Ok thanks, does anyone know how long it usually takes once you apply?


Applied for my fiancee's on September 4, 2012. We got her card in the mail with the # on September 10, 2012 so for us, 6 days. But, they tell you at the SSN office it takes two weeks.

When did you apply for it? It isn't really assigned until you have the card in hand with the number although the date on the card was the date of our application. Applied for my fiancee's on 9/4 and got in the mail 9/10.

If she wishes to get a visa to come the U.S. it will not be listed. My fiancee had gaps between factory jobs, has stayed home helping her parents and helping out in her sister's tiny shop for the past few years, this never came up in her interview.

Application I-129F questions 18 asks you HOW, WHEN & WHERE you met. So yes you do need to tell USCIS how you met. Also in your fiance's G-325A it will ask for her previous employment. Even though she worked there for only 2 weeks it will most likely come up on the background check. Also the G-325A asks you not to leave any dates blank. So you either have to write that as one of her places of employment or write down unemployed.

I am not sure if you should lie bc if u do ur fiance could possibly be banned from entering the USA.

Highly unlikey that it will show up on a background check regardless of how long she worked there. These are cash businesses that keep very few documents aside from their license to sell alcohol and taxes paid.

I think you've answered your own question. There are heaps of stories like Karee's from numerous countries. If you are 100% honest I think you stand a 100% chance of getting a denial. That being said, are there men who did you are doing and end up happily married?, sure. However, I doubt they told the USCIS that they intended on bringing a prostitute the U.S. You will have to make a judgment call.

In developing countries it is a means to put food on the table. Then the person's fmaily gets used to the money and wham, before one knows it they have a career they never really wanted to sign up for. I don't know about Phom Phen embassy but I know that as Karee said that at the Bangkok embassy if you even mention working in a bar, no visa. In fact there were posts in regional forums that even working in "certain" cities, even in a hotel or restaurant, kept people from getting visas. My sense is that if you put down her employment history and check the box on the form in Packet 3 that your fiancee engaged in prostitution in the last ten years you probably won't even make to the interview stage.

I was not allowed in. However, I hand carried all the documents for the interview and was there for moral support (aside from the fact I got to be with my fiancee!) The CO asked my fiancee during the interview the last time she saw me and she told him that morning as we waited in line for her to go into the interview. She also took my passport inside with her to show the CO my most recent arrival stamp. While I may not have been let in, it was important for me to be there with her.

Is there a particular reason you want to hire a lawyer? If you think there will be issues with your filing, there are different lawyers specialising in different parts of the process, such as Laurel Scott for waivers (if you had previous illegal entries to the USA etc).

If you are simply not comfortable with all the bureaucracy and paperwork, a simple visa preparation firm- there are a few advertising on VJ- can be useful, and cheaper than a good lawyer. But as mentioned, most people here do it themselves.


Agreed. Due to time constraints with work and the ease of working with a translator who helped my fiancee fill out some of the forms, I used one of the firms that advertise at the top of the page. They were top notch, did a great job and are now assisting us with our AOS and EAD/AP. I would highly recommend them to anyone seeking a little help in an otherwise do it yourself process.

What they were demanding exceeded their statutory authority. In other words, it was unlawful.

Their authority is granted by Congress under Title 8 of the United States Code. They can't simply make stuff up and then deny citizens because they want to. If a petitioner fully complies with all the applicable statutes then the petition must be granted.

And remember, the request from the CSC was different from the instructions on the Form I-129F.


A few months ago there was a poster here who was going to sue the USCIS for some greivance, good luck with that. While you may be 100% correct, wouldn't it be easier to give them what they want so you get what you want? I don't thinking citing constitutional law to a government cubicle worker will advance your position very well but, I could be wrong. If you could show a denial of due process you may have a case. I reckon a good constituional law attorney will run you about $400.00 an hour.

As an aside, when we submitted our Packet 3 we submitted a "Free to Marry" certificate and a certified translation. It is "technically" only required in Thailand when you have been married before or have children out of wedlock, neither which applied to my wife. However, I was not going to take any chances and since it was listed on the instruction sheet we were provided with our Packet 3 we gave them one just to be sure.

I don't believe you can get it notarized. However, if you go to the court you can get a certified copy. The certified copy is the one you want to bring. It costs a couple of bucks and has the official stamp and clerk's signature on the last page. Good luck!

nunc pro tunc (nuhnk proh tuhnk): adj. Latin for "now for then" this refers to changing back to an earlier date of an order, judgment, or filing of a document. Such a retroactive re-dating requires a court order which can be obtained by a showing that the earlier date would have been legal, and there was error, accidental omission, or neglect which has caused a problem or inconvenience which can be cured. Often the judge will grant the nunc pro tunc order ex parte (with only the applicant appearing and without notice). Examples: a court clerk fails to file an answer when he/she received it, and a nunc pro tunc date of filing is needed to meet the legal deadline (statute of limitations); a final divorce judgment is misdirected and, therefore, not signed and dated until the day after the re-marriage of one of the parties---the nunc pro tunc order will prevent the appearance or actuality of a bigamous marriage.

Oh, and yes, my ex has re-married, and has children I believe.


I believe the nunc pro tunc order must be issued by the judge to correct an error made by the court. You might want to contact your local bar association to talk to an attorney about a potential malpractice claim for messing up the divorce. Your prior attorneys may be more "amenable" to rectifying the situation free of charge if they face a potential claim.

I think you're better off taking deathheat's advice and try to get a new one issued. I wouldn't go crossing out anything on a government form. We've got some CBP officers that work in my building, if I see one tomorrow I'll ask them but, I think you'll need to get a new one issued, not sure if they can back date though. Good luck.

yes the actual I-94 has my husbands name on it. I'm thinking they grabbed the wrong one and didn't realize it. When we came through we had been up all night on the flight and then I was also in a wheel chair which caused some confusion in the line up. My fiance at the time filled it out by mistake and I told him it was for me. He was trying to help me out. The first officer who did the finger printing was the one who took the cards and gave one back to him. So not sure what to do. I have made a note on my application form though. It has my correct A# on though.

Then obviously heatdeath above has the solution. It seems strange the CBP agent didn't catch that. And I was under the impression that US citizens didn't need an I-94. Maybe your fiance is a LPR and needed to do one?

There is barely enough room to write one name there let alone two. Are you confusing the "VISA" with th I-94 "Departure Record" card stapled to your passport? Very strange indeed.

This is probably not anything, but possibly a big ooops on the poe. When looking at my passport to make sure my I-94 was there so I could start my AOS I noticed my now husbands name there instead of mine. Is that correct or was a mistake made? If a mistake who do I contact to fix it?

You mean the actual I-94 card stapled to your passport has your husband's name? Well, who filled that out? I find it hard to believe that wasn't caught by the CBP officer. I don't think you can get the I-94 re-issued but you should also have a stamp in your passport for filing your AOS. US citizens do not need to fill out an I-94 upon arrival so it seems strange your husband would have filled it out.

Or, are you referring to the actual K-1 visa where under annotation it says:

FIANCEE OF (Husband's Name)?
That is what it supposed to say.

Nigerians fall into 2 classes , those that are very compture literate and those that aren't. My husband was in the second class. He had no reason to use a computer in his life in Nigeria and created an email for talking to his uncle and myself eventually. When he arrived he had never created a facebook account and didn't understand the "woman" chasing his from the dating site spam. We tend to forget the whole world isn't stored online. My own mother only got online once in her life, with my son showing her at her local library shortly before she passed on.


Those classes are not unique to Nigeria. My father, a retired university professor in the US has never used a computer and never will. The books he has written are done long hand. My mother still cannot attach photos to her e-mails while my wife from SEA with only a minimal education knows heaps more about computers than I ever will and schools me regualrly on stuff. My comment was based more on the fact the story seemed like nonsense that based on the fact his fiancee could get on MSN but not yahoo the OP had a friend help register "his" account on msn so when the CO checked into the e-mail address it came back to someone else's name. That sounds more than a little fishy to me.

I am very perplexed by this statement. You know how to register for yahoo messenger but because your fiancee doesn't know (hard to believe, all you need is an e-mail address and she apparently knows how to register for MSN)you had someone "help" you register for hotmail but didn't use your name? There is absolutely no way in the world you could make that make sense. Given Nigeria's problems with the internet, I reckon that statement sealed your fate and may be a problem in the future.

If you have received your NOA1 why not make an InfoPass appointment and explain to the nice nice folks at ICE your predicament. I'm sure they've got a way to help you out. I would call right away.

I don't think that will raise any issues.  My fiance brought the Western Union receipts as evidence of my support for her.  I think it's actually a good thing.  It shows that you want to support your fiance!!  My 2 cents worth.

 

Agreed. My wife stopped working some time ago and was taking care of her parents when we met and working in her sister's little shop in the village. I offered to help out and also paid her nephew's school fees. We provided the Western Union receipts as well as evidence that I had been, and was willing to continue, taking care of my then fiancee. However, a few VJers warned me that it be a red flag to do so after I sent in our petition. Never came up in the interview.

That is correct, that is how it WAS done LAST year. As mentioned in the previous posted responses, the CBP has recently automated the I-94 process at POEs.

I believe the I-94 is handed out on the plane, filled out and handed to the CBP officer at inspection. They write your A# on it, tear off a piece that is stapled in your passport. That piece is then turned in at your AOS interview, if you have one. That is how it worked for us last year at POE LAX.

I'm sorry but something doesn't smell right. It is possible that if an individual suffers a traumatic brain injury they can suffer from retrograde amnesia (forget things in the past). However, barring some event like that I just don't know how how a guy would forget marrying someone until she reminded him. I guess you have to ask yourself "Does this sound right to me?" I would certainly be questioning what else he "forgot" or what else you haven't asked him yet. And why was he looking for his ex wife on facebook? If he knew her name didn't he know she was once his wife? Or is he chatting with some random stranger who says "Hey, remember we used to be married?"

He has a daughter. And he told me about the baby momma but apparently this union was BEFORE the baby momma. I gathered his information and translated the question to get his answer. He only informed me about the baby momma.
It wasn't until recently he found his ex wife on Facebook!

Wait, I am assuming you are the petitioner. You filled out the I-129 and in filling it you asked if he had been married before, yes? Therefore you did ask unless you just assumed. And the paperwork you translated was that from Vietnamese to English? Does he read Vietnamese? Seems he probably understood what it was before you translated it. Something doesn't add up or I am missing something here.

Just a thought, I have read many comments here that COs have made as "jokes", i.e. why would marry a bald man, why would you marry a man as old as your father etc.Unfortunately, given cultural differences and the gravity of situation, they made not be understood or even funny and may make the beneficiary very uncomfortable. It is entirely possible that CO may have made such a comment as joke or ice breaker (I know at our AOS interview the guy was trying to be funny and my wife did not understand at all). With the 2 week return interview there may some documents missing but she didn't understand the COs humor and may think that had something to do with it. Good luck to you.

FWIW, I took my chances. We got the interview very quickly and I wanted be there for the interview even though I could not go inside. The interview was originally scheduled for 8/27 and they called the week before saying they needed to move it to 8/28 because of a meeting. We had originally planned on flying home on 9/1 but changed it to 9/2 at a cost of $100.00 for EVA. The visa arrived on 8/31 via EMS as promised and we flew home together. Good luck.
