K-1 Fiance(e) Visa Process & ProceduresDivorce and Red Flags
Although I was separated since 2010, and Divorce had been in process since Feb 2011, my divorce was not final until Nov 2011. I filed my initial 129F in December 2011, just two weeks after my divorce was final. At the final interview, just 9 days ago, did not cause a problem for my Fiancee.

K-1 Fiance(e) Visa Process & ProceduresI-134 Question

Hi, I would like to ask some questions if it's ok.

Would it be okay if the I-134 have some erasures? Like for example the white correction liquid, is it ok to use it for corrections? My fiance made a mistake of putting my name on page 2 question # 8. He also check the "intend" box and indicated the exact nature and duration of the contribution on page 2 question # 11.

Thanks! :)

K-1 Fiance(e) Visa Process & ProceduresQuestions About My Criminal Record

Good luck with your visa in Lagos. Best be prepared for the strange and unusual. If the phrase injures your sensibilities you are in for a rough time of it.

I am very prepared. I grew up in Nigeria so I am very prepared. And you are being rude for no reason at all.

K-1 Fiance(e) Visa Process & ProceduresQuestions About My Criminal Record

ahem. "Ukraine" not "The Ukraine". Now, Jim, I don't go around saying "The VietNam"

Anyway, it is a misnomer to say the consulate in Ukraine is "very easy going". In fact they are very strict about having all the documents needed for each case. In your case, that can mean all the court records. They are also well known for discussing past indulgences of the petitioner with the Ukrainian fiancee. And they are well known for doing so in unflattering ways..."You know your fiancee is a drug addict, right?" So....make SURE she knows all the details of these cases. The worst that can happen is for them to surprise her with this information.

The consulate in Ukraine does not make up reasons to deny people. It does not look for reasons to deny people, it is not a high fraud country when it comes to family based visas, they do not have a lot of strange (perhaps "unusual" is a better word) traditions. No one cares if you had an engagement ceremony or if Mommy and Daddy approve, because that is how Ukraine society is. Typical Ukrainian women do not come to the USA and then try to find a way to bring all their cousins, brothers, sisters, parents, aunts, uncles, etc. to the USA. They are not a country associated with terrorism. They simply do not have all the "red flags" other countries have...but the women HAVE been vistims in the past of human traffickers seeking the hot Ukrainian women for porn and prostitution, they tend to be more protective of the women coming to the USA, making sure THEY are not being taken advantage of. There have been many instances of Russian/Ukrainian women being found here in basically "sex slave bordellos" and it is still happening regardless of the IMBRA.

Plan on them discussing your history with your fiancee. How that plays with her is another matter. Such things will have less impact on a younger Ukrainian woman than an older one. More mature Ukrainian women have had their share of intoxicated, abusive men and do not look kindly on abuse of drugs or alcohol, it is a deal breaker for a lot of them.

be honest and direct with your fiancee. Good luck

Such violations should have nothign to do with your ability to get an approved petition. YOU are not applying for a visa so it will have no affect on her visa application, except that you can expect them to discuss it with her. She should answer directly and with clear knowledge and they will drop it like a hot potato. She should not let them rattle her with terrible sounding statements.

Being different is not strange or unsual.

K-1 Fiance(e) Visa Process & ProceduresDon't want to marry her anymore!

Dude I would honestly get the hell out of that right now. If you are caught doing that, you could face time in prison.

Just tell her its off and cut your losses. Or go to prison and start a business with a guy named Brick,+

On another ANGRIER note. Its because of people like you doing ###### like this that honest, real couples who are in love (aka me and my husband) have had to live in near poverty because the government makes such tight guidelines.

so eff you.

K-1 Fiance(e) Visa Process & ProceduresJust a few questions about fees.

The medical is around $200 if you have no extra shots to get ( extra shots cost a lot !! unless you get them at your regular doctor )
The Visa interview fee is $350 USD.

AOS fee after marriage is $1070 USD. (not including the cost of passport photos and photocopys etc needed for the package) Needs to be filed soon as possible after marriage.

Our license and wedding at the court house cost us $75 USD
Getting my car plated and registered was around $375 USD
Getting drivers license was around $26 USD
Crossing the land border cost $6 USD cash for the I-94.

hmmm okay. so as of now, we will only need around 600 dollars?
and what is the latest we can file after we get married?

K-1 Fiance(e) Visa Process & ProceduresJust a few questions about fees.
okay! i know the basic fee of 340 to petition.
but after that? like what will all the costs be after that?
because i know there is a cost for an interview/medical, but is there anything else?
i am just curious because i want to know if i am going to have to help my fiance out at all.
so can someone give me a list of all the prices after the 340 dollar fee?

Thank you!!!

K-1 Fiance(e) Visa Process & ProceduresPOE question

I don't plan on returning once I have my K-1, so won't be taking anything.

yeah neither does my fiance, and he wont have a job when he comes down because he doesnt want to just leave his job without quitting a few days before..
i just dont understand.

do you actually need proof that you are returning even when you get approved for the k1 visa?
could you get denied at POE if you dont have enought proof that you are returning?

K-1 Fiance(e) Visa Process & ProceduresQuestion about my fiance's time in US

They won't reject the visa because he stayed too long. The issue arises at the border. They might only give him a small window to visit because he's been there so often or they might not give him any time at all (i.e. he would be rejected at the border).

He won't be able to stay until his interview for several reasons. Once the NOA2 is received (about 5 months from NOA1) the file will be sent to Canada. He will need to have police clearances done (with fingerprints) as well as medical.

but he can stay till the noa2 right?
lacieteeFemaleCanada2011-12-24 03:11:00
K-1 Fiance(e) Visa Process & ProceduresQuestion about my fiance's time in US

There's no rule about staying 30 days, unless his I-94 specifically dates his expiration date as 30 days. Do NOT overstay that date.

The issue you may have is when the IO reviews how many times your fiance has been in/out of the U.S. during the year. If it looks like your fiance is attempting to live in the U.S. (which may be considered as spending more days per year in the U.S. than in Canada) it may look suspicious. Proof of ties to Canada, return information, etc should be brought - but it should be brought regardless as entry is never guaranteed anyway.

and what is IO mean?

Earlier I said this: "I suggest that he visits you for less than 30 days during the K1 process"...

what happens if he stays over that time?

It's okay :)

Oh, you haven't filed yet? I suggest that he visits you for less than 30 days during the K1 process (since he has already been in the US for 150 days), but he has to be in Canada for the interview... so perhaps you can be with him in Canada for that?

oh :( so he cant be here until his interview?

K-1 Fiance(e) Visa Process & ProceduresQuestion about my fiance's time in US
okay so my fiance has been down to the the states in intervals that equal up to about 150 days within the last year...
and if im correct when he is down here he can only be down here for 180 days in one calender year if im right.
and i dont want to be apart during the whole duration of the k1 visa, and i want him to stay with me for a few months until his interview.
so im wondering if its okay that he do that? or will that reject him of a visa due to him spending too much time in the states... im very confused...
please help!!!

K-1 Fiance(e) Visa Process & Proceduresquestion about sending in my petition.

You and your joint sponsor will both fill out an I-134. You'll also both submit your most recent tax returns, and evidence of current income. Your joint sponsor will also need to submit proof that they are a US citizen or permanent resident.

The I-134 is submitted at the visa interview.

i was meaning to respond to you sooner, and say thanks! and that you have been very helpful!

and hmm okay, i wont have any tax returns to send in due to me just getting a job... so. what do i do?
and okay, so we both fill out the i134? does my sponsor do anything different than the petitioner?
and one more question, what if my co sponsor doesnt have the most recent tax return?
im so scared they are going to deny us because of this :(
lacieteeFemaleCanada2011-12-31 09:40:00
K-1 Fiance(e) Visa Process & Proceduresquestion about sending in my petition.

If your state's law says you are legally able to marry at 17 then you will not need parental permission. If the law in your state lists legal age of marriage at 18 you will need parental permission.

Your birthday is in 2 weeks. Best to wait until you are 18 and file with the knowledge that you won't be denied.

Just out of courisity, how will you qualify income wise for the I-134? I assume at 17 you are probably still in school or just starting out in the work force.

Sorry that I assumed we had discussed your age in a prior post. Recently there was a young lady in a similar situation and I assumed it was you. You might want to do some forum searches where underage petitioners have dicussed exactly what you are asking.

Good luck.

haha its okay! no worries!

but no im currently taking CNA classes though, and plan on working just part time as a CNA. but i can have a co-sponsor right?
and if so what form would they have to fill out? and what would i have to fill out? gosh im so confused.
and do i have to send in the I-134 with the petition? because i didnt think i did.
lacieteeFemaleCanada2011-12-31 09:30:00
K-1 Fiance(e) Visa Process & Proceduresquestion about sending in my petition.

This was covered many times in your PRIOR posts about you having to be able to legally marry at the time you file.

So... If you are NOT legally able to marry at the time you file due to your age your petition will be denied. You will lose your $340 petition filing fee and you will start all over again with having lost months of time waiting...

WAIT FOR YOUR BIRTHDAY TO FILE...

im sorry, not meaning to be rude, but i never once asked question that had anything to do with this.
this is the first time i have ever asked about me filing before my birthday, so i am VERY oblivious.

so i couldnt even get a notarized note from my mom saying i can marry to help it? and with my birthday being so close do you think they would be okay with it? thanks.

okay so im 17, and my birthday is January 13, so its only two weeks away. could i send it in now? or do you think they will reject it? im so confused :(

also, my fiance is coming to see me a few days after my birthday, would that be okay? even though when i sent it in only a few weeks prior it says he isnt in the country?
and if in the case of them returning it, if he is in the country when i re-send it in, would i have to state that he is in the country? or not? PLEASE HELP

K-1 Fiance(e) Visa Process & Proceduresquestion about sponsorship

Thats what I thought.... All the Answers were assumptions. It's the begginning of the year. I'm not sure until your licensed but a Certified Nursing Assistant is Only a 9 week Course and take a test and pay a Fee.
A CNA will make more than Poverty LInes by far and be required to work So much Overtime ( Double Shifts) Most are Union and require Double time on Holidays. Being a CNA is not a job everyone wants to do, but the sick and elderly require 24 Hour Care. It is a Good job with a Future.
You just Filed your 129-F and you have lots of time before the interview to show Pay Stubs at that time. (About 7 or 8 Months from now) Your in a good position.. I'm sorry everyone assumed you were an adult but in fact your are (were) a minor.
My indication was when I seen your Time-line. LOL hahaaahhhaaa.
CNA's have a good future (Anything in Healthcare) Be pre-pared to adjust to working 50 Hours or more per week.
GOOD LUCK TO YOU

thanks so much! so i will be fine with just sending in pay stubs? and not a tax return?

but i plan on just working part time because im going to be going to school to become an RN, so i will need a co sponsor...

I'm courios of the Age of the OP? There might be well be a reason for no previous Tax returns. So, OP can you say your age. Your look both look young.

K-1 Fiance(e) Visa Process & Proceduresquestion about sponsorship

I-134 only requires copies of tax returns IF a person is self-employed according to the instructions: Section: Supporting Evidence , sub-section C. -and then only a copy of the LAST tax return filed (not three years), and it states a copy of the return not a transcribe for the IRS.

Sub-section B, requests a letter on business stationery if you are employed with the required details of employment.

okay so what do i do then to state that i have only just started working? and what will i need as the primary sponsor?
and my co sponsor will need what to be exact

so, again.
I JUST STARTED WORKING SO I WONT HAVE ANY TAX RETURNS. what do i do?

K-1 Fiance(e) Visa Process & Proceduresquestion about sponsorship

Yes you can use a co-sponsor, but you are still the primary sponsor. You still need to fill in the I-134, and your co-sponsor will fill one in too. You both need 3 years tax return as well as paystubs and ideally a letter from the employer. No need for a letter of explanation, but if you haven't files taxes at all you need to write a letter, explaining why.

What kind of different answers have you gotten? They may have been refering to other countries.

... but i honestly havent had a job, i just finished up school, and now in getting my cna license.
soooo i fill out the i-134, and what form does the co-sponsor fill out?
because i havent ever filed taxes so.
ahhhh im so confused about thisssss.

K-1 Fiance(e) Visa Process & ProceduresJamaica No-Impediment Form
Just wanted to share some information I recently received from the RGD, Jamaica. I emailed them last night and asked if the certificate of no-impediment can be ordered online and shipped to an international address. This is the response I received today:

Dear {Redacted},

This serves to advise that the No-Impediment cannot be done online. You can visit the nearest RGD’s Office and apply for same on your Fiancés behalf. The cost for the 7days service is J$5500. After same is completed and you received the document you can FedEx same to him overseas, or you can make the FedEx payment to the RGD to send same to him overseas when completed.

If there is any other matter you will like us to address please feel free to contact us at information@rgd.gov.jm

Do have a great day. “We aim to satisfy”

I emailed the U.S. Embassy in Jamaica yesterday my question was how old can the police report, certificate of no-impediment and medical be to for submittal for a K1 visa as my fiance just completed these steps in late August/early September for another visa in the US and will be able to reschedule our interview if he is not in the country and this was the reply I received today:

Good day:

Thank you for your email. The police certificate and medical results are valid for one (1) year from the date of issuance. The Certificate of Non-Impediment does not expire. If your fiancé cannot make the scheduled appointment, you can send us an email and we will be happy to reschedule him on a date convenient to him.
