I just got word from my fiance' she was approved at her interview, and she was very impressed how smoothly everything went. Tonight has been the most nerve racking experience I've ever known,,,but after hearing she was approved...there is no way to explain the enormous utopia after such a long long journey. Praising God in every way. Soon I will try to post more details of her interview, but I would love to take a moment and give a special thanks to all the VJ'ers out there who have really helped more than you can ever imagine, and that support was from day one all the way through...and a very special thanks to STEVE and NATASHA!

I went through a similar fiasco with my K-1 visa petition of my fiance from Lagos. It is a very bad embassy to work with. We were denied in Nov. of 2011, and have been fighting ever since. By the way- we never received anything that looks like the yellow page you have received. The only reason for denial we were ever given was to print at the top of our petition "FOR IMMIGRATION PURPOSES ONLY" . I contacted my attorney (who helped us file), 2 congressmen, 2 senators, the ombudsman in DC, the USCIS, the NVC, and anyone else we could think of that might be of some influence. No one at the NVC, OR USCIS knew what to tell me. Everytime i would ask a question, I would get a different answer. The embassy in Nigeria would not even answer their phone- it rang and rang- not even a voice mail (I got their number from the State website). Since we were getting no answers, (and were being told that they could not locate our paperwork, and could not therefore get a reopening of our case, or a re-interview,) and the time was quickly approaching that our validity period for USCIS was ending, I made an appointment to visit my local USCIS office in Boise Idaho. I took all of our proof, and information (which was not even looked at, at the interview,) to explain our situation, and ask for an extension of our validity period. I was treated rudely by the officer at the counter, and basically laughed at. He said he had no way to extend the expiration date, and told me I was welcome to get more forms and re-file. I found this sooo frustrating. If the embassy is sure that we are trying to "scam" the system, wont we still be "scamming" if we re-file? and- if we re-file and are approved, does that mean that they were wrong with their first denial, and they will refund our money? We have been together for almost 3 years, and it makes me sick that money is keeping us apart. In the world today, it is very easy to meet someone from another country, shouldn't the laws change to reflect an easier way to be with the one you love?? The system is broken. It needs fixed. I want to fix it, but I don't know where to start. I feel your pain, and I have felt it for many years, it never dies, until you are with the one you love. I just received a copy of the yellow form that was given to my Fiancee.

What I have done so far is email the Embassy and they responded by saying that "You are allowed to file a new petition, or marry Applicant and file for her to immigrate as your spouse."

So I am headed out the door at 8AM to fax stuff to my Senators.

What else should I be doing?

When you check your account status on the USCIS website, check the date under "last updated." You consider your application to be 'touched' when this date changes. Who knows what 'touches' mean, though. Our application did not get touched any time near our approval date. Best of luck to you!

I always advise people to make their life plans based on their own personal and family priorities and then take the visa path most appropriate to the life plan. None of the issues you mention will enough difference to worry about but the countries involved may.

Certain countries have widely varying timelines from when the case leaves the US until interview. Some of the variances depend on visa type.

I take it, she's 15 years older than you. Whether and how much this matters can depend on country and culture as well and if you're 18 and she's 33, that's a different story than you being 55 and her 70, so paint us the picture please.


Wow, thanks to each of you. To answer the questions. Firstly, sorry for the long windness, being a pastor I guess I can speak quite a bit....

I reside in the U.S. and she resides in the U.A.E. with a work permit resident card. Her homeland is the Philippines and hehehe I am the one older, I am 47 and she is 32. U.A.E. is such a hard country, they dont allow women to sponser their husbands to come and live with them and to try to get even a small ring to them is useless through the safest mail carriers they do not allow anything and to find a public notary is almost impossible. Thus our trip to visit somewhere we have never been. Thanks to each of you, unless one of the dilemas mentioned in my start letter poses a problem one way or another, we will use this also as a trip for our proof and seemingly apply for a Fiance Visa. We definately dont wish to interview where its pretty hard to and costly even though travel to abu dhebi is not the easiest task either.

Greetings:

Firstly, let me say hello to everyone, and to the board administrators a big Thank you for having such a forum. Secondly, if I have placed this wrongly--please forgive me and would you please still assisit.

My Fiance and I are preparing for a trip to Thailan in a little over a week. Our First meeting after knowing each other for 3 years was in Hong Kong and a very exciting and memorable one. Part of our journey there is to notorize the final papers she needs to notorize since in the country she works in they are not readily available. The thought then crossed our minds how we yearn to be married and yet know, after reading here, that it would cause troubles if we marry after the K1 Visa has been filed. So, before we actually file, and with an appointment set in Thailand with the US Embassy we could use some help in making a decision.

After reading, and a lot might I add forum entries and written info documents we know each hold their true weight in Gold in also processing. Besides for the obvious difference between the two--one Fiance... and the Second For Married, what are the benifits of each compare to the other in which circumstances. Such as maybe one would be easier to work with lets say if their was a large gap in age or another--short term knowing of each other or Fiance knows little english or applied once for immigrant already or ect... i am sure you get the nature of this question by now. Below I will share some about us, please--it would be awesome to marry her there but it is scary because ultimately we simply want to have our life together forever as soon as possible.

I met my Fiance, 3 years ago and as every Fiance out there, she is the best of the best in my eyes and the server here could not hold all the wonderful things I could share ABOUT HER, WITH THAT SAID THOUGH, we did have our first visit in Hong kong and the time was magical. There is an age difference though between us of 15 years. She extremely does not look her age but much younger. She is shy while i am vibrantly talkative. For the last few years we have wanted to marry but things have come up and not allowed such to happen. she is a resident of another country apart from her homeland. We have made engagement announcements already here and am trying to find a way to make them in the paper from her homeland but with very little success on the part of communicating with the newspapers their. we have talked with each others parents and share with them our plans. She speaks absolutely remarkable english, is loving, as like I said--she is quite shy and sometimes to those she dont know a woman of little words but never ever rudly stated, and has quite a nice professional career started in the country she resides in.

Please, we look forward, and faithfully thank each fo you assisting us in our endeavors. Do we get married and apply for the K3 or Not get married and follow the adventure of the K1. Please assist us in learning so we will also be able to help others as well, when one or the other is the obvious choice, please share with us why and for what reason.

Thanks for bearing with this long message and taking the time reading through it and most of all, thanks to each of you for assisting us in our Happy Ever After lifetime of Joy...

We were approved in August. Paperwork forwarded to embassy in December. They requested a different birth certificate from a specific agency. That was returned in January. In Feb they asked for a letter explaining what she had done in the years 1992-1997. Once this was answered, we had to wait 3-4 weeks. I only know this because I called the state dept visa every 7-10 days. Finally we got word that the interview was scheduled for 4/21.

Hello,

I'm new to the whole forum thing and I am just looking for some guidance if anyone has any.

I just recently married a Canadian citizen on Dec 29th, 2010 in Chicago. We have planned for her to move down to the states with her 5yr old son. I have a few questions.

Do I have to file a seperate I-130 for her son?

Since the father is not listed on his birth certificate and she has sole custody(never married) do we need to obtain permission from him?

I've read that we have to show evidence of the marriage, other than the license, is their any other proof that we can provide since we just got married not more than a few weeks ago?



If anyone can help with these questions, we would surely appreciate it!

Thought I'd add my 2 cents on this thread. They received the I-130 petition for my wife back in July 6th. In November I was a victim of the infamous California to Texas transfer. I called in December to see if they could expedite things since it was past the 5 month mark but they blew me off because we didnt have a medical excuse. I called again today and entered my receipt number and the recording said that I need to sit on my thumbs for 180 days after the November transfer before I should call back and then it ended the call. I called back again and didnt enter the receipt number so I could talk to someone and this time they acted like they might do something and gave me some service request number and told me to call back in 30 days if I didn't hear anything back from them.

On the USCIS web page it still shows that I'm in the initial review stage. Right now it's 199 days or 6 months and 16 days into this process. At this rate my wife might be in the states sometime in 2016.

Just wondering but did anyone else get 1 of those numbers when they called? Is this 16 char alphanumeric number something that I can track online?

I know what you mean. We are almost 8500 miles apart and in different hemispheres... and I'm a day ahead also 18 hours as well. It's an expensive proposition to fly back and forth that often. But all that is not as difficult as spending time with my darlin' and having to leave yet again.

We try not to stress as the time wears on, and we have no 'touches', no news of any kind. I knew it wouldn't be easy. I never expected it to be this hard.... *sigh*

Trying to keep busy. Andy's still pooped from his long flight so I've only had a short hello time. He's going to need another day to recover - that 9 hour time change is a doosey. Then hopefully he'll stay busy with job hunting and stuff during the day. We're sure going to need the money to help pay for all the visa/medical/flight/wedding/AOS stuff coming up down the road. Wish I had time to work a part-time job to make the financial stuff less overwhelming, but it's not realistic with my studio projects & intern job. I have a ton of work to catch up on this weekend since last week I couldn't focus on it.

Basically I'm trying to keep my nose to the grindstone so I don't notice how empty and quiet this place feels without Andy here.

Thanks to everyone for the kind words and consoling. It's really helped me. I can't stand hearing from people not going through this - "it's not forever" or otherwise blowing it off like it's no big deal. It feels so much better knowing there are people out there that really understand and care.

Well, Andreas started his journey back to Germany today. I'm trying not to fall completely apart. If there was any possible way around spending this time apart, I would do it. I cried so much today that my contacts were all foggy the last hour of my 2 hour drive home. I can't describe how hard it is to people around me what it's like to find the person that completes you, spend 3 months making a home together, and have to say goodbye for an unknown length of time. I'm happy for the June vermont filers, and I'm so pissed that Vermont is running 2 months ahead of CSC. This system is the biggest load of bullshit and red tape.


I along with most everyone here really feel your pain! It's unfortunate that as a country, we cant get our ####### together and make it a little more fair for all and prioritize the applications.

I certainly believe that if a US citizen files for a spouse or fiancee visa, it should take precedence over the illegals and the refugees, but thats just my vote! After all we are the tax payers...

Hang in there, we are in the same boat and this long distance relationship is killing us too. We just need to have faith an preoccupy our minds with day to day tasks. We will get there! good.gif



ummm... ya... our relationships with our wonderful partners from areas that are not war torn and full of civil strife should take precedence over those who have help our soldiers in the fight for freedom overseas.

I will glady give another month or two of my time to give a family a chance at the freedom we have. I think as Americans, we sometimes forget how good we have it.

In the grand scheme of life, we are all waiting a few months to be with the ones we love. Were not talking YEARS- were talking MONTHS. There is a system in place for a reason, and as slow and f'd up as it may seem at times it serves a purpose. As much as waiting hurts, there is an end in sight. Everyone here seems to want to dwell on the negative instead of the positive. Thats why I quit reading and posting. Checked again tonight and its the same old song and dance. I have a suggestion... instead of crying in our cheerios, why dont we celebrate the positive? Why dont we talk about the future and the GREAT AWESOME times that are ahead for all of us shortly? Just a thought....

The best way to support each other is be there WHEN the other is fustrated OR feeling bad about things...YEs it is GREAT to try and stay positive BUT sometimes it is VERY rough and tough to do..I know I been apart from my sweetie 1 year 5 months..I cry a lot I work hard he does to ..so he can COME home...SO YA lets stay positive for EACH OTHER and when the other is down be there FOR them instead of getting crabby

We were so happy when kai got OFF the plane BUT then when he had to go I felt like a part of me was beign ripped to shreds. I cried for DAYS! He cried to..

As you said I keep seeing CSC PUSH back our times on here and I want to F*ing scream!! I think it is a bunch of BS if you ask me, after all they HAVE more people and they get JUST as many at Vermont SO why is California lagging like a dang 1980s computer???

I am happy for vermont filers BUT I get fustrated and SO pi**y that CSC is slower then a mud fence compared to the other centers. It is like that are having some party with drunks and using our petitions as dart boards!

I just want us ALL to get our visas so we can have our loved ones home

yes yes..crabby day I had a doc appt as I have cellulitus that came back in my legs SO now I have special socks to help out. I so cant wait till my baking is done so I can get out of this crappy job and be abel to have the freedom for more pay, less time ON my feet and a FUN job LOL

Today I am missing Kai so bad though. It has been 1 year 5 months since I physically saw him and it seems that only yesterday he was here in my arms. It was a horrid rough night last night on top of it. one of our favorite residents died at the veterens home and I saw it happen. I was cleaning up a mess in his room on the swing shift and He said * oh hey you, thank you for cleaning that up and then I turn around and he looked awake..nope he died. I grabbed a nurse and sure enough.

It just made me realize how precious and short life truly is and I am grateful I was there with him so he did not die alone like many do. It also made me miss kai because Each day that passes is one day I do not get to touch him, kiss him, sleep next to him so I can listen to his breathing and heartbeat; BUT it also made me realize HOW incredibly lucky I am to share this life with this amazing man

Yep, correct. I was asking if those with May weddings minded their SO's staying out of the US for extra time. I do. I want Andy back here ASAP. I don't want to wait around an extra month or two because I booked something later than we needed. Maybe for others the big day is more important. I don't know, that's why I'm asking.
