K-1 Fiance(e) Visa Process & ProceduresQuestion about Responding to RFE

I got the RFE hard copy today. All it was for was for a passport photo of me (which I sent the first time...but whatever).

I immediately went out and had two passport photos retaken. The RFE asked that I put them in an envelope and staple them to the RFE notice and send it back. The RFE notice has my name, case number, barcode, etc.

I didn't include a cover letter or anything. My question is, should I have?!? Or is it ok that I sent it like that? I was in too much of a rush to get it back to them to write a cover letter. The notice states all the information about what the RFE is for and has my info so I am hoping it is enough. Thoughts?

It should be fine. I just hope that you are still smiling at them through the camera because the only thing left is your approval :) !! Also i hope that you did make a copy of the RFE, but i believe that if you go check your status online it will show the exact hard copy information. Just for good record keeping ( not necessary ) it is good to have a copy of the RFE. Hope to hear about your experience with the CDJ interview process. Wish you and yours the best. My fiancee and I are waiting on our NOA2.

Best regards,

This is why I recommend Priority mail over Express mail. You pay extra and lose a day, making the delivery the same day anyway. Priority mail with delivery confirmation is the way to go but that's hindsight. No worries. The package will be delivered or has been already.

K-1 Fiance(e) Visa Process & ProceduresK2 turning 18 before interview

Your still confused.. A K-1 is a visa type. NOA2 is a petition approval NOT K-1 approval. The I-129F petition approval is merely the USCIS acknowledging that the alien has had there eligibility reviewed and now is eligible to apply for a visa. Nothing more and far from a visa approval.

Uncle uncle. I give.... Thank you for clarifying the whole K1 process. 1,000 pardons.

K-1 Fiance(e) Visa Process & ProceduresK2 turning 18 before interview

Thanks to both. So what should I do with the medical for the kids, since it takes 3 days? they take theirs on Monday, then I go take mine on Wednesday and I pick all the results on THursday?

Also, you mean the petition for fiance has been approved by their approving form I-129F, and now I need to fill other documents for the kids? I will do more research on that, thanks a lot :)

I was answering the K2 question you had since when I went through this process in my prior petition, I was confused at that time as to what paperwork was needed to generate the K2. Well it is born as part of your initial K1 approval (NOA2). You'll be getting a Packet 3 from CDJ. There will be instructions as to forms you need to fill out for your consulate visit/interview process. The Step-By-Step Guides for K1 found in the FAQs are excellent : http://www.visajourn...content/k1guide

I was also letting you know what I was preparing for the K2's on my current K1 petition. It's good to have all the medical vaccinations done ahead of time if you can. Every embassy has their own unique process and reading the reviews for CDJ they have recently made changes as i noted above. Some VJer's have recently posted their reviews as seen here: http://www.visajourn...php?cnty=Mexico

I believe when you take your medical you will probably need to have the kids with you. Plus proof of already have taken your AOS prior to the medical. And the results aparently are ready the next day and given to you in a 'sealed envelope.' Instructions will probably state to not open the sealed envelope and deliver them to the consulate for the interview.

I hope this answers your questions and by no means do i intend to miss direct you.

A sus ordenes,

E&R4ever

P.S. There are also payments that need to be done and they are explained in the reviews. eff :)

K-1 Fiance(e) Visa Process & ProceduresK2 turning 18 before interview

Thanks for any input!

My son will turn 18 on July 11 and we can't locate his father therefore he has to wait and get his passport himself. He has been included in my K1 petition. Do I need another form or him being included in K1 is enough? Do I have to take anything else into consideration due to him being 18 at the time of interview? Do you know if all interviews for K1 are open in Juarez?

Thanks again :)

Hi Sarah&Michael,

As part of the K1 his K2 is initiated. There are no forms needed to generate the K2. His age should be fine since I believe he needs only be under the age of 21. My fiancees daughter is 17 and her son is 18. I am making sure they have their birth certificates "apostillado" in order for the embassy to acept them. Also I am making sure they have all of their vaccinations taken care of and stamped with the dates taken; my fiancee says she has the booklette for both of their shots. She recently completed her shots as well.

God willing when we get our NOA2 approval I will be working on getting my affidavit of support completed with 3 yrs of federal income tax returns. Also a letter from my employer on company letterhead stating my employment status. I plan on having more proof of ongoing relationship since I expect to travel to Mexico to delivery my part of the packet 3 requirements to my fiancee.

I understand only hte beneficiary can enter the consulate for the interview. There are excellent reviews posted from recent VJer's experiences. The process has changed where you need to get the AOS done one day prior to the Medical and the medical should be one day prior to your interview appointment.

Hope this helps you as I have gathered this wealth of information from our wonderful members who have shared it. This is my second K1 I've applied for so I am familiar with the process. Any quetions please message me if you wish.

K-1 Fiance(e) Visa Process & ProceduresJuarez consulate appointment

Please don't pay any mind to unnecessary negative comments about the safety of Ciudad Juarez!

In the three weeks we spent in Juarez I felt safer in the consulate zone than I have felt in areas of many cities in the U.S. I consider myself to be a perceptive person and have lived and traveled all over the U.S. and the world and can tell you that the areas that you are going to be frequenting for your interview related purposes maintain a high level of safety.

There are no boarded up buildings, no thugs walking the streets, no pushers or pimps, not even pawn shops or liquor stores, beggars or even street vendors! The only thing that may feel unsettling to anyone not familiar with Mexican cities is the large number of pickup trucks filled with cops bearing machine guns. That is how they do it. That is how they show you that they are keeping the area safe for you to come and do your business.

Also there are swarms of annoying people with homemade laminated tags that want to help you when you get near the consulate. They are not "coyotes" as many people on VJ have termed them and they are not trying to rob you, they want to give you information on where to go so you give them a tip. If you can ignore them you will be just fine.

As with many of the border towns there are going to be dark parts of the city that are full of people working in illegal trafficking, those people do crazy ###### and kill each other. I can assure you that they won't be doing their business near the US Consulate where it is swarming with cops.

If you all keep a reasonable level of awareness and use the same common sense you would use in any other city you will have the same chance of being just fine as you would anywhere else.

Enough of the fear mongering, it makes the world an uglier place.

C-Maria,

I appreciate your reassuring post. We will keep you in mind as we travel to CDJ! Dios te bendiga!!

K-1 Fiance(e) Visa Process & ProceduresAOS - where are the border crossing papers!?!?!?!

Hey guys how long is it supposed to take for the papers to come in from the border crossing? My guy has been here 4 weeks and the El Paso border patrol had told him they would send the papers to my house. Nothing has shown up. Do you know if this is normal? I can't send in the AOS papers until those come in, and I'm getting nervous! Is there someone I can call about this?

Are you talking about the DS-3025? That would be the only other form that one could have requested prior to or at the time of your POE.

US Citizenship General DiscussionN-400 filling time?

JimmyHou

Thanks for clarifying this for me, I appreciate the step by step answer as it removed any confusions I had.

Our son will be 15 maximum (unless there is an extremely long delay in the Gov't process)

Thanks again, I appreciate it

Robert & OlyaMaleRussia2014-09-26 03:10:00
US Citizenship General DiscussionN-400 filling time?

The copies should be good enough. But I want to clarify that your son will NOT be applying for naturalization. The N400 does allow for dependents to be part of the naturalization process. Instead, when your wife is naturalized, your son will be allows to apply for a passport using his birth certificate and his mothers naturalization certificate. But he will not get his own naturalization certificate. So if you want added proof of citizenship, he will have to apply for a certificate of citizenship using an N600 application.

so if I understand you correctly,

we would need file a "N-400" for my wife and at the same time file a "N-600" for our minor son?

Robert & OlyaMaleRussia2014-09-25 05:41:00
US Citizenship General DiscussionN-400 filling time?

Thanks. in answer to your questions/statements

1) we were married on December 10, 2010

2) her/our son is under 18 years of age, so he would then be included due to being a minor

3) in order to get a "corrected" PR card for him we needed to mail to the USCIS the PR card that listed him as a female. but of course made photo copies of this card as well as I copied it to my computer

again thank you for your response and information

Robert & OlyaMaleRussia2014-09-24 09:40:00
US Citizenship General DiscussionN-400 filling time?

My wife (K1) and her/our son (K2) have been "Permanent Residents" since 3/26/12. It is my understanding that since she married me (born and bred US Citizen) that she can file for Citizenship (N-400) after 3 years of being a PR, as well as up to 90 days prior to here 3 year anniversary, which would mean if I am correct we could file on or after 12/26/14. am I correct?

also there is one hang-up right now.when USCIS issued my son's new PR card they listed him as "F" (female) and not "M" (male). Have done everything that USCIS has asked (returned PR card) with proof that it was USCIS's fault so that I did not have to pay again. I have received their notification (I-797?) informing us it has been received and they are working on this case. that was 3 months ago and still no corrected PR card, and never any answers when I call them.

so my second question is do I/we need wait to file the N-400 (assuming we don't receive the new PR card prior to our early filing date (12/26/14)? (if I am correct above)

or

when the time comes can we file the N-400 even if my son has not received the correct PR card?

Im going to call to the embassy again, ask if they mail me the package, ask if they set the intrview yet, Well my fiance is working on all the papers we are going to need for the interview, and im doing the same, i have another question.... my birth certificate have to be from RENIEC? Im register at Miraflores and always when I need a birth ceertificate I have to go to Miraflores municipality. Hope some of you have the interview the same day like mine, so we cant get bored waitting!!! hahaha..... My best wishes to everybody!!!!!!! and have a really nice day!!! remenber always when u woke up theres just one day less to be together with the person u love!

Andrea,

My fiancee went to get her birth certificate stamped at the RENIEC in downtown Lima even though she is in Jesus Maria. She asked if that was all that was necessary. The RENIEC informed her that she needed to go take it to Relaciones Exteriores and get a stamp there too. She went to Relaciones Exteriores to have that done and also found there was a panal of translators to officially translate the documents. The translations were done that very same day. Hope this helps and is valid. We are at the start of our K1 process, but it is great to see you wonderful folks advance in your K1 process!!

My fiancee mentioned that the RENIEC in downtown Lima operates quicker in order to get the papers out, but any RENIEC office will suffice. My best regards,

Good luck on your interview. It would be great if you could share your experience there. My fiancee and I recently submitted our 129f and are in the hurry up and wait point right now. I very much appreciate everyone's willingness to help each other and only feel like I haven't contributed much, but I am willing to share my experiences once I pass that path. One quick question, did you have a choice with picking out who would conduct the medical screening? I went to the embassy info portion of this webpage and it shows 3 available.

Again I wish you the best on the 31st!

Mexico, Latin & South AmericaFlying to Peru for Interview

Hi, I am posting for the first time on this forum. I just applied for the fiance visa on January 21st for my fiance in Piura, Peru to come to the US. I have read other posts and I noticed people are saying that it's pretty important for both people to go to the interview in Lima. I don't know if it is possible for me to do this though because I will be starting a new job as an instructor at a college this fall and it would look bad for me to take time off in the very beginning. But I'm afraid if I don't go, we will be declined because we don't have much evidence other than about 6 pictures, e-mails, and my receipt of my plane ticket from going down there. I was wondering how long I should plan to stay in Lima if I do go to the interview. Is it usually just a one-day thing or do they ask you to keep coming back with different forms? Please write back soon. Thanks, Sara.

Hi Sara,

The interview is a one day event barring any delays. From there it usually takes a few days to receive the visa in the mail. Depending on the day of the week I would take a 4 day weekend if possible, but i fly from the midwest and connect through miami. I would not go as far as purchasing tickets for your fiance since you really do not know how long it will take to receive the Visa in the mail. Piura is pretty far north. Not sure when you plan on having your fiance travel to the states, but I hope this does help. One favor and I realize you just joined, but could you update your timeline with the date you sent your 129f and received your NAO1? It really helps everyone out. Good luck and here's to a quick K1!!! Happy V-Day too!

If you look at the Embassy Info section of VJ you will see folks who have rated the Peru Embassy. I've seen a couple of folks write about their expriences attending the interview without their USC/Finance and it turned out fine. I'll be in traveling from Trujillo to Lima with my Fiancee that day and we'll be thinking positive thoughts for you!! Do sit in the back bench area too!

ebony sean,

ESL is a good way to keep you SO busy. During the day I too will be working, so I still plan on being online as much as I could get away with here at work. Anything that could keep my fiancee busy like having a bike available, family to come visit when they can, satellite tv for watching programs from her country, online English courses which she currently studies... things like that go a long way. If you could have lunch one day during the week helps. It's going to be different for them, but truely well worth having them with us. If you could during this summer maybe take 2 fridays a month off to stretch the weekend. I'm sure you'll find the right combination of things to relieve your SO of boredom.

OK yes my fiancee has that receipt. I appreciate your support as always!!!! It's a shame I'll be there strictly for 48 hrs, but those are going to be one of the very best spent hours of our lives!! The embassy did send an old version 134 form which I'll pre-fillout without signing it if they want it, but I do have the current version ( 3 copies all certified ) in hand. Again thanks for your reply !!!!!!!!

Mexico, Latin & South AmericaDiscrimination
Vi,

Sorry to hear that you felt/were discriminated. It’s definitely a touchy subject and one should never be discriminated, but it happens. Being born and raised here ( like I was ) doesn’t disqualify one from being discriminated. This country is composed of many immigrants and SOLEY the Native American Indian is the True American.

This subject is so touchy that common America has invented ‘politically correct’ phrases to describe just about anything. I do not condone discrimination that’s for sure. I only reach higher within my CULTURA and PROUDLY act accordingly. Trust me, my Mexican heritage has gone through many trials since the Alamo. Just look at the map of the US and you still find cities named in Spanish ( Santa Clara, San Diego, Los Angeles).

Don’t let the few idiots get under your skin. You have the option of not associating with them; it is just surprising when you do not expect to be treated in a derogatory manner. The moment we give them the benefit of letting them get under our skin, that is when they feel empowered by their acts. More than that, they are just sick individuals who do not deserve our attention. Keep your chin up!

Thanks eff, sounds like it's best to get more than one copy just to be safe. I guess she'll need in Juarez and later here in USA, so we'll get a few copies. Lucky for me, that will require travel to Puerto Vallarta. lol, could be a lot worse places to go.

Pto Vallarta is one of my favorite places to go. I was just there last November with Ross. It was our 'honeymoon' since we will not be able to get away over here once we marry for real under the law. You'll have to stop by one place called "La Bodeguita del Medio" a cuban resturant which serves aweome Mojitos! They have live music Tuesday night through Saturday night. Don't forget to order your typical cuban sandwich !!! Yummie in the tummy!! Hehehe! Man I wish I were there today because tomorrow we are going to be hit with quite a snowstorm in Chicago! Take care and enjoy!

p.s. placed a pic from La B del M. Man the Havana Club Rum was outstanding!! jejeje

Thanks Jay-Kay. Anything else I should be thinking about while I'm down there? This will be the last visit until our appt in Juarez. Anticipating/hoping for NOA 2 in early June, so just want to accomplish anything that will help us be as prepared as possible when the date comes. Thanks.

I concur with Jay-Jay,
My fiancee will need to travel to Mexico City for that same reason. Do get copies apostilled and then translated afterwords. As always save your trip reciepts for future proof of an ongoing relationship ( both yours & hers bus boarding passes, hotel stays, etc). If you haven't done so, update her copy of the I-129F you sent with the additional NAO1 you received, that way it is updated. I can not think of anything else, but be careful and enjoy your time together!!! Jalisco is a beautiful state and Guadalajara has a lot to offer!

My best to you!

Trumperfire, I have to admit, that I too took your post as somewhat racist. After taking a moment to reflect and reading your follow-up posts, I truly feel that you are scared. Fear is a good thing in the situation as it is now. Do not let your guard down, not even for a moment. While I don't feel that you would be targeted for being white, you are at the same risk as all of the residents and visitors to Ciudad Juarez. Think ahead before you do anything and consider consequences and alternatives. You are going to be there for one reason and one reason only. Do what you went to do and get out of there as soon as possible. Good luck with your interview and your future life together.

Completely agree all points Robert de Bonda.

Trumpettefire,

Just be careful and mindful of your surroundings. Unfortunately Cuidad Juarez has become one of the deadliest this side of the globe. I have those same concerns/worries and my Fiancee is from the state of Chihuahua. Not so far in the past there was an unfortunate incident where embassy personnel were targetted. Very sad to find that bad things happen. You could also read posts/reviews from that embassy where VJ members here have posted. What can I say other than I share the same concerns about visiting that area. I plan on being there for my Fiancee. I also appreciated your reply!

Again my best to you and your family!

It is not safe for ALL people regardless of race, creed or color. I am sure you have read about the crisis there and you should excercise great caution whenever you travel abroad. Check the travel advisory for Cuidad Juarez at the Official Embassy website. Good luck to youand your family!
