SINCE I make the 125% do I need a bank statement??? I have read on here it is just an extra thing
My boss also wrote that she is willing to give me overtime as well to meet the 125% poverty level.

So am i okay without the bank statement????
I do have a printout of the money in the bank so I am including that without going to the bank. I just printed it off of my online account.

I honestly do not see how insurance will be a guarantee or help her case. What will help is pictures, chats, emails, phone calls and so on. Having travel insurance does not prove to them that it is a bona-fide relationship...does not make sense at all.

Congrats...soooo happy for you both. I considered the same, being there with her for her interview (not scheduled yet...still at NVC) but is looks so complicated trying to go there to visit. I do have a passport, but have not applied for a visitor visa yet...but any suggestions would be greatly appreciated:) Just to get medical insurance to cover a visit there seems to be required...but not sure.

Well just 4 weeks from now on the 18th of July she will have her interview. Finally! I will fly there to meet her and go with her to the interview as they want the petitioner there as well if they can be. You bet I want to be there!smile.png) Got a couple more things to get before that time but they should be here. Her police report and some passport photos and her medical appointment as well. Enough to keep us busy until that time.

Set up your new user account using your email address and password.

That should take you to My Dashboard - It should give you a list of Visa Information, Visa Fee's, Family Details, Appointment Conformation, Document Delivery Information.

Go to Update Profile and add your fiancee's information in there. Her information, not yours. You can however use your email address if you wish to receive the information at home.

Next find the Visa Information and add the visa type. In your case it's a K1. It should take you to the next step in setting up your interview. It will ask you where you want the visa delivered to so add her address. 

Next page will ask for your receipt number so add that number. ( you might have to wait here until the Embassy receives the payment. When it does it will in show up on the first page under Visa Fees)  When you sign in and under the Visa Fee's section it shows a payment is received you can them move forward to set the interview. Please understand these pages are progressive, in other words when you finish one it will take you to the next page until you are done.

When you set the interview it will ask you to print the conformation. So make three copies and they will have the bar code on them that you need to get into the Embassy.

It will also send a copy to the email address you give them.

 

I'm not sure about adding children if she has them. But it should still walk you through the process. Hope this helps?

Does the fiance fill out all the other information under the tab...non-immigrant visa application?...like where it says apply and pay? etc...?

Our petition should arrive in Moscow in the next few days, meanwhile my fiancee tried to register at the link you mentioned, and after going to new user, and entering everything, and submitting, she kept getting the message: Your request cannot be processed at this time. When my fiancée scheduled her interview appointment she cod not add her son because his passport had not been issued. She will get it on Monday and would like to add him using the usatraveldocs website. However there does not appear to be a way to do this I called the help line and they said that she'd need to cancel and reschedule. This is a problem as the Moscow embassy has no open appointment times (plus we don't what to slide things any further if we can help it). Is there any way to modify the existing reservation?

Like yourself, my fiance is waiting for a renewed passport....and I wondered how she adds her son on the website...ustraveldocs. I am assuming she just fills in everything for herself, then resubmits for her son...not sure, but if you find out, I'd sure like to know.

My news went from bad to good in 10 days.. This emotional roller coaster is doing a number on me... This news is great to have reaffirmation 2 times..I hope it helps the interview in HK. Marie, my family and myself don't want to get to excited because if the consulate has a bad day when she gets her next interview it will be a long way to fall.

I was hoping some of you in the VJ community had some suggestion on helping our application go smoothly at the interview. What other kinds of Proof could I get and should I write some letters to some of the agency's?

Re. your previous question - The consulate can extend the validity of the approved petition, and will usually do so automatically, as long as they believe the beneficiary is pursuing the visa application. They'll usually do this for up to one year. This is how your fiancee got an interview after the initial expiration date set by USCIS. After the petition was returned to USCIS, they decided they didn't want to readjudicate the petition, so they just closed it citing the original expiration date.

In my opinion, the consulate's ability to automatically extend the validity of the petition approval is how you got into this position. After they received the first petition they kept extending the approval until she applied for a visa based on the second petition. With two approved petitions on file they had no choice but to return both of them to USCIS. It's probably safe to conclude that both petitions are now dead, but not necessarily forgotten. If you send another I-129F petition it is possible that USCIS will send you a letter of intent to deny, citing the reason your first petition was returned. The petition you filed was returned because of a technicality - the consulate can't have two approved and valid petitions from two different petitioners for the same beneficiary at the same time. However, there is also an implied suspicion of green card shopping. Generally, a beneficiary would have to be moving through relationships pretty quickly, or even have multiple relationships at the same time, in order to have two approved petitions at the consulate at the same time.

If your previous petition were being readjudicated rather than administratively closed then I'd recommend getting married and filing a spousal visa petition. If I thought there was any chance there was still an approved fiancee visa petition at the consulate then I'd recommend getting married and filing a spousal visa petition. They were clear that they were returning both petitions, so I seriously doubt there are any approved petitions at the consulate (unless someone else also filed for her). At this point, you can either file another fiancee visa petition or get married and file a spousal visa petition. It's your choice. I think the first relationship is still going to be an issue at the interview, and she should be prepared to deal with it.


Thanks for all the good Info. in my Post #49 I explain how I was expired, and now it looks like my application is in review?? I was wondering if anyone knows what my expiration date would be? Is it the USCIS expiration? Or is it the NVC expiration, or does the Hong Kong consulate extend the validity of the application for the 4 month increments, I have read about?

Looking my case # up at the USCIS website it says in review (9-28-2010), Again the expiration notice is dated 9-20-2010.

I have a feeling that the consulate has added its 4 month expiration from Marie's interview date(7-26-2010). If that is the case ,should I start thinking about a extension while the USCIS is reviewing the case?(they said that their review could take up to 180 days)

NEW UPDATE!.Ok this is totally weird!!! so on Sep.20,2010 i get a notice that says my case is closed because it is expired. It was expired July 23,2010, that's 4 months from USCIS approval. OK, I'm hoping that someone is still reading this thread that can help me. My case has been closed. My question is should i apply again? or take another route? Now the USCIS says I can apply again, But I'm thinking there may still be my suspended application at the consulate,and It will just happen all over again.Do you know of a better option? or are there any steps i should take on the 2ed go around?

Hi every one! OK i will try to answer every ones questions. I will give post # than answer. Here we Go. #5..The previous Application ,approved and i assume it went all the way to the Us consulate in HK.

#8..Yes she told the consulate officer that she thought the case was expired.

#11..we will send additional evidence and letters from previous employers to verify character.

#12..We had lots of proof.we have been a couple for 14 months. 1st k-1 applicant only a couple 1 month.

#13...Yes they asked if i knew of the previous petition and sent a RFE about it.yes had time line of relationship,but it did not mention 1st K-1 app. She has never been to the USA.

You said you knew about the previous visa application. Did you disclose it in your petition ? Did you have a time line of your relationship that explained how you two met during / after the failed relationship ? How far did the previous application go ? Did she come to the US ? If so did she leave in the 90 days ?


In MY app the USCIS sent a 797 request for evidence asking about the previous App. We both sent replies acknowledging the previous app and stating "I" knew of it,and it was a mistake on their part. not sure "don't think there was a time line with APP" We met AFTER their mistake"filed APP" . Apparently their APP expired but was not canceled. I imagine the approved F-1 visa went all the way to the HK consulate, But Marie moved and thinking that the APP was expired never expected or received any mail on it. She NEVER cane to the USA
