well, we got the RFE in the mail today (finally!!). here's what we need to get -

evidence of meeting
- copies of passport pages that show the ID page and admission stamps

not a problem - just might take a little time through the mail. is a fax acceptable?
- airline ticket stubs and receipts

not so easy - not sure what she has kept as far as this goes.
- film dated photos of us together

we have lots of photos, and we sent in a bunch. unfortunately, they didn't have date stamps. anyone know how to get the date stamp added to the photo? photos were taken with an olympus sp-510 uz if that helps
- any evidence that will help the uscis to determine.......

any suggestions for things to submit other than what is listed here?

submit a birth certificate with certified English translation
don't remember this in the instructions, but again, not a problem - mail or fax?

we want to make sure there are NO questions, any help would be GREATLY appreciated!!

It takes about a week to get to the NVC, so you will likely hear something about status if you call after that. Make sure you speak to a person. K1's are not updated on the automated status option.

we just got word that the NVC now has our case. it took 6 days, and we checked by calling 603 334-0700. they will need your uscis case #, name and date of birth for both people.

now we're working on compiling stuff that we'll need for packet 3. however, it's a little confusing. to my knowledge, we need to fill out the following government forms: DS-156, DS-156K, DS-157, DS-230, I-134.

can anyone confirm or direct us to a good thread for packet 3 help?

i would simply put "Tehran" because you would put "Iran" in the box in 3b. if you try to write both, the box will not display all the letters, which is a bigger problem. you could always go back and add it by hand after you print the form. (instructions say type or print LEGIBLY)

On question 9 should I leave it blank of put the word "none" in the box?

do not leave blank. depending on the question, use "N/A" or "none". in this case, "none"

For question twelve how do you fill out the boxes for arrival/departure date and date of arrival and date authorized to say expired? If I put in the box above all of that that she is not currently in the U.S. do I just leave it blank? I was thinking that was a "no-no".

if she is NOT currently in the U.S., just put N/A in the box for question #12. we only wrote N/A once and left the arrival #, date of arrival, and expiration date blank - N/A covers all of those.

On question 15 when they ask for the phone number that she has in Canada do I put it like this? 011 1 555 555 5555? Will they ever call that number? The reason I ask is because my fiances family since finding out what we are wanting to do has been extremely hard on her. They won't let her work so she can't have money to get her own place. They tell her to leave me or they will kick her out in the streets. They call her names and recently her father said that he would actually take her life! We have decided to keep this all under the rug until things start to blow over a bit. If that's even possible. I try to be there for her as much as I can but I don't make a whole lot of money and flying to Toronto takes a big chunk out of my check everytime. It'd be so much easier if I could just go visit all the time....Ugh, the call worries me.

sorry about the situation. family members can be tough to deal with - especially those who don't understand/agree with cross-cultural relationships. however, if the are abusive, THAT is a big problem, and i wouldn't recommend waiting for it to "blow over"

BIG QUESTION!!!!! On question 16 it asks if my fiances native alphabet uses other than Roman letters, write her name and address in the native alphabet. She lives in Canada. She speaks and write English. But she is formerly from Iran and can also speak Farsi. Does she need to sign this in Farsi? Does she write in her current address in Farsi too? If not do we just keep it blank? Geez, I don't expect a lot of repliers to this I know I'm making it too long! I'm sorry.

is she a citizen of canada or iran? if she is iranian with an iranian birth certificate but living in canada, then i would write her name in her native language, but write her address in english. if she is now a canadian citizen, then N/A everything. for more info, go to the example forms page - http://www.visajourn...p;page=examples - they have examples of each form you'll need.

Thanks all for the feedback.

Yes we are an inter-racial couple and we know that we are going to need to submit a lot more evidence because of that as well as India is more strict about the visas as well.

We actually opted not to have an engagement ceremony when I was in India as we did not want there to be any question or doubt that it was too extravagant and think that we got married. We just did a very small engagement party once we got back to the US.

I'm feeling pretty organized because I've been saving so much stuff but I definitely want to make sure everything is aligned to try to make this as smooth as possible (which will still be bumpy, I'm sure... ;-)

Hi All-
I've been watching VisaJourney for 6+ months now as my relationship with my fiancee has been blooming and well...we are officially engaged now so our own Visa Journey is beginning! He lives in Mumbai, India. I'm prepping all the documents to submit the I-129F and wanted to get feedback on how much "evidence of on-going relationship" should we send in right now?

I have hundreds of pages of chat records, phone/text message records as well as a lot of pictures from our 3 meetings over the last year. I also have receipts, boarding passes, and other momentos that validate our meetings, engagement party guest list and invitation, a book of encouraging advice for our marriage that our friends wrote us during our engagement party, etc.

I know that a lot of this we bring to the interview but how much is too much to send with this packet since this is the main evidence they will use that will get us an interview scheduled?

I've tried searching for the answer to my question but have not been able to specifically locate it. I'm filling out the I-129F and it says to fill out my fiancee's name and address in his native alphabet if other than Roman letters. My fiancee lives in Mumbai, India and actually grew up learning English as his primary language. Does he still have to write in the Indian alphabet as that is technically the native alphabet of where he is from? Or is English popular enough in India as it is a primary language that we do not need to fill in anything there?

Hi All-
I posted earlier that I just filed my I-129F and as I'm waiting and waiting, I want to be as prepared as possible for when we receive our NOA2. I was looking at the I-134 Affadavit of Support and I was a little concerned. I have a good, steady job that I have been at for the last 3 years. I make well over the 125% of Poverty Level requirement. Everything is fairly good for me financially.

My concern is that just recently, my position was ultimately outsourced. I was long-term supplemental/contracted employee and my contract was up for renewal. Instead of renewing with the same company, they outsourced the position to a staffing agency. My job title is the same, my job description is the same, and my pay has even increased. The ONLY difference is the company name on my paycheck and the fact that when asked if I'm a permanent or temporary employee, I believe they have to say temporary because it is a staffing agency.

Will this require me to have a co-sponsor? Also, how do you know if you need a co-sponsor? Do you submit the I-134 with Packet 3 and then they advise you in Packet 4 if you need a co-sponsor and you either submit it then or at the interview?

Once the Embassy recieves the documentation from the National Visa Center, what has been the average Time Period, before your significant other recieves her Packet #3 or just plainly, when does the Embassy usually mail out Packet #3?

I'm at that stage now for Thailand (Embassy in Bangkok)

Just wanted to get an idea, when she can expect her paperwork in the Mail?

My fiance' and I have submitted a K1 visa application. She is from the Phillipines and I am from the US. I have been hearing a little about age difference being an issue with approval. I am 51 and she is 31. I realize this is a 20 year spread, but she is no teenager. I would think that it may be more of an issue if she were younger, say 18-25 and I was 38-45. We are almost 60 days into our wait after NOA1.

What do you VJ'es think? Will this be an issue?

Touches mean someone has updated the status on your case (ie: someone is using the file) you would see this on the case status page you are viewing at the USCIS webpage.

NOA1 is the receipt you received (Notice of Action)

NOA2 means your petition has been approved (looks just like the NOA1 - basically just the info on the notice is different).

Things you can do now, not much really except ensure she has proof of all of her vaccinations. You can see the age appropriate list at the panel physician's website, also gives other info on the medical, like what you have to bring.

I see several posts where on their timeline it says "touched." What is that? I know that it has something to do with your papers actually getting touched by a person - but how do you know when they do this? We sent in our papers for a K1 Visa on April 6. Did get the notice that it was processed on May 6. There have been no updates since that time. I check every day and have signed up for email and text notices. So far, nothing. Seems like such a long time with no updates. Is this normal? I am in the US and she is in Canada. Is there something else I should be doing?
Also, what is this NOA1 and NOA2?
Are there any other terms that would be helpful to know?

We went through Delhi and it took my fiance a long time to receive the packet in the mail. For some reason it took like 3 weeks for it to make it to him in Noida! We called DOS a couple times a week until they told us that the Embassy had received it, then we printed the forms from online (DS230 Part 1 and the Applicant statement is all you need) and mailed them to the Embassy. We had already mailed them before he even received Packet 3. Same with Packet 4, basically I called DOS twice a week and found out the interview date from them well before we received Packet 4!

People's timelines tend to be different. Some have to wait more than others.
Your fiance could start gathering all or some of the documents needed for the interview. Also, you could start working on the Affidavit of Support. The beneficiary could also check the American Embassy/Consulate in India website and see what is needed for the interview. Some websites even have the forms available. This way, when the beneficiary receives the packet from the consulate, they will have something done already, just to make the process shorter. Good luck!

Hello everyone, I have few questions about my case status.

My name is Leticia. I came on the K-1 visa (Sept. 11, 2007) to marry with a US Citizen and we got married within 90 days (Dec. 10, 2007) of my entry into the USA. We were going through a tough time in which my husband actually domestically abused me, followed with me filing an order of protection against him and a police report with the city that I was residing at with my husband. I did not follow up with the order of protection and dropped it in court because we talked and worked things out. After 1 year (Sept. 2008) of marriage my husband applied for my 2 year Green Card. I received my 2 year Green Card (March, 2009), and a month later we separated because after me not following up with the order of protection, the abuse continued followed with more police reports. A month after receiving my 2 year Green Card we separated. I then moved to another state.

My Green Card is due to expire on March of 2011, I have to apply my 10 year Green Card by December of 2010. As I contacted a lawyer to get a divorce in the city that my husband resided, I was informed that I have been divorced since April of 2009. I was told that the divorce was approved because my husband published a divorce notification for me in a newspaper because he was not aware of where I currently reside and since their was no response on my part they granted him the divorce. They granted him the dissolution of marriage which notes "without cause or provocation on the part of the petitioner, the respondent has willfully deserted and absented herself from petitioner, commencing on April 3, 2009, and continuing for a period in excess of one (1) year, to the present time." Throughout this period before the divorce was granted I tried to reach my husband many times by email and phone with no response.

Now I must file for my 10 year green card and I currently do not have sufficient amount of money to pay a lawyer for my paperwork and I have taken the first steps to resolve the matters of obtaining my 10 year green card. I obtained a copy of my divorce and will be obtaining the order of protection documents which will prove some of the abuse that I went trough in my relationship with my ex-husband. I set-up an interview with 'InfoPass' (Nov. 15, 2010) to obtain the proper documents and any advice in regards to my case.

I am currently self-employed and will be filing my taxes in the beginning of January 2011, and my husband last filed taxes for 'us' for the year of 2008.

I am asking anyone to give me any advice and/or testimonial so that I may prove to immigration that my marriage was of good faith and what is the possibility of me obtaining my 10 year Green Card with my case. Is their any other information that I will need to provide for this mater. Please help, any advice is good!

In general, eligibility is based on whether a qualifying relationship exists or existed and the petitioner was subject to extreme mental cruelty or battery by the U.S. citizen or LPR. The Act also allows for an abused parent of a U.S. citizen son or daughter to self-petition for lawful permanent residence.

I'm right on the edge of the poverty level, so I'm tallying all of my assets. My bank accounts are a little thin, but I have a life insurance policy, some mutual funds, etc, so that helps.

Anyway, besides my crappy car, I don't have much in the way of assets. However, I'm an academic (ABD grad student and research fellow) with a large book collection (3000+), own a lot of guitars (5), amps (3), and other music equipment (mics, preamps, recording stuff), and other pricey objects (computes, etc). These items have a fairly large cash value. I have a property insurance policy valued at $80,000. I want to list these things as assets. Is that OK? If I claim such things as assets, and if I include a copy of my insurance policy (or whatnot), can I claim that full value? By the way -- I've had the policy for about 7 months or so.

I'm not sure what to count or not. I don't want to stretch it, but these items are valuable, and it seems to me they'd count as assets.

CSC received my I-129f on June 9th and after signing up on the site it shows that my file has not been "touched" since June 14th, 2010. Is this normal? I know it takes a while and we are waiting, but now starting to get antsy / concerned.

I booked my venue for my July 26, 2009 wedding in July 2008. I submitted our I129F application in August, because I wanted to make sure we had more than enough time to get approved (even if there was a chance of an RFE). Since I have been living in the UK for the majority of the last 4 years, we were also planning on doing a NON-legal ceremony here right before moving to the US, for all the friends and family who we weren't expecting to make the trip to America, but after most of them said that they will be coming to America, we decided to save the money and put it all towards the real ceremony.

Yes, the poster runs the risk of not being allowed entry into the US for the visit, but they wouldn't technically be getting married, so the visa (when/if approved) would not be invalid.
Yes, you could run into trouble with the embassy if they catch wind of it.

Is it possible, though? yes.

Not that it's impossible to have everything ( including visa ) for that time, but unlikely. Talking to him last night, I mentioned that it's a good thing to be mentally prepared for a later date, and now we are hoping for August too. ( EEEKK In a South Carolina summer!!! I'm going to melt!!) I've only brides maids picked out, and we both belong to the same faith, so the church won't be a problem. What I've asked Tim to do, is look for plans A, B, and maybe even C for halls and photographers, because you never know which may or may not be available for your wedding date. We won't even set the date until I have my interview. ( Then he'll probably get on the phone and say "mail off those invitations!!!) LOL

I do hope that things will work out for you considerably. This waiting game sucks!!! * and all peoples nod their head in agreement* This is the price to pay about marrying a foreigner! The hurry up and wait game. I like the comment of "penciling" in the tentative date. All though way too many people have said they want to be at Tim's and my wedding....( well over 300!!), it's a strong possibility that when our date is finally set, a lot of guests won't be able to make it because of prior commitments. Thank you so much smile.gif I think if we get too close ((maybe april/may)) and aren't well through this process we will just move it to a later date...but I really don't want to sad.gif But trying to do it in August isn't worth the chance he wouldnt even be allowed in the country, not to mention the implications it could have later. It looks like CSC is moving fairly quickly, so hopefully we will make it.

By the way, I was looking at Igor's list, and some of the people who just got approved, their timeline said it only took 60-70 days?! How is that possible??

OK I just want to clarify what I felt was unnecessary. I think that telling me NOW to not make plans, etc, was unneccessary because clearly we already have. And yes, I am really uneasy about having him come here before the K-1 gets approved, etc. I just wondered if what my pastor said was even an option. We've actually been extremely lucky because most people ((photographer, band, cake etc)) involved with the wedding haven't even asked for deposits because they are close friends of ours, so even if we have to change the date, the only deposit we may lose is the reception hall, which I think might be willing to work with us. Other than that, there's no other deposits to put down, so we can afford to just wait now and see what happens.

But mainly I just want to clarify that I didn't think he was being rude because I did not like his answer. If he could have answered without the bit about "but you shouldn't be doing this..." I would have thought nothing of it.

Of course, it's both possible and legal but there's not assurance the foreign fiance will be allowed to enter the US at the appropriate time. K1 visas and traditional "far in advance" wedding plans don't really go together very well.

Nothing to "ensure" it. That was my point. You can read lots here about how to improve the chances of being allowed to enter. Start with the FAQ's or read about others asking the question nearly daily.

I'm known for being blunt but I guess I wasn't blunt enough. Making traditional wedding plans before the visa is in hand has a pretty good chance bringing you major disappointment. You would be trusting to luck.

Oh no sad.gif I just read the guidelines for the passport photos (here on VJ) and now im kinda scared. The passport pictures for the UK are a different size than US passport photos. And my fiance did his picture in the UK, so it is different. Is this going to be a problem?? Will I get an RFE for this? Also, what is the reason that the USC has to send there photo??
