Removing Conditions on Residency General DiscussionHow long before biometrics?
Can someone tell me how long it took to get a biometrics appointment after receiving the 1 year extension letter? I received that letter in June and am just wondering how long it will take to go in for my biometric stuff. TY.

Removing Conditions on Residency General DiscussionNeed to submit passport pics or not?
QUOTE (ucla_cutie26 @ Oct 31 2009, 07:49 AM) <{POST_SNAPBACK}>
To my understanding, I thought we had to submit 2 passport-style photos with the I 751.

But from looking at the instructions, it says this under the section for military who reside overseas to include passport pics.

Do all others also need to submit passport pics?

I'm a bit confused! helpsmilie.gif

Nope. I did not have to include those. They took my picture at my biometrics appt.

Removing Conditions on Residency General DiscussionTravel after 10 Year Card Issued
QUOTE (sailorinaz @ Nov 2 2009, 05:20 PM) <{POST_SNAPBACK}>
Hi All,
I apologize if this has been discussed and answered before. Once the conditions are removed and a 10 year green card has been issued, is a U.S. Passport needed to travel out of the U.S. and back in again?

I am confused about this because I am thinking the U.S. Passports are only for U.S. Citizens.

No. Your GC is your "passport" to enter this country. You would need your country's passport to enter there. For example, I have my GC which I will use to enter this country if I were to visit my mom in Germany. However, I need my German passport to enter Germany.

Removing Conditions on Residency General Discussionfiling I 751 with almost no evidence, just 2 kids together
QUOTE (Helen G. @ Nov 2 2009, 04:36 AM) <{POST_SNAPBACK}>
Hi,

I have asked this question before and never got an answer.

I'm gathering eveything my husband and I have together so I can file I751 but here's the thing: I just have the business acct. as a joint account, health insurance under his policy, car insurance under his policy and my verizon cellphone is under his name but I will print detail in coming and out coming calls so they can see how often we called each under (which is every day) I don't work. This is everything we have that appears both of our names. Now, we do have two girls together, one is 2 years old and the 2nd is 3 month old, he is a born US citizen. My question is: HAS ANYONE BEFORE BEING ASK TO SENT MORE EVIDENCE BESIDES HAVING KIDS TOGETHER????

I am so scared that they would look at my package and see: bank account together, car insurance, health insurance, verizon bill, affidavits, boarding passes, income tax return for 2007 (we haven't file 2008) and TWO BIRTH CERTIFICATES OF OUR CHILDREN and send me a letter that they need more evidence. IS THIS POSSIBLE????? HAVING KIDS TOGETHER CAN'T BE ENOUGH EVIDENCE OF A MARRIAGE IN GOOD FAITH?????

HAS ANYONE BEFORE RECEIVED A LETTER ASKING FOR MORE EVIDENCE BESIDES HAVING KIDS TOGETHER???

PLEASE RESPOND.

I NEED TO MAIL MY PACKAGE AS SOON AS POSSIBLE BECAUSE I HAVE TO MAKE A TRIP ON DECEMBER AND MY GREEN CARD WAS STOLEN, SO I GUESS IF THEY FIND EVERYTHING GOOD IN MY PACKAGE I WILL BE ABLE TO HAVE A STAMP BEFORE THE END OF NOVEMBER.

Can you not get your name added onto your utility bills such as electric, water, etc? If you have a car, can you get your name put on the title? Do you have your name on the car insurance? These are all things where you can easily get your name added to it, which will mean more evidence for you to submit.

Removing Conditions on Residency General DiscussionYes!!! Got an approval letter in the mail yesterday!
I sent my petition off for removal of conditions in June. I had my biometrics appointment in August, and yesterday I received my letter telling me that the removal of conditions has been approved and that I will be receiving my card in 60 days!

At first I thought it was a letter asking for more evidence, or perhaps even an interview date, but nope, just a big old congratulations letter! I am so happy today! My baby is due on November 19th and this is just a double blessing for me! I did not think I would get this letter so soon.

Anyhow, just had to share since you guys have helped me out since the beginning of time when I filed for the fiancee visa! TY!

isn't the appointment letter the I-797C NOA? That's where the appointment time and place is listed. Ah yes I see on the top it's listed as the ASC Appointment Notice on the I-797C

Yeah you should have received a I-797C NOA1 extension letter first and the a I-797C biometric appointment letter. Take both.

take both if you want... but the requirement is only the appointment letter, state/government issued ID (in the name on the appointment letter) or if not in the same name then a state/government issued ID and the document that changed her name (ie.. marriage certificate).

I know this is late, but just in case someone down the road sees this, I say also bring the envelope that the appointment letter came in. When i went for my biometrics appt. in Birmingham, AL, there was a couple there who just brought their letter along with the required ID's. The immigration officer there made a big old deal about them NOT having the envelope in which the letter came in. He said he wanted to see the envelope. I still haven't been able to figure out why, but he turned them away and they were not able to get their biometrics done that day!

Your husband should file form I-90 to replace his green card. This application can actually be filed online through the USCIS site. We did this as my husband's green card was stolen a few months ago. The fee is $370 (which is a $290 filing fee and $80 biometrics fee) My husband got his biometrics appointment within 3 weeks of filing and we are now awaiting the replacement card.

Best of Luck!!

Does anyone know if they still have penalties for losing a GC?

I have actually had a GC before. My mom married a US citizen back in 1983 and he petitioned for me as well. Anyhow, I remember when I was about 15, my GC got lost and my mom filed for a replacement. However, there was a 1 year penalty.

There is no penalty for loosing the greencard... other than the $370 you have to pay to replace it crying.gif

Well that is good to know that it changed! LOL, not good to know about that fee though. Back then my mom paid $75 to replace it. LOL

Removing Conditions on Residency General DiscussionRemoving of Conditions
QUOTE (Machita @ Oct 19 2009, 05:57 PM) <{POST_SNAPBACK}>
Hello Everyone,

Here is my situation and I would really appreciate it if I can get some advice from you guys. My friend referred my to this forum and I hope I find it helpful.
Background:
I am Palestinian (Palestine is not listed in this forum neither at the USCIS website/system). I came here in 2005 for two months then I went back home. In 2006 I came back to the US on F1 and finished my Masters in 2008.
Right after I finished my MA I received an OPT. In the day OPT started, I got married to a US citizen. We got married on August 30th 2008. So we have been married for a little over a year. Since I had my OPT I didn’t file right after I got married. I filed for green card on January 15th 2009. Then went to an interview which took only about 10 minutes and my card was approved. I received the actual card in June 2009.

For the past couple months, our marriage has been going down hill. We have been trying counseling since then it seems it is not working for us. Now we feel we are different and actually stupid. It is so difficult and I don’t think it will work out.
I moved out last week and I was about to file for divorce. My wife asked me to wait. So I waited but I don’t know why, I think I should have filed for divorce. But I know we will have eventually file for divorce.
We have entered marriage for love. Although my dad was a little against it, I decided to get married. She is 30 years old and I am 26.

I know I have to file to remove the conditions on my own if I want to stay- Of course I want to stay in the US.

Here is an example of what I have:
1. Heath Insurance
2. Accidental insurance
3. 401K
4. Two cars insurance
5. Two ownership of cars
6. Joint back account, checking and saving
7. Joint credit card
8. Tax return I filed separately but married.
9. Letters of love to each other
10. Letters from family and friends for birthdays, Christmas, etc///
11. Emails: over 1100 pages between me and her since we got married
12. Records of calls
13. My paychecks and hers
14. Dental insurance
15. Pictures of us and family in holidays and activities: over 3000 (crazy ha? My wife never let go with the camera)
16. Trip planning to Palestine for both of for her to meet my family in August 2009( with pictures and videos with my family)
17. Marriage video
18. Videos of us: more than 12 GB
19. Letters from friends testifying of our marriage
20. Mail that shows our addresses
21. To leases agreements with both of our names on it
22. Comcast bills with both of names on it
23. Netflex with both of name son it
24. Questar gas with both of name son it.

I can’t think of anything else, but I think I have more stuff (please suggest).

My questions are:
• Is this enough evidence to remove the conditions on my own?
• Does it matter to the USCIS that my wife is older than me? (It did matter to my dad)
• Have you know of any I-751 waiver that got denied? Or ended in deportation?
• Should or should my wife file for divorce?
• How long does it take to get approved? Will I be asked for an interview?
• Do I have any other alternatives if my case was denied? What is the worst case scenario?
• If there are people with waivers that got approved, please share your experiences.
I am sorry for the long post. I know that my marriage was real and God/Allah knows that too.
Your answers are greatly appreciated.

I'm confused. You said that you have to remove conditions on your own if you want to stay. Are you talking about divorcing and signing the waiver? If not, then your wife also has to sign the petition to remove conditions. Sorry if I missed it in your post, but I am pregnant with placenta brain and it's causing comprehension problems for me LOL.

Anyhow, I think that you have a lot of good evidence and don't really need anything else. You asked if you or your wife should file for a divorce .... I would say no, unless she is not willing to file your petition for you to remove conditions. I was in a similar situation. My husband and i actually separated for a while and I thought about divorce. He still signed the petition for me though since we have kids together and he did not want my kids to end up without their mother. I think that when you sign the waiver, you have to prove hardship if you leave the country, or domestic violence if you sign the waiver claiming abuse. I heard that it is hard to prove these things.

Anyhow, I just got approved and am getting my GC .... my husband and I have also decided to stay together and work things out. Is there no way that you can work things out? I know you said you don't think so, but I felt the same way too for a while. Then since we got back together, things have been really different and pretty good.

Also, for some of the stuff you asked, no USCIS will not care about the age different. It really isn't that big of a difference anyway. I do know of a person whose waiver got denied and ended up in deportation. However, she showed all of her evidence to the immigration judge and since she proved that she did enter the marriage in good faith, he allowed her to stay. She has a GC now.

Since you are under Tricare (like me) why not include some of the EOBs (Explanation of Benefits) -- also called Tricare Claim Summary -- that Tricare sends to you. It shows your husband under Sponsor's Name, his last 4 digits of SS number, your name and mailing address.

Edit to add: I also inluded a copy of of our Military ID cards along with our DL in our application.

I dont have any EBOs. All I have got from tricare this years was the renewal letter. Military ID, I ddint think about that, so thanks, I will add them. DL, I cant add because my husband still have his old DL and he doesnt want to change it. So we have different state DL's.
Thanks so much.
I will add a copy of our military ID's to the package.

Oh yeah, speaking of military stuff .... I also sent a copy of the DEERS enrollment where it shows that I am his dependent. And yes, I also sent a copy of my military ID.

Since I was pregnant when I sent off the petition, I sent them a copy of my ultrasound pic which shows my name and due date. LMAO!!! My husband thought I was retarded for sending that but I was like hey, it shows that we have another baby on the way LOL.

Anyway, yes, I think you have more than enough evidence. You pretty much have some of the same stuff that I sent off smile.gif

You should definitely get an Infopass appointment. When we went, we saw the supervising adjudicator, explained the situation, and she got things moving really fast. Call the military helpline and see what they say. Either way though, make an Infopass appointment. We were told that in cases like this, they will expedite.

I went and got my Infopass AFTER we submitted our paperwork because it was afterwards that we found out about the whole Iraq thing. We filed in April and then found out about Iraq at the beginning of June. Our Infopass appointment was June 12. I had my Visa by July 19th.

Wait, was your ROC expedited or something else? You say you had your visa by July 19th, but that doesn't match your timeline for your ROC.

No, it was my AOS - it even says it in my timeline. However, I was told that they can also expedite for ROC in military cases.

Good day all, My wife got her green card back in April of last year, it expires in October 2010, so we were going to do the removal of restrictions paperwork the 60 days prior like required.

But, I just received orders for the Horn of Africa for a 10 month Deployment, since it's a deployment she will stay in Guam were we are stationed right now. I depart in Feb of 2010 so my question is there any special form or place to contact to see about doing the paper work early in lieu of military orders overseas .
Without the extension she would not be able to travel outside of Guam from October until January until I return, meaning no visits to her family in the Philippines during the holidays since the green card will have expired.
Any advice on this would be helpful.

Thank you

Please call the immigration military line. My husband was sent on orders for Iraq in August of 2007. We were able to make an infopass appointment and our case was expedited. Look at my timeline and you can see how quickly we were able to do AOS. I know that you are needing to remove conditions, but it can also be expedited!

We found out about his orders in June - had Infopass appt on June 12 ... and had our interview on July 11. They also let me know I was approved that same day. I got my GC a few days after the interview.

About 5 weeks ago my wife (permanent resident with conditions) filed her AR-11 online to file our new address. I also mailed in my sponsor change of address form at the same time.

I got a receipt in the mail for my change of address about a week later. But we haven't received an NOA or any type of receipt for the AR-11 filing. Is this normal? I remember when we change our address before the AOS process, we got a receipt in the mail for the AR-11. I did print our a confirmation of the AR-11 the same day we submitted it, but I always feel better when I get the official receipt from them in the mail acknowledging the change. Should I be worried?

Thanks for your advice!

Hmm, I never even sent a letter in the mail. I changed my address online and printed the confirmation.

I don't think you should be worried. You can always call them and make sure they have the updated address.

After the exam at SLEC do they tell the patient if something is wrong or do they find out at the interview at the USEM? Someone told MJ that she would find out at her interview so now she is all worried.

Thanks,

Oh, they will let you know (the CS). That is not true that they will tell you at the interview unless it happens like this in some countries, but I have never heard of this. I went to my CS in Germany. They sent the results in the sealed envelope to the embassy and they sent copies to me in the mail - this way I knew exactly what stuff the embassy was seeing.

Have her request copies of the results.

Can't speak for the Phillipines but I do know that in Germany, you do not get an x-ray while you are pregnant. It's not considered safe.

I was at St. Luke's yesterday (i'm 14 weeks pregnant) and the nurses informed me that i have to wear an abdominal shield during the procedure but they could not guarantee that it's 100% safe so i did not take it. LOL, they aren't qualified to interpret medical exams either so I don't even know what the heck they look at them for. The procedure should be that someone at the embassy reviews it and once the visa is approved, you shouldn't need any more BS.

I experienced quite a hassle because the IO had no clue what anxiety disorder or polycystic ovarian disease is. I waited forever and a day for someone from the CDC to review my medical records. When she finally came around and asked the IO what the problem was and he explained what was on my medical record, she rolled her eyes and told him to let me through. I could tell she was annoyed. She even apologized for him. wacko.gif

Sworn affidavits are not needed. You can use them to supplement your evidence which you already have, but it is not a must. I didn't get them.

Just wanted to say that I grew up in El Paso! Lived there from 1983-2002. I used to live on the east side right by Cielo Vista mall. I miss that place! Although I am originally from Germany and a freaking immigrant, El Paso will always be my home - it's where all of my memories are.

Hello Everyone

My fiancee had his interview today and was APPROVED!! kicking.gif He has to go back November 6th to pickup his visa. I don't have any details from the interview just yet. I can't wait to hear how it went. He will arrive November 22nd and we have planned our wedding for December 1st. I would like to thank everyone who lent me their listening ears and who were very encouraging to us through our first part of this journey. I know it's not over until he has his 10yr card but right now we are happy and thrilled that we got over this first hurdle.

Wow. What a racist b!tch!

did I miss something?

Who WHere WHen WHat??

The woman's blog that has the pics up. Wicked racist against Arabs and Muslims. blech.

but when someone on this very website writes "once you go arab you never go back" it isn't demeaning or belittling or worthy of a "blech"? strange. very strange indeed.

First of all, why don't you compile the entire conversation that this remark came from rather than taking what I said out of context. This remark was made about how some of us fall in love with the culture and don't want to go back to anything different.

It is YOU that is making more out of this statement than what it truly was!

I don't know you, so what is the point of continuing to bring up this issue?

We don't know the woman about whom this thread is written, either, but we're still discussing it.

Your statements were offensive to some, and that is just the reality. You can say over an over what you might have intended, but that really doesn't matter in the long run if you never get to the point of understanding why anyone might take what you said offensively.

I love it when people are offensive and then say that their form of offensiveness is not at all like something that is **really** offensive. As if your perspective on offensiveness is the only one that exists. If it were, your statement wouldn't still be called up as something people find offensive, now would it?

You're seriously offended by that comment even though it was taken out of context?

well, you would think so but I do know at the time that whole scene happened the VJ moderators were well aware of it all and to my knowledge nothing was ever done. so that makes me think that maybe doing something was not an option? because its true, those pics are still there a year later, so obviously nothing compelled her to take them down....

Since pictures and timelines are posted on a public forum, a person can do what they want with it. However, it is a crime to defame someone and tell lies. Without having hard facts with accompanying evidence that what she's saying is true, she is incriminating herself by saying some of the things she is saying. The owners of the pictures, etc., have a right to ask this bit__h to remove their pictures and names. If she refuses to do so, she can be sued for defamation and libel. I am assuming that nothing ever got removed because no one pursued it. I know i would have. I would have even contacted the media to have them run a story on this so called journalist who seems to be a moron.

That's what this is all about. I've deliberately malformed the URL so it can't be tracked back to VJ using referring URL. To view, just remove all the whitespace between characters.

Oh gosh, that is horrible! There are EVERY type of race/nationality that might try to get a ticket to the states every now and then, but come on! My friend got paid $20,000 to marry a Korean man so he could come here so like I said, it can be ANY race/nationality. I find it awful that this person makes it seem like it's only muslim/middle-eastern men and like it's the only intention a muslim man has. What a disgrace and how tactless and tasteless for her to write something like that.

Oh God, the whole "vulnerable" and "gullible" diatribe is just nauseating. OK. This lady is just plain old stupid and I can't read any further.

I am sorry to those of you who have been affected by this obvious, uneducated, ignorant person! You should threaten to sue her for defamation and libel.

Middle East and North AfricaNo Visa's here

Of all the things I thought would or could go wrong, I never thought it would be the financials. I had submitted about 35 thousand in income and assets, and according to the USCIS website 29,5 is the poverty level for a family of 5, which is what we will someday be. Hopefully.
According to the lawyer, we had enough proof of a relationship. We had photos of the wedding and of me with all of his family. Photos of us together at Petra, and some of me with his neice and nephew. There were also about 12 letters I have sent to him in the past year.
So, now I am scrambling around trying to find anything and everything to send to them that will validate our relationship. IM"s, e-mails, phone call records. Can anyone think of anything else?
Would letters from friends and family of mine stating that they believe the marriage to be valid, and that I gained nothing financially for having married him ,help any?
The funny thing about our communicating is that I have always understoon every word he has ever said to me. I may not speak arabic, but I am learning, and his english is very good with me, and his writing is very proficient.
I wish I could have been there with him to tell them how "valid" our marriage is.
When I talked to him this afternoon he was reading the letter from the interview to me. When he got to the part about proving the marriage was not for a visa, he said.."Honey, I think this woman not believe we love each other" as if he had just realized that fact.
She also mentioned that she had an issue with the fact that we had married only 4 days after having met in the real world. Little does she know that I have always been a "fast" working woman. LOL

Do you have any cards? Birthday, christmas, etc...... Any cards that were sent to you after your wedding? And yes, you can take letters from people stating that they know you are living a valid marriage. Do you have any gift receipts? I know, I know, most people wouldn't have a receipt of that anymore but my husband kept a few receipts for stuff he bought me.

I can't think of anything else that you could bring. I brought emails, letters, cards ( I put sticky notes on them noting the date and occasion for the cards), pictures, boarding passes, gift receipts and that's about it. I had stacks of them and my clear envelope was pretty thick and heavy LOL.

IR-1 / CR-1 Spouse Visa Process & ProceduresMarriage with a US Citizen

There's nothing to stop you getting married while you're in the US on your visitor visa. But as the visitor visa is quite clearly NOT for immigration purposes, you would then need to return to your own country (without overstaying on your visa) and have your USC husband/wife petition for you as a spouse. Alternatively, the two of you could apply for a fiance(e) visa and then get married (and stay) in the US once you get it. Either way, a long wait will be involved. And being 'very much in love' and not wanting to be apart makes you, oooh, no different whatsoever from any of the other people who are posting on here - funnily enough we're all in love with our fiances/spouses and don't relish the idea of having to spend months apart.

Like midicat says... entering the US with a visitor visa with the intention of using it to marry and immigrate is, well... illegal. And you would run into problems down the line when you tried to adjust status to become a permanent resident. If it was as easy as that, nobody would bother going through the proper process, and would just use tourist visas or the visa waiver program to immigrate to the US - however, they are NOT for immigrant purposes, and USCIS doesn't care that you're in love.

Have a read of the guides at the top of the page here and have a talk with your partner - you can work out which way will be the best way for the two of you. It pretty much comes down to being separated while engaged or separated while a married couple, but if you read the guides & FAQs (and come back here to ask any more questions you might have) you'll be able to get a good idea of which process will be best for you.

Good luck. :)

Hello! :)

Just a quick question. I stumbled upon this thread and was wondering about the topic being posted. I now know 4 people who are from Germany, who ended up going to the states with their boyfriends on a tourist visa ... who then all ended up getting married, being able to stay in the states permanently. How on earth did they get away with that if you are not supposed to do that? And just today, a friend of mine told me she is leaving next month and is doing the same exact thing. I recommended that she get the fiance visa and she laughingly asked me "why?"

It frustrates me to no end because I am sitting here waiting out this long process for my fiance visa and find it so unfair that other people are getting away with something that I was told not to do. So, does anyone have any idea why some are still getting away with this?

wow, i have another question!

my husband had his medical the other day (in london) and was given a blood test for alcohol & drugs. he wasn't expecting it because he had drinks the night before and a beer with his dad before going into the medical! then the dr. asked him if he'd ever been convicted of drink driving and my husband stated he had, but 10 years ago.
did anyone else out there get asked this? did it come up at the interview? does anyone think this will be a problem for receiving his spousal visa?

paranoid!

bee

He got convicted for drinking? Why? It is not illegal to drink. I don't think they will be worried about him drinking alcohol and no, it did not come up at my interview and back then, I also had a few drinks every now and then. I'm addicted to strawberry margaritas with whipped cream on top. Hehehehe

It was drunk driving, not just drinking.

K-1 Fiance(e) Visa Process & ProceduresInterview date -

My fiance and I have been waiting to receive an interview date since sending our packet back on 11-30-06. I called today and although they have our paperwork and confirmed it has been processed, they still have not scheduled us an interview date. I know we will get it soon but I say screw the govenment for making us wait for 7+ months to be together. We could know tomarrow or in a month. But the waiting and not knowing is unbearable. We are thinking about getting a plane ticket and just having him come over until the interview date. There are many obstacles if we do this such as more costs, Jon leaving his job, selling his car, maybe not being able to get into the country, etc. but we just want to be together. In the end that's all that matters. I know everyone else feels the same way. I see it when I read your blogs. I ask my friends what they would do but not being in the same situation they all say do the logical thing and wait it out. If you were us what would you do-Wait or take fate into your own hands??? Are there things to consider that maybe we are not considering? Also, please share your stories with us. It makes me feel not as alone in all this.

Gosh, I am sorry that it is taking so long for you. I am in Germany and I received my interview 2 weeks after sending back my signed checklist. I hope you hear something soon because you are right, waiting is a pain in the butt! Good luck to you!

K-1 Fiance(e) Visa Process & ProceduresNotary?

Which documents HAVE to be notorized?

Thanks

Read the guides... plus you need to tell us what part of the process your at... I-129F or ??? But follow the guides..that is what they are there for....
But we also will help...

i haven't started my process yet, sometimes in march i'll start and yes, i will be filing for I-129F
i read the QA, but i am just making sure cause so many things confuse me
if all of the papers will be notorized, will it be a problem? better safe than sorry

Hmm, hopefully I can remember what I got notarized but I remember getting all my translated paperwork notarized including my birth certificate and divorce papers. My fiance got the Affidavit of support notarized. The affidavit of support will have to be filled out by you so you will be responsible for getting it notarized. ;-) I hope I didn't miss anything. Good luck!
