I think it is until the immigrant has 40 quarters of work under their belt.


40 qtrs of work or becomes a citizen. I think the spouse's work counts, too.

OKAY confused...I thought we were filing for a k3 not the AOS...i thought that was after 2 years!!
NOW im having a panic attack over the 1010 dollars!! OMG i am about to just give up...i thought THAT came later...

K-3 is a VISA (e.g. it would be the permission for your husband to enter the country legally). You already filed and used the K-1 VISA for your hubby to enter legally as a fiance. Now after marriage, he must adjust status to become a permanent resident (and get a "green card"). That is the "AOS" we're talking about here. Yes, it's $1010 filing fee, I'm afraid. And I wouldn't bother trying for a fee waiver... Been there, tried that. Do a cash advance on your credit card if you have to; at least you finally found a joint sponsor.

From what I recall, I think only 1 year of tax returns is required, the employment letter (stating income, hiring date, and continued employment), and the affidavit I-864 (each of these for both you and your sponsor). I would add additional tax returns if there's some inconsistencies (dips) in income and your prior returns can show more.

Hi,

I, Francesca, (petitioner) sent in Lobo's (beneficiary) K-1 visa petition this summer, and received the NOA 1 on July 12th 2010. Anyone else still waiting from July 2010..??? It will be 5 months Dec. 12th. Isn't this a little long?? My service center is California and Lobo's country is Brazil....do these have anything to do with the wait time?? Also, we did not use a lawyer, I did everything myself.

Thanks for any advice, guidance, and comments....

Just a quick few questions...

It seems as if some know when things have been touched prior to receiving their first noa1 just wondering how you come to find this info?

Some also look like they got their apps right in and checks cashed. still waiting to see my check cashed electronically online with my bank and I know the packet was delievered to their post box last Saturday. Getting anxious, seems some get right through and some like mine sit and wait... I know I am in for a long wait but why is their such a difference in acceptance of apps, new ones coming in and processing payments ?

Last Question or thought here. I know on our timelines gives a promising estimate on aprox date the apps will be approved and sent to state office, but looking at processing times online, csc seems to be at least in august just starting January 2008 packets. That means we are nearly 8 or 9 months waiting instead of the typical 3-4 months?

I know exactly how you feel. I got married in July 2002. Sent AOS application in August 2002. I then had my AOS interview in December 2002. Well I sort of got approved but couldn't get the official approval until the fingerprint checks had cleared. I had to be fingerprinted a total of three times because the prints were not coming out. It wasn't until July 2004 that I got approved for the 2 year residency. I had made inquiries in the 18 months just to be told basically to hang in there. If truth be told I think I got stuck on the backburner and then my file was discovered during "spring cleaning." When I got my approval the date was after the 2 year mark of my anniversary. I went in to our local office and pointed that out only to be told that they didn't have to issue me the 10 year card as there was nothing clarified in writing that that was how it was to be. When it was time to remove conditions, I sent my application, fees, etc in to Nebraska. I then get everything sent back to me, cheque included with them stating that I was supposed to have gotten the 10 year card back in July 2004 and I was issued a 10 year card. I sent my application in for citizenship near the end of July 2007 to Nebraska. In early November they claimed I owed more in fees. I then sent a copy of my receipt from USPS showing that my package had been received by their office before the new fee deadline. I then get a letter from them stating that I didn't owe the fees. I figured I wouldn't get a notice from my local office for the fingerprinting until at the earliest November 2008 so was shocked to receive a letter in late July to come for fingerprinting on August 11. Of course problems once again with the fingerprinting so I could foresee having to come back for fingerprinting in the future once again. Surprise! A letter in yesterday's mail stating my citizenship interview/testing will be September 29th.

Back in June 2002, I brought my then 11 1/2 year old son to the interview. I figured if he was going to be part of the immigration process he would come along and see what it was all about. We travelled for 5 hours from southern Ontario to Montreal, stayed in a hotel for the night, walked around the city checking things out, then attended the interview the next day. The interviewing Consulate officer was really nice and asked my son questions too. Later that afternoon my son and I were on the train headed home again.

As far as a letter from his father authorizing permission for our son to immigrate to the U.S., we had a letter drawn up by a lawyer I was using as my son's father and I were never married and there were never any legal papers set in place when our son was born. My lawyer signed, his lawyer signed and that was fine with the Consulate.

I was looking for them to play a 'powerful' song like they did with the Calgary Winter Olympics (Can't You Feel It?), The Atlanta Olympics (The Power of the Dream sung by Celine Dion) and The Salt Lake City Olympics (Call of the Champions directed by John Williams with the Mormon Tabernacle in the background). They just didn't have that "powerful" song for the Vancouver one.

Loved the First Nations people, loved the skier coming through the rings, loved the whale/salmon theme. What was up with the hair on the opera singer though?

Oh and the tribute to the luger - very nice/respectful.

I think the "About Me" section will work quite well for that type of job :) The biggest thing they are going to want to see is that he has a social insurance number -- as long as he has one of those I'm sure they'll be happy :)

Thanks. He's in Ontario and has his Ontario driver's licence and SIN. I'm glad he gets his health insurance coverage starting mid April as well. Just now has to find that job.

I should have clarified a bit better. For now he's aiming to work in places like fast foods, pizza places or retail stores...until he figures out what he's going to do in the future in the way of College.

When he has gone to these places and asked for an application to fill out, alot only want a resume. For example he inquired at an A & W at one mall that was hiring and the woman told him just to hand in his resume.

I like that idea about the "About Me" as mentioned by the poster "Dan and Ali" here.

My son is Canadian born, now 19 years old and has just returned to Canada to live and work, from the U.S. He lived in the U.S. for 7 1/2 years and gained citizenship as well.

Bear with me on this. His resume shows "U.S." information only - schooling, organizations he was part of, part time jobs.

My question? I don't know how ####### Canadian employers are when it comes to hiring "foreigners" not knowing that my son is also a Canadian citizen.

I remember moving here and being told that in the state that I reside in when it came to jobs, American citizens came first and lots of age discrimination. No, it didn't come from the employers of course but the everyday American citizen. Unfortunately I also live in a State that is 30 to 40 years behind the times so none of this surprises me.

Any thoughts?

I have an almost three year old granddaughter living in Ontario, along with aging parents and two adult daughters. Not being part of my granddaughters life has been eating away at me since the day she was born. This is what had factored into me returning along with other issues.

Great...thanks alot. If I remember correctly when I applied for AOS initially back in 2002, they wouldn't take a personal check so I wanted to double check. It says checks on their site but my husband didn't trust it....lol.

Well this weekend, all of my stuff gets gathered to have conditions lifted for my son and I. I'll be glad when it's over for another 10 years or citizenship (whichever comes first).

Does anyone have an idea on how long it's taking Nebraska to process?

Just wondered if anyone is currently dealing with Nebraska (or has in the past few months) on having your conditons removed. I see they accepted our package just over 2 weeks ago and was curious to see if anyone knew how long they were taking on issuing an approval.

NSC has been up and down speedwise. There are a lot of I-751s posting at britishexpats lately; maybe you'll find more specific info in that more mature forum.

Ours took 9 months when we expected 18. Then again, I've seen 3 month approvals come out of there this year. Seems they go and make a run at a batch, and then go do something else.

It's really a "file it and forget it" form; nothing changes for you while you're waiting, and you are still eligible to apply for naturalization on schedule if you want to.



LOL I agree they should be paying me for this one. Actually when I first dealt with Nebraska back in 2002, they were pretty good. It was our local office that screwed me over big time. To add insult to injury I then get issued a 2 year card after having been married for over two years when I finally got approval. I tried to fight them on that but lost. Fun and games!

I'd be curious as well because I will be submitting my removal application in a few months to Nebraska.

I remember seeing someone on here that was approved in 4 months, but I can't remember who.

P.S. Did you send letters from friends with your application? I don't want to, and I'm not sure if it's mandatory or just an example of some of the evidence you can send.



No I had never sent letters from friends with our application. Here is what we had sent copies of:

1. Front and back of permanent residency cards for my son and I
2. Both of our names (husband and I) showing on the title to one of our vehicles as well as the title to our house
3. My name showing as beneficiary on his pension
4. His name showing as beneficiary on my pension out of Canada
5. Dental statement with my name on it and him showing as policy holder; did the same for my son
6. Son's student ID card

I think that was about it.




Oops I forgot, also a copy of our joint income tax return for 2005.

See my post under "It never fails...." Apparently Nebraska (who I filed with) does not agree with Boise giving me a 2 year card (back in July 2004) after I had been married over 2 years at time of approval. I have made an InfoPass to see an immigration office at Boise as per the instructions by Nebraska. I had just sent all my paperwork in to have conditions removed with Nebraska last month.

I ran into this situation back in July 2004 with our Boise, Idaho office. My approval date was July 7; I had been married July 1, 2002. I went back into the office with my card and marriage certificate, pointed out they had made a mistake and that I should have received the 10 year card. They told me basically they had the right to issue the 2 year card as nowhere in the law does it clearly state in black and white that after a 2 year marriage do they legally have to issue a 10 year card. They had run into this situation in the past, had checked with their lawyer on it and he told them they were within the right to issue the 2 year card so until there was something clearly written in black and white, they will keep issuing the 2 year card first no matter the length of marriage. The Supervisor also told me she was aware other immigration offices do issue a 10 year card after a 2 year marriage.

Take your card back to the office and question them about it, you might just get lucky.


I have just called the USCIS and wasted an hour of my life. They said it didn't matter how long i had been married the first Green card is conditional.

I'm sorry to hear it worked out that way. So there are other ones out there that deal with it the same way Boise does. It really sucks.
