I plan on being at my Rosalia's interview in Cuidad Juarez ( it being the most dangerous city this side of the earth ). This is a second K1 filing being done on my behalf. Hey, if worse comes to worse we marry over there in Chihuahua and file a CR1.

Our plan is actually just the opposite, we are going to do the "official" civil ceremony in the U.S. first. And then after she gets her green card, we can go back to Mexico to do a non-official "church" wedding that all her family will be able to attend.

Its all quite far away or so it seems right now. I'm still patiently (well maybe thats not the right word lol) waiting for my NOA1. I just hope I get to stay with all you January filers, this is a lively group :)

I love reading all the stories. Makes me feel pretty normal after all. Most think Im crazy, but I have never felt so sure about anything. It is really hard for Edouardo and I because we can't travel very often. I have kids and am a full time student. Edouardo works full time in DR and supports his teenage sister in Haiti. Plus we didnt even try and get a travel visa for him. They do not give out many visitor visas to Haitians. I start work on Feb 15th and Im trying to get out there before then for a quick visit. My job will be very strict as far as time off, so I need to stay until interview time.
Edouardo and I met on Facebook through a mutual friend. He 'friended me' and sent me an email on 1/7/10. Honestly, I did not reply. I just thought he was another crazy internet guy. When I heard news of the earthquake I finally went to email him and add him as a friend. I was very worried. I got his phone number through a friend of mine, but it would just ring and ring. I would pray to hear his voice and hope he was ok. His mom passed away a month before the quake, so he was alone with his 14 year old sis. Everyone feared the worst. Five days passed and no word about either of them. I was in class one day and checked my FB. I had an email from Edouardo, everyone was ok.
We began to talk everyday. Emails, texts, phone calls. It was very friendly at first. I just wanted to be supportive to him. One night we were on the phone and he asked what I thought about LDR. I told him I hated them and would never, ever do it again. LOL. Soon I found myself falling in love with him. He moved to the Dominican Republic to find work. He lived there and went to school in DR before his mom was sick. He returned to Haiti to take care of her. By Valentines Day 2010 we decided to be exclusive
I went to visit him in May for about 2 weeks. He was everything and more that I expected him to be. We had an instant connection. I am a shy person and I was so comfortable with him. It was like we knew eachother for years. I had the time of my life getting to know him and his friends. We talked about the future and knew that we had to be together forever. When I left, I felt like I left half of me there.
Back to reality and we tried to find options of how we would be together. I was open to moving down there with the kids, but soon realized that wasnt realistic. We are so excited to start this process and be together. It has been such a test for us to be apart, but we know that if we can make it through this we can make it through anything.

I agree such wonderful stories I am very blessed to be part of January Filers! I must say that when I first met Rosalia, my fiancee, it was through a mutual friend we had. I had met her best friend online and she introduced us. Well the moment I spoke to my Rossie she swept me off my feet. I was not expecting nor allowing anyone into my pertrified heart while it was in repair. I was steadfast on that, but Rossie said otherwise from that first phone call which lasted 5 hours into the early morning. Our commonalities surpised us from movies to pets, philosophies to up bringing and of course how romantic we are! I enjoy making her laugh and see her smile, surprising her with details she never would imagine and holding her in my arms whenever i possible can. I've even employed forces with her sister and dad to pick me up at the airport hours early without her knowing so that I could be surprise her at home; in the mean time she would be worried about me crossing the border through El Paso into Cuidad Juarez traveling via bus. :D I know i am terrible, but i explained later how I was feeling every minute of the way and calling her from DFW instead of ELP airport loving her to pieces, knowing that when she expected my call from El Paso I would actually be at her house! I could go on with so many more surprises and the bottom line is I LOVE ROSALIA!!!

I know everyone in our January Filers group has such wonderful hearts and I also wanted to share a little bit of mine with the group!!

Thanks for letting me share and if there is anything I could be of assistance to all of you please don't hesitate to ask. I'm pretty familiar with the K1 process and also most willing to learn more!

Mid-Ocean,

One copy for you, one copy for your beneficiary and one copy sent to USCIS Dallas Lockbox. Make sure that that your Filed copy to USCIS has original signatures on the I-129F and related G-325A's. Everything else could be copies as USCIS will request originals if they desire. Hope this helps and any feedback from other members is most appreciated.

Congrats guys, I might be a filer this month but I have a feeling it will more than likely be in February. Anyway, I have one quick question for previous filers. I seem to recall reading somewhere on here that you should make 3 copies of your packet - is that just for you to keep a copy for yourself and your fiancee, or do you actually mail off 3 copies of everything to them? I'm guessing it is mostly for your own benefit and the USCIS only needs one packet. Is that correct? I know what documents I should send them, I'm a little confused on how many copies I should be sending when I file.

Unfortunately that is the way they operate in Mexico. I am about to file my 129F this week and asked my fiancee for her translated version of her birth certificate. She is in Chihuahua, but was born in D.F. She could not get her birth certificate apostille'd in Chihuahua and has to travel to D.F. to get it done. We she asked if she could have someone there do it, but was told it was not possible. I hope that there is a way to do it without her needing to travel. She has no family in D.F. so we have no other options as of this moment.

As I fill out the K1 application my Fiancee is currently working. In September we have decided for her to stop working and go full time to school to learn english. By the time the application should go through she should be in school. Will this present a problem? Should I just plan on filling out the application with the school where she will be attending? The K-2 is part of the K-1 process. Assuming all your factors are acceptable by the U.S. embassy in Peru, the child's visa will be approved with the mothers. Just make sure that everything is in accordance with the laws of Peru.

Just so you know, a child under age 21, can follow the parent within one year of the parent's visa issuance date. It sounds in this case that the child is young and will be accompanying the mother. It should not be a problem for you.

I also included a translated copy of his birth certificate along with a copy of the letter of intent signed by his natural father giving him permission to exit the country. My question is how and when will I be able to start his K2 Visa or is it automatic for him to be included with the initial I-129F? A little clarification is what I am needing since the K1 package does not quite describe it. Thanks ahead of time!

So there should not be any problem with obtaining both the K1 and K2 Visas at the point of K1 Visa approval? There are no known issues with my case and the father is 100% O.K. with everything. I realize for you it may be speculative, but just the 'consulate process' appears to be in parallel with the I129-F. I just inquire because I want to avoid getting the approved K1, yet not have the K2 approved at the same time. We wish to travel together and no one to be left behind. Thanks!

What you will also need is the birth certificates ( and divorce decree is applicable ) translated. They will need to be taken from RENIEC - Registro Nacional de Identificación y Estado Civil to Relacciones de Exterior. At Relacciones Exteriores there is a panel of translators who could officially translate the said documents. Just a note from my experience. Hope this helps and do follow the Step by Step Guides found here in VJ. Hope this helps!

Sorry I'm very new to this and not sure how it works. We are VERY serious and have been together for over 2 years and 5 months now. Over 1,000 emails between us, atleast 50 pics together. She has just never been to america. What is the faster/better choice for her to move freely between mx and tx? She already has her passport. I would like nothing more than to make a phone call and just be married; however I don't believe it is that simple. Plus it takes atleast 500 dollars (that I don't have to spare) to get a lawer to do anything for me. Is this something I can reasonble do myself?

If you are both in agreement to marry then either the K1 or K3 option will work for you. Do look at the guides tosteer you in the right direction for filing them. Don't worry about being new to this because everyone has to start from the beginning at first. I am filing this on my own ( but really with the help from reading a lot of things here in VJ and through some folks who kindly lend a hand here). I've even had the pleasure of meeting one VJ'er while in Peru with my fiancee.

So if you feel that you need a lawyer to help you through this it really is your choice. I did not feel it necessary in my " K1 case " since it is quite plain and simple. Being ex-military just remember attention to details. Must have met each other within the last 2 years and show proof of a relationship. Everything you could find here in the guides which are excellent. Also, feel free to PM me if you wish for I'll be more than happy to offer what advice about the process I've learned. Good luck in your journey and time goes by rather quickly.

For those that have already sent off your I-129F and all related forms etc....Did you all put the paper work in folders?...or in plastic sleeves? Because I have a folder with plastic sleeves in it...and was thinking it would be a good idea to keep it all together in that?

I know its a stupid question but i havent got a clue :unsure:


Thats what I did, with clear plastic sleeves. I heard they don't really want bulky folders cause they have to take it all apart and arrange it the way they want to arrange it. You can put passport photos and little things in a plastic sandwich bag and staple it to a sheet of paper.



I used the acco fasteners to do my 129f. I also put those hole punch reinforcements on all my documents in case they begin to wear and accidentally tear off. I used a standard manila folder and followed the guide on VJ. I sectioned off items with tabs and on the 'tabbed sheet' had a list of things to be found there. I also personalized a note on that sheet signing it and thanking them for their time ( silly, but i thought i couldn't hurt jejeje). At the front of the folder on the outside i wrote " Familia xxxxxxx 129f " in permanent marker and using the clear strapping tape i pasted a nice picture of me, my fiancee and her son in a family hug shot ( just personalizing it as much as I could so maybe they might give it an extra thought or attention. Hey i play any card so that whenever they touch it regardless of tossing the front cover away, they still could read my messages jejejejej ). Anyways that's my crazy input and I wish you a speedy Visa process!!!

P.S. and don't forget to triple check everything from the back of the passport pictures to signing every sheet of paper. We filled everything out my last visit to Peru and i sent my 129f in when i returned. I left my fiancee a copy of what was being sent. Just pay attention to details. eff

Happy Valentine's Day TOO! Although we may be apart from our loved ones here is what my fiancee and I did last year and will do again tomorrow. It was a last minute surpise I had thought of. I had her rent the same DVD Movie from her local video store ( Return to Me last year jejejje) that I had already rented. After my future son was put to bed I called her by phone using the cheap calling cards that last me forever. We syncronized starting the movie together and watched it like if we would had we been out on a date. We talked, she cried and laughed the rest of the night away! I can not tell you how nice it was; we just need a little imagination and a whole lot of Love!! It was the first time she had seen that movie and it's one of our favorites now. Months later when I visited her we watched it together..... :crying:

So you see one could be romantic regardless of the long distance seperation (L) !!

Waiver only needed if had 2 petitions in the past, or last petition was less than 2 years ago.

As for K-2, yes, just one petition needed and the fee for the one I-129F covers both. K-2 is a derivative visa, and will need to pay additional visa fee at interview time.

Hello Everyone!

Just about ready to file my K1 for my fiancee and have one sanity check question. I previously had a K1 filed in 12/06 with it being approved in April 2007 followed by marriage in the States in June of 07. Unfortunately it ended in divorce in April of 2009. In my present K1 I have included the divorce decree and stated appropriately the alien name/place & date of filing/A# with result stated as " ended in divorce." To be safe, should I also include a waiver? It's been over two years for the initial filing date as per the I129-F question 11.

Additionally, for the K2 part for filing, I am pretty sure that I need to just include my fiancee's kid's name ( under 21 yrs) and later it will automatically be process. Henced the $340 fee should cover everything for now.

Fill out 1 copy of of the current G325a for the petitioner and 1 for the beneficiary. They're 2 pages each. That's what you'll send in with your petition. See section 6a of the I-129F instructions. http://www.uscis.gov...i-129finstr.pdf

Hello VJer's,

Just one last question prior to shipping my I-129F for my fiancee. I know that in 2006 there was a form used which printed out 4 325A's, but this new form G-325A ( Rev 06/12/09 ) only print's out (1) one. The FAQ's states if you are using the new version only one print's, but it is does not indicate as to how many should be sent. So the I-129F Jeopardy question for the day is, " How many 325A's ( for the Petitioner & Beneficiary )need to be sent on your original filing of your I-129F?"

My fiance lives in paraguay. Here if you don't work for a large company all of the work is done under the table and paid in cash. So if he just put the employers name and address is that ok or does he need to put phone # also? And a general question on the form it just asks for name of employer and address therefore no phone # is needed?

I would technically put he is unemployeed if there is no way to 'legally' collaborate that he is indeed working. If the Embassy does their backround checks and can not find your fiance technically employeed at his under the table job, it may raise a flag. But if 'under the table' means that they also state he works there, than cool. Bueno eso son mis consejos y les deseo muy buena suerte!

I sent my fiances Visa papers in about a week ago. I sent the I-129F, 2 biographic papers, one for her and me. 2 passport photos, and 4 photos of use together. A copy of my birth cert. Was that all i was suppose to send in?

Also how long will it take for me to hear back from them that they got the papers, and for them to send word that they will approve the visa? I heard since im military its a little faster?? Any truth in that?

This site has the FAQ section which provides an excellent guide for you to use. Please read up on it and detrmine what you may have forgotten. Also, do expect an RFE as previously stated, but it will speed up your process having ready what should have been included.

You need to wait till you get your NOA2, this police report which is called in Mexico ¨Carta de NO Antecedentes Penales¨ actually has an expiration date of about one month of when it´s issued.

I agree that is the only one required and I would recommend getting it once you receive your NAO2. That way it would be as most recent as possible just to make sure it is within reasonable time.

Agree with the previous post. You will also need a notorized signed letter from the 'father' stating that he grants permission for his child to depart the parent country with the mother/mother's grand parents in order for the child to pass through POE. At the POE this letter would be kept. If the grand parents do bring the child at a later date, then the mother of the child will also need to provide the same type of letter. The US if very strict about this and will not budge from it's policies concerning children entering from another country without proof of parental consent.

My advice is to bring the child with you and your fiancee at POE.

P.S. I did go through this process and POE with my 1st K1/K2. Also recommend a good set of original/certified birth certificates & divorce decree ( if applicable ) since P.I. is quite a ways fromthe USA.

I got the RFE hard copy today. All it was for was for a passport photo of me (which I sent the first time...but whatever).

I immediately went out and had two passport photos retaken. The RFE asked that I put them in an envelope and staple them to the RFE notice and send it back. The RFE notice has my name, case number, barcode, etc.

I didn't include a cover letter or anything. My question is, should I have?!? Or is it ok that I sent it like that? I was in too much of a rush to get it back to them to write a cover letter. The notice states all the information about what the RFE is for and has my info so I am hoping it is enough. Thoughts?



It should be fine. I just hope that you are still smiling at them through the camera because the only thing left is your approval :) !! Also i hope that you did make a copy of the RFE, but i believe that if you go check your status online it will show the exact hard copy information. Just for good record keeping ( not necessary ) it is good to have a copy of the RFE. Hope to hear about your experience with the CDJ interview process. Wish you and yours the best. My fiancee and I are waiting on our NOA2.
