we are in the same boat when we started our K1 visa application... so i wil just share my experience to you guys. My fiance visit me on middle of May and we submit i-129F early June that's before we discover i am pregnant. we request expedite but yes as what the people here says pregnancy can't be a ground for ucsic to expedite. so we are just praying and hoping that the papers be approved quickly its a race of the visa and our baby... end of October we received notice from uscis we are in rfe they need my original g325a and we sent right away so 2nd week of November we saw in the uscis that they already approved the i-129F so one week after we call the nvc for the case # so we can get the schedule for embassy interview.. we did it all as fast as we can and while waiting we are also preparing for the papers we might be needing for the next step... so we did it fast medical then interview even though we been through circumstances because after the interview (dec 12)i get 221G because my passport was wet... so i need to get new one... so i process my passport right away i got my passport (dec 27) and sumbit to embassy right away and request for expedite because im about to due good thing embassy honor my request, last friday they said i can get my visa so after 2 flight moves finally on Thursday i will leave to US... the airline will allow me to leave even if im just turn 8 mos prego they just ask for medical cert... my doctor gave me since i am healthy as well as my baby...

just sharing my experience so to give you idea.... God answer prayers in his own perfect time. i hope same thing will happen to you too or even faster... God Bless!!!

Looking at my cover letter. Do you guys think I sent TOO many Forms and supporting evidence?
Should I be pro-active in submiting additional evidence of support, and Forms?
Or will this clutter the file?

Also from what I have been gathering from the information included all over this website I would come to conclusion to say that no you cannot expidite because of pregnancy, and the only thing you can do is wait for the whole process to be over and hopefully bring your fiance here before she has her baby... because if she has her baby before she comes to the US then that would be another seperate process. I beleive that even if you contact anyone about the pregnancy they wont be able to do anything for you.. Goodluck and hopefully you will come to a solution soon

You may want to look into her having the baby there; she MIGHT get the visa before she is due, but it will be close and she may be too pregnant to travel. Hopefully things will go quick for you and she can travel before the baby is born.

extension on a USCIS approval date

Hello, I would like to know if anyone has experience getting an extension on a USCIS approval date. We jumped thru all the hoops, (hired a lawyer, paid all fees, got all the forms done, have tons of evidence, no police record on either of us, clean health record, etc.- a very clean simple case.) and were denied a K-1 VISA at my fiances interview in Lagos Nigeria on Nov.21st 2011. Our USCIS approval was good until Dec. 8th. We have been fighting to get a motion to reconsider or a reopening of our case at the consular level, but meanwhile our approval has expired. We have talked to everyone about both getting the date extended, and getting a reopening, and haven't had much success. They seem to want us to reapply. I fail to see the sense in that. If the consulate is sure that our marriage is "for immigration purposes only" (basically scamming) as it states on the denial, then I suppose that next year after we pay thier fees, and redo everything they we wont be scammers any more??? This denial is going to make things very difficult for us, even though they try to tell me that it wont. Anyway, I just want to know if anyone has gotten the USCIS to extend an approval date. This has noithing to do with terrorism. This is about relationships for immgration purposes which is what they believe and they are the ones that get to decide that. US congressman or Senators will not and ACN not get involved unless there is a violation of the law. There has been none.

Your fastest, cheapest and easiest solution is to re-apply, yes. ANY OTHER course of action will take longer, cost more and be much more difficult.

They have NOT told you that you "cannot be together". They have told you that your fiancee cannot use the petition you have already sent to recive a K-1 visa and adjustment of status. You CAN send in another application which will overcome the previous problem and probably result in a K-1 being issued. You could also go to Nigeria and be together. They have told you ONLY that THIS visa with this petition will not be issued.

I only mean that the American people are so paranoid about possible terrorism, that they have allowed our immigration system to be abused under this guise. We are supposed to believe that this system will keep the "bad guys" out. It wont. Apparently you have not dealt with Nigeria. Also, I have 2 congressmen and a senator helping me to get this case re-opened, but the system is so badly screwed up, that they cant even tell us where the petition is at this time.

What is your income ? I have this personal belief that if you have a lot of history making good money in America that they tend to believe in your relationship more. I have seen people who get denied also say we were above the poverty line. The poverty line in America is one step above living in the slums in third world countries and I just have this hunch that they turn away many people who are marginal income. Someone correct me if I am wrong.

We had a cousin of his who lives in Texas, (with a very good income) as a co-sponsor. I think that they can use any reason they want. Any thing you do or do not do, or have or do not have can be construed for or against your case. It is that simple. There is no way for them to know if you are honest or not. It is a joke. People should be allowed to be with the ones they want to be with. Either the interveiwer likes you or doesnt.

The laws are wrong. Why not have a law that states "if you are divorced from the benificiary, then the person goes back to the original countr"y or something to that effect. This playing a game to get married is not right. If they had better laws about moving here in the first place, there would not be such a scam going on to get married to get a green card. The government has overstepped its bounds in so many ways.

We had a similar experience!! I am a US citizen applying for my male Nigerian fiance to come here. Ola had his interview on Nov. 21st, and was denied. We used a lawyer, we had every piece of evidence required, we had clean health record, clean police record, we had record of the wedding plans, and a building reserved for the wedding, chats, phone record, etc, EVERY THING!! The interviewer spent 10 minutes questioning Ola about MY ex-husbands race ( which happens to be native american indian) then the interviewer tried to find Bishop Weber (the man who was contracted to perform the wedding) online, then he denied the visa. HE LOOKED AT NONE OF THE EVIDENCE WE HAD. We are hurt, humiliated, shocked, and MAD!!

This system is a farce. Do the american people really think this is a way to keep a terrorist out??? I have contacted senators, congressmen, NVC, USCIS, and tried to contact the embassy in Nigeria. ( i can not get anyone to answer the phone at the embassy, or even an answering service.) We are at a loss. We dont know how to proceed. I cant believe that they expect us to totally reapply. We have been working on this for almost 2 years. Not to mention, we have spent every penny we had. If anyone has advice, please share!! I feel so so bad for all those who just want to be together, and are told that they cant be. Who are they to tell people that they cant be together??

On November 15, 2011, I had an interview at the us embassy in lagos and i answered all the question the CO asked me correctly. After answering all the question with confident, the CO paused for a while. The CO told me that my fiancee was still legally married when we met so he gave me a blue slip explaining that "Dear Visa Applicant, We are returning your visa petition to the Department of Homeland Security office where it was approved with our recommendation that the petition be reviewed for possible revocation. Any futher inquires should be directed to that office. The reasons are as follows:
Evidence submitted indicated that this relationship was entered into for purposes of immigration.
my fiancee was married before and the ex-husband use to abuse her. She seperated from him since the year 2007. the divorce filled in 2009 and finalized in August 2010. We met in late late 2008, proposed in 2009 and filled k1 visa 6 month after divorce finalized. we are so disheartening, depressed, and helpless. We went to be living together already, married and start having kids. how can someone has our lives in their hand. since then, i have not been very happy, i dont know where to go or where to start. we both cried. GOD help us. we love each other so much and this distants is effecting us. the co did not found any fault but that. according to the law,it is perfectly legal to get engaged before your divorce is final. we both were free to marry when we fill the petition.

Lawyer said to get married in 60 days not 90???

Okay so my fiance got his visa approved on March 3rd...his currently still in Mexico. I live in California and I called my lawyer to let her know he would be crossing in the next two weeks and she was freaking out and telling me that we have 60 days to get married from the day he got his visa...which means were pretty much screwed since it will be 60 days by the end of this week. I am so confused because I thought once he crossed with his visa, then we would have 90 days to get married, which was what the lawyer told me at first and now she's changing things around for me. So if anyone can please help!! I'd appreciate it....because this is really frustrating! PLEASE HELP!

I wish i could say for sure ,but i thought it was 90 days from entering the US too!! I hope you are rite and your lawyer is wrong

Forms Montreal Consulate requires before interview is set

Can someone help clarify this for me. I received the package from Montreal indicating that before they can set an interview date they require the following forms:
DS-230 Part 1
DS-160 online
DS-156
DS-156k
Receipt from DS-160
Checklist

I have looked on Visa Journey's and have read conflicting information about only sending the DS-230 and the DS-160 and checklist and that the other forms the DS-156 and DS-156 k and receipt from the DS-160 is required at interview but this is conflicting to what the package says. If someone could please help clarify I would really appreciate it.

What was the hardest part of the process??

I am in Canada and my fiance is in US and I would say that the hardest part of the process is filling out all the forms and making sure you have correct documents as the interview is the easiest part. As far as proof of relationship, you can use other things like printouts of phone bills or emails, cards, pictures of the two of you. If you start compiling this stuff now it will be easier down the road. Basically any proof that shows their is a relationship between you. Hope this helps. Good luck.

NEVADA DIVORCE(not a CA Resident)

I don't know about California, but here in Idaho, you can file an uncontested divorce, online, for 149 dollars. after you pay your filing fee at the courthouse you will wait 20 days, come back, sign some papers, and you are divorced. easy as that. No stinking liyers need to be involved. especially if no kids or property is involved.

Income?

Howdy friends,

I am a permanently 100% disabled Veteran and I receive income from VA Disability as well as Soc Sec Disability.

My question is: Do they accept both of these incomes for lawful in come on the I-134?

I know I am well over the poverty line, in fact by their guidelines I can handle 8 people. (There will be just me and my soon to be wife.)

I was wondering about using the tickets for Primary Evidence. I had no ticket stubs added but I did have 5 years of travel to and from the Philippines stamped on my passport, plus pics of us and other stuff. Will I need something else?

MY RFE

Okay folks. Got my RFE late last week, which was not enough time for me to respond to it, and get it in the mail back to them.

It was my stupidity that slowed us down.

1. Had to show divorce decree WITH THE FILING DATE AND JUDGE'S SIGNATURE.

2. Had to show that we met in the last 2 years. I didn't have pictures with dates on them, so I gave them the wrong pages showing when I was in the Philippines last. I COPIED AND PRINTED THE PROPER PAGES FROM MY PASSPORT.

Now I hope it doesn't take long from this point.

"The State Department's National Visa Center has recently received and approved I-129F petition on behalf of your fiance. this letter is to let you know that withing a week the petition will be forwarded to the appropriate visa-issuing post where your visa interview will take place.

K-1 Visa Holder - Ability to Work

The ruling was in response to a Tennesee couty that denied marriage to an illegal immigrant. The court ruled that marriage grants no immigration benefit, and legal presence nor participation in the SS system was not required.

It is directly related only that K-1s can no longer be required to obtain an SSN before getting a marriage licens. The ONLY reason the SS Administration classified K-1s as "work eligible" was to default the system to give them an SSN so they could get a marriage license where needed. I imagine one day that the SS administration will catch up and stop issuing SSNs to K-1s until after they have an EAD or green card...the same as they do for K2, K-3 and K-4 visa holders, none of which need to get married and none of which had any reason for an SSN before adjusting status.

Also may I add in reference to those coming from other countries. If you are holding a job back in your country, to consider a "leave of absence" if your company allows it. I was fortunate that in my last job in Canada I was able to take an "unpaid year leave of absence" and I did ask for it. My friends and co-workers told me then even though they felt strongly that everything would work out well here in the U.S., there was always that chance that something could go wrong. I brought this up with my then fiance and he had encouraged me to do it. It didn't matter about a home because I was only renting a townhouse at the time and would have been able to live temporarily with one of my daughters or parents if need be.

I understand that the K2 visa must be obtained within a year after the parent's K1 has been obtained. After the K2 has been obtained, up to how many months after that can the child enter the U.S?

MY USC FIANCEE HAS CHILD SUPPORT DEBTS

Guess I just like playing the Devil's advocate but I was wondering how he is going to pay the back child support if he isn't working. Also, does he intend to start paying the support now on time as well as pay up the back support? I know that we don't know the details of what you discussed but does he have some other source of income that will allow him to do this without getting a job?

Again, I think some of us may come across as being harsh but I think, at least in my case, I have seen acquaintances who have dealt with this very problem and it eventually led to the end of their marriage. Dealing with the issue of children from prior relationships is something that most definitely must be worked out in detail before a new marriage begins or it can come back to bite you in the b***.

My thoughts exactly.

HI all
I am new here so bare with me. I met my wonderful man Kai 3 years ago on world of warcraft and have been together 2 years...We have a 21 year age gap and are in love love love. I know on the age gap forum I am in many have received their K1 visas with no question to the age gap except one but they also had other issues besides that and they did not receive the visa

has anyone else had issues with them asking about the age gap. We have heaps of poof pictures you name it and are prepared for this to come up just in case. I was just curious if any of you experienced this and how did it go.

PS will be filing first part in 3 weeks CAN'T WAIT!

Huge question

Okay here is some background history so you all know and then I will ask the question
Fiance is 21 almost 22 I am older of course and we are SO in love
We met on World of warcraft on sept 12th 2006 and on sept 24th we were inseperable. We have yahoo chat up 24/7 on voice and cam..EVEN when I leave for work I leave it up and he does the same so we can hear and see each other come home.
We go through about 3 headsets a month

OKAY HERE IS THE ISSUE
He is renting a flat that is on his families property he pays for his own things rent you name it to them and even has a written agreement. HOWEVER they have tried hard to sabotage our relationship from day one. They think I am a phase LOL...I think NOT ( stands tall) The rest of his family though is in FULL SUPPORT of us. The police have been called on his father MANY TIMES and he has done this for YEARs I guess..Kai my fiance had his auntie talk to me and she said they lost all their friends because of this

And to think I was going to move there at first! LOL

He went and got a PO box So I can send things to him as they will snoop open his mail and rip up my letters or just control things. NOW mind you he does not put up with it and is in the process of trying to find a place. BUT it is very epensive and he is saving up for his plane ticket and medicals and works two jobs.

NOW when I put his address on the forms Do I have to put where he lives OR can i put the PO box so his mail will go there
OR can I include a paper asking that all his mail be sent to the PO box??

Or can we have have the Postal office forward all his mail to the po box..

they know he is coming to the US and we do not want anything to go wrong.
