Okay I know I will not make enough for support and have a co sponser who makes MORE then enough...does the co sponser fill out this form as well? Do I put co sponser on this?

and do I need to copy MY passport as well for it

Later when adjusting status in the USA after marriage, you have 2 options for the affidavit of support used for the I-485.

If son is living in same household, he can provide I-864A as member of household, and you will do I-864. This is additive.

If son is not living in same household then son can provide I-864 as a joint sponsor, and you will do an I-864. In this case joint sponsor has to make 125% povertyline.

As most know we sent off the I-129f already BUT have a question. My son will be co sponsor. He makes enough money BUT do they combine our income together OR is is seperate. (like this 25,000 plus 15,000=40,000)

BUT make sure you have enough of those photos for the whole k1 process BECause i was told they have to be the same...and it needs to be as closest as the filing date as possible, because you need to write the date on the back and your name (if I remember right) if you are using the same photo as the passport and it has been just recent then YA as long as you have as many as you need for the process:)

Sign up at Uscis.gov website so you can check your case online. Remember though it will take 3 to 5 months to get the NOA2 so have lots of patiences LOL Do not check it everyday or it will make you insane AND KEEP busy!

My understanding is that you can use recent wage slips and a letter from your employer confirming that your total annual income is now $x and a covering letter explaining why your last return was below. If you're very close to the 125%, it might be worth seeing if you can get a co-sponsor for peace of mind, if anything.

Also consider any assets you have that you might be able to use - savings, etc.



Well I did get a letter from Sydney embassy stating I can use my SSI payments that I receive for my accident as well as my current job..SO that is a HUGE plus and they said i do not need a co sponser (THANK THE HEAVENS!!!)

I wrote To whom it may concern,
I make the 100% poverty level and make more then enough to go over it, however I am a little bit under the 17500.
So I am looking for extra work to get my Kai home to me. We have been through so much to have this issue come up and not be together. If I have to work a million hours to get him back home with me I will.
My question is my co-sponser backed out in fear of having to pay something (yes I explained the whole thing)
I make 16,292 minumum and with overtime i can make up to 17,900. I also receive SSI of 576 a month which equals 6,912 extra (unless I make over 18k) I was in a bad car wreck and have been back to work now for over a year.
(feels WONDERFUL!) I am also going to be taking on a second job so I can ensure he comes home.
With what I have now will we be okay OR should I take that second job to be on the safe side. I will do whatever I can to get my Kai home with me.

Hi VJ friends.. I am so happy when I got up this morning and checked our status.. The immigration approved our petition. It says that "For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State." Is it mean that it is my turn now? (the beneficiary to send docs, etc) or they need more from my petitioner, like biometrics, interviews or something? Are they going to collect another payment?
I am just so excited what will happen next. For now, I just can't wait and get more sleep thinking about this important thing.

He had an unfair interveiw because the CO didn't look at any evidence we had, and wouldn't even allow Ola to answer the few questions he asked of him. Ola was questioned about my ex-husband's ethnicity (which happens to be Native American) and which tribe he was a member of. Then he asked my fiance who was to perform the wedding. Ola handed him a document signed by the bishop who was to perform our wedding, and the CO attempted to find the bishop online, and was unable to. He then excused himself and returned with a denial letter stating "for immigration purposes only". We have evidence that wasnt looked at.

We are currently trying to get the case reopened or reconsidered, but in the meantime, our approval date with the USCIS has passed! sooo, we are trying to get the USCIS to extend its approval date so we can work this out. they are being less than co operative. I have had senators, congressmen, and the ombudsman contact USCIS, and the Lagos embassy. I feel like i am kicking against a stone wall. i dont know where to turn next.
I have contacted USCIS by email, by phone several times, and have even made an appointment with the local USCIS office in Boise to speak to them about extending this approval date. I was told there is nothing that can be done, and that we should refile. I fail to see the sense in refiling. We have done everything required of us, and were still denied. If it is believed, by the consulate, that we only want to be married "for immigration purposes only" ,and we refile our petition, will it not still be the same belief next year when our interview is conducted again?

We have been in a relationship for almost 2 years, and engaged for over a year. We have ample proof of this. We have all the proof necessary to establish that we have a real, bona fide, loving, caring, engagement. We have plans together, dreams for the future. We have done everything expected of us and more. We hired a lawyer, we paid all fees, Ola has a clean health record, a spotless police report, we have evidence of our relationship including 2 years worth of DAILY contact thru email, telephone calls, yahoo, and postal exchanges; we also have the building reservation (for the wedding) signed by the woman in charge of it, a letter from the bishop (who has agreed to perform the wedding), invitationsletters from both of our mothers, pictures. There is no reason we should have been denied. We had our wedding planned for the 9th of December, and have had to cancel the building reservation, and notify everyone involved.

I am outraged that we have been treated so poorly. He is a great man, and he did not deserve to be ignored, humiliated, and treated as a criminal. Furthermore, he is college educated, holds to strong morals and ethics, is a devoted Christian, has a clean health record, and a clean police record. We are both good, solid, law abiding people.

I am new to this site, but I am so glad to find a group of people who understand what my fiance and I are going through!! I have felt so alone during this whole process. My fiance Ola had his interveiw on November 21st, and our K-1 was denied. We are devastated. He was not given a fair interview, and though we have lots of evidence and proof, it was not even asked for, looked at or mentioned. I have tried to contact the Lagos embassy repeatedly, and I can not get anyone to answer the phone. (has anyone else had this problem?) I contacted my senators, and congressman, and though they are willing to help, they are telling me there is not much they can do. Is there someone more influential we could call on? I am at a loss. I dont know where to turn next. We used a lawyer to file our case, but we cant afford to pay for another lawyers service. Does anyone have any ideas? I am just sick about the whole thing.

Well, we decided to send him to Malaysia to work. The easiest way was to get a student visa, which allows him to work there while studying. We were denied for "immigration purposes only" . In less than 5 minutes of the interveiw without even looking at one peice of evidence we had. we have no issues that should keep us apart. It is a matter of the immigration system being broken. That is a whole different story. Right now, we are looking for any thing that might help us get funding fast.

Do you think his staying or studying in Malaysia would pave route to moving down to the USA

I am engaged to a Nigerian man. We filed for the K-1 visa and were denied in November of 2011. Since he has been unable to find work, we gathered together all of our resources and sent him to Malaysia to work. Now that he is there, he is in need of funds to pay the school fee so he can get a student visa to work. We are at our wits end trying to come up with the $2,000 needed for this. We have tried every option we can think of. Friends, family, churches, agencies, charities, philantropists, celebrities, but no one seems to want to help. the problem is that they dont understand the importance of it all, and they dont understand how tedious and complicated the immigration system is. If anyone has any ideas, ANY AT ALL, please please let me know. We are desperate for him to get this chance to work so that we can continue on this journey. We are 2 years into this, and we will not stop until we are together.

I just went thru a similar circumstance. We had an immigration lawyer do ours so we could be sure it was all done right. My fiance is 8 years younger than me, and our interview lasted about 5 minutes also. The interviewer didnt look at one piece of evidence my fiance took with him. Same reason given. We have tried everything to get our case re-evaluated. We have a lawyer from California, we had a senator, and a congressman intervene on our behalf. We had tons of evidence of the entirety of our relationship.(2 years). But in the end, before they could re-evaluate our case, the USCIS still denied us, because our petition had "expired" and suggested that we "start over". I dont understsand how refiling can help anyones case. If they suppose you are scamming the system now, wont you STILL be scamming the system next year? not to mention all the money we will spend and time wasted apart. Everyone I talked to in the immigration offices, or USCIS, gave us a different answer to any questions we asked. This system is in serious need of reform. I can understand having laws, but I dont think one interviewer should determine the outcome of a visa request.

So after reading some of the posts, I was curious about this online appointment system in Tokyo. Hmmm... it says that I can not use this because I filed in the US. So I wonder, if my priority date is before someone elses, why are they getting an appointment? So I emailed them and asked status and put that question in the remarks. Turns out that on the 325, we only went back 10 years. Now they want her to account for what she did during the 7 years before that. I haven't received the request. She said she just got it this morning and has already returned it. Hope she was as thorough as they will expect. I would guess she just said i.e. student 1997-1999 and did not provide sufficient detail. okay, after the obvious frustration ranting, please tell me this, (rhetorical in nature) why does the embassy think they need to go through extra security checks after the USCIS and NVC have already said Approved? Seems to me if the embassy received an approved NOA, they should not be trying to second guess big brother and screwing everything else up. Well thanks for letting me ask silly questions. I wonder if the embassy ever reads these posts, it would be nice.

This is really confusing. What is the purpose of the priority date? I see here couples who submitted their packages after we started and already have interviews. I also see couple who completed package three since our package three was confirmed back at the embassy. They have had interview appointments set and in some cases interviews. Yet we still do not seem to be making progress. I have called the NVC line and they can only say soon and confirm everything on track. I wonder what track that is. It is encouraging to see the progress people are making, but discouraging to think we are still waiting.

Is packet 3 the one that tells you about the medical appt? Our documents were delived to Tokyo about the sametime as yours, but they requested some additional papers. Those were provided 2nd week January. My wife still has not heard from the embassy and she is afraid to make a medical appt without the documents from the embassy. They have the police certificate already. She is beginning to get depressed and I am trying to cheer her up. Any good thoughts?

Since the child obviously has a father (who also has rights by the way) I strongly suggest you do what you can to get his permission. Otherwise you may delay your case, especially if you get that dragon woman at Montreal - she's tough on everyone!

Hey thanks again for the info, I was hoping that we wouldnt have to go that route but it seems like we do. What would we need for permission, an affidavit or something to that effect? Also do you know or anyone else know if she would be able to travel to the U.S. during the process or does she need to stay in Canada throughout until the visa is approved?

Does the father know about the child? Is there a custody agreement between her and him?



The father knows about the child but there is no custody agreement. Do you know of anyway around this or do we have to get his permission? Thank you for your attention to this, I really appreciate it.

Being from Canada, there are only 2 consulates that do the interviews, Montreal (does K and Cr-1 visas) and Vancouver (only does K). So if you marry, her interview will have to be in Montreal. Montreal is a terribly slow consulate - averaging 3 - 4 months for an interview after a completed case at NVC.

Bringing her son will need a seperate I130 with separate fees if you marry. The son can be as a derivative off the K visa if you decide not to marry. The father of the boy will need to give his consent for the child to immigrate to the US.

I STONGLY suggest you stop calling her 'wife' before you are married - especially if you intend on filing for a K visa. VJ members have been denied a fiance visa for referring to a fiance as husband/wife. The adjudicator assumes they are married.

She is not going to lose her citizenship. First, after this process, she will become a permenant resident. She then has the choice of becoming a naturalized citizen or staying as a permenant resident. While the US does not require you to formally give up Canadian citizenship, they do not recognize dual citizenship - however, Canada does. So she can actually be a citizen of both countries without issue.

If you marry in Ontario, you are looking at 6-8 weeks before you can file since it takes that long to obtain the marriage certificate

Questions regarding her military service are best asked to her CO or liason officer. Not too many people here are knowledgeable about the Canadian military so for best answers, and not guesses, have her ask at the base.

Hello all,

I am new to this whole process and I am looking for some guidance. My situation is as follows. I am currently engaged to a Canadian who resides in Winnipeg. She has a four year old son with an ex to whom she was never married to. We were planning to get eloped in September while she is in Ontario for business, then have a ceremony after we get her to the states. However we are having a hard time trying to decide which visa to apply for. She currently serves in the Canadian Forces and will be seperating in July, which is another complication. Would it be advantageous to file for the K1 or K3 or the CR1? Time is a factor for us and we are looking for the fastest way to accomplish this whole process. Also, my wife to be doesnt want to lose her canadian citizenship, will that happen if we apply and she is still serving in the military? I've been reading the guides for the K1 and K3 and it looks like I would have to provide evidence of a relationship for the K1 and evidence of an ongoing marriage for the K3. Im confident with the first, however, Im not sure what evidence I could provide if we go the K3/CR1 route. Especially since we are or possibly marrying soon, any advice? Also, is trying to bring her son over going to be difficult? I apologize if this seems like a lot of stupid questions. I've been reading the guides and as many posts as I can and Im more conflicted than when I started. If anyone can help us with some wisdom it would be greatly appreciated.
