Just wanted to give an Update on our situation In Ciudad Juarez regaurding our K1 Visa !!!! Some of you know our story, if you do not please read our post. Teresa and I now have the support of our Senator and our Congressman. We have also made a formal appeal with our attorney and we are going to be published my Local News Paper this week. I believe that within a month we will be hearing some good news. So all things looking up !!! We will continue to fight the good fight and thank you for all your support !!!

Hello all good people !!! Soon I will have to Leave Juarez and we found it to be cheaper to fly from El Paso to Kansas City. Instead of Flying from Ciudad Juarez to kansas City... The difference is about $300 dollars or so !!! So here is my question !!! What is the Best way to get to the El Paso Airport with no car from Juarez !!! Anyone done this before any reconmendations !!! Also I was hoping to find out the distance between the border in Juarez to the El Paso Airport !!! We have about two weeks before we need to do something !!! We are Praying the consulate accepts our appeals and allow us to go together, if that happens we will rent a car and drive together !!! Please Pray for us that, that will happen !!! We still have some good people on our side fighting with us !!! But you know that whoever is faithful with little will given Much !!! Good Afternoon all, we felt like we should update VJ every Monday as we can on our progress to appeal to the consulate. Since April 22,2008 when we were deined our K1 Visa because the consulate officer stated he believed we were already married. Even though we provided legal documents that we were not married. If you like you can read about that on our memeber site. We did give the consulates office everything they wanted but they rejected our document because they said it was worded wrong. Then they refused to see all our other supporting documents. SO here are the steps we have taken to resolve our issue. We ourselves tried to request a review at the Juarez consulate. We also contacted our attorney to make a formal appeal and factual finding on April 28,2008. Then also contacted Congressman Cleaver and on April 30,2008 their office recieved a fax back from Juarez that they was going to review our case. We also contacted Senator McCaskill and on May 5,2008 we received an email from her office stating she would assist us with our case. We also contacted the media and on May 8,2008 we made front page news below is that link http://www.examiner....ped-in-paradise On May 9,2008 we spoke with the Mayor of Missouri Don Remial. Then today we were contacted by Senator Bonds office but miss the phone call. We are fighting hard for this injustice. We believe this can be resolved quickly if they just review our file, isnt that their jobs. We were approved for the K1 visa pending the interview with the same documents that we filed the I129f with. Except the Certified letter the CO asked for to state we were not married and we waited for that document to be Fed Ex to Juarez at our hotel. The document was on State Letter Head Notarized with the State raisied seal stamped on it. It was supported with contact name and numbers as well as a goverment website that is public record for the consulate to review this will show that no marriages has taken place between my fiancee and I. I am still in disbelief that despite all the eveidence we have showing we are not married that the consulate continues to deny our visa on their opinion. Visa Journey is a great site with lots of invaluable resources and adivices. We are blessed to have found this incredible site. Helping people help each other. We Cant believe it but we have recieved a letter today in the mail that we have a NEW OPEN APPOINTMENT for our K1 visa. After all we have been through to get another appointment is a Huge Blessing. We have used our Senators and Our Congressman and our Attorney to make this happen. This was a fast turn around only three weeks. We Pray that we are recieved with the Favor of the Lord. I dont believe that she would need another medical appointment but do you think we will have to pay Banamex another $131 dollars for this interview. Well, I was to. I never received nothing from Juarez in Mexico. They send the packet by ordinary mail. My fiance (now my husband) received the packet in USA and I went to the interview with that packet. Actually the packet hasn't arrived in Mexico yet, at least nobody has told me nothing to this respect. If I had been waiting for I will never being in USA hahaha!!. You are right after I posted that question I realized my mistake. By the way we did get our Fed Ex Package we are still waiting for our USPS Express package. These are our original documents from the attorney and from the congressional office we have been in contact with pluse are newspaper article. We arleady have our Fiancee packet but since this is a second interview we wanted to have of all of our original documents to the congressional offices before we went back to our appointment. After this process I know we have 90 days to be married and believe me that is not an issue we are going to marry right away. So what is next step with the K1 after you marry do you file an I485 for an adjustment status. I have many questions about this process. Today was definitely a day that I will remember forever!

I arrived to the Consulate around 7:15, my interview was at 8:00 am. I was assigned the No. 3 and entered the Consulate until 9:00 am, later they called me to the first window, where they checked my papers, everything was in order... UNTIL the woman (who was guatemalan), told me that I had not realized we needed a co-sponsor, I responded quickly "No, we don't". Later, she started to "explain", if that can be called explain, because she obviously had no idea what the heck she was talking about, that my fiance's 1040 of 2006 did not report enough income, then I explained her that the reason was that my fiance is in the military and was deployed in 2006 and he was exempt of paying federal taxes during that year, but he did file for the forms anyway, I offered to show her a letter signed by his commander, and she refused. I told her, why do we need a co-sponsor, even if you want to believe that he did not have enough income in 2006, which isn't true, he DOES meet the income TODAY, you can see it on the I-134 and his employment letter, she said NO, we need the tax declarations, and then she said: "If he is marine ( I never said he was a marine, so I don't know where she got that from), and did not pay taxes then he CAN NOT BE YOUR SPONSOR" I tried to explain her again, in the nicest way I could, but I was getting really upset at this point, this woman was talking non-sense! I said, so just because he was in the military overseas he can not be my sponsor now? eventhough he DOES meet the requirement today (and back then he did too!), she said.. well if you want to, you can debate that with the Vice-Consul, I'm advising her that your application is incomplete and that you must come back another day with a new I-134 and tax declarations of a co-sponsor! Then she put a big yellow paper with her recomendation on my file.

I was beyond upset! I went back to the waiting room and took a sit for 1 loooooooooooooong hour, I waited and waited and went crazy, trying to figure out where did she got all that ####### from?

When the Vice-Consul called me by my name, to my surprise...she was sooo nice to me! She smiled at me and said hello in spanish, the interview took less than 10 minutes, she asked:

How did you meet?
How many times have you been in the U.S.?
How many times has he been in Guatemala?
Does he speak spanish?
Do you speak english?
What do you do in Guatemala?
What does he do, besides being in the N.G.?
ye
She reviewed all the papers, asked about my fiance's deployment, asked again if he was still in the N.G. I gave her the letter that my fiance's commander signed. She did not ask me ANYTHING about the tax forms! She just checked them and checked the rest of the papers too, she was not saying a thing... and I was starting to get more nervous. And then.. she grab the yellow paper.. and threw it away!!!!! I was soo anxious for her to say something! Then she finally talked to me again. she said: "I will cancel your tourist visa, because you will receive your K-1" I had a huge smile on my face when she said that! Then she said: "Everything is in order, CONGRATULATIONS! You have to come tomorrow at 3.30 pm to pick up your passport and visa and rest of the papers"!!!!!!!!!!! I was sooooooo happy and wanted to get out of the consulate ASAP to call Eric!!!! kicking.gif

I could not be happier about the approval, but I'm still wondering why does the Consulate has this type of local employee's and does not even mind, about explaining them the rules! And the worst part is that this guatemalan lady, is the same person who replied to an email I sent to the Embassy a long time ago, where she gave me the wrong requirements for the interview (she thought I was applying for residency) I know because I asked for her name on that ocassion after I was aware of her mistake, and today when I saw the yellow paper she filled out it had her name on it too!!!! headbonk.gif I wonder if the Consulate ever realizes what kind of inepts the have working there!


This is great News Congratulations ! We also got an second interview and we are feeling very blessed. We are having some papers sent via fed ex from our attorney and our original news paper article in case we need them and we hope to attended this apointment on Monday or Tuesday. Today Teresa and I sent our papers to the attorney for our AOS. We were married on the 24th of May and our K1 visa was good through the 18th of August. So hopefully soon we will be able to get Teresa her EAD and then her green card or perment visa. No worries it is all in Gods hands. We love the support here. We also love to share our expereinces. Hi there Chuck and Teresa Here !!!! We did encounter the same issue in Juarez on April 16th !!!! Please read our Post !!! Howerever to make the long story short here !!! The Consulate officer asked us for the same documents to show we were not married !!! When we produced them Noterized with the states raised seal as well as emails from the goverment webiste and contacts of the person we talked to. Also we provided them with the goverment website of where thoes documents came from. The officer then stated well this Certified Certificate is worded wrong and he denied us anyhow with out looking or considering any of our other documents. It outrages me that you can Clearly be in a US Consulate and have a US goverment website with all the factuall eveidence and still they can deny you. Trust me this is not over for us !!!! So we are Praying that someone any one can help us or give us some type of insight of what to do next !!!! Also by the way we took photos of our engagement dinner with both of our families present and the consulate officer stated these photos appear that you are Married. The Consulate officer has Nothing but his Opion there is no Law to back his descisions or alligations. We hear all the time about safety and Homeland security but when one US goverment does not look up another US goverments website and people go off of opion and not on facts. My fiancee was very worried because her notarized certificate of being single wasn't going to come before we file the K1 Petition. I kept telling that I did not think we needed it for the I-129F. It wasn't until I told her that no such thing exists in the US, that there is no certificate of being single, that she finally "got" that it wouldn't be necessary for this step. (now later on, at the interview I think it will good that she got hers)

It just blew her mind that such a thing didn't exist here. She kept saying, "But how do you prove that you can get married."

"I don't know, you just swear that you can I guess."

Ha ha. (of course I'm sure background checks alleviate some of that concern on the governments part)


Hi there Chuck and Teresa Here !!!! We did encounter the same issue in Juarez on April 16th !!!! Please read our Post !!! Howerever to make the long story short here !!! The Consulate officer asked us for the same documents to show we were not married !!! When we produced them Noterized with the states raised seal as well as emails from the goverment webiste and contacts of the person we talked to. Also we provided them with the goverment website of where thoes documents came from. The officer then stated well this Certified Certificate is worded wrong and he denied us anyhow with out looking or considering any of our other documents. It outrages me that you can Clearly be in a US Consulate and have a US goverment website with all the factuall eveidence and still they can deny you. Trust me this is not over for us !!!! So we are Praying that someone any one can help us or give us some type of insight of what to do next !!!! Also by the way we took photos of our engagement dinner with both of our families present and the consulate officer stated these photos appear that you are Married. The Consulate officer has Nothing but his Opion there is no Law to back his descisions or alligations. We hear all the time about safety and Homeland security but when one US goverment does not look up another US goverments website and people go off of opion and not on facts. Hey there if the wedding was not registered she can still apply. However after they recieve the K1 visa they have 90 days to be married legally. I hope this helps ! Chuck and Teresa
