K-3 Spouse Visa Process & ProceduresWhich to choose, K-3 vs IR-1/CR-1?
Thanks for the input. If I file for the CR-1, I understand that I have to send it in to the Chicago lockbox. Correct? If so, what service center will handle it? Is Vermont still the nightmare it was a few years back?

K-3 Spouse Visa Process & ProceduresWhich to choose, K-3 vs IR-1/CR-1?

k-3 became virtually obsolete on February 1st - Go CR-1

Is that good or bad? If I recall, K-3 was quicker than CR-1.

Off to catch up on the guides........................not looking forward to all this paperwork again. On the bright side, I think it should be pretty damn easy for her approval. She's been here for 1 1/2 years and we have a 9 month old now.

K-3 Spouse Visa Process & ProceduresWhich to choose, K-3 vs IR-1/CR-1?
My wife arrived in the US in June 2008 on a K-1 and we married the following August. In September of 2008 we learned we were having a baby, YAY!! Unfortunately, I was laid off of my job the following month. I was out of work until I took a job in Florida in February 2009.

Because of the lose of my job, we did not file for her AOS when we wanted, money was tight as you could expect. It took every penny we had to make the move out to Florida and with the baby coming the budget was even tighter.

The end of September 2009, the company I was working for decided to close up shop. What luck......................I am now working again, since January, and feeling pretty secure at the moment, knock on wood.

My wife is a little homesick and her parents are not in the best health so we decided that she would go back to Thailand so her family can see our son. We will take care of her immigrating back to the States while she is there.

My question what is the best route for us to take?

Which to choose, K-3 vs IR-1/CR-1?

She will be leaving for Thailand March 24th and will be in Bangkok for a few days before heading home to her village. I'd like to get all the paperwork in order before she leaves.

I'd appreciate any recommendations you may have.

Thanks!

K-3 Spouse Visa Process & ProceduresK3 being processed

Sorry, I'm afraid my answer wasn't clear. This thread is about a petition already approved and sent back to USCIS from a Consulate, so it was a NOIR. Your NOID was for a petition not yet approved, so the decision to approve or deny the petition WAS still entirely up to USCIS. There was nothing to "revoke" yet.

Thanks for clearing that up pushbrk, after all these years reading your post I should know better than to question them. Posted Image

K-3 Spouse Visa Process & ProceduresK3 being processed

In a visa case, it's a NOIR, "Notice of Intent to Revoke" Notices of intent to deny are for adjusting status or other decisions where USCIS can approve or deny. USCIS doesn't approve or deny visas.

Has that changed the past few years?

We received a NOID in 2008 for a K-1 due to a missing divorce decree, I'm looking at it right now.

When they said make a copy should I make two original copies just in case.. Because they did say whatever you send to the USCIS needs to be send to your fiancee abroad..what do you guys think?

Please read the replies you've received to your other post....it directs you to the Guides. Your question is clearly answered there...please take a few minutes and read up on the info there.

Make TWO copies of the entire package before you send it in. This includes the money orders too. You want to have a perfect replica of the package you are sending in.
One copy for yourself, and one to send to your fiancee.

US Embassy and Consulate DiscussionNo need to Pay $18 for a call

Our petition has been received by the US Embassy in Manila and we didnt have to pay $18.00 to call the embassy to get such information. Petitioner can call directly the Department of State (202)663-1225 Press 1, press 0, press 0 to inquire if your petition is already in Manila. Be ready with the case number. To get the interview date ahead, call the DOS also. Hope this info helps. $18.00 is not too much but , if we can call free then the better

No, you will need it for AOS though, DO NOT LOSE IT! IT will be pretty expensive to get a duplicate issued.

I was able to confirm that my package arrived at the Bogota Embassy around march first. US Embassy and Consulate Discussiontax return papers
Just get the transcripts from the IRS, it will take about 10 - 14 days. By sending the transcripts, you will not have to send your W-2's, 1099's, etc..........................

http://www.irs.gov/i...=110571,00.html

Requesting transcripts (individuals):

You have two easy and convenient options for getting copies of your federal tax return information--tax return transcripts and tax account transcripts--by phone or by mail.

Request transcripts by calling 1-800-908-9946, or order by mail using IRS Form 4506T (Request for Transcript of Tax Return). We do not charge a fee for transcripts. Allow two weeks for delivery.

Definitions:

A tax return transcript shows most line items from your tax return (Form 1040, 1040A or 1040EZ) as it was originally filed, including any accompanying forms and schedules. It does not reflect any changes you, your representative or the IRS made after the return was filed. In many cases, a return transcript will meet the requirements of lending institutions such as those offering mortgages and for applying for student loans.

A tax account transcript shows any later adjustments either you or the IRS made after the tax return was filed. This transcript shows basic data, including marital status, type of return filed, adjusted gross income and taxable income.

US Citizenship General DiscussionHow do they know how much time I spent outside of US?
All they would have to do is look at your passport and see the stamps if they ever asked to see it.

I went through this before with my ex-wife, they actually asked her to bring her passport to the interviews and reviewed it. This was the Tampa office that asked for it.

Better be safe than sorry....................CYA

I was just reading most of this thread and I have to say it left me crying...My father passed away one month ago because of the negligence of the veterans hospital he was in. He had to have a trach because his esophagus was swollen and he couldn't swallow and had breathing difficulties. He was getting great care until they decided to close down the critical care unit and make them into offices. He was moved to the private ward in a room by himself. My mother went crying to the head nurse that he needed 24/7 supervision (stated on his chart) due to mucous build up that could block the trach. Well that night a mucous plug lodged in it and no one checked on him for over 40 minutes! He suffocated!! They brought him back but he had 100% brain damage and seizures. He died not long after that. My mother does anesthesia in that hospital (for 29 years) and said "I gave 110% to care for the veterans under my care. Why couldn't they take good care of mine!!?" It's heartbreaking and I cry every time I think of my father. I am so glad he got to meet my husband and place my hand in his at our wedding! He loved my husband in the short time they had together. He called him 'son'....The heartbreaking part of THAT is...my husband's parents passed away about 9 years ago and he was looking forward to being close to my dad. I'm so sorry I ranted here but I needed to share. I can't help but think as I'm crying here, that my mother feels it 10x worse. Here is a pic of them....

Within the G7 (G8 sans Russia), the UK and US take the second to last and last spot in life expectancy and both take back seats also in regards to infant mortality where the US manages to even fall behind Cuba. That says something about the health care systems in both the UK and US. I don't know the former but I do know the latter and it utterly sucks.

Think preemies................

The more preemies that are brought into the world, odds are many of them will not survive. Look at what fertility drugs do, woman gets preggers with 6 kids and 3 survive after birth...............that's 50% right there.

I reckon those numbers are for live births, right? So a preemie is a live birth.............

CanadaCalgary's Broo-ha-ha over Support our Troops Decals
 I like the Mayors suggestion.....but I don't trust politicians and money

scrap this - was trying a poll.

Basically the question was going to be:

A citizen of Calgary offered to donate 5000 'Support our Troops' decals (completely free of charge) to the City of Calgary, to be used on city vehicles. Yesterday Calgary's city council voted against this proposal.

The Mayor suggested that instead of putting the decals on municipal vehicles they should instead be sold at city offices and the money be donated to organizations supporting military families.

What do you think?
