Wife and son finally made it home Thursday evening. Flight landed at 8:30 PM but she did not clear Immigration until midnight. The first two agent she dealt with in immigration were a$holes, she was pi$ed at them. Both were Filipino and they were talking ####### about her in Tagalog, they had no idea that she understands Tagalog, she learned quite a bit when she stayed with me in the Philippines when I worked there.

Long story short, she approached another Immigration Officer and he was very accommodating. When she was leaving the immigration office at LAX, she made a comment to the two Filipino Immigration Officers in Tagalog, they were horrified she could speak Tagalog. Wished I could have seen their faces!! My wife don't take sh!t from anyone, makes me proud!!

Good luck to rest of you!!

We should receive her 10 year Green card soon as well as her Social Security card.

Yes, I think London is about a months wait currently, so that's not too bad. It seems the NVC are sending out ridiculous RFE's (see ours), but there is no way to overcome it it seems, other than to abide by their requests. It all seems so very petty after what we have all been through. Being on expedite has not helped us in the least, not at any stage have we been "sped through the system". It's frustrating to say the least.

Maybe those of us who spoke the loudest are now suffering from USCIS payback.................not a conspiracy theorist but wouldn't put it past them. Maybe they will prove me wrong, at least I hope so.

The "system" does not have the same sense of urgency that we do, now if they were in our shoes, what do you think the response would be???

No, I feel like I am being stonewalled after the "tactful" ####### chewing the District Director of my Congressman's office gave me earlier this week.

They have everything they need to either Approve or disapprove the wifes I-601, they have had everything for 12 days now.

Approved!!!!!!!!!!   We are sooo excited and happy, it was a beautiful day in Bogota (meaning no rain haha) and the woman who interviewed us was one of the nicest people ever. We are so thankful for everything, for all the help my fellow visa journey friends have given us. This was the best anniversary gift ever! It wasn't crowded at all, so we got out of there in less than 3 hours, that is almost record time for the Bogota consulate :D

Congrats!! That is awesome........................

IMBRA Special TopicsNotice of Intent to Deny
I received a NOID on Dec 24, 2007 for IMBRA and another issue that I had already provided info for. Back in '99, I married a Turk/Swede while living in Sweden. Filed for her visa at US Embassy in Stockholm May '99 and received it in Sept '99. We divorced in Florida back in '03.

I replied to my NOID by just giving more details of my previous marriage and giving them another certified copy of the divorce decree. I also told them I had no idea what her A# was and we are no longer in contact and had no idea what the forms were that we filled out at the Embassy in Stockholm.

Got my NOA2 Today!! Funny thing is I called on the 22nd and was told it was under review and the NOA2 is approved as of the 23rd. kicking.gif

IMBRA Special TopicsRFE police report
The RFE will say what it is for and what is needed.

Worse case scenario, get a police check from everywhere he has lived, make sure that the police check has a seal, signed and the time period covered for the police check.

If he is clean and has lived in numerous jurisdictions, you may just want to hire a private investigator to do all the leg work.

USCIS Service CentersUSCIS Website updated Processing Times page as at 15 June

Really confused as to why they are still saying that they are processing data from Dec 14 last. That's what they said last month too. Does this mean they havent processed anything in the last four weeks?!

From what I have been reading here on these forums, the Dec 14th date you are referring to is the "oldest" application that they are working on, doesn't necessarily mean that they are not processing anything from Jan, Feb, Mar...........

I have a dumb question. What does it mean when somebody says there case was touched? I filed an I-129F for my fiance and I received my first NOA on April 9th 2007. When does everyone think I will receive my second NOA? Thanks for your time. This website is great!

USCIS Service CentersPassport revoked!
http://www.acf.hhs.g...ls/passport.htm

Passport Denial

Another tool provided to state and federal government by the Personal Responsibility and Work Opportunity Reconciliation Act (PRWORA) is Passport Denial. PRWORA requires the Secretary of State to refuse to issue a passport to any person certified by the Secretary of the Department of Health and Human Services (DHHS) as owing a child support debt greater than $2,500. Further, the Secretary of State may take action to revoke, restrict, or limit a passport previously issued to an individual owing such a child support debt.

How does the process work?

All cases receiving full child support services through the local or state child support agency are eligible for passport denial. Persons who owe child support debts greater than $2,500 will be sent a passport denial Pre-Offset Notice, which also includes information about the Federal Tax Refund and Administrative Offset programs.

Through the Federal Offset process, states submit to the Federal Office of Child Support Enforcement (OCSE) those cases that meet the criteria for Federal Tax Refund and/or Administrative Offsets. When a state submits a case with arrears exceeding $2,500, OCSE automatically forwards that case to the State Department for passport denial unless the case has been specifically excluded from the Passport Denial Program.

When an individual applies for a passport, the State Department denies the application based on the child support obligation owed by the applicant. When the State Department denies an application for a passport, a notice is sent to the non-custodial parent explaining that the passport application was denied because of delinquent child support, and advising the applicant to contact the appropriate state child support enforcement agency, listed on the notice, for further information.

What steps should I take if my passport has been denied because of a child support debt?

You must contact your local child support agency to make satisfactory arrangements to pay your delinquent child support obligation. If more than one state reported a delinquency in excess of $2,500, you must reach an agreement with all states involved in order for the passport to be released.

Once the debt has been satisfied or a satisfactory agreement has been reached, the state(s) will request that OCSE remove you from the passport denial process. It takes approximately two weeks from the time OCSE receives a request for removal for the State Department to withdraw the passport denial. After the denial of the passport has been withdrawn, you must reapply for your passport and pay any accompanying fees. Fees are not refunded when your passport application is denied.

USCIS Service CentersThe NCSC

I have been working with a non-profit agency that help individuals with immigration matters, for several of years now.

I have seen on this website many let downs about the NCSC, I happen to call them several of times a month. Things that you should know and take into prospective is as followed.

Verify address? They don't have access to your personal information, don't even bother.

Case status? They don't have anymore access to your case then what you have already been given. You should try looking at the case status, and processing times since thats what they seem to do. After it has been over the estimated processing time, then maybe you should call.

Filling out forms? They can't help you do this either, #1 you are paying for the form. #2 they would be legally obligated to you if they help you fill out the form. #3 If the form is denied or reject for any reason you could always have the right to sue the individual that helped you. #4 The toll free number would be over populated and have long call wait times, you wouldn't want that would you?

Interview Schedule? They don't have access to that either, but again once your case has went outside of the estimated processing time, then maybe you should call.

The reason for this post, is for many people is what they should take into prospective before calling. Did you know the NCSC takes around 24,000 calls a day? Did you also know that this is human beings working for them? They try to help you the best they can, but its not as simple as you think, USCIS does not provide the 1st person you speak to with enough information to likely make you happy, I assume they are given script information that they have to read from. I do feel sorry for them, I can't imagine doing their job could you? However, this is their job. The job that feeds their family, pays their bills, and feeds them. If you had all of this on the line, wouldn't you be sticking to your guns and reading directly from your script? Try patience and respect it can get you a long ways in life. I wanna see how this post effect some people, and hear opinions. Hit reply now.

Here is some good reading material.............been a nightmare for my family.

USCIS Service CentersOctober fillers are not moving up

If you have done this already, then disregard this comment. Make sure you have done a "Registration of Foreign Birth" at the US Embassy / Consulate in Thailand for your son. At the same time apply for his passport, which you may get the same day. Also at the same time apply for a humanitarian visa for your wife so that they can travel together ASAP to the states. Then do the immigration paperwork, (or continue with it), once she is here. You may have to be there is person to do all of this, but I am sure in this situation this is the smallest of your problems. I am not going to say hang in there because I also have a frustrating story and know how much I hate that hang in there and be patience #######. Just keep fighting for your rights and never give up.

(Also, Forget ACLU. They profile and you don't match the type that will get them in the news which helps them raise funds. The Red Cross may be a better source of help or one of the humanitarian organizations the major religions have although they seem to be focusing on illegals quite a lot lately.)

btw.. I was an August filer at CSC, sent to Texas and got NOA2 last month, about 2 weeks over the 5 month period.

Thanks............my son is a US Citizen born in Florida, all the details are in the blog post in my signature. I doubt ACLU will do anything but I have to try everything. It's a shame that elected officials are failing as well.

USCIS Service CentersOctober fillers are not moving up

i read ur blog, it touched my heart. i´d give my turn in the list so that u and ur family were reunited.

it really makes me sick when i see lots of people who enter the country illegally, work illegally, and bring their families illegally, and they even get free help. I´m a law-rules follower, but cases like this make wonder if it´s worth it to follow the rules anyway.

Thank you for your kind words........

I just completed filing Legal Intake forms via the ACLU's Southern California web site. I'm ready for battle!!

USCIS Service CentersOctober fillers are not moving up

if u check Igor´s List, October fillers have barely been answer in comparison to Novemeber and December fillers.

What could be hapenning?

Does this mean that October fillers will have to wait longer than 5 months?

Would love to be able to give you an answer. I cannot get an answer from USCIS why Oct/Nov CSC IR-1/CR-1 filers are are getting approved when 35,000 Jul/Aug CSC transfers to TSC filers are getting pretty much ignored.

I think the Service Centers are experiencing some major management issues, and it starts from the top back in DC.

Good luck to you!!
