Well, I guess my question is irrelevant now ... Just went out to the mailbox and the I-797C form was there. I guess it's the 'Application Number' shown on this form is what my wife would use to check on the status of her case?

I just looked over the N-400 instructions again ... Nowhere did I read that there is a separate form you need to fill out in order to be contacted via email or text message.

 

In fact .... "Part 3 - Information to Contact You" it says "Provide your current telephone number as well as your current e-mail address"

Thanks alix .... My wife never included a separate form with her email address or cell phone number on it ... but, she did put her email address and phone number on the N-400 where it was required.

 

Had no idea there was a separate form you needed to send them (even when your email address and cell phone number are already on the N-400).

1.  Yes. That doesn't mean you will be approved, just that your paperwork is sufficient for them to start processing the case.

 

2. If they don;t accept, they will send everything back, including check.  It is much more likely that they either send you an RFE for clarification/ evidence, or deny your accepted case, in which case no money back.

The reason I was asking these questions is that looking at other people that have sent in there N-400 in the early part of July, these people have already received a text message / email or an I-797.

 

In my wife's case, Dallas received her N-400 on July 11 and cashed her check on July 16 .... but she has not received anything at all stating that her case has been accepted.

I understand that if your N-400 has been accepted, you will normally get an email or a text message stating so. Additionally, you will get an official letter (I-797) in the mail stating that your case was accepted.

 

1. If they cash your check, is that a good indication that they will accept your case, and sooner or later send you the I-797 stating so?

 

2. If they don't accept your case for some reason, will they give you back the $680 you sent them .... even though they have already cashed your check? 

 

 

The reason I ask this is that I read somewhere that someone's N-400 was [not] accepted and they got there check back because of it .... But, if they cashed your check already, they certainly can't send your original check back to you.

What she needs to include more than anything to her N-400 is a certified copy of the final court disposition showing that the charge against her was dismissed. If she does not have that, she can request a copy of it from the Court Clerk's Office. Don't send in your N-400 without it.

If they want any additional info from you, they will ask for it later, but attaching the final court disposition is very important.

I have been through this exact situation before.

Only days in which you were not in the US at all count as days outside the US.

If you left on the 15th and returned on the 17th, then you put down 1 day for that trip.



 

I don't agree with you .... If you left the US anytime on a certain day, that day counts as a day you were not in the US ... It don't make any difference whether you left just before midnight or just after midnight.

 

Same as returning .... The day you get back to the US counts as a day you were outside of the US. You were still out of the country on that day you returned.

 

Leave the US anytime on Jan 1 and return anytime on Jan 5 = 5 days out of the country (partial day on the 1st, full day on the 2nd, 3rd, and 4th and a partial day out of the country on the 5th)

Any other government document I have seen states that the day you leave the US counts as a full day, and the day you arrive back in the US also counts as a full day ... The time of that day means nothing

My wife was arrested and charged with misdemeanor battery (touch or strike) a couple of years ago (domestic dispute).

 

The case was dismissed (thrown out) by the judge, before she ever had to go to court, so she was never convicted of any crime.

 

Since then she had the record 'expunged' here in Florida. And since it was completely expunged, she could not get a copy of the arrest record or the court's final disposition.

 

The only thing she could attach with her N-400 was a copy of the final expungment order signed by the judge and a letter from her explaining why she is not attaching the police record or the final court disposition dropping the charge.

 

Immigrations has accepted her paperwork and they scheduled the biometrics for August 6.

I am sure they will find out that she was never convicted of any crime.

 

She is a little worried, but not that much.

Why is it that the applicant needs to provide a copy of the arrest record and the courts final disposition in the first place?

 

Immigrations (Dept. of Homeland Security) is going to do a full criminal background check on the applicant anyway (that's why you need a biometrics) ... They will certainly know whether or not the applicant has been convicted of any crime or not ... and will have full access to the applicants prior arrest records.

Today my wife gets this yellow letter in the mail ....

THIS IS NOT AN INTERVIEW NOTICE

USCIS recommends you bring the following documents to your interview:

1. Bring your state-issued driver's license or state-issued photo ID

2. Bring all passports and travel documents (including expired and current) issued to you by any government

She finishing her biometrics about a month ago. She also got an email telling her she is in-line for her interview (but no interview date yet).

I have a feeling that not everybody gets these additional requirements. I wonder what's up with this?

There is really nothing special with her case ... We got married in the Philippines 6 years ago, and she came to the US with me 3 years ago.

She has been back to the Philippines about 4 times in that 3 years she has been here in the US ... but not more than 3 months at a time.


BTW ... she mailed in her N-400 in July.

I can't see that hiring a lawyer will help you at all. The N-400 form is not that difficult to fill out. You certainly don't need a lawyer for that.

 

I can't see that a lawyer will really be of much help at the interview either.

My opinion ... Get the lawyer if they turn you down for citizenship .. but not before.

 

A lawyer may also be of help if you have any convictions on your record.

Well, we just got back from the Court Clerks Office. Obviously they could not give me a copy of the courts final disposition of the case, but they did give me a certified (embossed stamped) letter stating:

 

"Based upon information provided, the requested document / record cannot be located. We cannot confirm or deny a case for: Case #12MM243--- / Name: Mary ----------) exist in our case management system".

 

Well, the request for further documentation my wife got from USCIS  during her interview stated that the certified copy from the Clerks office of 'No Record'  should confirm that the record is 'Unavailable'.

 

I just hope the wording the Clerk's office used is ok ..... This is the best I could do.

 

Anyway ... That certified document is now in the mail on it's way to the USCIS field office where my wife got her interview a couple of days ago. I also addressed the letter to the Attn: of the officer that interviewed her.

 

I guess we shall now see what happens.

What I learned from this is that I should have gone to the Court Clerk's office [prior] to the expungement date to get a couple of certified copies of the final court disposition for my wife's case ... but, I had no idea.

Expunged records are not available to the public - but are still available to law enforcement, the courts and government agencies. 

 

If you don't get quick action through pleading, then subpoena the Court for the records.  You'll need to show cause why they should be released, but I think you're justified here.  A judicial order can release the records under subpoena.

Just talked to the lawyer that handled my wife's case.

 

He told me to go down to the Court Clerks office and ask to see the supervisor and show them the letter USCIS in Tampa gave me.

 

Where it reads ....

 

"If the court record is unavailable, you must provide an original or certified document from the court having jurisdiction over your case, confirming that the record is unavailable (expunged). Claims of "No Record" must be certified by the Clerk of Court in both the felony and misdemeanor divisions in the county where the arrest occurred".

 

He said if they still don't give me a certified document stating that the final disposition is now unavailable, to call him, and he will see what he can do.

i suggest to you that the clerk at the court was wrong.  It was convenient to use a telephone, but I suggest you show up in person with your wife, sometime in the next 5 days, have a different conversation. 

 

 

 

Well, the lady I talked to on the phone at the Court Clerk's office had me on hold for a long time while she talked to her supervisor about my problem ... and what I posted is what her supervisor told her to tell me.

 

I guess I could go down there in person, but I can't see that it will make the outcome any different at this point.

You know, if my wife's record had just been "Sealed", it might be easier to get this final court disposition, but an "Expunged" record is certainly a different matter.

I talked to the lawyer's secretary about why someone in the office did not at least make a photocopy of the certified court final disposition of the case [prior] to sending this certified copy of it to whoever it had to go for the expungement ..... they say it was a mistake by someone in there office.

 

I would like to call the officer that interviewed my wife, but if you go to the Tampa USCIS Field Office website, that don't even show there phone number. And I can't make the 2.5 hour drive up there to talk to him either since they won't let you in the door without an invitation letter.

 

Well, my wife's lawyer is in court today, but is supposed to give me a call later in the day .... hopefully he will have some info about what to do about this mess.

You know ... You can bet that USCIS did a very detailed criminal investigation on my wife, and you can certainly be sure that they know very well that she was not convicted of any crime. And you can bet they already know that her record has been officially expunged.

 

But they still want paperwork that I just can't get by myself ...... "Catch 22" situation here !

Had I known what I know now, I would have had my wife go to the Court Clerk's office and get 2 or 3 certified copies of the Final Court Disposition [prior] to having the case expunged.

 

And my wife's lawyer never mentioned anything about it.

 

BTW ... the lawyer actually got a certified copy of the final court disposition, but had to send it in with the paperwork to have the record expunged ... so now he has none.

We have a real mess on our hands now ...

 

My wife was arrested a couple of years ago on a misdemeanor charge. Prior to her court date, the judge dismissed the charge against her, so my wife never had to go to court.

 

Because my wife was never found guilty of any crime, she was able to have the record expunged here in Florida.

 

When filling out the N-400, she stated the day of her arrest, what the arrest was for, where arrested, and stated that the charges were dropped by the court and the record expunged.

 

Yesterday, she had her citizenship interview in Tampa. The interviewing officer told her she passed the interview but would need to send a certified copy of the Final Court Disposition of her case and a certified copy of the Expungement to USCIS in Tampa before they would set her a date to receive her Citizenship Oath ... and they gave my wife 30 days to comply with this paperwork request.

I called the Court Clerks office as soon as we got home .... There is a BIG problem here. Since the record was expunged, the Clerk stated that they do not have access to the final court disposition. They also stated they would not write a letter stating that the final court disposition was unavailable.

 

The Clerk's office told me the only way to get this final court disposition would be to petition the court to re-open the case. Then get the required documents, and then have the case closed again.

 

WOW .... This sounds like something that will take more than the 30 days my wife was given, and it sounds like something that is going to have some really expensive lawyer fees!

 

 

Anybody here ever try to get a certified court disposition [after] the record had been expunged?
