

She DIDN'T include receipts I had for engagement rings (in Brazil both the man and woman gets one), nor any other gift receipts and said it was unnecessary.

My fiancée is pregnant and she did include an ultra-sound and doctors report from 8 weeks (we're now at 17!!!) and perhaps she felt that trumps all, but I'm nervous as you can imagine.

Of course my fiancée will bring all the above mentioned documents to her interview, but I'm just hoping there is no risk of RFE.

Thanks for any help and good luck to all!!!

You will be fine. All they're wanting to know is if you two met in the last two years. Your passport with your stamps into Brazil and the pictures of you two together are sufficient. The other documents you will take to the interview, but more than likely, they will not even ask to see it. However, take it to the interview just in case.

K-1 Fiance(e) Visa Process & ProceduresAccidental Visa mistake-My fiance put the wrong birth date for his father
QUOTE (amydb9 @ Nov 10 2008, 08:20 PM) <{POST_SNAPBACK}>
Hi Guys,

This is my first post and I would love to get everyone's opinion on this. Here is our situation. My fiance's father has not been in the picture since he was a baby. He somehow got the wrong information and put the wrong birthdate of his father on the G325 form. Now that he is filling out the DS 230 he realized the mistake. I guess the mistake was not found by the Service Center or wasn't a big enough deal to prevent the process from moving on, because my fiance got his packet (containing the DS230) sent to him, etc. Here is the dilemma.....Does he play dumb and write the incorrect date that was on the G325 or does he put the correct date on his DS230 and maybe have an attachment saying how there was a mistake? Am I making a bigger deal out of it than it really is? My biggest fear is that we will have to start all over and we already have our wedding planned for May! PLEASE HELP!

Thanks for your time!

I had actually entered my fiance's name and the mother of his child as being my fiance's parents; birthdates included. The paperwork showed my fiance as being his own father. This was not noticed at USCIS. When he took his paperwork to the consulate, I had him change this information to show his mother and father as being his parents. It was never questioned.

I suggest changing the paperwork to reflect the actual birthdate.

It is truly your decision to send receipts. We applied for a K-1 and part of our evidence was every Western Union receipt I had. We were approved without any problem.

It might depend on the country if showing proof of money transfers is a good idea or not.

Maybe because your data is already in the database and what you will be doing is just renewing it. Not sure though but it is better to ask the NBI personnel so you will be guided accordingly as to how to correct your NBI record. And don't forget to bring your birth certificate, they might ask you for it.

Well we are STILL waiting.. I've contacted my congressperson's office. The say they will look into it and get back to me but REFUSED to give me a timeframe when anything might br resolved. The said that NVC definitely does not have it and the problem is with USCIS.

I am potsing here again to bring this topic back to life and try to find out if anyone else out there is in out situation or has any new insight.

received NOA2 Decmber 19, 2008.
as of today 2/2/09 NVC still hasn't recieved it.

ANYONE??

Numan, I recieved my NOA2 on Dec.19, 2008. from the california service center. i have read your posts and seems that we are very close on the visa journey. i contacted uscis today feb209 of course 'not in there system" they say they forwarded it to the manila embassy. which i knew was a lie since i have previously learned all petitions go from uscis to NVC. so i called NVC today. " no record' lastly i paid the 18.00 to talk to the manila embassy. they asked for my case number , and of course i do not have that , just a reciept number. and they have no record. i have accepted the fact that i will just have to wait and hope the petition was not lost somewhere along the way. keep me posted to your progress, i see your dealing with japan right?

K-1 Fiance(e) Visa Process & Proceduresmultiple visa applications
i filed an I-129F application for my fiancee at the beginning of march. that is her main intention for coming to the States. however, she also wants to attend school while she is here, but we're worried that the K-1 visa process will not be complete by the beginning of the fall '09 semester. once accepted by a university, she can take the school-issued I-20 form to the consulate and try to get an F-1 student visa, which would allow her to come here 30 days before the start of the semester (beginning of august).

is she allowed to file for the student visa while the I-129F is pending? will she be denied based on her intention to come here and marry me? will the consulate view this as an attempt to bypass the I-129F process?

K-1 Fiance(e) Visa Process & Procedureswhat's the worst that could happen?
I've seen a lot of examples on this site of people successfully entering the US on tourist visas while their K1 visas are pending approval. however, i understand that entry is in the hands of the border patrol agent.

my question is, what happens if entry is denied by the border patrol agent? if a person is sent back, is it at the expense of the individual? more importantly, can a denial adversely affect the K1 visa process?

i don't mean to focus on the negative, but i just want to know both sides of the story.

i would love for my fiancee to visit me during this process, but we don't want to do anything that will jeopardize our future together.

thanks everyone!

K-1 Fiance(e) Visa Process & ProceduresNeed an Extension?
My fiance and I started having the basic jitters I'm sure everyone has had going through this process. We decided it would be best to take a break from everything. During this time, on June 30th we got our NOA2. We have recently gotten back together and he is going to send in Packet 3. It says our NOA2 will expire October 30th. Do we need to ask for an extension? Do we need to call the consolate? Any help would be very appreciative. Thanks so much, Danielle

Before I get grilled here, this site has some excellent information on applying for a K1 Visa & after serious thought, I know I can follow the step by step procedures for obtaining a K1, but my Thai Fiance lives in Isan, I'm afraid of not being there to hold her hand thru this process & having someone explain to her in Thai & in contact with her, while I'm in the states, would give me a better piece of mind.

Has anyone went that route & can you recommend a good Thai Lawyer?

Any input would be greatly appreciated!!

I used these guys to get my THAI marriage visa. They handled everything pretty good. Took care of my marraige there, and filing the paperwork with the Ministry of Foreign affairs etc.

Not sure how they are for getting a US visa. They have 2 packages. One where you do everything on the US side, and the handle the Thai part (which isn't much.) And a more expensive package where they do everything.

I've contacted several Thai lawyers & Siam Legal was one of them, I've setup an appointment with them, when I arrive in February of 2009, just wanted to know if anybody became highly recomended?

K-1 Fiance(e) Visa Process & ProceduresK-1 petition and expedite @ CSC
QUOTE (Nill @ Apr 3 2009, 07:10 PM) <{POST_SNAPBACK}>
Hello, I am active duty military stationed in Alaska. I am in a highly mobile position, so I can deploy at any time. I am using Brian Wright in Thailand to help me through the process. In two weeks he has gathered all required documents/info, and they are on there way to me now. (fed ex says they are in china at the moment) Some may say a visa Lawyer (if you can call them that) is not worth it, but to explain the process and get the info I need from my fiancee (Naan) is sometimes a bit rough. My thai is not the best yet, and her English is not the best yet either. So Brian's office has, in my opinion, been invaluable so far.

My biggest questions to date are what is the deal with CSC? I hear stories of couples getting in and out service from them, and others who have waited for a substantial amount of time with nothing. I know I will have no problem getting an expedite. Is there anyone else out there with the same scenario? Or anyone who has a thai fiancee at all? And what was your experience with CSC?

As far as making it to an interview, I am a bit worried about proof of ongoing relationship. Naan has no internet access, and we just text, and phone (she calls me and hangs up, I give her the call back.) I am worried they will not be happy with that, But I speak enough thai to get by, and it is just easier than email, or chat. Also, will they get bitter if our text messages are in thai?

Ha, I think I am a bit paranoid, but who doesn't worry when the fate of their love rests in too many other peoples hands...

?????????????????????

Try to have as much information to prove the ongoing relationship as possible!!

K-1 Fiance(e) Visa Process & ProceduresWas I scammed
I requested the help of an Agency in Bangkok, when I visited my Thai Fiance in January, we sat down with them and discussed what they covered in the whole process, being that my Fiance lives 3 hours from Bangkok & her English is moderate & computer skills are very poor, I had no alternative to seek help from a private party, to help her thru the whole process.

The fee I payed was $1,000.00 They basically told my Thai Fiance what documents she needed to provide & filled out her initial side of the I-12F Form, they also help her when Packet #3 arrives & for the Interview at the US Embassy in Bangkok.

I did aot of research looking for someone to help her & this lady who heads this Agency was really nice to me & my Thai Fiance when we met, so I'm happy so far!!

There was no way my Thai Fiance, would've been able to complete this by herself, So this was worth it for me

the biggest red flag that i see right now and you might get burned during the interview process is you sending money, usually for K-1 even though you send money you should not mention it, it could be mis-understood.... i doubt her dad's info will cause problem at the USCIS process, because this is mainly about you and if you have met your fiancee prior before filing. from now on make sure you put the correct info for her dad...

I send money all the time by W/U can that be mis-understood on a K3? After all I have a wife and a baby to take care of.

K-3 is normal because you are sending money to support your WIFE good.gif this is actually a plus because it shows that you care about your wife and it gives your brownie points for the "bonafide Relationship"

I met my Fiance in Bangkok & she worked at a shitty Factory making hardly anything, just enough money to live & send a little bit home to the
Family in Isan living on the Farm.

I've been sponsoring her for about 6 Months now & she's able to live with her Family in Isan, where she's very safe & I have a great peace of mind, until our very "Great Goverment" mad.gif can decide on how my life is going to be spent?

If sending money to a woman you love & want to care of is a "Red Flag" The Hell with Them" I attached Paypal transactions, to my I-129 in which my Fiance has withdrawn from her Bank

Just an update here to everyone. I also posted this in the Bangkok interview section.

It is the wee hours of the morning and I am still in shock that my VISA process has moved ever so rapidly and the interview is set for March 18th.

See the posts at for further background
http://www.visajourn...h...=108011&hl=

Since that Radio show, engaging my Senator and just pure support from this forum I am shocked how things moved so quickly. I have not posted lately, because work has had me drained and my Mom's condition is getting worse and all of that really has worn me out. However, at 3AM this morning my phone rang with great news from the Bangkok embassy, your fiancée interview has been expedited and set for March 18th. I said What?, who is this and what again. It was nothing less than the US Ambassador's aid calling me. Again, I asked, who is this and he explained, again and I was left shocked. My VISA process has flew like the wind. Take a look at our time line and it speaks loud and clear. In came the NOA 2, Out it went from the USCIS, through the NVC and to Bangkok requesting the interview in record time. The interview, which normally takes a time of 2 months to get, as you guys know, is now set for March 18th. This is really quick considering also that there were no interviews for this month of February in Bangkok. On March 18th, my fiancée and I will be together in Bangkok for her interview.

Here is an extract of the email

The IV Unit has received the applicant returned Packet 3 checklist and DS-230 part I on February 21, 2007. Normally, the waiting period for scheduling regular interview appointment is about 4-6 weeks. However, due to the medical emergency, the IV Unit has scheduled an expedited interview appointment for Ms. XXXXXXXXXXX on 18-MAR-2008 at 08:00 am. The Packet 4 which is an interview appointment instruction has been electronically sent to you and mailed.

Hello everyone,

Just an update here and perhaps some feedback from anyone who has received a approved expedite request would be helpful.

The USCIS is reviewing my expedite request. They touched it again today. It has taken them a little over month to get the details. Normally I would of not requested it, but my mother is dying from cancer and wants to see my fiancee and I married before she dies. Hope that happens, however, I am assuming we are minimal 2 months to 3 months out even if it goes quickly and mom is starting to show signs that things are rgetting worse. She was diagnosed with stage 4 cancer, unable to opperate and it now has speard to her spine, brain, lung, liver and who knows where else. Looks like it is moving rapidly. Unfortunately she is also the caretaker for my 76 year old father and my 91 year old aunt and without her there, I will have to take care of them to keep them in their home they worked for their whole life for. I am making plans to temporalily reside there, not change address as I have a job where I can work form different places in the US, but to provide them security in their home. Anyway the USCIS requested additional information back on December 20th, which I provided a two page letter from me and the Doctors diagnosis, limited in detail because of Hippa laws.

Anyway, if we are lucky enough to get approved, I am seeking information from anyone who has gone through this process and has received an expedite approval to learn how I might get the rest of the process expeditied, not to cause problems. My hopes are that the expedite approval, if granted, will follow the the papers to the NVC and then to Bangkok Embassy. I have thought about contacting my Congressman and my mothers asking for them to look into this and see if they can help but have not done so as I am afraid my case will all of a sudden get delayed longer. Anyone with experience here please fill me in. I may call my congressman to get advice.

We did have a Budhist ceremony, not an official marriage in the sense of Thiialand or the US unless you file marriage papers in Thailand at the local Government office, which we did not. We did this for her family and it was wonderful. I talk to her twice to her a day in the morning and at night as she is waking up when I am about to go to bed. I have been learning Thai daily and she has been studying English.

Sawadee, waiting and hoping

K-1 Fiance(e) Visa Process & Proceduresquestion on letter of intent

Ok, I am the one going for the interview. Do I have to have another letter of intent as well? If so, how come I wasn't told that? This process is extremely frustrating and I'm tired of learning I need "this and that" when I wasn't told in the first place.

Joe...this is from the Guides section. The part you question is bolded and underlined. It has been there this whole time. As far as you "being told what you need" it's your responsibility to read these Guides and find out this information instead of relying on everyone to tell you what you need.

What to send to your fiance(e) once the I-129F is approved (Receive NOA2): 1. A copy of the entire I-129f package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one). 2. Send all originals of the documentary proof that you submitted for the I-129F to your fiance(e) for their interview at the embassy. 3. Send an original letter affirming your desire to marry your fiance(e) and your continued support of the K-1 Visa. Sign and date the form. This will be similar to the letter you provided with the I-129F, but dated much closer to the interview (it will have most likely been several months since you submitted your I-129F). 4. I-134 Affidavit of Support form. Ensure it is notarized (by a US Notary Public), with all required supporting evidence. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all. 5. You will likely need at a minimum (for the above form) two to three of your most recent pay stubs and a signed letter from your employer listing you job title, start date, your salary, and the status (full-time) of your position. Begin collecting these ASAP after your NOA2 arrives. You will also probably want to include other evidence such as your banking information and other assets as required by the I-134. Specifically you will need at least 2 of the 4 options mentioned in Section II-Supporting Evidence of the I-134. See this FAQ for more tips and ueful information on the Affidavit of Support Form. 6. A copy of the NOA2 that you received in the mail. 7. Proof of your ongoing relationship. This needs to be taken to the interview! Include photos, travel documents, emails, etc from between the time you filed and present (NOA1 date-now).

Examples: Copies of phone bills, cell phone bills, emails (you can edit personal info with a marker), letters (edit personal info also), stamps on the letters (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)

a) you can be a tad more respectful in your tone, thank you very much

B) When I say "what I was told" I am referring to my PACKET 3 INSTRUCTIONS, thank you very much

c) the "guide" is a hell of a lot different than my PACKET 3 INSTRUCTIONS, thank you very much

d) I don't "need everyone to tell me what I need" thank you very much. What I do ask for is clarification as to why the "guide" is so different than my PACKET 3 INSTRUCTIONS, thank you very much

Yep, a new/updated letter of intent is required from the USC fiance when you go to the interview, and if I remember correctly, this requirement is stated in the package 4 letter -- at least it was in mine.

I know that. I already have it. What I was asking is if "I" need to make a new letter of intent. Why does everyone assume I'm the USC fiance? It was stated in my instructions as well, however, contra to the rude post above which referred to a "guide", my instructions did not mention that "I" had to have a new letter of intent as well.

I wasn't being rude...just stating the facts. Sorry you took it as such. Maybe you could have phrased YOUR post a bit different, hmmm?

I accept your apology. How differently could I have phrased my post? I thought I did it fairly accurately.

Oh never mind. I see how I could have done it more accurately. I am sorry as well. It was kind of vague.

K-1 Fiance(e) Visa Process & ProceduresK1 Visa and EAD at the same time??
I find this to be a very confusing subject. At the end of my interview the gentleman handed me a sheet with answers to questions. On that sheet it said that your visa comes with a foil inside it and that foil gives you the right to work.

Why do they make this subject so confusing?

K-1 Fiance(e) Visa Process & ProceduresHelp:- Birth certificate without my name on it

Hi Yodrak, thanks for your reply. I have just found that FAQ section on US consulate website has an answer to this.
I will post some extract of it here for people like me.

Each applicant must submit an original and a clear photocopy of his/her birth certificate. The certificate should include the applicant’s name, date & place of birth, the names of both parents, an annotation by the issuing office indicating that it is an extract from its official records, and the seal of the issuing office, i.e. the municipal authorities or the village authorities (gram panchayat or talati-cum-mantri). The certificate must be in the original, official language of the state in which you were born. Unobtainable or incomplete birth certificates If your birth was not recorded, please submit a “no record of birth registration” letter from the relevant municipality or village authorities along with secondary evidence (see below). If your birth record has been destroyed or the municipality or village authorities will not issue one, submit a letter from the municipality or village authorities stating so along with secondary evidence of birth. If your name is not mentioned in the birth certificate, submit the certificate along with secondary evidence. If any details are missing in the birth certificate or if there is a discrepancy regarding your date of birth or name, submit the certificate along with secondary evidence. If your birth was registered more than three years after you were born, you must submit the certificate along with a magistrate’s order concerning the late registration. Acceptable secondary evidence of birth Following are examples of secondary evidence of birth (which should also include your name, date and place of birth; names of both parents; and the seal of the issuing office): a baptismal certificate, an adoption decree, a school record, a notarized affidavit from a close relative (a parent, a close relative, a neighbor or friend who was present at the time of your birth) on the appropriate stamp paper which must be sworn before a First Class Magistrate. The person making this affidavit must state how he/she knows your family and how he/she knows the facts of your birth.

LOL shouldn't the fact that you're alive be evidence of birth?

Anyways, I hope things work out for you. According to the post I quoted, you shouldn't have a problem. Good luck.

K-1 Fiance(e) Visa Process & Proceduresproof of having met...hotel receipt

Thanks for the advice. I was a little worried about that. Unfortunately I didn't use my credit card over there. I have printed out my trip intinerary from Expedia, copied my passport stamp, have my return trip boarding passes, and 5 pictures. Hope that will do it.

Hope you are planning on making another trip. That's not much evidence of a bonafide relationshp!

beckypua, that may be more evidence than I had. I provided a photocopy of a bus ticket and a plane boarding pass. I explained on there how my fiancee picked me up in a different town because no bus went to her town. That was pretty much all that I provided.

Yager, I think you'll be fine but don't only take my word for it.

K-1 Fiance(e) Visa Process & ProceduresIt has arrived
Thanks you guys.

Yeah it doesn't matter since I'm moving in a month. I just wonder how that happened. Maybe cuz I told them we had a definite wedding date set.

K-1 Fiance(e) Visa Process & ProceduresIt has arrived
I received my K1 visa today.

However, I have a question. Aren't you supposed to have 6 months to move there and then 3 months to get married? I'm moving there next month but I just thought it was odd that my visa says it expires October 19th. Anyone else have this happen?

K-1 Fiance(e) Visa Process & ProceduresI must cancel this journey

Bush talks to all the Immigration Head Officers and is responsible for the breakups of couples due to delays from bad paperwork and just the fact that certain countries just have more people trying to immigrate than others... this kinda reminds me of everyone saying Bush put a bomb in the ocean during Hurricane Katrina to make it go towards New Orleans.. hmm... and Bush responsible for Global Warming... all his cows I guess? and Bush responsible for oil prices going high (Let's not say its the greedy oil companies in the middle east understanding supply and demand in America).

One question I think you ppl should ask to yourselves when you come up with such dumb comments about immigration and why the US has an immigration policy and a procedure to follow... How do you think it would be if we allowed EVERYONE in the world come who felt like it, without a screening process nor an application. No checks, no concern if someone will become a public charge to the country. No nothing. Just total anarchy.. there would be no control over society.

Let's stay on topic and not bring silly comments into such a great helpfullll board like VJ.

Procedure??? Last time I checked we had 20 million losers from Mexico here eating up our social programs and taking jobs from America's less fortunate. You know your country is being overrun when you have to press 1 to get english. Nice procedure?? My girl is educated, knows english and she has go through a bunch of BS to come here yet 20 million losers with no education , most cant speak english just come over the border??? Some procedure??? Round this cancer up and send them back and build a fence with a mine field. Let the people who can add value to the country and show respect come in without the BS. Let the losers who come illegally and then think they are entitled to something wait 6 months or longer after they get deported. Procedure?? Gimmie a break.

Maybe they'll show respect when you start showing respect? Your English is lacking as well.

Those people want to come to the states like many other people. Some of them people can't afford it. So they do what YOUR forefathers did. Packed everything up and just WENT there!

To the OP: sorry it went like that. I wish you the best in the future.

K-1 Fiance(e) Visa Process & ProceduresCashiers check or money order?
I don't know. I went to the bank, asked for a money order and got a cashier's check. This country is confusing. Everything is done so differently. I assumed a cashier's check was fine since that's what the bank gave me.
