I understand what you feel and what you're going through:( and i'm hoping that you'll get yours by monday:)
As of know i just want to be positive with all what i've gone through with this immigration process, what am saying is not only with I-130 coz i had an ongoing immigrant petition and because of retrogression it became impossible.
In fairness to USCIS all their response to me were consistent but of course 7 months of waiting is not a joke at all :blink: :angry: :devil:
Hoping for our approval by next week, i mean ALL of us.

Last Monday we received our congressman's response to our inquiry, and it says that our peition is currently with an officer and we will be receiving the decision by the end of February, wink"


I was told a month ago by a Tier 2 that our petition was with an officer...............and each call after that it has been a different story.

Not trying to rain on anyone's parade, I've heard it all. And having an expedite approval going on 90 days................

I got this message from TSC today saying all applications will have a response within 2 weeks:

"Unfortunately, our office is closed today because of the ice/snow storm that has hit Texas, but I did not want you to wait to hear from me. The I-130s are the priority for the Texas Service Center and we will have an action taken on every petition within the next 2 weeks. On a separate note, we are working with our call centers to ensure a more accurate and consistent delivery of information so hopefully your experience will not be repeated."

Got the RFE hardcopy, Them want proves of our wedding, affidavits of guests and bills. Things that were sent when we filed, which they probably lost :angry: My husband is pissed off.
So all we have to do is feed their lack of common sense, send the stuff, wait & see :wacko: :bonk:


I have a feeling we are going to see a lot of ####### like this so they can cover there a$$ and pad the stats. I guarantee that they are pulling this kinda sh it.

A CONGRINT is a generic term but applies to all government agencies. When an inquiry is made via elected official on behalf of a service member, there are certain protocols that have to be followed by the agency that is in question. I bet the DHS has a PDF somewhere that covers how they are supposed to handle it.

Like I said, get your command involved and see if you can at least get a 1 star to endorse it.

What a long day.............thanks for the support guys.

I have been in training all day and spent my whole lunch hour on the phone with the District Director of my Congressman's office. She kind of tactfully told me I had no reason to NOT be happy about what they have done for me. I made it clear I was not happy with them in the beginning but since they got the ball rolling with NVC and the Embassy, I was happy. She tried explaining to me that the Congressman cannot tell USCIS what to do, I KNOW THAT!! I just wanted some support and someone to light a fire under USCIS #######.

I spoke to the reporter about 30 minutes ago and there is a lot of interest in the story, CNN has contacted her but I told her no to CNN, personal reasons, they always seem to slant stories for their benefit. She will be doing a follow-up story when it is appropriate.

To all those that would like to, feel free to pass on the story. Also, make comments on the article...............

wow....my wife just got a call from the embassy in Bogota and we have our interview NEXT thursday March 31st...I am really excited, but wow, they couldnt even give us at least 2 weeks headsup?! Now Im going to have to rush big time

When it rains, it pours...........................

We have hit a freaking roadblock and I am pi$ed. Wife called about an hour ago, pretty upset so I had a hard time understanding what she was saying.

Eventually I figured it out, for one, they said they do not have the divorce decree that I sent, the original and a copy. Christ!! She said that they said I could scan and email it to the Embassy.

Secondly, they are saying she was an OVERSTAY on her K-1 Visa even though we were married well within the 90 day window. We did not file AOS right away as I was laid off soon after we married. I made an INFOPASS appt back then to see what the requirements were for filing AOS and I was told there was NO time frame to apply. Good...........Long story short, unemployed for 5 months until I took a job across country in Florida. Due to the move and our son due 3 months after arriving, we delayed AOS once again. 4 months later I was laid off again, went a few months until I found work only to be laid off for a 3rd time. Needless to say, no income, no AOS. The economy really screwed me when it came to finding a damn solid job!!

Well, now we need to file an I-601 (Application for Waiver on Grounds of Inadmissibility) and pay an additional $585; they are expediting this. I am waiting for an email back from the Embassy since I cannot call and speak to anyone in the Visa Unit to confirm what my wife had explained to me. I am going over the I-601 and it is pretty straightforward, all 11 pages!! I'll email it to my wife and she can show up at the Embassy on Monday or Tuesday to continue this NIGHTMARE.

I want to BREAK something right now!!

I was just checking out the scheduled appointments at the US Embassy in Bangkok ( http://bangkok.usemb...edule030111.pdf ) and as of March 1 when it was published they have no appointments scheduled for the 18th. We received our notification on March 3 so we would not be on there but it looks likes my wife will be the only one there that day. I hope this is the case and they can stamp her passport the same day so she will not have to hang around in Bangkok for a few days to go back and pick it up. I am planning on flying them home the week of the 28th but if she can get her passport back the same day, I will try to get them home the week of the 21st..............

The only thing that sucks is that I have a week of ShoreTel Telecom training March 28 - April 1 so I cannot take time, at least my mom is taking a week off when they get here so she can be with them if i cannot get time off.

I want this to be over NOW!!

Hang in there everybody, I know it's tough but what other option do we have?? NONE

Holy #######!! Almost 3 AM for me and just finished putting together all of the documentation that my wife will need at her interview on the 18th. She will have all originals plus a copy of all the originals as well as the copy's I have for myself here. I think I killed about 10 trees tonight. I'll get some sleep for a few hours and then go to the Post Office and send this Priority Overnight or whatever they call it.

We are going to Skype Saturday night my time, Sunday morning for her, and I will walk her through the paperwork that she will have to do. I am going to fill out the PDF's for her and email them so she will just basically have to sign them, except for Part 2 of the DS-230, that has to be signed in the presence of the interviewing officer.

I did not provide much evidence of "bona fide" marriage, having a child with her that will be at the interview should be sufficient enough. She also has a her Military Dependent ID Card since I'm a retired Marine. I did provide plane, train, and hotel receipts from my trip in October as well as all the Western Union receipts.

On Monday she will call the hospital in Bangkok to schedule her physical, I am having her use the same one she went to when we went through her K-1 Process, they also take my insurance, TriCare, so there should be no cost at all. Her Police certificate is ready for pick up on Monday so she will get that when she goes to Bangkok for her physical. She received her translated birth certificate a few days ago too.

It looks like we have all of our ducks in a row, she will be busy as hell the next two weeks. She has to take a 6 - 8 hr train ride to Bangkok this week then back home. The following week she will have to it again for her interview, I wished that I could be there right now to give her a hand.

The Bangkok Embassy will issue her the IR-1 two days after the interview, once she has that we'll get her flight booked. It won't be cheap since she insist on flying Thai Airways because it's an awesome airline and non-stop from Bangkok to Los Angeles, about 14 hrs.

I hope I have every in order and ready to go!!!


Be glad when this whole process is finally over!

I mailed everything via USPS Global express, cost $81 for 2lbs of documents. The soonest it will get there will be Thursday US time, cutting it close!!

Went over all the paper work with my wife last night and she signed the PDF's that I sent. We are crunched for time, especially since she is a 6 - 8 hr train ride from Bangkok. I sent this email to the Embassy last night:

Greetings,

My wife has her appoint scheduled for 18 March 2011 at 7 AM. We just learned of her appointment less than 48 hours ago and are thrilled that the expedite was approved. My wife required some additional documentation that she will need to send with the rest of her package prior to the interview. I sent what she needed via USPS Global Express Guaranteed and the soonest that she will have it will be 11 March 2011 Thailand time, one week before her appointment.

What is the latest that you can receive her Packet III and Packet IV documentation prior to the scheduled appointment?

We do not want to miss this appointment because of the delay in getting the documentation since we have been fighting with USCIS since November for an expedite due to my son being hospitalized in Surin numerous occasions for pneumonia.

Can you PLEASE call my wife or I rather than try to coordinate via email? This would be more efficient. My wife can be reached at 66 87 *** **** and I can be reached at 714 *** ****.

I want to get them back to the States ASAP so I can get my son to doctor for a complete physical to identify why he keeps getting sick.

Well, the Embassy called her a few hours ago and told her to send what she has now and the rest when she receives it. They are going to be accommodating to our situation.

She called the hospital and scheduled her physical for this Friday at 9AM. They have records of her last physical so that will be of assistance. The only caveat is that they will not use my insurance for her physical, we have to pay cash, ugh!! It sucks being strapped for $$ but it is what it is. She will take a trip to Bangkok on Thursday and go back home Saturday. While in Bangkok this week she will pick up her Police Check that is ready as of today.

Next Thursday she will be off to Bangkok again for her interview on Friday, I HOPE that they will give her passport back on Friday with the Visa stamp and all documentation rather than have her come back the following Mon or Tue.

We are planning on her and my son flying out of Bangkok on Thai Airways during the first week in April. Can't wait!!

Hope the rest of you get through NVC ASAP and have your Interviews scheduled quickly!! Being that you have your case number, you may be able to have your spouse get their physicals done now, rather than wait for the Embassy to receive your petitions. Check your respective Embassy website for details.

Since you're working with an embassy abroad, you won't have to pay the $88 fee. Read the section 'filing fee' here for the I-864: http://www.uscis.gov...00045f3d6a1RCRD The $88 bill is only for those that didn't get expedited and the AOS is reviewed at NVC.

Looks like I (my wife) will pay the $404 at the Embassy but no mention of paying the $88 AOS in any of the documents provided by the Embassy. Read the Packet III & IV two times and did not see it. Fortunately, my insurance will cover her physical.........too bad that wasn't the case when my son was in a remote hospital multiple times.

Obviously, I'm no expert on this (as I am not as far along in the process as you) but... I've done a lot of reading in various forums on VJ and it sounds to me that the email she received (with the IIN) about the AOS and COA is just a boilerplate template. From what I have read and understand, once an IIN is assigned, they send a "bolerplate" email wth the IIN and details on paying AOS and submitting the COA. Your case is a little different because it has been expedited straight to the Consulate/Embassy. What I think happened is.... they assigned an IIN (which automatically generates the AOS/COA email) and forwarded your case to the embassy/consulate.

From what I have read and understand in other forums/topics within VJ, NVC assigns an IIN wether your case is expedited or not. Once an IIN is assigned, they send a "bolerplate" email wth the IIN and details on paying AOS and submitting the COA. I've also read (not sure which website: VJ, Consulate/Embassy, or NVC) that... once your expedite is approved.... NVC no longer processes your case... it is sent to the Consulate/Embassy and they will handle all the processing. I'm pretty sure that you will have to send all payments and documents to the Embassy/Consulate in Thailand. I'm confident that the email she received regarding the AOS payment, is nothing more than boilerplate. Either way, if you've already made payments... just send the receipts and you should be good-to-go. I will see if I can find where I read this and send it to you. Please keep me informed, as I am trying to get ours expedited too.

HaHaHa............................15 minutes after posting the above, my wife calls and tell me the Embassy called her!!!

She has her interview on March 18th at 7 AM, WoooooHoooooo She is so excited, I had to tell her to slow down because I had no idea what she was saying. She said they have sent her an email as well so i logged into her account and there were three, one for Packet 3, one for Packet 4 and the important one:

I still have not received a response from the Embassy, it is already Friday afternnon there so if I don't hear anything by the time I get up in the morning it will end up being a long weekend.

On my wifes email account, we just received an email from NVC saying that everything has been processed at NVC and forwarded on to the Embassy:

Your inquiry has been received at the National Visa Center (NVC). The NVC has completed its processing of the visa petition you mentioned in your letter and has forwarded the petition to the assigned US Embassy/Consulate General for further processing.

Please be advised that further forms and/or fees may still be requested by the US Embassy/Consulate to complete the processing of this case. Any further inquiries should be directed to the assigned US Embassy or Consulate General.

Great, fired off an email to them but no word yet.

She also received an email just after the one above with her IIN, how to make AOS payment and Choice of Address and Agent for Immigrant Visa Applicants..............................OK

This is the confusion now; Do I make the remaining payments through the Embassy? If I pay through NVC, will the Embassy also ask for a payment?

Those are questions that I posed to the Embassy in my email earlier this week. I am not comfortable making a payment now through NVC fearing that somehow I will have to pay twice. This whole process have been a cluster ** up to this point I expect the worse............

Thanks so much! I had started to think I wouldn't hear from the NVC until late March :)

Any updates on your end? Last I read I believe you had said your family may be in the States by the end of this month


Nothing yet, still waiting to hear from the Embassy...........I did send a message to the Ambassador via Facebook and Twittter, we have corresponded previously and she is aware of our situation.

Xelance... how long did you have to wait (from receiving the IIN to paying the AOS fees)??? I just received my IIN this morning. At first, it was telling me that the payment was "not invoiced"... but now, I'm getting the dreaded SIF error :crying:

anyways, thanks for the info! I am going to shoot them an email, is the case number still the NVC case number? Or is there an embassy case number?

I gotta get everything ready for my wife in case they want my wife to bring the AOS stuff to the embassy.


The NVC case # is what the Embassy uses. I have not got a response yet, hope to SOON.

Our case was expedite to the embassy too, I just got the notice....so what do I do now? What did they tell you to do? Because I have the AOS packet and everything here in America along with my wife's DS-230 forms. Do I send them back to the embassy? Thanks!

The NVC people just told me to call the embassy...


Everything is handled by the Embassies Visa unit now. Find the e-mail address to the Embassy and send them an inquiry and be sure to include to include this in the Subject line:

EXPEDITE APPROVED "your case number" "beneficiary name"

Do not send anything until the embassy contacts you or your wife.

Maybe we can get away without paying as well.....................WISHFUL THINKING

Thanks!! I could write a book but who would read it?? If I could get a full time job being a "Watchdog" of USCIS, I'd take it in a heartbeat!! They need a Jarhead running that place and I could do it easily.
