K-3 Spouse Visa Process & ProceduresK1 / K3 or CR1...looking for guidance
Hello all,

I am new to this whole process and I am looking for some guidance. My situation is as follows. I am currently engaged to a Canadian who resides in Winnipeg. She has a four year old son with an ex to whom she was never married to. We were planning to get eloped in September while she is in Ontario for business, then have a ceremony after we get her to the states. However we are having a hard time trying to decide which visa to apply for. She currently serves in the Canadian Forces and will be seperating in July, which is another complication. Would it be advantageous to file for the K1 or K3 or the CR1? Time is a factor for us and we are looking for the fastest way to accomplish this whole process. Also, my wife to be doesnt want to lose her canadian citizenship, will that happen if we apply and she is still serving in the military? I've been reading the guides for the K1 and K3 and it looks like I would have to provide evidence of a relationship for the K1 and evidence of an ongoing marriage for the K3. Im confident with the first, however, Im not sure what evidence I could provide if we go the K3/CR1 route. Especially since we are or possibly marrying soon, any advice? Also, is trying to bring her son over going to be difficult? I apologize if this seems like a lot of stupid questions. I've been reading the guides and as many posts as I can and Im more conflicted than when I started. If anyone can help us with some wisdom it would be greatly appreciated.

Anyhow it doesn't matter that he's gone this route before and I assume (although they say you should never assume) that he has. I figured that perhaps the poster would have known how it all worked from the last time. That's all.

anyone know if I can use my photographer side business as income...its not taxable and dont know how to make it taxable...but its an extra 300 to 400 a month which puts me over for the k3 issue for money requirements

As for me here, Rich sent off the affidavid of support and the rest of the documents today via express int'l...so as soon as I get - hopefully next week, fingers crossed...then I can send the packet 3 off and request for an interview date..

Just wondering...once you send off the packet 3....how long does it take for them to respond to let you know that theyve received it..I'll be sending it off by express mail (next day delivery) ..also, how long does it take for them to issue you with an interview date after them receiving it? Im just trying to timeline this all ....My K1 approval expires in June and i want to get it done sooner rather than later just in case i get a slip requesting further evidence (ie, financial support, etc)...

I am also wondering how Anne is doing in the states!! I cant wait to hear from her and since she's never been to the states, I wonder how she is adjusting...

Yeah, I've contacted the Consulate via email a couple of times and they've always been very prompt. Are you talking about when you send all the doco's to the embassy? If you are I think it depends, because we sent the documents in and then about a week later (Look at my timeline) we had an interview date... now from the time the packet was actually received by the consulate and our interview date it only took four days!

so it depends really!

It really does depend someone from aussie who is on another site did not get theirs for 3 weeks , BUT most cases it is up to 10 days. If you have everything in order; like I said it wont be more then 10 days:)smile.gif

Thats all you need, you both will do great! As long as you take what they asked of you in packet 4, and more snippets like evidence (just in case because they barely ask for it!) be there at least 30 minutes before your scheduled appointment interview!

I miss Anne!!! anyone heard of her? I know she is already in the states, she said she was going to get here April 14! hope she reports soon!

bring the packet you all sent to the uscis ( they more and likely won't ask you for evidence BUT bring it!!) bring the letter they sent you with your interview date so you can present that to the guards or you dont get in.

hi all gratz to all visas!

SO I HAVE A QUESTION!! what order does his stuff have to be in for the interview..He had everything except the police cert medical and his

NOW they say on the form for 134 form they want it noterized HOWEVER i used the new form that did not have ANY place to be noterized. they want evidence od HIS assets and funds ( he has #######) so what do we do there?? he has MAYBE 400 in the bank..should he get his bank deposits and balance?? OR hmm??? they only asked for 2008 tax return (again its ####### but have letter explaining WHY)
evidence of my legal residence or status..( birth cert of mine ...copy and a few other things)
evidence of MY assets..dont really have any as I am starting over bascially.

I included in the 134 like i said , letter from boss, letter from them stating I make enough with my ssi, tax return, omg the list is long

are we forgeting anything and in WHAT order does this all have to be in..does it have to follow the list????

Update: It's three days since Matt will be going in for his interview! and I am exicited and yet so nervous.. I am getting worried over petty things, like the affidavit of support, I am currently only studying (don't work) my parents are the sole providers for the affidavit (I hope this is OKAY) they make well above the amount required so that is good so I don't think I should be worried... You'll be fine good.gif My husband had no income when we did ours either (he had already quit his job and was waiting to begin grad school) so we used his parents as our joint sponsors and the Consulate had no problems with it (though we did put our assets down there too but I don't think it had any affect on the approval)

Okay UPDATE
Cant get an earlier appt I Just am so fustrated I see a few folks who got it sooner then we did and we sent ours in sooner then them..gotta LOVE that..ANYWAY it is calling it super close and panic has officially set in my gut.
What if they say a new law says we cant except your ssi as extra income..or you dont have enough Tax forms for the last three years
I only had ONE and have not filed yet...I am waiting to file till the very end because I want to use THAT money for the AOS...SOOOO AHHH I did write an explanation on why i only had one and its a CRAPPY one as I just started to go back to work since my accident. PLUS my ex filed the one before that..so anyway I am in panic mode.

I think we will be okay I sent the email they wrote me saying we could use it and we are above the 125% plus a letter from my boss saying she will help me meet the guidelines and so on..

I JUST NEED TO BREATHE AND RELAX!!!

ANYWAY his interview is april 7th and there are two lovely holidays so WONT Get his visa till weds or thurs..so having him fly in on a sunday night

Cham- just adding.. I think 13th is cutting it too close. If the interview is on the 7th, they should issue the visa on either the 8th or the 9th. Add overnight delivery and he shouldn't get it until the 9th or the 10th.. but then the 10th (Friday) is a public holiday as is the 13th (Monday).

Does Kai live in Sydney? I wonder if he can negotiate with them to issue it to him on the 8th and have him go pick it up. Don't know if they do it but it's worth asking.

ps - the 2 working day thing is their usual rule but look at my timeline to see how delayed mine was.. I had a very panicky time waiting for it to arrive!

Susan - thank you for sharing ur story about Georgia. How did she handle the flight? My Lagotto does well in a crate and would probably just sleep the whole way (she sleeps at least 18hrs a day, if not more!).. but I still worry since I'm sure it's a stressful thing.. first time flying for a pet. I would book her on a direct Brisbane to LA flight (about 12hrs). Not sure if we'll get them to fly her onto Portland for us, or if we'll drive/fly down to collect her. but it's still early days and we're still deciding if it is even best to bring her over or not so I'm trying not to get my hopes up too much just yet



I know Sucks but IF i have to my boss will give me two days off ( cant really afford to but will cause I want him home)

The Australia embassy will count SSI I do know that as I sent a email asking if I could count my ssi with my income..they said yes and that I did not need a cosponser..not sure how NZ is and the best way to ask is email them and find out...it takes about 2 to 5 days for an email response to your question

You will just need to keep records of income and expenses, then file a Schedule C - Income from business when you file taxes.

One good thing there will be LOTS of things you can deduct, but you will only be able to claim the profit as income, not your net.

i.e. You do $3,000.00 a year in business, but your business expenses/deductions are $2,750.00, your profit is only $250.00 and that is what they will consider.

I know because I was self-employed when I filed for my wife and they would only look at my profit, not my gross income.

I started a photography business but no taxable income just paid to do it. I make about 400 extra a month doing that and it is permenent. I have signatures from folks i took them off and are regular customers. Can I include this with our income for the k3 money requirement????
