I ran into this situation back in July 2004 with our Boise, Idaho office. My approval date was July 7; I had been married July 1, 2002. I went back into the office with my card and marriage certificate, pointed out they had made a mistake and that I should have received the 10 year card. They told me basically they had the right to issue the 2 year card as nowhere in the law does it clearly state in black and white that after a 2 year marriage do they legally have to issue a 10 year card. They had run into this situation in the past, had checked with their lawyer on it and he told them they were within the right to issue the 2 year card so until there was something clearly written in black and white, they will keep issuing the 2 year card first no matter the length of marriage. The Supervisor also told me she was aware other immigration offices do issue a 10 year card after a 2 year marriage.

Take your card back to the office and question them about it, you might just get lucky.


I have just called the USCIS and wasted an hour of my life. They said it didn't matter how long i had been married the first Green card is conditional.

I'm sorry to hear it worked out that way. So there are other ones out there that deal with it the same way Boise does. It really sucks.

Everything was returned - passport photos and cheque. My first thought about it all was - here we go again! Like I mentioned above "It never fails". I just hope I don't have any hassle with the Boise office over this.

Nebraska has never caused me any hassle, it's been our local office.

For those of you who remember (particularly Meauxna), I was the one who was married on July 1, 2002, had my AOS interview on December 23, 2004 and due to screw ups (fingerprinting not done right) and basically being put on the back burner for 18 months, I then received my conditional card dated July 7, 2004. Ok so I went back into the local office and told them they must have made a mistake. I should be getting a 10 year card based on being given approval after my 2nd wedding anniversary. The Supervisor went through the spiel about how there is nothing in black and white stating that I have to be given a 10 year card and until it clearly states it in the law, they will continue to issue the 2 year card no matter the length of marriage. Their lawyer says they were within their right to do so.

So on April 23, 2006 I sent paperwork into Nebraska to have conditions removed. It was all sent back to me today (minus Acclo fastener) and paperwork all mixed up with the following letter:

The Nebraska Serice Center is returning your Form I-751 and any supporting documents. If the date of marriage indicated on your I-751 Part 3 is correct, you have have been improperly classified as a Conditional Resident upon entry or adjustment and that this filing would then not be required. You will need to bring this letter to your local office for review of your classification. If it is determined that you are not subject to the conditional residency requirement, your local office will process a new Permanent Resident Card with the correct classification at that time.

Ok so now I have to make an appointment and hopefully get this cleared up locally. Does anyone know if this letter will take precedent over what the local office told me above?

Actually I'm not so sure right now. I'm being told by two people in other forums that my local office is not following the correct procedure for having the 2 year card switched to the 10 year card.

I'm going to do as I was advised by my local office and see what the end result is with Nebraska. That's all I can do.

I am just to fill in the rest of the information, attach a copy of Nebraska's letter to my I-90 and my son's, then forward back to Nebraska. We will then receive the 10 year greencard, no charge.

Now my question is this. Expiry on these 2 year cards is July 7, 2006. What if I receive nothing back before then?

I'll try to keep it short. I was given approval on residency in July of 2004 "after" my second wedding anniversary and was given a 2 year conditional card. I went back into the local office to tell them that I think they made a mistake. I should have received a 10 year card. They said they did not have to give me one (long story on this). In April of this year, I applied to have conditions removed with Nebraska. I received my paperwork back along with photos and my check with a letter stating a mistake had been made on my residency status based on having been married for over 2 years at time of approval for residency. I was to take their (Nebraska's) letter back to my local office, have my case reviewed and I should then be issued a 10 year card (no charge). I went back to my local office and showed the officer my letter. He gave me the I-90 to fill out and to send back to Nebraska for the switchover from 2 year card to 10 year card. With the I-90 I have included my 2 year conditional card, copy of my marriage certificate and a covering letter along with a copy of the letter that Nebraska sent me.

Then go back to the Boise Office with your I-90 receipts and get I-551 stamps in your passports. But the I-90 NOA should be good enough evidence of your permanent resident status..



Thanks. Hopefully I at least get the NOA back within a month. Our office here doesn't deal with the I-551 stamp. Discovered that from past experience. They only issue temp cards which means my son and I would have to have more passport style photos done.

I had sent in an I-90 for my son and I to Nebraska on June 8th by certified mail. Nebraska were the ones who noticed that we (son and I) should have received 10 year cards rather than the 2 year cards when I went to file to have conditions lifted on the 2 year card in April of this year. Boise back then (July 2004) refused to make the correction when I had gone in to let them know that I think they had made a mistake. I had been married for over 2 years at the time my son and I got granted permanent residency.

Today my son received a NOA in the mail; I have not received mine yet. Also I received back today this green card that was filled out by the post office to send the paperwork certified. So now I have the signature of the person that received our package in Nebraska as well as the date received (June 12).

Here's hoping everything else goes smoothly and I get my NOA on Monday. Our 2 year cards expire July 7th.

So it appears I'll have to go back to our Boise immigration office to get a 1 year extension on our (son's and my) cards. Two year cards expire on Friday. This means my son and I will get passport photos done today as Boise doesn't use the stamp in our passports, only issues a temporary card instead. What a pain.

We've only received receipt for our original cards that we sent back to Nebraska to be corrected.

My question. Do I have to drag my 15 1/2 year old son along with me? Can I just bring documentation for him with me instead?

For those that remember my case, I was issued a 2 year conditional card after my 2nd wedding anniversary back in 2002. Tried to fight my local immigration office to have this card made into a 10 year card and they wouldn't do it. This year I applied to have conditions removed through Nebraska only to be told that I was issued a 2 year card in error initially. I got an I-90 to fill out, sent me and my son's 2 year cards back to Nebraska along with the original letter Nebraska sent to me saying we were issued two year cards in error. Nebraska received my package June 13.

Well today I get a I-797 Notice of Action from Nebraska, Notice Type: Welcome Notice.

Down below it states that my application is being processed or permanent residency. If approved a permanent residence card will be mailed directly to me from the Immigration Card Facility. If I don't hear anything from them in 30 days, I'm to call......

Ok is this a normal letter for a card that was only supposed to get changed from a 2 year to a 10 year card because the original one was issued in error?

I can hardly wait to apply and receive citizenship to get beyond all this nonsense. It's been a fun ride so far. We apply in April 2007. By the time we get this 10 year card which we should have gotten back in July 2002, me and my son will probably have already received citizenship.

In the meantime I had already gone in to our local immigration office to get a 1 year extension for me and my son.

Since sending in my 2 year conditional card to have it changed to a 10 year card (inital immigration office error) to Nebraska which they received in the middle of June, I so far have received four "Welcome" notices on a I-797 form. I got one dated in August, one dated in September and two dated in October (same date). Each one says my card is being processed and if I haven't heard anything within 30 days to give them a call. At least it's good to know I haven't been forgotten about if nothing else. Should I be taking bets to see how long it takes before the actual card arrives?

came in the mail today from Nebraska so that took just a little bit over 4 months. Me and my son carefully checked to make sure there were no errors. Phew...none. Cards are good until October 2016 but we'll be applying for Citizenship next April anyhow.

Age gap is not the issue but the age, or more importantly, the emotional maturity of these young Filipinas. It is obviously a big enough concern for the PI Gov't. as well for them to require parental consent for young women under the age of 21. I don't know any parent of a 20 yr. old girl living here in the states who wouldn't take great pause with news of them wanting to marry, let alone to a foreigner, requiring they leave their country. The parental consent is one extra step that can help provide a cushion of reason with these marriages.


Well you must live in the state of I refuse to let my adult child grow up then. I know many who have let there daughters marry and they are doing JUST fine. My fiancé is 22 and his parents like me and he is MOVING HERE. Not all young adults are immature and maybe if mommy or daddy would let go maybe they WOULD grow up and be allowed to without mommy or daddy interfering. Seriously. If they are old enough to vote and go to war they are old enough to do what they heck they want.

I respect your opinion and it is just that, an opinion. I just want to know when does the prejudiced nature toward younger adults getting married will stop??? I Know more older folks who got married and got a divorce compared to someone marrying a younger person. I know MANY that been married for years and I am not talking 2 or 5 years I am talking 10, 15, 20 years with considerably age gaps.

Maybe in YOUR world or YOUR experience younger people are immature BUT you can't speak for ALL younger adults over the age of 18. That is a generalization and a stereotype. We are not in the S anymore OR the S.
Time to wake up and give these younger adults credit. If Mommy's and daddy's allowed there children to grow up and let go and let them do things for themselves, stop assuming they are to immature to do anything and let them stand on there on ..MAYBE just maybe they would be more mature in your eyes.

Like I said come to that age gap site and see for yourself about younger adults dating older people. There are many many out there and they are working JUST fine.

You have a right to YOUR opinion, but you do not have a right to judge someone who is marrying someone younger or older who is under the age of 25. There is no need to generalize. I realize it is still taboo but throughout history it has been happening. It was just never brought out to the media. Now that it is, many are coming out and saying Hey we got married when he or she was 20 and now he is 45 and I am 68 and so on...it happens...its life...

Just because you are older does not make you more mature, more stable, more wise, THAT is obvious from some folks I know. It's a trip to be marrying someone who's barely an adult without even considering their age an issue. Even with Filipino/Filipina marriages in the PI, it's rare to see someone that young marrying. Every couple has their own reasons for getting married when they do, but you should prepare yourself for a lot of hurdles now and in the future. Getting married that young is playing against the odds, and with the divorce rate in America already high, the future looks bleak.



check the divorce rates most are closer in AGE then in age gaps...Not sure where your from but there is MANY relationships that work in age gaps You are more then welcome to visit agelesslove.com and find out for yourself. Instead of judging why not get to know them and realize OUR relationship works JUST like any other. Like I stated before JUST because you are closer in age OR older does not make you more mature OR guarantee it will work. I was married to someone MY age for 10 years..he beat me and was a jerk..I met Kai and have NEVER been happy..So come join us there and FIND OUT FOR YOURSELF instead of judging Being OLDER does not make you more mature..I know several folks over 30 over 40 over 50 who are so immature they act like they are 12! It depends on what you experienced as well..I know many younger adults who have gone through more then older folks and have their ####### together..Kai is young..he went through HEAPS he is well educated and is a chef now. My ex is a loser he is 45 and watches nascar while drinking and blames the world...

California service center is WAY behind and many of us have not received anything YET. You will have to be patient as it will take a LONG time.
I filed on the 15th of july and many at the biggning og the month like you and have not seen one word yet OR checks/money orders cashed.

right now this is NORMAL for them..sigh:(

After USEC asked me to cough out phlegm three times. the evaluations resulted to negative; after that, they have cultured my phlegm to check further. Wow!!! crying.gif I am now back to the "waiting bench" innocent.gif I am hoping that the culture will also result to negative.

Anyone in here you had experienced the same and who is kind enough to share it with me? I would be seriously grateful to hear back from you.

I hope that time would move faster and the system that were dealing with would move faster as well..i am beginning to miss my baby love so much... tongue.gif I am really beginning to hate delays.... whistling.gif

Please write back...i am in need of some comfort

LORDY! You been throughhell and back! I hope it comes back negative so you can just get it all done and over with and be int he SAFE ZONE with your sweetie!!!

I PRAY ours goes good as well as others on here. IT ticks me off that we sit and WAIT forever to be with our loved ones only to be poked proded and bent over to look for evidence (it seems!) and they JUST take their time!!

yes
Go to the uscis.gov sign up with your case number that you see on the NOA1 you got (should start with wac)
THEN sign up and if the date is different then the date on the letter YOU been touched!!

We cant afford to fly to see each other at all and it has been a tad over a year. THank the stars for webcams and voice chat 24/7 or we would go insane!! We leave it on all day THIS way he can see me come home from work and the same for me with him.
