K-1 Fiance(e) Visa Process & Proceduresis applying for fiance visa really worth it?
What happened to your friends probably won't happen to you if you follow all the guides and advice from folks on here. I have learned so much from all the folks here and even if I drove them insane with questions, they still were helpful.

The guides are easy to read and understand. If you have all the paperwork in order and proof of a bonafide relationship, then you should not have any issues.

YES it is a long wait BUT if you truly love someone it is worth the 6-9 months to get them home to spend the rest of your lives together. The longest part of the wait is the NOA2 after that its faster.

So to answer your question....YES it is worth it, because I get to spend the rest of my life with my Kai!!

The Sydney consulate is really good (and quick) about responding to emails. I'd write them, explain your situation and see if you will need a co-sponsor. Don't bother calling them, you wont be able to get through to anyone who will help with k-1 questions.

Email to: SydneyIV@state.gov

Also, I dont think you need to include tax info unless you are self employed. Just the letter from your boss, checks and statement from the bank and any info on assets.

Tell your co-sponsor that the I-134 is form over function... it is not legally binding....

It is the I-864 that comes later when applying for the greencard that is the binding contract

K-1 Fiance(e) Visa Process & ProceduresNew I-134??????
QUOTE (Captain Ewok @ Jan 6 2009, 09:37 PM) <{POST_SNAPBACK}>
I have contacted the USCIS regarding this:

QUOTE
USCIS Web Team-

Regarding the I-134 Instruction Page:
http://www.uscis.gov...00045f3d6a1RCRD

The page states that the I-134 requires:

"To file this form, it needs to be sworn to or affirmed by a USCIS Officer at any USCIS Office, by a notary public, or other official authorized to administer oaths for general purposes. If the sponsor is outside the United States, the affidavit must be sworn to or affirmed by a USCIS Officer or Consular Officer at any U.S. Embassy or Consulate.

Once the form is affirmed, it should be mailed to the same USCIS office where the application was filed."

However the Form instructions state:

Execution of Affidavit:
"...It is not necessary to sign form I-134 in front of a notary, nor have your signature notarized after you sign it"

This is in direct contradiction to the "I-134 Instruction Page". I think that since the I-134 was recently updated the instruction page was simply not updated as well to reflect the new policy (not needing the form notarized). There actually no longer any place on the form for it to be notarized.

Thanks for your attention to this detail!

K-1 Fiance(e) Visa Process & ProceduresRelationship Problems due to Language
Here is my two cents:
I understand your fustration, but don't you think its being a little superficial to worry about his english?? I am sorry but the English language is one of the hardest to speak and you should be happy he is trying hard to speak it so he can be with you. Remember, it is not YOU who is leaving your homeland, your culture to be with him, it is HIM who is leaving everything to be with you. BE PATIENT and help him. Buy him learning tapes, watch tv, movies radio and when he does not understand it HELP HIM. You should also do the same and learn HIS language (if you got language tapes its not as hard as you think...practice practice practice. Put yourself in HIS shoes and think about how you would feel if he was impatient with you and you were leaving everything behind.

Best wishes good.gif

....... By regulations, he cannot come here on a visitor visa with the intent to marry you (even if the pastor is willing to call it a non-marriage). So that is not an option.

He can come here with the intent to marry-many do it and then return home to file for the appropriate visa. Also many have been here on VWP or tourist visa and just decided to get married spur of the minute-then adjust status. Intent when entering the US on a VWP/tourist is what matters here. He CANNOT enter on VWP/tourist/student visa with the intent to marry and adjust status.

EXACTLY! Immigration NOW has you on file for a k1 visa. IF he were to come here and marry you no matter how you do it..it will be ILLEGAL. This can be a huge mess. You already started it so waiting a little while longer will not kill you.

I have not even PAID for our wedding place or pastor yet because I know he will not be here this month or maybe even the next. SO we set it for the end of April. I have it reserved for 50 dollars and will PAY the rest after I know he has entered the USA. WHY? because there is no guarantee POE will let him in. Even with visa in hand they can still say NOPE go home.

Your best bet is to WAIT to even if you do not want to. The reason being is you might not even get your NOA2 until the 6 months waiting time. Some folks from JUNE and JULY are still waiting for their NOA2s! So your best bet:
Talk to your pastor and tell him you will have to postpone it till your NOA2 arrives. THAT would be the wise choice there.

I know you miss him trust me I know. I have not seen my fiance for 1.6 months now. NOW that we finally HAVE money to visit we wont because we are to close to the interview and medicals...

YOU will be okay.

We are planning our wedding for August 15, 2009. We've got a lot of things reserved, etc. However, I don't think we are going to receive our visa in time. So my first thought was obviously to move the wedding. However, my pastor said that he thinks we can still do the wedding without the visa, but just not sign the paperwork. What i mean is, have the ceremony, etc, but not do a marriage license. And then after getting the visa approved, we could fill out the marriage license. Is this even a possibility? Or is it still illegal?? Please help!!!

Of course, it's both possible and legal but there's not assurance the foreign fiancé will be allowed to enter the US at the appropriate time. K1 visas and traditional "far in advance" wedding plans don't really go together very well.

if we decide to go this route, what can we do to ensure he will be allowed to enter??

Nothing to "ensure" it. That was my point. You can read lots here about how to improve the chances of being allowed to enter. Start with the FAQ's or read about others asking the question nearly daily.

I'm known for being blunt but I guess I wasn't blunt enough. Making traditional wedding plans before the visa is in hand has a pretty good chance bringing you major disappointment. You would be trusting to luck.

I completely understood your bluntness. I ignored it because thats pointless now. Its done, so theres no point in saying those things, is there?

Yes there is a point. Push has made a great point and the point is there is no guarantee he will be here in August and there is no guarantee that if it is close to the interview they will let him go through the port of entry.
I know it is NOT what you want to hear; but its a fact and there is no way of ensuring anything during this visa process.
I learned that the fast way.

4. For adjustment of status, the sponsor must meet a minimum of 125% of the poverty level for the applicable household size. Generally, the immigrant isn't working at the time the I-864 is submitted but if they have income or assets to contribute to the picture, they can be considered.

Is the 125% for both the interview/K1 stage and the AOS stage? I got a little confused there.

What passes muster for the visa interview varies widely by Consulate. London is one of the easiest and commonly 100% is accepted. For AOS it's 125%.

That's a massive relief. (Not to say I'll rely on the 100% figure - better safe than sorry)
Thanks smile.gif

your best bet is to make the 125% JUST in case if you have to take on a small part time job like i did after all you will need to make that after you are married anyway. Try not to make the MINIMUM requirement because even if it says 125% is 17, 500 making a lil more is better

How can you establish a real relationship if you haven't met in person, most of the cases at US Embassy they asked for pictures. It's also a way for you to know him better;let him come over and visit you first... so he can meet your children and if he can accept them as his own..and you will be able to know somehow what kind of person he is..it might be traumatic for the kids if they will go to the US and then your man might not really love them as his own,or he might not treat them right.I asked my husband to go to the Phil.first so he could meet my son, and when i saw that they have a good relationship and my son accepted him as his stepfather, that's the only time we decided to petition him..consider also the feelings of your children and thier future.yes it's good to go to US..lot's of opportunities, but it can also be a nightmare for some..

I find your response RUDE how was SHE suppose to know..honestly I swear SIGH
So what honestly..I have Not seen my SO for 1.5 years but I am not going to be stupid enough to withdraw my K1 petition JUST because I miss him. If I want to be with him I am sticking to the legal route.
JUST because YOU get married does not guarantee you will get a visa for it. EVEN IN CHINA. Now you are on file and IF you cancel and get married they will know it was fraud; IN TURN will get you jail time.

I realize YOU MISS YOUR SO but we all do, WE are all in the same boat!
THIS IS WHAT HAPPENS WHEN YOU FALL IN LOVE WITH SOMEONE FROM ANOTHER COUNTRY!

If you filed the k1 visa it will be 6 months to 9 months... BUT if you go get married it will 9 times out of 10 BE LONGER

THINK ABOUT IT
If she is WORTH it then she is WORTH THE WAIT and IF your love is THAT strong then this wait for the visa WILL BE WORTH IT. If the love is strong YOU both will with stand this wait. It will go by fast..stay busy. WE all have to go through it if we choose to love someone who is not a US citizen

K-1 Fiance(e) Visa Process & ProceduresMedical Exam
QUOTE (Carlawarla @ Oct 21 2008, 06:57 AM) <{POST_SNAPBACK}>
As above, blood tests are used to determine whether you have any STD's, and HIV. Chest x-rays are for TB. Since June, skin tests are being used for TB testing, so I don't really know how much longer they're going to be requiring chest x-rays. As far as blood tests go, they don't do drug testing on your blood unless you've been sent there for specifically that reason. Case in point, someone who disclosed during their medical exam that they had used drugs in the past. The Dr. sent them for blood tests to determine if it was still in their system. However, whether it's in your system or not, if you've disclosed this to the Dr. during the medical, then you're going to be denied your visa, unless you can obtain a waiver.

Do you have an article on the drug use of the past at all? Someone I know is trying to obtain the K1 visa and her fiance is a drug user. He said he will stop taking them enough to pass the medical. I say they will know or find out if he does not stop at all .
BUT my question is this. there are people out there that used drugs during teen years and stopped. So why would thye deny you something IF you are clean and that is a past thing??

K-1 Fiance(e) Visa Process & ProceduresFiance Pregnant, Please help!

This is true. Most airlines won't let a pregnant woman fly in the last trimester without permission from a doctor, and often won't let them fly in the last month of pregnancy at all.

Kelly, I recommend you look into the process for filing a Consular Report of Birth Abroad (CRBA) in Manila. Your child has a claim to US citizenship and will not be eligible for a visa. You have to get a US passport for the child. They sometimes ask for a paternity test in the case where the US citizen is the father and the child is born out of wedlock.

I'm not sure what the rules are the Philippines, but most countries require an exit visa issued by the host country for foreign citizens who have no record of entry, which would apply to a child born in the country. It's usually easier to get a native passport in that case. In other words, get a Philippine passport for the child, as well. The child would be leaving the Philippines as a Philippine citizen and entering the US as a US citizen.

Thank you so much.

just sharing my experience so to give you idea.... God answer prayers in his own perfect time. i hope same thing will happen to you too or even faster... God Bless!!!
