What Does the experation date on an I-129F really mean?


Nothing really ... Since sometimes there are so many delays in the consulate receiving your file and then issuing you an interview date that you can be well after the expiration date of the I-129F before you receive your K-1 Visa ...

The only expiration dates you want to worry about is the one that will be on your K-1 Visa (6 months) and the on the I-94 (90 days) at your POE ...

I used a lawyer and have had a speedy approval. Probably because the paperwork was complete and arranged in good order. IMO they process these cases faster.


I would have to disagree with you ... The lawyer has nothing to do with getting your case processed faster ...

The only reason why someone might get a faster approval than someone else would be the fact that they had an more organized package and weren't missing anything requiring a RFE ...

Obvioulsy if you get an experience lawyer then they will put together an organized package and would make sure nothing was missing which defends what I said above ...

Basically as others have said, If you have a straight forward case (no crimal records ect.) and feel comfortable filling out the papers and asking questions on VJ then you should be fine ...

I actually have a similiar situation ...

When I was about 5 years old I started using my step dad's last name ... I even had all my ID in his name (to this date I am not sure how the Canadian government managed to let this slip by and give us a social security number under my step dad's name) ... When I met my fiancee and decided it was time to get a passport I decided that I better get this straightened out as it was always a pain in the butt at US and Canada Customs ... So I applied to "officially" change my name to my step dad's name because that would be the least painful way as all of my ID, credit cards, bank stuff, work stuff, ect., were already in my step dad's name but my brith certificate was under my birth dad's name) ...

In Canada when you legally change your last name they give you a new birth certificate in your new last name and make you return your old birth certificate. They supply you with a Name Change Document that shows the name you were and the name you changed it to ... When filling out any of the paperwork for the K-1 and AOS whenever they asked other names used I always filled in both names used ... I also put in my package a copy of my name change document ... When I went to get my RCMP criminal check done I made sure that I had it done in both names and also supplied this at my interview in Vancouver ...

The officer interviewing me never asked or commented on this so I kind of brought it up and he told me that most people who are trying to hide something wouldn't supply all of the info that I had and that he was sure I had a good reason for changing it ... I told him the reason and that was pretty much the end of it ...

I was also worried about what would happen at AOS time in regards to the FBI name check and I was recently approved so I guess it wasn't a problem either ... I think the bottom line is to make sure that you supply them with this info so that they don't find it on their own and think you are trying to hide something ...

Just so you know USCIS is famous for loosing things in your file ... And it doesn't get any better once you start the AOS process ...

Hopefully when you receive the RFE you can turn around and send the info back to them ASAP to prevent further delays ...

Ohh and the misinformation line is pretty much useless ... They pretty much repeat what you see when you look at your case status online ...

hi guys! i just wanna ask if any of you hired an immigration lawyer in processing your K1 visa. and was the lawyer of any help ?....my fiance and i are planning to hire a new lawyer coz our former lawyer isn't at all informing us as to the status of our case. we filed our k1 application last march 2006 at the CSC and until now we haven't received any call or note from the USE in Manila. We are very, very frustrated right now. we've been waiting for more than 7 months now and nothing has happened. how long does it really take before we get a call from the embassy from manila for the medical and the interview....guys please we need your answers coz we feel like we're groping in the dark here.....does it really take more than 7 months before we hear anything from the embassy?

Your Lawyer should definately be sending you copies of any papers they have received from USCIS ... I thought that even if you use a lawyer that all the NOAs from USCIS come to you first ... After all it is you who is petitioning not your lawyer ...

You should have had at a minimum your NOA1 stating that USCIS received your case back in March or April at the latest ... Did you write a check to USCIS or how did you make your payment ?? Like someone else stated here if you used a personal check you should be able to find your case number on the back of the check once your bank received it back ...

Have you been told if your I-129f has been approved yet ??

If I were you I would be demanding that you get a copy of any correspondance your Lawyer has from USCIS ... And after you receive that info get a new lawyer .... I hope that your have some proof that your lawyer did indead submitted your papers ...

Hi, I'm a Canadian citizen currently in the US visiting my fiance (a US citizen) as a tourist. We were just boyfriend and girlfriend when I arrived, but about one month after my arrival we realized we want to spend our lives together and got engaged. After some research we have come to realize the need to file for k1, and are very thankful that we didn't just do the impulse wedding. I have about two more months left in my stay and we are wondering if it is alright to start the petition while I am still in the country. I do fully intend to return to Canada at the end of my permitted stay.

Will we find any issues with filing while I'm here? As I stated I do intend to comply with my requirement to leave at the end of my permitted stay.

Any input would be greatly appreciated.


I guess the first question you need to ask yourself if you want to return to Canada to see family and friends and deal with things before you make your permanent move to the US ... If this is the case then applying for the K-1 Visa would be your route and yes you could start the process now while you are in the US ... You may have to return to Canada for your interview if it happens to be before you planned on returning to Canada ...

Also note that K-1 timelines are very different and especially when your a Canadian as the two consulates that do K-1 Visa's are drastically different in how long it takes to get an interview ... Montreal takes months and months where Vancouver only takes about a month ...

The time it takes for you to receive your K-1 Visa really depends on your fiance's location in the US (does your fiance fall in Vermont Service Center's jurisdiction) and your location in Canada (do you fall in Vancouver Consulate jurisdiction) ... If both are true then your process to receive a K-1 would be rather quickened ... If you had to go through California Service Center then also have to go through Montreal Consulate then you could be looking at quite some time to receive your K-1 Visa ... It took me rougly 5 months from when we submitted the I-129f (to Nebraska Service Center) to when I had my interview at Vancouver Counsulate ... There are way more delays now a days (with IMBRA) and the fact that NSC is now forwarding all of their petitions to CSC which means CSC is over loaded ...

Also as others have posted, once you have applied for the I-129f (the first file towards K-1 Visa) be noted that future visits to the US to see your fiance could result in denial of entry as you have to prove to the US border officer that you have strong ties to Canada and that you plan on returning and not immigrating ... I am not saying that you can't come to the US to visit but be prepared that you could have problems ...

Your other option would be to get married now (or married while your still "legally" allowed to be in the US) and apply for adjustment of status (AOS) like someone else mentioned ... You would have to explain that you didn't plan on getting married and immigrating but it just happened ... The fact you didn't have an I-94 would be good evidence that you didn't plan on this happenning because Canadians do not usually have to fill this form out ... The first time I ever filled this form out was when I was activating my K-1 Visa and I have been to the US 100's of times in the past ...

We were worried at where to start and is required ... Once we found VJ and read all the guides here we decided that we could do this on our own ... I just received my green card and we did all of the paperwork from the begining so it isn't really difficult ... When you run into problems the people on VJ are always eager to help out ... But some people might not feel comfortable with the paperwork and the process ...

The best advice that I can give you is if you choose to use a lawyer that you make sure that you pick one that is very experienced in the type of Visa you are applying for ...

You might want to do some research up front for the state and county that you plan on getting married in to make sure they don't require that she have a SSN card to get married ...

If a SSN Card is not required and since you are getting married within the first week of her entrance into the US then you my as well wait till after the wedding and get it in her new name ... You should wait 2 weeks anyways after entering the US before applying so you shouldn't have any problems ...

I totally agree ... Some people get so arrogant when someone asks a question that they don't ask future questions because they are worried about looking like and idiot again ....

Sometimes when you are searching for something on VJ it is not always easy to find what you are looking for or to know what to search ... I spent like 2 hours looking for the doctor information for Vancouver a while back and was unable to find it ... Because I didn't want someone to give me a hard time about not searching for it properly or for asking stupid questions I decided to PM a fellow Vancouverite got the answer very easy ....

I think sometimes people need to be a little more patient with the new people ... Remember all of us were once new on this site and overwhelmed with what to do and how to do it ..

Thats just my 2 (canadian) cents worth :)

Hi Seven Congratulations on the start of the journey !

I sent mine in on 27 Jan 2010 ( Post Office said it was delivered on the 29th ). I used the outline on the VJ site for the cover letter. Put everything in that order and stapled any attachments to a particular form. I then used one of those black office type clips ( 1 inch or inch and a quarter size, I think ) to hold everything together and put the packet in an envelope and sent it on it's way.

2. Apply for CRBA ASAP.

- Make sure the hospital will forward your child's BC to the local municipality's Civil Registrar Ofc as soon as possible too - like the day or couple days after you completed to fill out the birth certificate. (Mine took 17 effing days for the hospital to forward it to the city hall, it was sitting there all those time w/o notifying us that the hospital still needs corrections before they can submit it to the LCR of Manila)

- As soon as it's forwarded to LCR, apply for an advance endorsement so you can get an NSO copy in as early as 2weeks-1month (it will take 4-6 mos. on normal processing)

- Make sure you have the NSO BC on hand or at least have an exact date when you can surely get one (release date/claim date of BC )before getting the CRBA packet coz it's validity is only within 60 days.

Time is of the essence when you're trying to comply with the CRBA with a visa expiring in 6 mos... When all is good and done the soonest possible, it'll take you approximately 3 months.

What is DOS, why do the papers end up there, and how do I find a number to contact them to see if our case has left the Cairo Embassy? Any information anyone could give me on this would be greatly appreciated. I write the embassy each week, and always get the same answer. From the beginning I contacted my senator's office, and there is a person that deals with nothing but immigration on staff. She obtained all the necessary documents, and told us what supporting evidence we would need to submit. She helped us with any questions we had, and made sure the forms were filled out right. This didn't cost anything. When Ahmed finished his paperwork, he emailed it to her, and she looked it over to make sure it was right before he submitted it. And yes, both of us did answer some questions wrong, and we had to clarify the answers. After we were done, we were confident with what we sent.

However, later I did skim through the internet and find that the documentation should have been submitted in a certain order to make it easier for the embassy to locate what they need. Besides that, everything went smoothly. If I had to do it again, I would do it exactly as I did, but ask more questions. VJ has been a wealth of information. If you can't find it on this site, someone here will guide you to it.

First let me say you need to make absolutely certain this is not a language barrier, and it is not just because of the different languages that you are misinterpreting things. Sometimes I will make a statement to my fiancee, and he understands me to say something different than what I meant. At first I always asked him if he understood me when he got quiet. I would explain things to him if he told me he did not. As time has passed, we do alot better understanding one another, however we still occassionally have times one of us does not understand the statement the other has made. We just keep asking each other to explain until we get it right. Sometimes it is frustrating, and others it is just a matter of changing a word or two to complete the communication.

Maybe the communication is not as lengthy in other cultures as ours, however contradicting statements are the same in any language. If this is the case, and it is not because of the language difference, then I would view this as a moral and personal value issue, not a cultural issue. I wouldn't care if the person were white, black, yellow, or green, it is not ok in any culture to be deceitful with statements one is making.

If this is an infrequent occurance, it could be that it is simply a misunderstanding between the languages. She may be getting frustrated because she did not understand what you said to begin with.

the nvc what a joke! my case "sat" for 6 weeks this fall without being touched. in december it took 1 month just to enter documents into the system. and i forgot the nvc lost my affadavit last june and told me in january. by the way they did receive the affadavit payment. and oh ya they sent me the wrong instructions for documents to send in. i cant believe the case was actualy complete. well thats my rant for the year. crying.gif

I am a US citizen how is engaged to a Hungarian citizen. Pretty easy so far, lol. He is in the United States already as an F-1 college student. We are planning on getting married next year on May 31 (which, as it turns out, is the day that his visa will expire). Now it gets complicated.

I have been emailing the US embassy in Hungary and they told me that he will not need a K-1 visa to get married since he is already here, and that we will need to file the I-485 form after the marriage. My question is: can he stay in the US while we are waiting for all of that to be processed? He wants to continue to go to school here that fall, so it would be nice if he didn't have to go back to Hungary, but sometimes the immigration services arent very nice :whistle:

So if anyone is in this situation, or has any insight at all for us, I would aprreciate it. Thanks a lot!

Hi Sarah,

If he is already here, on a valid visa what the consulate told you was accurate. You can marry (you may want to do it before his visa expires) and apply for Adjustment of Status. Since he was on a studen visa, and his intention was not to fall in love and marry, you should be able to adjust status w/ no problem, and he can stay (in fact he should not leave the country unless he gets Advance Parole) while the AOS is in process.

It took us 9 months to get NOA2.
We had an RFE since they lost our passport photos. wacko.gif
Other than that, we had no issues. However, it still took them 9 months to process our petition...
Based on your timeline, it seems you are in a similar situation; taking long though there is no problem with your case.
It is great that your attorney could talk directly to a supervisor.
Your petition should be approved soon.

You need to call and ask what is going on? sometimes you need to call and follow up not just wait.
I have called the USCIS twice a week now,,, I made the Inquiry along with my attorney on December 1st,, so I am not just waiting,, have done alot,,, but nothing is happening...

Like everyone else here we have good days and bad ( Though gotta say more bad than good LOL) we all knew when we started this process it wasn't gonna be easy but how many of us really realised just how inhumane it really is. How stressed we'd become how much we'd miss our SO's how badly our general health and well being would suffer to say the system is flawed and incompetent would in my opinion be a great understatement and saying it sucks is putting it very mildly LOL ( there's a lot of other words I could Use LOL) But anyways all I gotta say to those waiting and hoping is you gotta hang in there the END justifies the means. That in no way makes it any easier but knowing your not alone in the struggle does help a little. By profession I'm a singer / songwriter and sitting here tonight at 4-07 AM sleepless again I thought I'd share a song I wrote just for people like us , the one's going crazy jumping hoops at the whim of USCIS & Company it's called " What We Do For Love " I think it kinda says it all LOL apoligies to anyone who don't like Country Music (Sorry)

Well, I finally had a night were I didn't have to wake up very early for work, and I was able to call the service center. That trick worked perfectly, I got ahold of a very kind woman within a minute, who told me she will have a NOA 1 sent to my american address. That's great. This time change is a killer, so it is very good to be able to save some time and get ahold of someone so promptly.


I have called 3 times and still have not gotten my NOA1.
