Your fiance should have the originals of *any* copies you submitted with the I-129F. Divorce decrees, birth certificates...anything.

The originals may not be asked for, but in case they do the originals should be available to compare them with the copies. Normally if asked for, the original is compared with the copy, they keep the copy and hand back the original.

ETA: I don't think I sent the original NOA approval to David...I only sent the originals of whatever copies I actually submitted with the I-129F.

David made several visits to the US and all but one visit went through Dublin. He was questioned once on the way here, but it wasn't for too long and was let through.

He did encounter a belligerent woman when he was returning home once, though, that insisted his bags be searched after the Pepsi he brought back with him "seemed heavier than it was supposed to be". :unsure: She asked him what was in it, where it came from, etc. She was a right nasty thing and ended up opening the can up and pouring out the Pepsi to be sure David wasn't lying and smuggling drugs. :lol:

All in all, you just have to be mindful of how many visits to the US, and how long you are visiting...once it appears you're spending more, or too much, time in the US they get suspicious, which is their job after all, I guess!

There is normally a seal or stamp put on a certified copy by the clerk's office. It would be best to contact the local clerk's office and verify what you have is the certified decree. That would be the only way to know for sure (each area can do things differently).

Chris was a K-2 (19 years old, if that matters) and he did not have an A# until the AOS processing began and one was then assigned to him when the NOAs were received.

He did have an I-94 in his passport with a unique departure number (the hard-coded number in the upper left hand corner of the I-94) so we used that on the forms. For A# I entered "None" since it hadn't been assigned yet.

The POE only wrote K-2 with the 90-day date on the I-94.

You don't have to answer here but I am wondering why he obtained a B-2 tourist visa when those from the UK can visit the US on VWP. There are specific reasons this is done and depending on the circumstances it could cause problems and/or delays for not only adjusting, but obtaining a visa.

Depending on those reasons, it is even more important for a consultation with an immigration attorney to discuss what could cause problems for an adjustment within the US, or even obtaining a visa if you decide to pursue a K-1/K-3, etc. Be sure that the attorney is advised of all issues so that you can receive the best advice possible.

Yes, 8 total. You each need to complete and sign all 4 G-325A forms and you should submit the originals with your petition. Do not sign one and copy 3 pages. They each need to have an original signature.

All actual forms should be original. Any supporting evidence can be copies. The originals should be available for review at the interview, in case they are requested.

It does specifically state in the form's instructions in BOLD letters: Any Form I-129F that is not signed or accompanied by the correct fee, will be rejected with a notice the Form I-129F is deficient. You may correct the deficiency and resubmit the Form I-129F. An application or petition is not considered properly filed until accepted by USCIS.

I realize you're frustrated and understandably so, but they do issue a warning upfront of what will occur if certain basic things are not included with the submission.

Yes, but if it's rejected then the whole petition and payment enclosed would have been returned. It doesn't make sense that they kept it, issued an NOA1 and are now asking for more fees/papers. If a petition is rejected the whole thing is returned and no NOA is issued until resubmitted with proper fees/documents included.

We would need to know exactly what the letter said and if the whole petition and original fee was returned to even venture a guess what it is about.

In that situation I would put "none" since it was an error and it isn't as if she actually goes or ever gone by that name. A letter of explanation would be a good idea and support your document if they notice a difference.

I was divorced in Illinois in January 2004 and submitted the I-129F in February 2004.

The cite merely states that there can be an appeal within 30 days but the divorce is considered final the minute it is signed by the judge. As a matter of fact, I know someone that was divorced in the morning and remarried that afternoon in another judge's chambers next door.

True, but an overstay, depending on long it is, may need a wavier. If by the time she finally makes it to the US and is 21. She will not likely be able to get AOS approved and will have to return home. Its always iffy, when dealing with older children.


I agree, but I was responding to the they were "too old" for a K-2 statement. Technically, the 19 year old is not. The OP had already stated they weren't interested in a visa so it seemed a moot point to pursue the overstay issue.

I was also responding to the statement "they don't need to be in the fiancee's petition". They do need to be named upfront, but his fiancee will have the opportunity to designate on her paperwork what is being done.

No, that isn't true. It's not even logical since a child has up to a year to obtain the K-2 after the K-1 is issued yet the K-1 must marry within 90 days of entry to the US. It would hardly be practical for the K-1 to hang in limbo during that time to await the arrival of a K-2.

Go ahead and begin the AOS process for your wife. At this point for the K-2 I believe you just need to contact the Embassy to notify them the K-2 interview needs to be scheduled and begin the process but hopefully those that actually went through the follow-to-join process will chime in to confirm.

For a K-1, she would also have 6 months before having to even use it after it's issued. I'm not sure if the K-3/CR-1 are the same since that isn't the route we took; but if it is, keep that in mind for your processing. You might want to have a bit of a cushion so she isn't waiting after she's ready to move.

I am going to echo what R-Jo stated...do remember there is no appeal if the AOS process goes sour.

Some issues I can see at this point are: 1) you mentioned he was living with his father and taking care of him. Is there someone now to take over that care? There will be several months in which your SO will not be able to leave the US if you take this path. 2) Your SO quit his job before coming to the US. To immigration, that *could* be a red flag, showing intent to immigrate.

I don't say this to sway you from marrying and filing AOS here. Just be sure to always cover your bases so that you have whatever proof of no-intent to remain upon entering the US. Whatever issues that he must wrap up in Australia now (closing bank accounts, etc), try to have proof that those were done after entering the US and you married, so that they can be presented if needed.

What Does the experation date on an I-129F really mean?


Nothing really ... Since sometimes there are so many delays in the consulate receiving your file and then issuing you an interview date that you can be well after the expiration date of the I-129F before you receive your K-1 Visa ...

The only expiration dates you want to worry about is the one that will be on your K-1 Visa (6 months) and the on the I-94 (90 days) at your POE ...
