K-1 Fiance(e) Visa Process & ProceduresI need your help......
Hi first let me introduce myself, Im from Thailand, im a fashion designer and im 24. My boyfriend lives in California he is 25. We met last year in Dec.2007 and ever since we still contacting each other (long distance relationship). In May 2008 he send me a plane ticket to go visit him and our relationship sort of elevated from there. He did ask me to marry him so that we can be together but it was too sudden and I was a little skeptical. Now I realized that I want to be with him, because we survive many months of not seeing each other and that have proven to me that we have a strong foundation. He will come and visit me in Jan 2009.

You were not sure about saying yes on your visit and to sudden I agree BUT it sounds like you are still not sure what you want.

At first i was going to go there using a tourist visas and see what it would be like with him there. So if everything went well, we will get married there and then apply for the K1 visas. I must admit although we knew each other for only a year, but I do trust him. But the future is uncertain, if he ever decided to divorce me or some terrible thing happen, I hope not, where does that leave me and how do i deal with it? I feel like I should plan ahead of the worst thing that can happen. The last thing I want is being deported, because I secrefied my dream job here. I don't want to go back home divorced and unemploy. The thing that scares me the most is the complicated processes will drift us apart. So I would like to know what is the best way to approach this situation

As someone said THERE IS NO WHAT IFs. If you trusted him 100% there would be no questions of what if he does this or that. What If I am deported. what if what if. If you trust him 100% you would not be thinking ANY what ifs ecspecially about him divorcing you. You are not even married and you are thinking about that. I honestly do not think YOU are ready at all to let go 100% of your life there and be with him in the USA. I do not think you are ready because your thrust level is not that high. (it may be high BUT it is not 100%)
You have only been together a year and this is called the honeymoon phase. Many people get married within the 1st year of dating and many do divorce that do this (no no NOT ALL DO but most)
IF you love each other THAT much this complicated process is NOTHING compared to a lifetime of happiness with your loved one. IF you are THAT in love it should not bother you. I say wait it out a while, your relationship is still new and if you have doubts, then DO NOT DO IT YET!!!

I understand you must be smart..and this is the time to think about these things YES..BUT if the love was 100% strong you would not be stressing and worrying SO much about it. I think you need to wait like I said and visit THEN once those doubts are gone THEN go for it

Best wishes

K-1 Fiance(e) Visa Process & ProceduresExtend fiance visa?
I third that. Why if you needed more time to get to know each other, did you file for the fiancé visa that is intended for marriage??
If you needed more time to know each other and not sure then you should have maybe visited on a waiver or something and THEN made the decision to marry when you both were ready.
It seems like a waste of time and money to do that.

K-1 Fiance(e) Visa Process & ProceduresAge Diffrence

You will be ok...don't worry. I know somebody who has same age gap as you and your fiance and they were never even asked a single question about it.

And for those who think that big age differences in relationship is silly...well, perfect age doesn't guarantee a perfect marriage.

offtopic45vn.gif RESPECT. Some people who think of themselves as "smart" or "wise" enough to know everything tend to forget this. RESPECT! star_smile.gif

Yeah, but what about when the woman is older than the man...the man being older than the woman seems so much more widely accepted, no matter the country. I guess I will find out when my fiance has his interview if they find our age difference an issue...

Same here I am older then Him and our relationship works JUST like any relationship that is closer in age. On another age gap website that we have joined that is a support group; I know 12 couples who are Older women younger men from Australia and they got visas...age gaps ranged between 13 years and 25 years.

Like someone posted,
QUOTE
in the high volume, high fraud countries of which the PI is both, large age differences can be red flags.
I have noticed those folks have a harder time.

IF you can prove you have a bonafide relationship then you will be fine.
GOOD LUCK ON YOUR JOURNEY!

K-1 Fiance(e) Visa Process & ProceduresAge Diffrence
We have an age difference of 21 years and there is many on here..
When I called to talk to someone about the visa process they said they do not care about the age difference..they care about the proof of it being a bonafide relationship and sincere

BUT like someone said check out manila and see what they ask for and that.

GOOD LUCK TO YOU BOTH!

K-1 Fiance(e) Visa Process & ProceduresA possible shortcut around all of this nonsense??????

Calling the legally knowledgeable...I don't know why I didn't think about this before. But wouldn't a student visa to study English followed by a marriage in the States be a quick shortcut around all of this nonsense??? I have in fact taught plenty of students in the past who easily got visas to study in the States. She applies for one of these non-degree English programs and gets a visa in a couple of months. (We have the means to make this happen.) While here, we get married, and do an end-around around the ABSURDITY of the constantly changing time frames of the G. Anybody see a reason that wouldn't work?

My SO and I were going to do this route (started the student thing prior to our engagement, though), but it's hairy. Your SO will have to prove she can support herself financially for the year and have strong ties to home in order to even qualify for the visa. You're talking tuition+living expenses, and to get a student visa, it will more than likely HAVE to be a degree program. They'll ask her a ton of questions about why she wants to study in the USA instead of her home country, and so on. Ours fell through because he didn't have the money to prove he could support himself with out of state tuition costs.

Not to mention, you have to apply in advance to get a student visa (get accepted into the program, and it can take months to get your student visa approved).

I don't think this is as much of a shortcut as you think. And then there's the whole visa fraud problem. If they realize that, you've got a ban to worry about.

Sorry for the bummer news.

I would LISTEN to Aubry, They were going to do this route AND already did the research. We had also thought OF this but things like lying came into the pot because we could not tell how we REALLY met and how long ago and all that.

If your love is strong then waiting that 6 months to 8 months time is WORTH IT. I would rather be able to say HEY we have been together this long to them then lie about it all.
Also Aubry is right they will ask HEAPS of questions and sometimes to get the student visa it can take about as long sometimes as the K1 visa...SOOOOO Stick to the K1

K-1 Fiance(e) Visa Process & Procedurescan i still go
I had a friend who was denied entry into the US because it was to soon after the K1 denial. BUT she had no proof to ties BACK to her homeland.

Even if you did have proof they can still deny you. There is no guarantee.

K-1 Fiance(e) Visa Process & ProceduresWhat the H*** is an 'IV-15'?????
Hi Halfbohemian .. I've sent you my copies of the IV-15 via email. There are 3 pages - first two are a checklist of sorts that you have to tick off each thing that you have documentation for. The third page is where you sign off on all that. This form would have been part of the cover sheets that came with your fiance's packet. Check your email and you'll see my samples of the form. You can do what the others said and get blank copies of this document since mine are only images for you to look at .. by going to consulate's website .. good luck hun!!

Sher aka .. Used to be Meandmygeordie .. now just 'me'.

My Geordie went back to the UK the end of Nov 05 and told me in March 06 that he won't be coming back to the US ever. I've taken some time away from this board and to heal from the last 3 years of relationship and hard work as we brought him here - and am going to post my experience so people who have experienced this can find some support. I don't want to be a downer on the board but think the other side of the story needs to be told as well. Stay posted.

IR-1 / CR-1 Spouse Visa Process & Procedures1-864 scares the hell out of me

A lot of you seem to think that he should just do it and not even think about it.
Ironically, the forums are also full of people discovering they're still legally bound to their ex-spouse after divorce and come here to say "what was I thinking!"

I don't think taking a moment to assess the situation can hurt.

I am the foreign spouse, so I didn't have to do that, but I would've totally understood if my husband took a little while to think about it. And of course I would also understand if his mom had declined being a joint sponsor. It's not "just a signature".

Of course thinking about it before starting the whole immigration process would be a lot better. But some of us were not really aware of what was coming in the next steps.

Very well said. Some forms and docs. can be difficult to understand specific line-items, especially when "and-or" phrase are made

Young man, You should slow down, take a deep breath and prepare for some work. The people on this site are helpful and knowledgable. Most if not all of the answers your looking for are easily found on this site with links to the government sites associated with those requirements. Just because you are not getting the answers you want to hear doesnt mean people are against you. People do want to help but are not going to do the work for you.

This is at a minimum 8-9 month process, really no way of getting around it. Start spending as much time as you can researching and reading the guides etc. on the wonderful site.
USEM does not accept co-sponsors. This means you and you alone will have to meets the minimum requirements.

Good luck to you and yours,

Kelly

K-1 Fiance(e) Visa Case Filing and Progress ReportsMarriage Question
Thank you all for your encouragement and wisdom. Often, it feels like such a long journey, and although I know it is best to wait it out, sometimes just voicing it out helps us make sense of it all, and helps us keep it in the right perspective. We are guessing our interview will be between June and July, and with spring fast approaching, summer will be here sooner than we think.
Wishing all you VJers the best luck and prayers for success.

K-1 Fiance(e) Visa Case Filing and Progress ReportsMarriage Question
Just a question of curiosity, As many of us feel the frustrations of the long waiting process, to be with our loved ones at last, After filing the I-129F, has anyone ever decided to get married before their interview? If this were to happen, what would the consequences be, and would this mean you'd ultimately have to cancel the I-129F and begin a new petition for a spouse? Of course, if that were the case, waiting for the interview first is the best solution, but just curious if anyone has done this before, and their feed back on it.

Thanks everyone

Sadly we got a RFE today, and I think it is because we forgot to include a passport size photo of my fiancee, which I hope it is as simple as that. Feeling depressed about the delay, but at least now I know they are on our case, and pray this will be behind us soon.

Wishing everyone with petitions out there, warmest prayers

K-1 Fiance(e) Visa Case Filing and Progress Reports2 RFE's?

If yours is like mine, I received my first notice of an RFE on May10th, then another on the 13th. I was practically pulling my hair out wondering why 2 myself...then I called USCIS and they said they only show the one on the 13th. My guess is it just didn't get mailed until the 13th...so keep the faith, and good luck

K-1 Fiance(e) Visa Case Filing and Progress ReportsI-797 NOA2 approval question

I just called them today and received my case number. You should try to call them again to find out. My NOA2 was issued on 05/31/13.

I tried again today and still not in their system yet, so I will try again Monday.  At least this call, I didn't have to wait 20minutes:) to speak with someone!:) My date was June 3rd, 3 days different than yours, so I am really hopeful Monday will be the BIG day:)

How long did they take to forwarded to the Embassy after they assigned you the case number?

I'm on day 10, and expect to hear from them in 4 more days:) so I have no case number yet

K-1 Fiance(e) Visa Case Filing and Progress ReportsI-797 NOA2 approval question

So I was bored at work today and decided to call again (you usually have to hang up and dial 3-5 times before you actually get through because it's always a busy signal, ..and then be prepared to wait around 20 min after you do get through but I digress), and I gave our case number to the woman I spoke with. She asked me if my letter said that my case was forwarded to NVC and I told her that it says it's been forwarded to the consulate. Her response: oh well then it's been mailed to the consulate! LOL ok lady, I was like, the gentleman I spoke with last night told me that the NVC has simply not received/entered in the system our case yet..and she was like oo well then that's what it is. Just funny you get a different answer depending on who you talk to and some of these people seem like they have no clue what their job entails

Thank you for your update:) I finally got through to the NVC, and after the long long wait...I was asked for the case number, and of course...it isn't in their system yet! It's only been 9 days since I got the hard copy approval, and they said it takes 14 to 15 days...so VJ is exactly correct about waiting 14 days to call them...other sites say you can call as soon as NOA2 is rec'd....and of course you can, but it's a waste LOL....When was your NOA 2 approval?

Have a great day!!!!:)

K-1 Fiance(e) Visa Case Filing and Progress ReportsI-797 NOA2 approval question

From here on you will deal with the consulate/embassy. I guess Moscow. She will get her packet 3 ( a list of docs needed for the interview,) in a few weeks. Your almost there. Maybe this summer you will be rafting down the Snake river ! (FYI. even as a native New Yorker, I loved Idaho)

Small world!!!! I loved your comment, thank you:) Funny thing about the Snake river...You cross it over and over almost every where you go...and of course it offers so much recreation throughout Idaho, because it can be rushing through a canyon at one point, then a calm lazy flow through the valley. If your ever back, hope to hear from you!:)

K-1 Fiance(e) Visa Case Filing and Progress ReportsI-797 NOA2 approval question

I just rec'd my hard copy of the NOA2, and I am under the impression, from the California Center, it is supposed to be sent to the NVC...yet on my copy it states" The above petition has been approved, and forwarded to the listed consulate. Please contact the consulate with any questions about visa issuance"....etc....So does this mean everything is being sent to the Consulate in Russia or what?

Any clarification greatly appreciated:)

K-1 Fiance(e) Visa Case Filing and Progress ReportsVisa Approved!!!!!!!!

I just got word from my fiance' she was approved at her interview, and she was very impressed how smoothly everything went. Tonight has been the most nerve racking experience I've ever known,,,but after hearing she was approved...there is no way to explain the enormous utopia after such a long long journey. Praising God in every way. Soon I will try to post more details of her interview, but I would love to take a moment and give a special thanks to all the VJ'ers out there who have really helped more than you can ever imagine, and that support was from day one all the way through...and a very special thanks to STEVE and NATASHA!
