Well, I finally had a night were I didn't have to wake up very early for work, and I was able to call the service center. That trick worked perfectly, I got ahold of a very kind woman within a minute, who told me she will have a NOA 1 sent to my american address. That's great. This time change is a killer, so it is very good to be able to save some time and get ahold of someone so promptly.


I have called 3 times and still have not gotten my NOA1.

I just printed off my skype logs for the past 3 months the other day and I found he basic print screen to be pretty good. U just go into the "Calls and SMS" section. U go to the bottom of the month u want to print off and tell it to show all items instead of the default 20, that way it will print off the entire month. U can edit ur print settings to get more entries on a page...but don't go so small they can't read it of course. smile.gif That way the most times u'd have to hit print screen would be 12 times for a year...not too hard IMO(in my opinion). Much easier than exporting files if u don't know what u are doing. smile.gif

Hi, I am not familiar with the process for K1, as I am in the process of getting my packet together for mailing to USCIS. I do hope things go well for your application. I am filling out my paperwork and am wondering. if I make a mistake, can I use whiteout? I know this must sound like a rediculously dumb question. But, I really do want to be as accurate as possible. Also, on the I129F for, it asks where my fiance will file for a visa abroad. As I am filing a K1-visa app. as her sponsor. do i need to put the consulate abroad in that space? please share your experiences with me. thanks.

USCIS does not look at any finances in the I-129F stage. That will be left to the US Consulate in your fiance(e)'s home country prior to visa issuance.... Typically if you can demonstrate that your income is at or above the 125% of poverty level then you should be OK....

Lagos is like no other US Consulate in the world when it comes to evaluating bona fides. Filing with only one visit may be fine but I think chances of success at a visa interview with only one visit are slim and none. Ask about this in the appropriate regional forum too.

Hi. I just received my approval on dec 8th. I had been to see my fiance several times before filing. However, I believe as someone posted before. You only need to have met once within the last 2 years. What does help alot is proof of ongoing relationship. IE: photos, copies of phonecalls, letters, etc. I believe you are going to file at end of Dec., and planning on visiting her again in March. For the initial filing 1 meeting should be enough. As I will probably be after March for the visa to be processed. When you revisit with SO take plenty of pics, save plane tickets and boarding passes. Save as many receipts as and anything paper that may help prove visits and time shared together with your SO. Good luck.

1) There is not intent to commit fraud. I was merely asking how to get my girl friend to the US to pursue the relationship. I can honestly say at this time I don't have intent to marry her as I have never met her face to face. I was hoping to get her here first as she needs to know if she is willing to live very far from her family forever.
2) I found a plane ticket to the Philippines to be around $1200. Which I can afford, but there is Hotel, meals and the dates. In addition, I would have to take about 2 weeks off work which may be difficult to do. I can do this but it seems it would be easier to have her here first.

It looks like I will have to go there first and then file the I 129f. I am no longer confused.

I am in the initial stages of getting a girlfriend to the US. We met on line and she and I want to proceed. I have read a lot of info on the net, but I am confused by all the information. It seems that the K-1 visa is the Fiancée Visa. But I did read that the fastest way is to for my Fiancée to apply for a tourist visa and then apply for a change of status. I could go there to meet her as required, but the expense and time away from my job to go to the Philippines would make things tougher than necessary. Besides, if she came to the US, we could spend more time together to see if how things may work out. But I also read that if the intention is to come to the US on a tourist visa, with the intent to marry, the visa will be denied.

I hope someone can help me with this confusing process.

Is there any way you could find out the price for the airline ticket, and see for sure how much time you can take off work. Maybe 2 weeks, just as long as you have met. The ticket may only be 1,000 - 1,500. Explore all the options. I really didnt think it would be possible for me to go to Ghana the ticket was 1,400 and I flew with martinair the first half and klm the second half, but I said ok I am going to go and then did all the things necessary, it took me a few months to get the money and all other things, passport, visa, shots. etc. I have actually read that the fastest way to get your fiance here is with a fiance visa. I have also heard that if someone travels to the US on a tourist visa and their actual intent is to marry, it is visa fraud, and they will have to go back. I found this site after submitting my I-129f, but found it to be very useful, I love it and wish I would have found it sooner.
The only advice, I can think of is travel to see her, or she can travel here, but without marrying. But when you think of it, it's probably easier for you to go see her. For you to get a visa is much easier, then for her to get one to come here. Anyway, hope you are having luck with getting the answers you want

We went the K3 route because of all the delays in 2007. I would suggest going the CR1 routwe now. Follow the guides until you reach the National Visa Center (NVC). Once your petition reaches the NVC follow the LingChe NVC Shortcut on the VJ Wiki to reduce wait time.

For co-mingling of finances we used money transfer receipts and I was able to convince a local bank to open a combined checking account with a copy of my wife's paasport. I also archived our Yahoo chats and copied all the chat records into a Word Document. Then I copied a few chats over the time period to show the Yahoo user names belonged to us.

One of the documents the USC will need to send for the K-1 visa interview is an I-134 for the affidavit of support. If you are already aware that the poverty level isn't met, then it would be advisable to send the co-sponsor form at the same time to present at the interview.

However, it is my understanding that at the K-1 visa level, only 100% above poverty level for the I-134 is required for UK applicants, so if the USC is above that, then the K-1 visa should be approved (assuming all other criteria is met) based on only that income. It probably wouldn't be a bad idea to submit the co-sponsor's affidavit for that interview, though, just to be safe. Of course, if the income isn't above the 100% poverty level, then a co-sponsor would be required, even at the K-1 visa interview.

Once you are married, it is the I-864 affidavit of support that will definitely require 125% above poverty level so the co-sponsor affidavit would accompany the AOS package at that time or you would undoubtedly receive an RFE.

No, the previous marriage wasn't a K-1, but I have seen several others have more than one K-1 and received the second without a problem. Of course, there could be questions about the previous K-1 at the interview, just be sure your fiancee knows the details surrounding that relationship since one never knows what questions could be asked. As long as she can be forthcoming to the questions asked, that aspect shouldn't be an issue.

Possibly the reason we, as K-1s, must submit a copy of the NOA2 is to ensure that when we submit the forms to adjust status the original petitioner and beneficiary married each other, since that is the only way a K-1 can adjust.

Sorry! :lol: I tried to word that delicately but had to be sure. :innocent: Sometimes assumptions can be problematic.

If you did not intend to marry AND REMAIN when you obtained the visa and came to the USA, then marrying and submitting an AOS (Adjustment of Status) petition could be an option for you. After marrying, you would submit I-485 AOS, I-130 (ummm...thingy), G-325A Biographical forms (for both of you, I think, in this situation), an I-864 affidavit of support (filled out by your husband), and other documents to support your petition (marriage certificate, etc...the documents required would be on the forms).

If this is an option for you, then you would not have to leave the US and await a visa. You definitely would want to be mindful of visa expiration and any out of status stays....if you overstay and leave the US, you would more than likely not be allowed back in (unless you have already received your green card by then).

Hope that in a nutshell helps...read the FAQ guides and on the USCIS website and go from there.

Please don't take this the wrong way, and perhaps I am interpreting your ID and into your post incorrectly, but are you in a man/woman relationship? The "lauraxmarie" ID and stating "living with my partner" made me wonder, so I wanted to point out that a K-type visa would only be available in the US to those in an opposite sex relationship. I just didn't want you to get your hopes up and find you are unable to obtain a visa.

That if one wants a congressman to be able to get any real information that they needed to be supplied with a signed privacy release form. Does anyone know anything of this? Because if that is the case then maybe that is something you should look at.


When our congressman's aide was assisting us, both David and Chris had to sign privacy releases that also provided pertinent case information so that she was given permission to act on their behalf and able to check into the status of their cases.

Although not technically an overstay at all, it *could* affect his trying to visit before the K-1 is issued, since he didn't "obey" the instructions before (if they were documented). You're like most of us are/were....overthinking everything and worrying about every little aspect, so I won't bother telling you to relax. :P

I wouldn't worry about contacting the Embassy beforehand about that aspect, you can just inform them the day of your interview (Good luck, by the way :D ) It shouldn't matter if he decides not to come to the interview, you can just explain the situation to them since you have found that the K-2 wouldn't be beneficial to him at this time.

Technically he could still get the K-2, but he wouldn't want to bother pursuing AOS or AP. He can remain in the US up to the 90-day I-94 expiration date, then return to Switzerland for his studies. I don't know if the VWP is available to you in Switzerland, or if tourist visas are difficult to obtain. He can still be granted another type of visa later (from an I-130 or student) even if he comes here on a K-2 and leaves.

Possibly a better alternative is for you to request the K-2 to be obtained later (within the year of your K-1 issuance...as a "to follow"). You never know, his plans within the next year may change and that way the K-2 option would still be open to him. I don't know if the fee would be required again or can be "on hold" for the year. I wouldn't think the visa payment would expire, but am unfamiliar with that situation. You can check on those details with the Embassy at your interview.

If he ultimately doesn't ever obtain the K-2, it still shouldn't affect an opportunity for a different type of visa later.

I know that's more than what you asked, but just some things to think about (as if you need that! :lol: )

It doesn't sound as if he should bother with a K-2 in his situation.

If he stays in Switzerland to complete his studies, and later goes to Kenya, you could submit an I-130 for him. Depending on the family preference/situation, and whether you are Permanent Resident or Citizen, it would be several years before a visa is granted as an F1, F2A or F2B. See the Visa Bulletin at uscis.gov here: http://travel.state....letin_2943.html

Since you say he has some time before completing his studies, the timeline for the I-130 might work out for him anyway. You could go ahead and submit it as soon as possible and by the time the visa is available, he might be ready to come to the US. Since the stepparent relationship wasn't created before he turned 16, your husband would not be able to submit the I-130, so you would have to wait until you are at least a Permanent Resident (PR) to do so.

He could try to obtain a student visa instead later on, but if he plans to reside in the US for a while then the I-130 could be beneficial (and if a resident could take advantage of normally lesser tuition fees). Of course, it could be some time for the AOS to be completed in order to get the lesser fees, and if he isn't interested in residing in the US beyond the 2 years education, then that may not be a benefit and instead would prefer to check into the procedure for a student visa. You could do so now and compare all the possibilities so you can understand what actions need to be taken, and when.

Just review the timeline shown in the visa bulletin, possibly use your local office's timeline for AOS as a guide and your own status (PR vs. Citizen), then compare it to his plans. Keep in mind the timeline for the visa bulletins vary depending on if you are a PR or a citizen (if you plan to be). That should tell you if what he wants to do would be feasible.

Good on him for his plans to further his education...it sounds as if he has great goals in mind and hopefully something will work out for him.

Before continuing, some facts need to be known.

How old is the child now, and how old will he be when you marry? How long before his studies will be completed in Switzerland? Until this information is known, there are too many variables to provide some possible resolution to your situation.

By coming to the US, his intent should be to reside in the US...neither AOS nor AP are designed to arrive here and then move back to his country to complete his studies. Either way the AOS will be considered abandoned. If you can provide answers to the above questions, perhaps some suggestions can be forthcoming.

Congrats on being near to sending it all off...I checked it all over so many times that my eyes crossed. I had two-hole punched all of our papers, too...some of them were a bit hard to see at the top once the ACCO fasteners were in, but everything seemed to work out alright.

As far as the envelope, I just mailed it in one of those large yellowish ones (the ones that are the color of baby poo) and mailed it Certified/Return Receipt Requested.

Russell, I don't know if you've done this yet, but be sure to email the Embassy at the address someone provided earlier AND explain your circumstances and date you need the interview by. They are very accommodating and will do everything possible to help.

I know timelines vary, but David began emailing them on July 14, 2004 and eventually the Embassy confirmed on August 3rd that Packet 3 had been processed and interview scheduled/Packet 4 mailed on August 2nd....they provided an interview date in the week he requested in his emails, August 23, 2004 (unsure if it could have been scheduled earlier, that was during the week he requested).

I don't know when your Packet 3 was sent in, but hopefully that might provide an idea of what to expect.

If your wife came to the US under an F-2, isn't it a derivative visa from an F-1 visa? If so, I don't understand how "No" would be an appropriate answer if an F-2 can only come to the US based on the F-1. Q11 is vague and isn't necessarily referring to a K-type of visa.

From USCIS:
Can I Bring My Spouse and Children with Me to the United States? Your spouse and children may come with you to the United States in F-2 status. They should go with you to the U.S. embassy or consulate when you apply for your student (F-1) visa. They should be prepared to prove their relationship to you. If your spouse or children are following to join you at a later date, they should provide the U.S. embassy staff with a copy of your USCIS Form I-20 ID (Certificate of Eligibility for Nonimmigrant (F-1) Student Status - for Academic and Language Students) and proof of their relationship to you. The F-2 status of your family will be dependent upon your status as the F-1 academic student. This means that if you change your status, your family must change their status. If you lose your status, your family will also lose their status.

Just my interpretation, but Q. 11 isn't asking the question regarding a specific type of visa.

The question "Have you ever filed for this or any other alien fiance(e) or husband/wife before?"

Since you apparently filed for your wife to join you under an F-2 visa previously, you have filed for someone, so I would have answered "yes".

hi everyone
i cant seem to get a straight answer, my now wife came in on k-1 visa , her 3 year old was given a k-2. her k-1 , expires october 9th,06, that is not a concern now that we are married and have filed i-485. the question i have is that her sons visa expires october 9th,06 . we are waiting for her i-131 ap to come in so that we can go back to colombia and get him . we were under the impression that the k-2 visa holder can follow k-1 visa holder up to one year ? what do we do if the a/p does not come back in time ? does the k-2 visa expire ,when the k-1 visa expires? i called the visa center and they are just customer service people , they can give you no specific answers, just frustrating. need help and info ,asap. thanks jon


Since it sounds as if her son was provided a K-2 visa at the same time she received a K-1, the entry for her son must be within 6 months of receiving the K-2 visa (not 1 year) and would expire at the same time as the K-1.

I haven't been following how long it is taking for APs nowadays, but I would be prepared to schedule an Infopass around mid-September to see if she can be given an emergency AP (due to the upcoming expiration of the K-2 visa). Since you applied in late June, it might be tight scheduling travel and plans without knowing when she will be receiving it.

If you are unsuccessful at obtaining an emergency AP, is it possible for just you to travel there and bring her son back with you?

If neither of those scenarios are feasible, then I believe the only alternative would be to file for another visa for him after the K-2 expiration. More cost and time, but I believe since you were married to his mother before he turned 18 you can apply for a visa as his father.

Yes, I scanned all of our docs with no problems at all. I also included a form that stated all copies were true blah blah. I also signed and dated each piece of paper that I submitted, but I'm ####### that way (including printing the G-325A copies white, green, blue and pink). :blush:

No, you can't...once NVC receives it, the case is assigned a different number and then transferred to the consulate. You can try to call NVC to see if they have received it/mailed it, and they can tell you the case number then. Sometimes it can take a while to get to NVC, the Service Centers normally send out batches every so often and depending on your approval it can seem to take forever!

I started the idea of updating the guides (we badly needed it), the Cap'n ignored my idea about including the beneficiary's BC...hiopefully he will put it back in. We've seen a lot of RFEs for BCs lately.


Yes, I had mentioned in another thread I thought it might be helpful to at least list this as an *option* for the beneficiary's birth certificate (long form with both parents shown and translated if not in English), but the idea was pretty much pooh-poohed.

In the past (when we were submitting our documents a couple of years ago) it had happened often enough that I sent David's BC in with our I-129F, especially since he has a common name. I don't know if I would have received an RFE had it not been included but if it can be avoided from the start, why not let each VJ member make their own decision about that?

How often have people had this requested? I would be ok with adding a line to the guide such as:

14. (Optional -- not required by USCIS guidelines) A copy of the foreign fiance(e)'s Birth Certifacte (front and back). There have been a few rare cases where this was requested to be sent in as part of approving the I-129F.

I do not want to add extra things -- saying optional will result in most people adding this to be safe and since this is not required per any published documents I am hesitant.


Having been around VJ a while, I can say an RFE for the beneficiary's birth certificate has occurred off and on, but it is infrequent. When we submitted the K-1, I submitted David's birth certificate (with both his parents' names) mainly because he has a rather common name. When a name check is done it can easily trigger such an RFE if a match occurs, and if the BC is available it can be verified at the time rather than risking an RFE.

I don't think it would be a bad idea to list this *option* in the guides (as well as noting it must be translated if not in English as any other non-English documents). Although infrequent, I have seen it happen often enough that if the information is there the parties involved can determine if they want to submit the beneficiary's BC up front or not. It certainly can't hurt, and may avoid further delays.
