K-1 Fiance(e) Visa Process & Proceduresworried sick about my K1 Visa:( any guidance anyone?

My USCIC is Nebraska...and it's showing that they are just processing cases from May of 2006. That's over a YEAR ago. So does this mean it takes them a YEAR to just process through my petition??? That seems like FOREVER.


I would like to know where you read that Nebraska is processing I-129F's for K-1 dated May 2006 as they do not report I-129F processing dates and have not done so for quite some time.



He probably looked at the general list with all the cases since they dont have K-1....

Also just to mention, the 2-3 months I just told you is only for your petition to be approved, its not the time it takes to have the actual Visa in hand. Your petition will have to be forwarded to NVC and then to the embassy in Thailand. And the final approval on the visa is given at the embassy at her interview. My process took around 8 months total before I got the Visa in hand ( in Canada).

Dont worry about the divorce, we applied for my K-1 last year 2 weeks after my USC husband got divorced from his ex-wife.

Also the age doesnt really matter. All they want is both of you to be legally able to marry ( never married or legally divorced) and they will make sure that she has no criminal background and shes gonna have a medical examination.

As for your case you will have to send it to Nebraska but its gonna be forwarded to California because nebraska doesnt process K-1s anymore. I don't know about the average time lately but few months ago it was around 2-3 months to get an approval from CSC.

Well the K-1 is a fiance visa. And if you two are now legally married, you are no longer eligible for one, so... yes, that would be a big problem. It doesn't matter whether the marriage is registered in the US or not - if it's a legal marriage ANYWHERE, then you will be needing a spouse visa, not a fiance(e) one. Which means starting all over again...

You sound to me like your petition only was approved which means your visa can still be denied, and it will be if you are married now.

If you are LEGALLY married right now and you hide that details for your interview to be able to come on the K-1, that could be considered as fraud. I would start back with the spousal Visa....

There was an article on VJ about that a couple got married before and entered with the K-1 visa and the woman left to visit her country and now has a 10 year ban.

Yeah I understood the same by reading it.

You can still send it to one of the four Service centers before July 30th, and then you will have to send to either CSC or VSC.

Direct filling means to send directly to the said service center. Since the IMBRA Texas and Nebraska were forwarding the I-129f applications to California as they are not processing them anymore. All it means is that as of July 30th the correction will be made in the filling instructions to make sure the people that are in the states related to NSC and TSC will send their petition to CSC.

Sorry guys but nothing about hand delivery in there. You have to mail it. Its up to you if you want to go in front of the service center and take a souvenir picture before you put it in the mail.....

My husband was in the same situation, but with 3 kids. However following an arrangement he made with his ex wife he claims 2 on his taxes and she claims one.

So for our household we hd to count as 4 people, me, him and the 2 kids he claims.

ETA: The children are with us only on the week-ends just so you know. I guess it really depends on how many are claimed as dependants on the taxes report.
