K-1 Fiance(e) Visa Process & Procedurescheck status online make me nuts...

you are typing the whole number with the WAC at the front right? Ours showed up almost immediately...right after I got the e-mail and txt it was on the USCIS site within a day or 2.

Good question to ask indeed. It is a 13digit receipt number. If you are sure you are typing in the correct receipt number and still see the same status, then you should give them a call and definitely find out.

Good Luck!

K-1 Fiance(e) Visa Process & ProceduresNVC Processing Time

I am not sure where the post is here on site but you can track the DHL shippment from NVC to embassy. I am not sure if you are speaking of from USCIS to NVC? I would not be sure of that side of things. Good Luck

David

I think the OP is asking about his approved I-129F package which should have been sent from CSC to the NVC.

I think they should have atleast sent it out to NVC by now,and if it has gotten into AP in the NVC stage then it could justify taking time reaching the embassy.

But you might want to check out the October CSC or VSC thread, there was a vj member whose approved application got lost!! They were so careless so as to actually lose their package.

I hope truly it is not the case with you,but do keep pressing them for more information.I wish you hear some encouraging news soon.

K-1 Fiance(e) Visa Process & ProceduresNext Step help Please

hi , i recieved the approved petition letter nearly 2 weeks ago and i am in the middle of collecting the required documents , divorce decree , vaccination records, ect , i have a few questions i wonder if you can answer , is there a time limit from when you recieve the approved letter till you have to gather your forms and documents and make your medical and visa appointment as i am at 2 weeks nearly from recieving it

and , as i understand it you have to have the medical first before the interview , is it possible to do them both on the same day or mabey medical 1 day and visa the next as i live 500 miles away and dont fancy doing that journey twice on a bus if i dont have to , if it is possible what would you schedule first , the visa interview then try to get the medical scheduled the day before , or the other way around . thank for any advice

ps . the letter in case you are wondering what i am talking about

both links are not working that they sent me in the letter , i dont know why .

We are pleased to inform you that we have recieved an approved petition in support
of your fiance or K3 visa application . You now need to complete appropiate forms and collect required
documents . A detailed explanation of the process is found at

http://london.usemba...visa/iv_15.html

Once you notified us that you all your documents , we will
schedule an appointment for your visa interview

All fiance and K3 applicants , regardless of age , are required to
undergo a medical examination with the embassy approved physician . More information onhow to
arrange for a medical can be fopund at

http://london.embass...iv/medexam.html

Hi,
You will get a lot more information in the UK forum. If you just went to the regional forums, there you will see all the answers to your questions.Well most!!
And I think as far as London goes, they do want your medical to be scheduled first and with a few days gap between the medical and interview.
Good Luck!

K-1 Fiance(e) Visa Process & ProceduresCall your Senator!!!

Thank you to those who have NEEDED to call and explained WHY it is necessary. Everyone randomly saying "Call your Congressman" is really frustrating!

I am not asking because "I" intend on it any time soon, just to clarify to those who might be newer here!

Nice question indeed. The 'contact your senator' suggestion is only for extreme cases ,unfortunate situations ,or for those cases which are way passed their time-frame.Not for kicks.!Else soon they might start thinking people are just not concerned about waiting it out even a bit,and will stop entertaining those calls which really are of a serious nature.

People who start this process have to wait. Then if you are super-lucky and things happen faster than you expected, it is well, just cause you got lucky :P

K-1 Fiance(e) Visa Process & Procedureswaiting for K1

My case is filed with USCIS and it is still at "Initial Review"

Hey Mugdha,
So you do have the NOA1 then and the receipt number then ,right?
Okay so that means they are now reviewing your application. What you can do now is set up an email account with USCIS.Add this case number in your portfolio and give a valid US number for text alerts and an email ID to receive notifications(like RFEs or approvals). Then each time you log in,you can check the last updated date field. If that changes that means they are handling your application and it is called a 'touch'.
It could mean nothing or it could mean something. But from what I see now, people have been geting approvals faster.Which service center btw?

Good luck and hope this helps for now :)

K-1 Fiance(e) Visa Process & Procedureswaiting for K1

Hi All,

Its been 2 months since We have filed for my K1 and not heard anything from the consulate yet.
My question is....can i apply for a tourist visa in the mean while and visit my Fiance ? Will that complicate the K1 process ?

Hi Mugdha,
Yep for starters, do fill in your time-line.Others can help you.
And you might have to wait a little longer.Right now the time-frame to get an approval is 5 months in both the service centers. But people have been getting approvals earlier than that,so you might be lucky.

Also, I think people do visit each other during the process,so you could. And if they ask you anything, you should be truthful at the immigrations counter and that you are following a proper process and would just not stay back in the states on a tourist visa.

Hope this helps for now.Wish you good luck for a speedy approval

K-1 Fiance(e) Visa Process & ProceduresForeign Fiance flipping out...

So now that we have about 4-6 weeks before her interview, she is flipping out about coming to the US. She feels "trapped" that she will have to wait several months before she gets her residency, social, job permit, and be able to see her family again. Help! Has anyone else gone through this? This is really wearing me down, I've run out of things to say over this topic! What can I do or say to her to calm her down?

I think more than the process which will help her obtain a green card, permit to work and permit to travel to meet her family faster, she is just emotionally a litle jittery about it,now that the interview is close by and things really are happening.

You should try to support her and convince her that all that will be surely possible with time.I think she just needs assurance(like most of us foreign fiances believe me).

I hope a little loving help will give her the much needed courage to do the move to a new country. (F)

K-1 Fiance(e) Visa Process & ProceduresK1 Procedure
I found the NVC number 603 334-0700 ,try this !

Also regarding your fiance's grad school stuff. All I understand is you will have to use your K-1 visa within 6 months of getting it.

So if December falls within that range then you will be safe.Once you use the visa to enter the states, then you have to marry within 90 days.So you can plan it out well, since from what I have heard Canada takes a while to log packet 3s and then assign interview dates.
JohnAnweshaFemaleIndia2010-05-13 01:57:00
K-1 Fiance(e) Visa Process & ProceduresK1 Procedure

Will he be contacted by Mail from the Consulate or by phone? And what is NVC? Should I at this point wait till his Consulate contact him before I take any action? I don't think the procedures list this clearly of when I should take action to do anything or when he should take action.

Do you know how he finds out when he will take his medical examination and interview? Hopefully it's on the same day? It wouldn't make sense for him to fly to Vancouver twice right? We are very confused.

And another question I'm not sure if anyone can help. I forgot to ask. He needs to finish 1 more semester of school which will be until December before he qualify to apply for grad school over here. Since I got NOA2 so soon, how can he stay there to finish fall semester? Or does he have to come marry me right away? We are very worried about this issue.

The NVC is the next halt after the service center approves your petition. So you can wait for a week and start calling them (you could just search for their number on here),and yes please do speak to a Human. Not to the automated voice response system. They will let you know the new case number and also let you know when they sent it to your fiance's consulate.

Then the consulate sends your fiance a packet 3.You need to fill some forms and send them back.Actually, from here onwards it would be better if you asked all your questions in the Canada regional forum, they are much better equipped since all consulates are different.

And only then you find out about your interview and medical.

Good Luck!

Hey all!

I've been here a while now and I guess I should know.....but I don't and I can't figure it out or find it. I know how to see status updates on the USCIS.gov website and I can log into my account and all....but how do you know if they 'touch' your case? Thanks.

If you log into your account, you should be able to see your case number listed in your portfoilio? And beside it there should be a 'Last Updated Date' field.Keep checking that.If that changes to a more recent date ,then your application has been 'touched'!

Hope this helps!

K-1 Fiance(e) Visa Process & ProceduresNeed help filling the K1 package

What is the difference between these two?

- Proof of having met in person in the past two years (I will put photos here)
- Proof of ongoing relationship (How about here?)

Also, for G-325A, do I need to submit 4 copies of it? How about the Letter of Intent?

Thanks alot.

Yes as proof of having met in the past 2 years, photos are acceptable. You can also use boarding passes, hotel receipts etc.

Proof of ongoing relationship I think comes into play after your petition is approved and sent to the embassy. When the foreign beneficiary finally goes in for his/her interview, since some time must have elapsed between applying for K-1 and the interview stage, the Consular officers would like to see that you still have an ongoing relationship at that point of time.

I have heard of people sending 4 G-325a copies, but we sent one each(for me and my USC fiance) and it worked just okay.Sending more is never a problem however!

Yes,the letter of intent is damn important. Both of you have to sign and send it,once during your initial petition phase.
And when the interview comes up, another one ,with more importance on the USC's letter with a changed date, closer to the interview date.

Hope this helps!

K-1 Fiance(e) Visa Process & ProceduresA little help/advice please?

Hi, wonder if somebody could give me some advice. I am a British Cit and currently live in the UK. I am however engaged to a US soldier who is currently deployed in Iraq. He is due home in August and I will be flying over to the US in September to stay with him for a month or so. As he is anticipating deployment to Afghanistan in Feb 2012 we would really ideally love to marry as soon as possible and at least try and enjoy some married life living together before this next deployment in 2012. The problem is that we have been told by so many different sources, so much conflicting information that we don't know where to begin. Can I marry him when I go and visit in September? Or will I have to apply for a visa? and if so, does it really take a year for the visa to be processed?
Any ideas/tips/advice?

Thanks for your help :)

You should not marry when you go visit him on a tourist visa or the equivalent, since that will constitute immigration fraud.
You could go either the K-1 or the CR-1 route. The K-1 is a fiance visa, where in your USC fiance petitions for you to be able to go to the US to get married in the States.Time-lines vary between 3 to 5 months i,e in a problem free situation.
The CR-1 is a spousal visa, wherein you both marry outside the States and then he goes back to petition for you to come over to the States.Again time-line vary between 4-5 months. It depends. It will not take a year I think but one never can say anything too safe about immigration.

Good Luck!

K-1 Fiance(e) Visa Process & ProceduresReturning Packet 3 before consulate sends it out

Hi everyone, we are fortunate enough to have gotten out NOA2 last week and have already heard that our case shipped to Madrid on Monday. First of all my NOA2 date says its good between May 5 and Sept 5. I begin teaching in August- which is also Spain´s month of vacation time off- so we want to do our interview before August. I´ve heard that the embassy is pretty backed up with interviews from now till mid- July. I want to get my paperwork in as soon as possible to get an interview before August. My fiance has all his paperwork ready. Can we send the DS230 to the embassy before we have received Packet 3 or will that pizs them off? What is the general opinon on this? We just need to get a date! Thanks all!

Hi Meghan,
You would atleast need to await some sort of confirmation from your embassy that they have received your K-1 package from NVC.
Once you do that ,probably then you could send them your papers.Or try asking if you could scan and send them too!
JohnAnweshaFemaleIndia2010-05-13 03:21:00
K-1 Fiance(e) Visa Process & ProceduresLost K1 application

Just when you think you are awaiting your packet 3 and interview you chase your application and receive this email:

U.S. Citizenship and Immigration Services (USCIS) is unable to locate your petition or application. You are requested to file a duplicate petition or application in order to reconstruct your case. In the interim, USCIS will continue to search for your approved petition, but at this time it appears that your petition has been lost.

Wow!! that sucks.

So do they expect you to file all over again and pay $455?That is completely unfair and such a bad blow.

I feel for you (F)

Hopefully, they recover your 'lost' petition.Could you may be contact your senator or congressman?Just give it a shot.

Good Luck !

K-1 Fiance(e) Visa Process & ProceduresNOA2 Stolen

I am about to loose it.

The NOA2 is needed for the interview, which I expect to be in about 2 months or so (I hope)... but I was going to bring it to the medical because I never received my notice from NVC. It takes CSC at least 3 MONTHS to file a I-824 (replacement I-797 aka NOA2). The fee IS $340, and if you want that waived you need to send a waiver request and in my case she said, an expedite request to Chicago. IF the waiver request is denied then you still need to go through CSC for a new copy. This is absolutely ridiculous. These items were stolen from a US Army base, I did not lose them or was negligent.

Every single person on this base (even up the chain of command) has been urging us to skip the Visa and just have me move here and we marry and file for AOS, it's how everyone else has done it and they all were approved no problem. But me being a good person and all wanted to do this the right and legal way and now I'm just getting effed over big time. Sad part is this is just the next piece of bad news in a string of bad news we've been getting over the last 4 days.

I am so sorry to hear this! I really wish things took a turn for the better.I had a similar scare about the NOA2 just a month before my interview, but I did find mine ,and they never did ask for it in the actual interview.May be they will not too during your's.Do you have any scanned copies of it?Cos then you atleast have a copy of it.

Wish you all the good luck you two need(F)

K-1 Fiance(e) Visa Process & ProceduresK1 Interview

Hi everyone,

so my fiancee (he's Dutch) and I have been waiting with bated breath for our NOA2, and discussing next steps of the immigration process, and we had a question I can't seem to find an answer to online, namely: if (and when) he has his interview for the K1 in Holland, will they tell him if he's "passed" then, or will he get some kind of notification in the mail as per the rest of the process? We're just curious, and thankful for any advice you can give!

Hi there,
He should be told right there at the interview whether or not he is approved. In case they need some additional documentation ,they might also tell you something like approved pending additional documentation, or the other thing that sometimes also occurs,if the consular officer is not convinced about something, then they might put you in Additional Processing(AP).
But they do however let you know of the outcome there and then, unless it is one of those special circumstances.

My fiance is in Oregon and i am in India.

I Am currently In India with my fiance And we both want To make sure that we compile all necessary evidence for our K1 application.

How many pictures do we need To submit In The K1? Do They all need To be close up face photos or do they accept full length photos? Which type (full lenght or close up) is better for The application?

Should The photos we submit contain only us or if there are some with family members is that ok?

Are they looking for photos of The engagement or will regular photos be ok?

If we submit a bunch of photos taken on The same day In The same clothing will that be ok? Or is it better To submit a variety of photos from different days And clothings?

Delhi Consulate is a tricky one and you have to be very careful and well prepared. Photographs are considered as the secondary eveidence but to be on the safer side take as many pictures as you can in different clothes and also with your parents and friends. Including the Engagements photos will give more strengeth to your case. I suggest you to go through the Delhi Embassy reviews and you will have some idea.
Wishing you luck

even if we've other proof : receipt of western union+ copy of our conversations( on msn)+ emails+ copy of conversations on phone+airline tickets

is all that 'll not be enough for the consulate???????

Why on earth would they not approve you simply for not having pictures of a 'party'? Just make sure all your other evidence is robust and don't sweat it.

thank u

I will say a big NO to western union reciepts. i suggest not to include them as one of the evidences. When we submittd our 129f petition in july 2009 we dint included any of our pictures and we got our NOA2 in 87 days without any RFE. Pictures may be asked at the consulate. Good replies members ......but I am still a bit confused ........ are all these datas uptodate ??/
So apart from the plane expenses etc the absolute necessary things are as Jessy G suggested :

$500 : I-129f (petition)
$200 : visa fee + medical & misc.
$1000 : Adjustment of Status (required)
$500 : Overhead (shipping documents, faxes, photo printing, notary, etc, etc

so total $2200 ??

does the above include

$340 - New EAD if have not yet recieved GC
$545 - Removal of Conditions
$675 - Naturalizaion

I am from India and already met her in USA. I am in India now and we are planning to apply for K1. We have all the evidences printed out and ready as a album.

b ) NO I-134 is needed at visa interview.

c ) YES, USCIS only needs copies of evidence, NOT the originals.

Also, at petition time, you don't need to send a lot of relationship evidence. You can save that for the interview. What you need with the petition is evidence you were together in person some time in the last two years. Passport stamps and boarding passes will usually do that quite well.

She is self employed and last year income was gorss 30K but but had 22k in deductions..the year before that it was 15K. Now 30K is gross income for 2006. For 2007 it wd be 18k gross. She operated at a loss so didnt have to pay much tax.

NOw she is publishing herbook and she has a sponsor for her book. She has assets with her home and car which wd be 1,30,000. Wd her I-134 be okk ?? She has no dependables ...or we have to look for co sponsor.

Pls help !!!

$130,000 in assets is enough. She should show documentation for income and assets.

I agree that this is a case for showing income and assets. She'll need to document the assets though, which could mean appraising a home etc.

So she can pretty show her income for 3 years and tax payments for 3 years and that wd do ?? No need of any cosponsor !!!!

No, she'll need to list her assets and document them as well.

I am sorry I really didnt get u ........... she wd list her assets along with her income but what do you mean by document them ?? so we dnt need a cosponsor ??

HI all ,
I really got concerned and want all of your advice on something about finance. MY fiance for USA is applying for K1.Now she has to fill the I-134 for me . I ama bit concerned abot her incoe things.

K-1 Fiance(e) Visa Process & ProceduresSpecific question about I-134 ..pls help !!!
HI all ,
This is a basic thing i have to know about I-134 ..may be all knows but i cdnt find out the exact answers......

what all documents my fiance need to submit along with I-134 as she is self emplyed .........

# I guess these are the ones :

Bank statements ( how many years and shd they be notarised too ?? )
I-134 notarised
Last year tax return
Asset documents like for house ( hope i can show photocopy of those and notarised )

# Also my cosponsor is employed with an university and she has to diposit the same ??? She says she cannot give an employers leter as its too hasslesome to take out. What can i do about that???

# In the question 11 in the I-134 where its goes like this "
I ..................make specific contributions to the support of the person(s) named in item 3.
(If you check "intend," indicate the exact nature and duration of the contributions. For example, if you intend to furnishroom and board, state for how long and, if money, state the amount in U.S. dollars and state whether it is to be given in a lumpsum, weekly or monthly, and for how long."

can my cosponsor write that she would help me thru 3 years in both money & housing whatever needed ( without specifying anything particular ) ..........

PLease extend your valuable experience and knowledge .....Thanks from my heart .............

Hi. I have a question what is the minimum salary what somebody have to make without that somebody have to cosponsor?!

Good Morning,

It depends on the number of people that are in the sponsor's household (children, or other dependants). Here is a link that will show you the exact dollar amount. (Shown is 100% and 125%, you will want to meet 125%.) Source

HI ,

is the povrty level guidelines at uscis site that u gave is a year salary ???

e.g. $17,112 as its said the 125% of poverty level in 48 Contiguous States, the District of Columbia, Puerto Rico, the U.S. Virgin Islands and Guam. So is it annually ?? pls answer though i know this is a silly question .............. thanks !!!!

You would be using the I-134. And yea your good on the income. Especially if she doesn't claim anyone. Just make sure you get her to get an award letter showing that the income is ongoing.

Thanks & what exactly you mean by award letter ??
