I don't think it's ever a good idea to try the financial hardship angle with a visa category that will require a sufficient sponsor. You're pleading poverty in order to get them to hurry up, while simultaneously expecting them to accept that you've got enough income to support your new family in the US. On top of this, you're using a medical basis for a humanitarian request. Both USCIS and the consulate know darn well that medical care is far more expensive in America than it is in the Philippines. You're not going to save any money bringing her to the US sooner, and they know it.

Furthermore, consulates are often very reluctant to issue a visa to a woman who claims to be pregnant with a US citizen's child. They strongly prefer that child to be born abroad so that they can go through the CRBA process to determine if the child really has a valid claim to US citizenship. If they allow that woman to get a visa and come to the US before giving birth then they are granting citizenship to that child regardless of who the biological father is. They don't like to take that risk.

I don't think you'll get the expedite, but if you do then don't be surprised if the consulate refuses to issue a visa until after the child has been born and the CRBA process has been completed.

You can't change the visa type, you can only cancel the K-1 and file for the CR-1 which means paying the fees again and starting over in line waiting for approval again.

I filed I-129F already (K-1).
Now I am wondering if: after the NOA-2 and before the Interview, at anypoint can we request a K-3 Visa instead of the K-1. We would like to Marry before our child is born. I see a lot of information including answers from VJ'ers on the difference of the 2 Visa's, but I am still confused about my specific situation. Provided the I-129F petition is approved, will it delay the Visa process if we prefer to marry before the K-1 Visa is issued and instead request K-3.
NOA-1 on 01/12/2012 (I-129F). That puts the estimated NOA-2 somewhere in May. another 6-8 weeks for Interview, puts us right about July.
My fiance is 8 weeks preg. that puts the approx. due day early August (I think)
We would like to be married before the baby is born, but I am concerned about the potential delays of requesting K-3 , when we have requested K-1.

If we get our I-129F approved sooner, I will go-fast and avoid AOS Request. This would also benefit in the fact We wouldnt have to get Passports and Visa for the baby.

This is what we did a little over 3 months ago and is solely based on our experience.

Your fiance should already be gathering her Birth Certificate, NBI Clearance, CENOMAR, Police Clearance if she worked overseas for more than 6 months from the country where she worked, Annulment (if applicable).


You as the petitioner should prepare I-134, employee letter, pay stubs, and tax transcripts for 3 years (you can order tax transcripts from IRS website for free), evidence of ongoing bonafide relationship, money remittance, and anything else that proves a genuine relationship, and then send it all to your fiance as she will need these things for the interview @ USEM.

You can pay the visa fee through BPI it is $350.00 but will pay in peso based on the exchange rate that day. Be sure to have your passport when paying for the visa fee and keep the receipt. Wait til the next day and schedule your interview online. You do not have to wait for the eligibility letter from the USEM. Otherwise, you will be waiting for awhile. When you are scheduling online, you'll need manila case #, passport info, and the receipt # from BPI. Give enough time in between interview date and when she plans on getting her medical done when scheduling. There is no need to schedule an appointment for medical since it is walk in. You can register through the SLMEC and fill up the registration online and this will save you an hour and a half. if you don't fill it up, they will make you fill it up on the spot @ the clinic.

A CFO sticker is needed to be affixed to your fiance's passport. If you do not have this, they will not let her board the plane. This can be done in advance and once you have the visa in hand, you can go back to the CFO office in Quirino Avenue and obtain it. Or, you can wait until visa in hand and then attend the CFO seminar and get the certificate the same day.

There is no need to withdraw the petition or do anything drastic. Just have complete G325a forms ready for any RFE. No need to even have the foreigner's signed. I doubt there will be an RFE. If there is, it only delays things a couple weeks if you're ready with what you already know they would need.

I agree with you. Seems to be a-lot of misinformation being handed out lately. Step 2 number 6 on the I-129F Instructions specifically addresses the OP concerns. (IMO he's ok).

They like all caps coz its easier to read hand-written words. Nothing to be worried about. Good luck to you. You will make yourself crazy worried about dotting your I's and crossing your T's. I can tell you from experience. lol! I have never heard of anybody at all where that was an issue.
I still go through my paperwork occasionally to see if I possibly could of missed something :bonk:

So when I proposed to my now wife I had no idea there even was a K-1 but figured there had to be something. I googled something about wife visas and came up with this site and started asking questions. Pushbrk answered most of them and seemed pretty straight forward and plain speaking which I admire.

Now I have been through the whole process and Alla is now a citizen and we never had an RFE or a question asked at an interview until the citizenship and even that was no problem and I thank Pushbrk for that over anyone else (not to belittle the others here and there are plenty) but Pushbrk was always eager to answer, always correct (being correct makes it more than an opinion)

Pushbrk will also pay you the compliment of being direct. I have no use for polite idiots who make up answers that are not correct

OP I believe Pushbrk is correct. USCIS asks for copies. If you already have a correct copy, Keep it and be well-prepared to send the correct copy back to USCIS (next-day air) as Gary&Alla and Hank&Amy sugggested. If you look at the I129F instructions Section B, Question 5(d) there is no mention certifying the "copies" or that a Decree is mandated, only proof of the divorce. The Decree is typically the easiest to produce for evedince.

NOA1 takes only few weeks to get. The Deportation occured months ago.
On the Forms somewhere it asks. (129-F or 325) has the beneficiary ever been to the States. I'm ALMOST Sure of that. I'm not looking at the Forms.



The OP say Oct. 07 that would be more than 4 years, if I understand correctly.

Hi guys! Does the consulate in the Philippines require the original copies of completely filled out I-134 and other related/suplementary documents? Or scanned copies will do? The documents sent by my fiance through USPS are still in transit and I'm afraid I won't be able to receive it until my scheduled interview which is on April 10 especially with all the holidays coming up. In case he mails another set of documents, do we still have enough time for me to receive it by April 4? I sent a copy of my petition via USPS in early feb. it arrived at a sort facility in Manila on feb. 9 and still hasent been delivered. FedX took about 5-7 days.

I called NVC tonight and was excited to get our MNL case number. My question is, can we pay the 240 Visa fee now or do we need to wait till it gets to USEM?
